They stated the purpose of these meetings was to introduce new members to OCWD and to gain support for OCWD’s federal goals, per the OCWD 2019-2020 Legislative Platform. Consultants also provided an update on President Sarmiento’s testimony before Congress on water, oceans and wildlife.

AB 841 (Ting) Drinking Water: Contaminants - Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS)

AB 841, authored by Assemblymember Phil Ting (D-San Francisco), would require the Office of Environmental Health Hazard Assessment (OEHHA) to adopt and complete a work plan by 2021 to assess which Perfluoroalkyl and Polyfluoroalkyl substances (PFAS) pose a public health risk and should be tested. The assessment would be required to be completed by January 1, 2022. The bill would also require OEHHA to determine for which substances the State Water Resources Control Board (SWRCB) should adopt notification levels. AB 841 proposes a modest approach to regulating PFAS. The bill simply 1 establishes a beginning point for the state to assess the impacts of PFAS and make recommendations to the legislature. The Association of California Water Agencies (ACWA) staff recommends a favor position on AB 841, and OCWD staff recommends a watch position as the District is advocating for the U.S. Environmental Protection Agency to set national PFAS standards.

AB 841 would also specify that the above assessment for PFAS would evaluate which substances should be identified as a potential risk to human health, rather than PFAS that are known to pose a public health risk. The bill would add that the assessment would be required to consider which substances have the potential to be detected in California waters based on the prevalence of manufacturing of, manufacturing products with or use of PFAS in California and which substances are technically feasible to detect based on current detection methodologies.

The bill would require OEHHA, by January 1, 2022, to provide to the legislature an update on the assessment. AB 841 would additionally require OEHHA to assess PFAS as new information, scientific research annually, and detection methodologies become available.

The bill would clarify that OEHHA may use scientific data and research from other state or federal agencies and authoritative bodies that have scientific literature on perfluoroalkyl and polyfluoroalkyl substances.

The bill would also require that OEHHA coordinate with the SWRCB to collect water monitoring data on PFAS, as provided by the federal Unregulated Contaminant Monitoring Rule, established by the U.S. Environmental Protection Agency (EPA) or WRCB’s investigative order authority.

Background

Existing law requires the SWRCB to administer provisions relating to the regulation of drinking water to protect public health. The SWRCB is required to adopt primary drinking water standards for contaminants in drinking water and requires the OEHHA to prepare and publish an assessment of the risks to public health posed by each contaminant for which the board proposes a primary drinking water standard. A public water system is required to provide prescribed notices within 30 days after it is first informed of a confirmed detection of a contaminant found in drinking water delivered by the public water system for human consumption that is in excess of a maximum contaminant level, a notification level, or a response level established by the SWRCB.

PFAS are a group of man-made chemicals which are generally resistant to heat, water, and oil. They have been used extensively in consumer products such as carpets, clothing, fabrics for furniture, paper packaging for food, fire-fighting foams, and other materials designed to be waterproof, stain-resistant or non-stick.

PFAS can move through the ground, getting into groundwater that may be used for water supplies or private drinking water wells. Such contamination is typically localized and associated with a specific facility, such as an industrial facility where these chemicals were manufactured or used in other products, or an airfield which used the chemicals for firefighting.

In February 2019, the U.S. EPA released a PFAS Action Plan in which they state they intend to propose a national drinking water regulatory determination. This Action Plan describes the U.S. EPA’s approach to identifying and understanding PFAS, approaches to addressing current PFAS contamination, preventing future contamination, and effectively communicating with the public about PFAS. However, the U.S. EPA has been non- committal in establishing a timeline for when a PFAS maximum contaminant level (MCL) might be adopted.

At the state level, in July of 2018, the SWRCB established guidelines for two PFAS chemicals (PFOA and PFOS) for local water agencies to follow in detecting and reporting the presence of PFAS. The guidelines adopted by the SWRCB for two PFAS chemicals set interim notification levels of 14 parts per trillion (ppt) for perfluorooctanoic acid (PFOA) and 13 ppt for perfluorooctanesulfonic acid (PFOS). These guidelines were based on levels set by other states and followed a recommendation by OEHHA.

On February 28, 2019, OCWD’s Philip L. Anthony Water Quality Laboratory became the first public agency laboratory in California to achieve state certification to analyze for per- and polyfluoroalkyl substances (PFAS) in drinking water. Certification was granted by the Environmental Laboratory Accreditation Program (ELAP) administered by the SWRCB.

The establishment of a notification level is often an initial step in the process of adopting a formal MCL. On March 6, 2019, the SWRCB conducted a PFAS workshop to discuss the need for PFAS monitoring and reporting specifically. In this workshop, the SWRCB acknowledged the work of the U.S. EPA and the action plan they developed. The SWRCB expressed the desire to create a state action plan on PFAS, similar to that of the U.S. EPA, which will identify a timeline for activities and data gaps. However, the SWRCB made it clear that it is not asking OEHHA to set a public health goal, which would necessarily be the start of the state’s MCL process.

On March 8, 2019, the local DDW office emailed out preliminary notifications of required PFAS testing orders to 12 Orange County Groundwater Producers/Public Water Systems and the number of sources (wells) they will need to begin testing for on a quarterly basis, with first results due by June 30, 2019.

As mentioned above, multiple government agencies at both the state and federal level are focused on addressing PFAS contamination. Since amended, AB 841 seems to add to that focus, by proposing clear timelines on how an assessment of PFAS impacts is to be executed. A similar bill, AB 756, authored by Assemblymember Cristina Garcia (D-Bell Gardens), would require that a public water system monitor for the entire PFAS family of chemicals and would establish new notification criteria for customers. ACWA adopted an oppose unless amended position on AB 756 and OCWD adopted an oppose position primarily due to the fact that reliable testing for the vast majority of PFAS chemicals does not currently exist.

