Extension 2.'The Diplpmatjc and Consular Officers (Oaths and Fees) Act, 19MC of Act (hereinafter keferred to as the princi9al Act) is hereby extended to, and 41 of 1940- shall come into force in, and in relation to, the State of Jammu and Kash- mir and accbrdingly,- (a) the provisions of the principql Act and the rules made there- under shall apply to and in relation to the State of Jammu find Kash- mir as they apply to and in relation to any other State;

(4) Either House of Parliai ent may, by resolution passed within thirty days from the date on which the Act has been laid before it under sub-section (3), which period ma be comprised in one session or in two successive sessions, direct any (m difications to be made in the Act and if the modifications are agreed to by the other House of Parliament during the session in which the\ Pct nas been so laid before it or the session succeeding, such modificat' ns shall be given effect to by the President by enacting an amendinP Act under sub-section (2): Provided that nothing in this /ub-section shall affect the validity of the Act or of any action taken thkreunder before it is so amended. BE it enacted by Parliament in the Twent -fourth year of the Republic of India as follows:- S

Short 1. This Act may be called the Andhra Pradesh Appropriation Act, title. 1973. I 71 J

Issue of 2. From and out of the Consolidated Fund of the State of Andhra Rs. 713, Pradesh there may be paid and applied sums not exceeding those speci- 033200 fied in column 3 of the Schedule amounting in the aggregate [inclusive from and out of the of the sums specified in column 3 of the Schedule to the Order made by Consoli- the President on the 16th day of February, 1973 under article 357 of the dated Constitution and published with the notification of the Government of Fundof India in the Ministry of Finance No. S.O. 100(E) of the said date] to the State of Andhra the sum of seventy-one crores, fifty-nine lakhs, three thousand and two pradesh hundred rupees towards defraying the several charges which will come for the in course of payment during the financial year 1972-73, in respect of the financial services specified in column 2 of the Schedule. OF 19731 Coal Mines (Taking Over of Management) 45 (4) If, after the appointed day, the Central Government is satisfied, whether from any information received by it or &herwise, that there has been any error, omission or misdescription in relation to the particu- lars of a coal mine included, or deemed to be included, in the Schedule or the name and address of the owner of any such coal mine, it may, by notified order, correct such error, omission or misdescription, and on the issue of such notified order the relevant entries in the Schedule shall stand corrected accordingly: Provide that no such correction in relation to the ownership of a coal mine shall be made where such ownership is in dispute. (5) Every person in charge, immediately before the date on which this Act receives the assent of the President, of the management of any coal mine, being a coal mine not included or deemed to #be included on the said date in the Schedule, shall, within thirty days from the said date, intimate to the Central Government the name and location of such mine and the name and address of the owner thereof. (6) Where there is a dispute with regard to the declaration made by the Coal Board under the Coking Coal Mines (Emergency Provisions) Act, 64 of 1971. 1971, to the effect that a coal mine contains coking coal, the management of such coal mine shall, notwithstanding anything contained in the said Act, vest in the Central Government under this Act and nothing con- tained in, the first-mentioned Act shall apply, or be deemed ever to have applied, to the said coal mine. 4. (6) The Central Government may authorise the Custodian to exercise such of the powers of the owner, including powers to borrow, as may be necasary for the proper man.agement of the coal mine and the Central Government may also issue such directions to the Custodian as to his powers and duties as, it may deem desirable in the circumstances of Ule case; and no other person, including the owner, shall, so long as such : management continues, exercise any powers of management in relation 60 the coal mine or give any direction wilth regard to such management. (7) The Custodian may also apply to the Central Government at any time for instructions as to the manner in which he shall conduct the management of the coal mine or in relation to any other matter arising in the course of such management. (8) The Gustodian shall receive from ithe funds of the coal mine for the charge of management of which he is appointed under sub-section (I), such remuneration as the Central Government may fix: Provided that where a Government company has been ,appointed as the Custodian of more than one coal mine, the remuneration -of the CILlstodian shall be received from the funds of-each such cod mine in such proportion as may -be determined by the Central Government. (9) The Custodian-General, and every- (i) Additional Custodian-General, (ii) Deputy