Based on the investigation , and by copy of this letter, Commander, Destroyer Squadron THREE ONE shall review the two most recent HOPPER command climate surveys, identify commonalities between reports where improvement still needs to be made, ensure adequate resources are applied to address these identified areas, and reassess command climate by conducting a command climate survey within 90 days following the commencement of command by the new permanent commanding officer. 5. Per reference (a) and enclosure ( 1), enclosures (2) through {36) are submitted in support of the findings of fact, opinions and recommendations for the command investigation into the C alle ntions of fraternization and adultery between CDR Jeffrey S. Tamulc\~ch, USN, an~ USN, while onboard USS HOPPER (DOG 70). 2. This investigation primarily consisted of interviews with personnel from HOPPER. I conducted all interviews in my office at 850 Ticonderoga Street, onboard Joint Base Pearl Harbor-Hickam, exce t the Volunta Statements b which were taken by ress. [Encls (2), (3), (4)] 3. Each interview was memorialized in a memorandum. Each memorandum has been made an enclosure, (see enclosures (5) through (8)). CDR Tamulevich an~ were afforded the opportunity to review the summaries of my interviews with them,~ signed the summaries acknowledging the same. 5. A Recorder was present during each interview so I could focus on observing demeanor and body language to best assess credibility. I reviewed every summary of interview for accuracy ( and signed them acknowledging the same. Following the initial interviews with CDR Tamulevich an~ I issued each of them a Military Protective Order {MPO), signed by Commander, Destroyer Squadron THREE ONE (COMDESRON 31) Deputy Commodore, to have no contact with one another until 18 June 2018, unless otherwise noti fled. [ Encls (9), ( 10)] 7. COMDESRON 31 Deputy Commodore authorized a search of the shipboard government email following the initial disclosure of screen shots of 11 emails between CDR Tamulevich and That search yielded approximately 325 emails but it was limited by the capacity of the ship's server. The server can only store up to 15 days of data, after which it is overwritten. Th~~ artment was able to recover .pst files older than 15 days that CDR Tnmulevich an~ had stored in data files. [Encls ( 11)- (14)] 8. After her first interview consented to a search of her personal cell phone. CDR Tamulevich consented to a search of his personal cell phone after being notified that I had already obtained Command Authorization for Search and Seizure from COMDESRON 31 Deputy Commodore. Those searches yielded numerous text ru1demail communications of evidentiary value. CDR Tamulevich's phone was returned to him the following day- ~ hone was returned to her within four (4) days. [Encls (13), (14)] 9. All reasonably available evidence was collected and the objectives of enclosure ( l) were met. No further investigation is required. I received legal guidance fro J AOC, USN, Staff Judge Advocate, Navy Region Hawaii C, USN, Sta Judge Advocate, Naval Surface Group, Middle Pacific, an JAGC, USN, RLSO Hawaii, through the course of this investigation. 10. In December 2017 approached the CO requesting that he set aside her 2016 NJP based on a notice from the Attorney General of the State of Hawaii that "an expungement order has been issued ... which annuls the record of arrest" for the 17 May 2016 arrest for " The notice contained no explanation or w y t e case a been dismissed or the record expunged~ iscussed her case and her request with the CO in his cabin in December 2017.
