The number of cryptocurrencies has increased from about 2,000, with a market capitalization of over $200 billion in late 2017, to over 8,000, with a market capitalization of about $1.6 trillion. Some currencies last for a decade, some a couple of decades and still others such as the US dollar or the British pound have lasted multiple decades before losing most of their value. The fact is, all government issued currencies have failed over time. According to Austrian economic theory, money is a an economic good like any other. It’s marginal cost of production is zero and that is why it always fails. The issuers of FIAT money always print more of it in order to try and solve other problems other than just being money. Whether it is printed for social welfare, to pay for wars to bail out banks or to manage markets, we are currently witnessing government issuers of paper money attempting to solve more of the world’s problems with printed money. This inevitably leads to its failure. History has also shown that those that understand this concept and allocate a specific portion of their portfolio to gold and rebalance annually have benefited. Their portfolios have substantially increased returns with less risk. Since bitcoin was introduced a decade ago, it is inheriting the characteristics of hard/sound money with its fixed amount and increasing stock to flow ratio. With the recent drop in bitcoin price combined with its improvement in fundamentals, we believe an institutional investor is compelled to at least “’do the work” on bitcoin to determine if there is a possibility that bitcoin can become “digital gold” and perform the role that gold has performed for so many years as the “hard money” alternative to government-issued paper money.

Created to support the Bitcoin digital currency, the blockchain is actually something deeper: a novel solution to the age-old human problem of trust. Its potential is extraordinary. Yet, this approach may not promote trust at all without effective governance. Wholly divorced from legal enforcement, blockchain-based systems may be counterproductive or even dangerous. And they are less insulated from the law’s reach than it seems. The central question is not how to regulate blockchains but how blockchains regulate. They may supplement, complement, or substitute for legal enforcement. Excessive or premature application of rigid legal obligations will stymie innovation and forego opportunities to leverage technology to achieve public policy objectives. Blockchain developers and legal institutions can work together. Each must recognize the unique affordances of the other system. AN ANALYSIS OF RETAIL USER PROTECTION IN BITCOIN REMITTANCE MARKETS Jared Cotton* This article examines the use of Bitcoin in money remittance markets as a specific illustration of wider emerging regulatory issues relating to the use of cryptocurrencies. While there are many conceivable benefits of using Bitcoin for remittances, there are also many risks for users of these remittance services. This article adopts a user perspective to look at what the major concerns are and what existing protections may be available to persons using cryptocurrencies under New Zealand law through the example of using Bitcoin for remittance purposes. The article then summarises approaches taken by other jurisdictions before suggesting a specific regulatory approach to cryptocurrencies that New Zealand should consider adopting.     The Lightning Network - Deconstructed and Evaluated Anti-Money Laundering (AML) and Anti-Terrorist Financing (ATF) professionals, especially those working in the blockchain and cryptocurrency environment, may have heard of the second layer evolution of Bitcoin's blockchain - the Lightning Network, (LN). This exciting new and rapidly deploying technology offers innovative solutions to solve issues around the speed of transaction times using bitcoin currently, but expandable to other tokens. Potentially however, this technology raises regulatory concerns as it arguably makes, (based on current technical limitations), bitcoin transactions truly anonymous and untraceable, as opposed to its current status, where every single bitcoin can be traced all the way back to its coinbase transaction1 on the public blockchain. This article will break down the Lightning Network - analyzing how it works and how it compares to Bitcoin’s current system, the need for the technology, its money laundering (ML) and terrorist financing (TF) risks, and some thoughts on potential regulatory applications. Refresher on Blockchain Before diving into the Lightning Network, a brief refresher on how the blockchain works - specifically the Bitcoin blockchain (referred to as just “Bitcoin” with a capital “B” herein) - is required.     Current Market state During the last week, the crypto markets crashed to their lowest levels of 2018. Over 12% has been dumped resulting in a $15 billion plunge to $110 billion market capitalization, a new low for the year. At the moment, the major cryptocurrencies are bouncing off a new bottom. The last week’s 10% dive took BTC from over $3,800 down to $3,400, its lowest level for 15 months. Many reputable investors had already predicted this and further losses down to around $3,000. This now looks to be inevitable as the world’s top crypto falls below $60 billion market cap. After the Ethereum has traded back its value of $116 by Dec 2nd, it has been absolutely smashed plunging 16% down to $85, its lowest level since April 2017. Currently, there seems to be no way back for as it gets hit harder than other major crypto coins. Ripple still holds the second place by market cap with $12.6 million. However, it suffers significant surge during the past week as its brethren. It lost 14% to $0.31 with new lowest daily trading price of $0.29 since September 2018.