Custodian-General, (iii) Custodian, shall hold office during lthe pleasure of the Central Government. (10) The Central Government shall receive, to the exclusion of all other persons, any monies due to the coal mine realised after the ap-, winted day notwithstanding that such receipt pertains to a transaction made at any time before the appointed day. Payment 7. (1) Every owner of a coal mine shall be given by the Central Gov- of amount. ernment an amount, in cash, for the vesting in it, under section 3, of the management of such mine. (2) For every month during which the management of a coal mine remains vested in the Central Government, the amount referred to in :rsub-Section (1) shall be computed at the rate of twenty paise per tonne -of coal on the highest monthly production of coal from such mine during any month in the years 1969, 1970, 1971 and 1972: Provided that if in relation to any such coal mine, there was no production of coal during the said years, the amount referred to in sub- section (1) shall be computed at the rate of four paise per tonne of such highest monthly coal producing capacity of the coal mine, before the appointed day, as may be assessed and declared by the coal Board: Provided further that in relation to R coal mine, the operations of 7yhich were immediately before the appointed day under the, control of a managing contractor, the amount, as computed under this sub-section, shall be apportioned between the owner of the. coal mine and such manag- ing contractor in such proportions as m~aybe agreed upon by or between the owner and such contractor, and in the event of there being no such agreement, in such proportions as may be determined by the principal 6~ 19731 Coal Mines (Taking Over of Management) srg Civil Court of original jurisdiction within the local limits of whose juris- diction the head office' of the coal mine is situated; ' (3) ~drevery month during which the management of a coke oven plant, which falls withi:: the definition of coal mine, remains vested in the Cefitral Government under this Act, there shall be given by the Central Government, in cash, in additlon to the amount referred to in sub- section (I), to the owner of such coke oven plant, an amount computed at the rate of fifty paise per tonne of coke on the highest monthly pro- duction of coke from such coke oven plant during any month in the years 1969, 1970, 1971 and 1972. (4) Out of the amount payable under the foregoing sub-sections, there shall be deducted by the Central Government, all sums equal to the amount of arrears due, on the appointed day, to the persons emp1,oyed by the owner of a coal mine- (u) in relation to a provident fund, pepsion lund, gratuity fund or any other fund established for the welfare of the person9 employed by the owner of the coal mine, and (b) as wages. CHAPTER I11 M~S~ELLANEOUS 8. (1) 1f any person- (a) f,ails to deliver to the Custodian any assets, books of account, penalties. . registers or any other document in his custody relating to the coal mine in respect of the managemen't of which the Custodian has been appointed, or - (b) retains any property of such coal mine or removes or destroys it; or (c) fails to comply with the provisions contained in sub-section d (2) or sub-section (4) or sub-section (5) of section 5, or (d) fails to comply with any directions given under sub-section (I), read with sub-section (6), of section 5, he shall be punishable with imprisonment for a term which may extend to ,two years, or with fine which may extend to ten thousand rupees, or with both. (2) 1f qny person fails, without any reasonable excuse, to comply with the provisions of sub-section (5) of section 3, he shall be punishable with imprisonment for a term which may extend to three years and also with fine. . . , , 9. (1) Where an offence under this Act has been committed by a com- ORenccn pany, every person who at the time the offence was committed was in by corn- paniq. charke of, and iyas responsible to, the company for the conduct of the \ business of the company, as well as the comp,any, shall be deemed to be guilty- of the offence and shall be liable to be proceeded against ,and punished accordingly : Provided that nothing contained in this sub-section shall render any such person liable (to any punishment, if he proves that the offence w,as committed without his knowledge or that he had exercised all due dili- gence to prevent the commission of such offence. (2) Notwithstanding anything contained' in sub-section (I), where any offence under this Act has been committed by a company and it is proved that the offence has been committed with the consent or conniv- ance of, or is attributable to, any neglect on the part of, any director, manager, secretary or other oAicer 01 the company, such director, mana- ger, secretary or other officer shall be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly. Explanation.--For the purposes of this section,- (a) "company" means any body corporate and includes a firm or other association of individuals; and . (b) "director", in relation to a firm, means a partiler in the firm.

