Butterworth, Advisor Copyright is in theory a neutral legal instrument, but in practice copyright functions as an ideological tool. The value of creative content in culture vacillates between the rhetorical poles of progress and profit within copyright law. This study is an ideographic rhetorical critique of <copyright>. Ideographs are rhetorical containers of ideology that publics use to define various aspects of culture. Some ideographs are contained within the dialogue of a topic. I argue five terms that make up the ideographic grammar of <copyright>: public domain, fair use, authorship, ownership, and piracy. The public domain is the space where <copyrighted> material enters when the term of protection expires. The public domain expresses the ideology that creative material belongs to the people who consume content. Fair use is the free speech exception to copyright law that allows for certain types of infringement. Fair Use is the ideology in which the use of creative work belonging to others must be fairly represented. Authorship is how an author creates content and how an audience consumes it. Authorship is an ideology focused on progress towards the process of creating content as motivated by an author. The question at the center of authorship is who controls content: the author or the public. Ownership takes the question of authorship one-step further by invoking material property. Ownership is the embodiment of the idea that management, control, and profit of copyright are more valuable than original creation. The Corporate Public is focused on ownership of content, because ownership is a legal condition of property where a person or group can profit. Piracy, which appears most often in any discussion of copyright law, is an intentional theft of copyrighted work(s). <Piracy> is a battleground between content theft and the people who publically resist copyright. iii DEDICATION To my two William Bergs: The one who got me here and the one who just arrived. iv ACKNOWLEDGMENTS Family Bill Berg- Saying that I could not have done this without you is an understatement. None of this comes easy to me and I spent several years trying to bend myself into the rhetorician that I thought I needed to be. It took until the last few months of this project when I finally understood what you were saying the whole time: The models are not always helpful, each person needs to find their own way through, and just be clear about how they got there. It took me a lot of false starts and terrible drafts to figure out what that looked like for me. I learned how to read through your criticism to find the tools to make me a better (but not great) writer and critic. The amount of pride I have of being part of the line of Butterworth advisees cannot be undersold. Dr. Victoria Smith Ekstrand-You are one of the most supportive women I have ever met. I will always keep your email notes thanking me for comments, work, and other little things that we did throughout our time at BG. You always made me feel like I was being seen in a v fundamental way that I did not even know I needed. That being said, you were always the person in the room who asked me the hardest questions and I think I am trying to still answer them. Dr. Joshua Atkinson-Thank you for being a great mentor in academic work. As your research assistant I saw the nuts and bolts of pulling good academic work together for publication.     IP4D – Sustainable Production of and Fair Trade in Creative Expressions Dr. Volker Grassmuck, Ph.D. contribution to the Research Workshop on Free Culture Berkman Center for Internet & Society at Harvard University Cambridge, MA, 23 October 2009 The point is not giving more to the poor but stealing less from them. (Jean Ziegler) The digital revolution provides great opportunities for free culture, i.e. cultural expressions that are free to circulate and build on. In this brief text I want to highlight three points: the overall idea of a Social Contract as well as the Culture Flat-Rate and a system of Fair Trade in creative expressions as two of its components. The guiding question is: How can a global Social Contract between creatives and society be established that ensures the freedom of culture and the sustenance of those who create it? A new Social Contract Under conditions of the digital age a new Social Contract between creatives and audiences (Grassmuck, 2008b, 2009) has to be negotiated, a new arrangement for the reciprocal „creative contributions“ by authors and by society (Aigrain 2008). The current debate on culture is focussed on property rights and their enforcement. The Social Contract is intended to refocus the debate on the issues behind the existing legal rules. The shift from the analogue to the digital knowledge order calls into question the boundaries between private and public, professional and non-professional, commercial and non-commercial. These are fundamental issues that should not be decided by case law but discussed in a broad inclusive debate by all of society based on empiric data and research.

Last Thursday, video game publisher ZeniMax Media Inc asked a Dallas federal judge to issue an order barring Facebook unit Oculus from using or distributing the disputed code, part of the software development kit that Oculus provides to outside companies creating games for its Rift VR headset. A decision is likely a few months away, but intellectual property lawyers said ZeniMax has a decent chance of getting the order, which would mean Facebook faces a tough choice between paying a possibly hefty settlement or fighting on at risk of jeopardizing its position in the sector. For now, Facebook is fighting on. Oculus spokeswoman Tera Randall said last Thursday the company would challenge a $500 million jury verdict on Feb. 1 against Oculus and its co-founders Palmer Luckey and Brendan Iribe for infringing ZeniMax's copyrighted code and violating a non-disclosure agreement. Randall said Oculus would possibly file an appeal that would "allow us to put this litigation behind us." She did not respond to a request for comment for this article.

Abstract This thesis seeks to address and clarify the changing interface between copyright law and other forms of regulation in the digital environment, in the context of recorded music. This is in order to explain the problems that rightsholders have had in tackling the issue of unauthorised copyright infringement facilitated by digital technologies. Copyright law is inextricably bound-up with technological developments, but the ‘convergence’ of content into a single digital form was perceived as problematic by rightsholders and was deemed to warrant increased regulation through law. However, the problem is that the reliance on copyright law in the digital environment ignores the other regulatory influences in operation. The use of copyright law in a ‘preventative’ sense also ignores the fact that other regulatory factors may positively encourage users to behave, and consume in ways that may not be directly governed by copyright. The issues digital technologies have posed for rightsholders in the music industry are not addressed, or even potentially addressable directly through law, because the regulatory picture is complex. The work of Lawrence Lessig, in relation to his regulatory ‘modalities’ can be applied in this context in order to identify and understand the other forms of regulation that exist in the digital environment, and which govern user behaviour and consumption.
