For the avoidance of breach, certain obligations and responsibilities of the parties to the contract need to be performed promptly. Ocean transport is an expensive venture and a shipowner could suffer considerable financial losses if an unnecessary but serious delay interrupt the vessel’s earning power in the course of the charterer’s performance of his contractual obligation. On the other hand, a charterer could also incur a substantial loss if arrangements for the shipment and receipt of cargo fail to go according to plan as a result of the shipowner’s failure to perform his charterparty obligation timely and with reasonable diligence. With these considerations in mind, this thesis critically explores the concept of timely performance in the discharge of the contractual obligations of parties to a contract of carriage. While the thesis is not an expository of the occurrence of time in all the obligations of parties to the carriage contract, it focusses particularly on the identity, scope, and limitations of timeliness in the context of timely payment of hire, laytime and reasonable despatch. -

Also today in 1958, NASA was established by an act of Congress. More? In 1962, the 300-foot radio telescope of the National Ra- dio Astronomy Observatory (NRAO) went live at Green Bank, West Virginia. It held place as the world’s second largest radio scope until it collapsed in 1988. Tonight let’s visit with an old lunar favorite. Easily seen in binoculars, the hexagonal walled plain of Albategnius ap- pears near the terminator about one-third the way north of the south limb. Look north of Albategnius for even larger and more ancient Hipparchus giving an almost “figure 8” view in binoculars. Between Hipparchus and Albategnius to the east are mid-sized craters Halley and Hind. Note the curious ALBATEGNIUS AND HIPPARCHUS ON THE relationship between impact crater Klein on Albategnius’ southwestern wall and TERMINATOR CREDIT: ROGER WARNER that of crater Horrocks on the northeastern wall of Hipparchus. Now let’s power up and “crater hop”... Just northwest of Hipparchus’ wall are the beginnings of the Sinus Medii area. Look for the deep imprint of Seeliger - named for a Dutch astronomer. Due north of Hipparchus is Rhaeticus, and here’s where things really get interesting. If the terminator has progressed far enough, you might spot tiny Blagg and Bruce to its west, the rough location of the Surveyor 4 and Surveyor 6 landing area. -

University of Keele June 2015 ii iii Abstract This thesis is in three parts: 1) a kinematical study of exoplanet host stars, 2) a study of the detached eclipsing binary V1094 Tau and 3) and observations of other eclipsing binaries. Part I investigates kinematical biases between two methods of detecting exoplanets; the ground based transit and radial velocity methods. Distances of the host stars from each method lie in almost non-overlapping groups. Samples of host stars from each group are selected. They are compared by means of matching comparison samples of stars not known to have exoplanets. The detection methods are found to introduce a negligible bias into the metallicities of the host stars but the ground based transit method introduces a median age bias of about -2 Gyr. -

Bring some food to share and any astronomy gear you’d like to sell, trade, or give away. We will have on hand some of the gear that was donated to the club this summer, including mirrors, lenses, blanks, telescope parts, and even entire telescopes. Come check out the bargains and visit with your fellow amateur astronomers in a relaxed evening before Christmas. We also encourage people to bring any new gear or projects they would like to show the rest of the club. The meeting is at 7:00 on December 22nd at EWEB’s Community Room, 500 E. 4th in Eugene. If that sounds familiar, that’s because it is: I changed the date in the previous sentence from October to November and left the rest of the sentence intact. Yes, our autumn weather is predictable. Korotangi (The Dove) The legend of the korotangi is that it came in the Tainui waka as one of the heirlooms which had been blessed by the high priests in Hawaiiki and which in the new country, would ensure good hunting for the tribe. It was said that the Kawhia and Waikato tribes, who descended from Tainui stock, took the korotangi into battle with them, setting it up on a hill and consulting it as an oracle. The "korotangi" can mean "to roar and rush as the sound of water" in either Maori, Hawaiian or Samoan has been used to support the legend that it was bought on the Tainui waka from afar. The expression “Korotangi” is still used as a term of endearment, or as a simile for any object treasured or loved. A mother lamenting the death of a child will, in her lament, refer to her lost one as her “Korotangi.” 1 No doubt the simile has its origin in the above tradition, which also seems to be a fea- sible explanation of the waiata. It certainly explains the reference to the eat- ing of the pohata leaves and the huahua from Rotorua, as well as the allu- sion to the taumata (hill-top or ridge). The Korotangi, Tawhio Throne, and the art work depicting The Lost Child TeManawa and Korotangi, arrived at Turangawaewae Marae on the same day. The Heart of Heaven is in part the sharing of the walk of TeManawa who lives these things, has fulfilled prophesy. Her journey has been documented since 1992 to current. -

For our orbital analysis we use 150 precise RV measurements taken at the Lick Observatory between 2000 and 2011, and we combine them with RV data for this star available in the literature. Using a stellar mass of M = 2:7 M for ν Oph and applying a self-consistent N-body model we estimate the minimum dynamical companion masses to be m1 sin i 22:2 MJup and m2 sin i 24:7 MJup, with orbital periods P1 530 d and P2 3185 d. We study a large set of potential orbital ≈ ≈ ≈ 2≈ configurations for this system, employing a bootstrap analysis and a systematic χν grid-search coupled with our dynamical fitting model, and we examine their long-term stability.