Mining 10. (1) No proceeding for the winding up of a mining company, the com- management of whose coal mines has vested in the Central Government panies not to b under this Act, or for the appointment of a Receiver or for any other wound order in respect of the business of such company, shall lie in any Court , up by Court. except with the consent of the Central Government. (2) Notwithstanding anything contained in the Companies Act, 1956,' 195e. or in any memorandum or articies of association of any mining company or in any instrument, no resolultion passed at any meeting of the Board of Directors or of the members of a mining company shall, in so far as it relates to the coal mine owned by such company or,any business of such mine, be given effect to unless approved by the ~ent$alGovernment. (3) Subjeot to the other provisions contained in this Act and subject to such exceptions, restrictions and limitations, if any, as the Central Government may, by notification in the Official Gazette, specify in ithis behalf, the qompanies Act, 1956, shall continue to apply to every mining 1 d 195s. company in the same manner as they applied to it before the appointed day. 13. 14. (1) No suit, prosecution or other legal proceeding shall lie against p,ot,ctio, the Custodian-General, Additional Custodian-General, Deputy Custodian- of actiou General, any Custodian or authorised person for anything which is in good faith done or intended to be done under this Act. (2) No suit or other legal proceeding shall lie against the Central Government or the Custodian-General, Additional Custodian-General, Deputy Custodian-General, any Custodian or authorised person for any . damage caused or likely to be caused by anythi'ng which is in good faith done or intended to be done under this Act.

15. (2) If the Central Goverfiment is satisfied, after such inquiry as it may think fit, that any contract or agreement between the owner, agent or manager of a ma1 mine and any other person, in so far as such contract or agreement relates to the coal mine, has been entered into in bad faith, or is detrimental to the interests of-the coal mine, it may make an order cancelling or varying (either unconditionally or subject to such conditions as it may think fit to impose) such contract or agreement and thereafter the contract or agreement shall have effect accordingly :

Provided that no contract or agreement shall be cancelled or varied except a5ter giving to the parties to the contract or agreement a reason- able opportunity of being heard.

(3) Any person aggrieved by an order made under sub-section (2) may make an application to the principal Court of civil jurisdiction withir, the local limits of whose jurisdiction the head office of ,the coal mine is situated for the variation or reversal of such order and thereupon such C!~urt may confirm, modify or reverse such order.

16. 17. (1) The Central Government may, by notification in the Official Power Gazette, make rules !to carry out the provisions of this Act. to make rules. (2) In particular, and without prejudice to the generality of the 'oregoing power, such rules may provide for all or any of the following xtters, namely: -

(a) the manner in which the coal mines shall be managed by kh? Cqstodian; 52 Coal ii4~7~es(7'aki~xg Ocer ol Management) [ACT 15 (b) the constjtutlon of a Board of management, by whatever name c,aUed, for advising the Custodian-General in the management of the coal mines; (c) the form and manner in which accounts of the coal mines shall be maintained; (d) any other matter in relation to which such rule is required to be, or may be, made. (3) Every rule made by the Central Government under this Act shall be laid, as soon as may be after it is made, before each House of Parlia- ment, while it is in sessian, for a to.tal period of thirty days which may be com~risedin one session or in two cr more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid, both Houses agree inmaking any modifica- tion in the rule or both Houses agree that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or an- nulment.shal1 be without prejudice to the validity of anything prerilously done under that rule. ( Coal 18. (1) Nothing contained in this Act shall apply to any coal mine- mines (a) owned, managed or controlled by Government, or by a Gov- to which \ this Act ernmeilt company or by a corporatioii which is owned, managod or shall net contfolled by Government; ~PD~Y. '(b) owned or managed by a company' engaged in the production , of iron and steel: Provided that clause (b) shall not extend to such part of the coal mine or production thereof which, in the opjnion of the Central Gov- ernment, is in excess of the requirements for the pioduction of iron and steel by the company owning or managing *such coal mine : Provided further that any coal obtained frola any such coal mine as is referred to in the foregoing proviso in excess of the requirements for the . production of iron and steel by the company owning or managing snch coal mine, shall not be sold, delivered, transferred or otherwise disposed of except with the previous approval of Ihe Centra! Government. ' (2) Suls-section (1) shall not apply where there is .any dispute as to the ownership or right of user of Government, Government company or corporation referred to in clause (a) of that sub-sectian, or company referred to in clause (b) of that SU-b-scction,with regard to any coal mine or any machinery, equipment, vehicle, railway 2r \earnway which is in such coal mine or is used for the purposes of such coal mine.

Power 19. If any difficulty arises in giving efflect to the provisions of this Act, to remove the Central Government may, by notified order, not inconsistent with the difficul- provisions of this Act, remove the difficultv: ties.
