Generally Carrying, bringing, using or possessing any firearm, dangerous device, or dangerous or deadly weapon in the school building, on school grounds, in any school vehicle or at any school- sponsored activity without the authorization of the school is prohibited, and grounds for disciplinary action. A student who has possessed a firearm on school property or at a school-sponsored activity as prohibited by Va. Ct. No. SCD242311 ____________________________________) A police officer found a Swiss Army knife in a pocket of defendant Emmanuel Castillolopez‘s jacket. One of the blades was fully extended. Defendant was convicted of carrying a concealed dirk or dagger in violation of Penal Code section 21310. Penal Code section 16470 defines a ― ‗dirk‘ or ‗dagger‘ ‖ as ―a knife . that is capable of ready use as a stabbing weapon that may inflict great bodily injury or death.‖ Under this definition, ―a pocketknife is capable of ready use as a stabbing weapon . only if the blade of the knife is exposed and locked into position.‖ (Ibid.) The Court of Appeal reversed defendant‘s conviction, ruling that there was no substantial evidence that the open blade of the Swiss Army knife was ―locked into position‖ within the meaning of Penal Code section 16470 because the knife could be closed simply by folding the blade back into the handle. We agree that defendant‘s conviction cannot stand and therefore affirm the judgment of the Court of Appeal. I. At about 10 p.m. on July 29, 2012, San Diego Police Officer Bryce Charpentier stopped a car in which defendant Emmanuel Castillolopez was riding as a passenger. During a patdown search, the officer found a knife in the front pocket of defendant‘s jacket. Officer Charpentier testified that ―it was a collapsible knife, and the blade was in a locked, open position.‖ The knife was a Swiss Army knife with multiple blades; only the ―large blade‖ was exposed.

AN ACT relating to weapons; revising provisions governing certain dangerous or deadly weapons; revising provisions concerning certain concealed weapons; repealing certain provisions governing the manufacture and sale of switchblade knives; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Under existing law, with certain exceptions, it is a crime for a person to manufacture, import, sell, give, lend or possess certain dangerous or deadly weapons. (NRS 202.350) Section 2 of this bill removes knives which are made an integral part of a belt buckle and switchblade knives from the list of such weapons. Sections 1, 6 and 7 of this bill revise definitions of “switchblade knife” set forth in other provisions of existing law to accommodate the change made by section 2. Section 9 of this bill repeals a provision of existing law that authorizes a sheriff to issue a permit to allow the manufacture or sale of switchblade knives under certain circumstances. Existing law also prohibits a person from carrying or possessing certain weapons on the property of the Nevada System of Higher Education, a private or public school or a child care facility, or while in a vehicle of a private or public school or child care facility, unless the person: (1) is a peace officer; (2) is a school security guard; or (3) has written permission from the president of a branch or facility of the Nevada System of Higher Education, the principal of the school or the person designated by a child care facility to carry the weapon.
