Welcome back to the continuation of the Fifth Minister’s Statement 58-15(5): Condolences To The Session of the 15th Legislative Assembly. I would like to Family Of Mr. Vince Steen take this opportunity to belatedly, but most sincerely, offer my personal best wishes to each and every one of you for HON. FLOYD ROLAND: Mr. Speaker, it is with great a happy and healthy new year. Although we have not met sadness that we observe the passing of Mr. Vince Steen, th th formally for several months, I know that you all continue to a former Member of the 13 and 14 Legislative work diligently in committees, Cabinet and in your Assemblies and a dear colleague to many of us in this constituencies. This ‘story’ also discusses how meaningful consultation made the Inuvialuit Final Agreement a reality, through which Inuvialuit land rights and freedoms were formally acknowledged and entrenched in the Canadian Constitution. Through meaningful consultation, Inuvialuit have become ‘meaningful participants’ in sustainable and future-making decisions of Inuvialuit nunangat (Inuvialuit lands) and waters, with respect to the Inuvialuit People and natural beings that Inuvialuit depend upon and maintain relationship with. As ‘meaningful participants’, Inuvialuit have the sovereign rights to “make meaning” and carve out a future as a sovereign nation within the country of Canada.

I call this challenge “Kymlicka’s dilemma,” after Will Kymlicka, the political theorist who has led contemporary discourse on “minority nation” rights. As Kymlicka observed, members of a state’s dominant cultural nation, or staatsvolk, may, by exercising universal mobility rights, numerically “swamp,” and then, by using universal voting rights, democratically dominate, an Indigenous minority nation in its homeland. To prevent this, an Indigenous minority nation may seek to exercise group-based voting protections, such as guaranteed representation. Where “Kymlicka’s dilemma” arises - i.e., where minority group-differentiated voting protections challenge the voting powers of individual staatsvolk and vice versa - a constitutional conflict seems certain.
