2019 New York State Environmental Scorecard An Insider’s Guide to the Environmental Records of New York State Lawmakers Back To Work Fifty years ago, New York’s leading environmental groups came together in Albany and gave rise to the “Environmental Planning Lobby” or “EPL.” Since that time, this organization — and our sister organization Environmental Advocates of New York — have been working to pass legislation that protects New Yorkers’ health and environment, as well as stop legislation that would cause them harm. For decades, our Scorecard has been a tool to hold legislators accountable to New Yorkers and the environment by reporting on their environmental voting record. During this half century, New York has enacted some remarkable environmental laws, such as the Adirondack Park Agency Act (1973), the State Environmental Quality Review Act (1975), the creation of the State Superfund (1982), the “Bottle Bill” (1983), the creation of the Environmental Protection Fund (1993), and most recently, the Climate Leadership and Community Protection Act. Yet, for the past 15 years, our Scorecard has lamented a lack of environmental progress. 2005 – “The Assembly scores… But the Senate strikes out…” 2006 – “ But that’s how things work in Albany. Voters send 62 senators to Albany to make decisions, but only a handful of those senators’ opinions count. The result — good legislation gets bottled up and environmental concerns go unresolved, year after year.” 2010 – “ The Senate also has a to-do list. Despite strong bipartisan support from 30 co-sponsors, legislation to cut climate pollution languishes in committee.” 2014 – “ The Senate Environmental Conservation Committee has rapidly become a place where the environmental community’s priorities hit a brick wall.” 2018 – “ ...the Senate continues to be a place where big, bold environmental ideas go to die.” During this time, important legislation that would have tackled climate change and protected our children from toxic chemicals sat around gathering dust. -

Neale Specialist in American National Government April 11, 2014 Congressional Research Service 7-5700 www.crs.gov R42589 The Article V Convention to Propose Constitutional Amendments: Contemporary Issues for Congress Summary Article V of the U.S. Constitution provides two ways of amending the nation’s fundamental charter. Congress, by a two-thirds vote of both houses, may propose amendments to the states for ratification, a procedure used for all 27 current amendments. Alternatively, if the legislatures of two-thirds of the states apply, 34 at present, Congress “shall call a Convention for proposing Amendments....” This alternative, known as an Article V Convention, has yet to be implemented. This report examines the Article V Convention, focusing on contemporary issues for Congress. CRS Report R42592, The Article V Convention for Proposing Constitutional Amendments: Historical Perspectives for Congress examines the procedure’s constitutional origins and history and provides an analysis of related state procedures. Significant developments in this issue have occurred recently: in March 2014, the Georgia Legislature applied for a convention to consider a balanced federal budget amendment, revoking its rescission of an earlier application; in April 2014, Tennessee took similar action. While both applications are valid, they may revive questions as to the constitutionality of rescissions of state applications for an Article V Convention and whether convention applications are valid indefinitely. Either issue could have an impact on the prospects for a convention. In other recent actions, the legislatures of Ohio, in November 2013, and Michigan, in March 2014, applied to Congress for an Article V Convention to consider a balanced federal budget amendment; these are the first new state applications since 1982 and are also the 33rd and 34th applications for the balanced budget amendment convention. -

The two are particularly alike in the emphasis they place on the kind of participation—and the resulting freedom and democracy—enabled by having access to the means of production. Highlighting the parallel could help socialists and liberal theorists of intellectual property to see how they might advance each other’s causes: socialism could eliminate the threat of privatization of the means of producing culture that liberals like Lessig rightly worry about; if the arguments about ownership of ideas made by Lessig and others like him end up gaining currency, then arguments about ownership of the means of production made by socialist theorists could have more resonance with larger numbers of people than is currently the case. Butterworth, Advisor Copyright is in theory a neutral legal instrument, but in practice copyright functions as an ideological tool. The value of creative content in culture vacillates between the rhetorical poles of progress and profit within copyright law. This study is an ideographic rhetorical critique of <copyright>. Ideographs are rhetorical containers of ideology that publics use to define various aspects of culture. Some ideographs are contained within the dialogue of a topic. I argue five terms that make up the ideographic grammar of <copyright>: public domain, fair use, authorship, ownership, and piracy. The public domain is the space where <copyrighted> material enters when the term of protection expires. The public domain expresses the ideology that creative material belongs to the people who consume content. Fair use is the free speech exception to copyright law that allows for certain types of infringement. Fair Use is the ideology in which the use of creative work belonging to others must be fairly represented. Authorship is how an author creates content and how an audience consumes it. Authorship is an ideology focused on progress towards the process of creating content as motivated by an author. The question at the center of authorship is who controls content: the author or the public. -
