Section 111(a)(5) provides that a “secondary transmission” by an entity that is a “governmental body, or other nonprofit organization,” rather than a “cable system,” is exempt so long as the transmission is made “without any purpose of direct or indirect commercial advantage” and “without charge . other than assessments necessary to defray the actual and reasonable costs” of the service. Locast’s system falls squarely within that exemption. Locast satisfies the exemption’s plain language. Locast’s Internet transmissions are “secondary transmissions” within the meaning of the statute, and Locast is a non-profit organization rather than a cable system.