Conversely, AB 841 proposes a modest approach to regulating PFAS. The bill simply establishes a beginning point for the state to assess the impacts of PFAS and make recommendations to the legislature. ACWA staff recommends a support position on AB 841. OCWD staff recommends a watch position.

SB 404 (Chang) State Parks – Chino Hills State Park

The Chino Hills State Park could expand by about 1,900 acres under Senate Bill 404, authored by Senator Ling Ling Chang (R-Diamond Bar). The bill proposes the acquisition of land by the California Department of Parks and Recreation (DPR) in two locations of Chino Hills as well as Brea to expand open space for Chino Hills State Park. The proposed additions in Chino Hills include land identified on the attached map as the 1,200 acre First National Investment Properties parcel and the 300-acre Eastridge parcel and are nearest the District’s 91-acre West of Highway 71 property in San Bernardino County near the Prado Basin. (Please see the attached map of land that would be added to the park). These properties are westerly and southerly of the District’s property and comprise a total of approximately 1,600 acres. OCWD staff recommends a watch position on SB 404 as the bill does not directly impact the District.

Per the bill analysis for SB 404, these parcels have been priority acquisitions for the park since it was initially created. According to supporters of the legislation, these parcels are available from willing sellers. The bill is not seeking an appropriation since the land that is available for acquisition can be obtained with funds from other sources, or, in one case, donated outright to DPR. The supporters are already eligible for acquisition grants from federal and state funding sources and are working to obtain sufficient grants to complete these acquisitions within fast-approaching deadlines. Additionally, management funds for these lands are available to DPR from a settlement agreement from litigation several years ago.

The proponents argue that the bill is needed in order to get DPR to agree to accept and manage these lands that are adjacent to the existing state park. The proponents argue that DPR has resisted expansion of this state park for many years because it has been focused on internal management improvements, addressing a deferred maintenance backlog and other priorities, and that the refusal to consider the acquisitions near Chino Hills State Park will be lost since those landowners would likely sell or develop the property into other uses such as housing.

The end of April is one of the busiest times in the Legislature. April 26 marks the deadline for any bill with significant state costs to be heard in policy committee. As most bills fall in that category, the month of April is a chaotic time where legislators, staff, and lobbyists are working hard on hundreds of bills. It has been a busy time for OCWD’s lobbying firms as well.

We continue to work on behalf of OCWD to oppose a tax on drinking water to provide funding to disadvantaged communities who do not have access to clean water. As a reminder, this issue is playing out in several venues at once. While Governor Newsom proposed a water tax in his January budget, policy bills have been introduced in the Assembly and Senate as well. While there has been very little movement on this issue in the budget, several bills have been heard in Committee since last month.

Senator Monning has championed a water tax in the Senate for the past several years. Accordingly, at the beginning of the year he introduced SB 200. In its current form SB 200 does not include a tax or any other source of revenue, but simply lays out how funding would be used. While it is widely known that Senator Monning intends to amend a tax into SB 200 eventually it is currently moving unopposed as he has yet to do so. As such, the bill passed out of the Senate Environmental Quality Committee on March 20 and the Senate Natural Resources Committee on April 23.

In the meantime, the water communities alternative proposal, SB 669 (Caballero) is also advancing. ACWA and CMUA are cosponsoring SB 669, which would invest surplus General Fund revenue and use the returns to bring clean drinking water to disadvantaged communities. SB 669 is not only an important solution to a major state issue, it is also very important to the efforts to stop the advancement of a water tax as it demonstrates that there are other options on the table to address this issue. We have been working to support SB 669 on behalf of OCWD since it was introduced. Despite opposition from the proponents of a water tax the bill has passed out of the Senate Environmental Quality Committee and the Senate Governmental Organization Committee without any no votes.

AB 217 by Assemblymember Garcia is a bit of a hodge-podge of different ideas. The bill would use new fees on agriculture, a tax on water, and establish a trust fund similar to SB 669. While it passed out of the Assembly Environmental Safety and Toxic Materials Committee at the end of March, the bill would still require a 2/3 vote to pass on the Assembly Floor. It is difficult to see how a bill with that vote threshold and so many different sources of revenue could muster enough votes from moderate legislators in the Assembly.

AB 134 is authored by the Chair of the Assembly Budget Subcommittee that has purview over the water tax. In its current form, the bill simply sets up a process for the Legislative Analyst’s Office to assess how any safe drinking water funding appropriated in the budget has been used once every five years. In reality, AB 134 is simply another vehicle for language related to the water tax. Similar to SB 200, the bill is not facing opposition as it currently does not contain a funding mechanism. It has moved to the Appropriations Committee in the Assembly.

In short, all of the policy bills on the subject of safe drinking water funding are currently moving forward and are now pending consideration in the Appropriations Committees in their respective houses. Technically, the purview of these committees is the fiscal impact of new policies the Legislature is considering. In reality, most bills introduced in the Legislature make their way to the Appropriations Committee, making them an effective bottleneck. Bills can quietly be amended or killed there without a public debate. As such, leadership frequently uses the Committee to work out difficult political issues where multiple members have introduced different solutions to the same problem.

We expect that process to play out with the four bills listed above. It is noteworthy that SB 669 (Caballero) has not had a single no vote from Democrats to date, and has been moved into the Senate Appropriations Committee along with SB 200. While it does not guarantee that leadership and the Chair of the Appropriations Committee will choose to move the bill forward, it does indicate that the water community has successfully engaged leadership in the Senate and has ensured itself a seat at the table as negotiations move forward.

OCWD has also joined a coalition of local governments and local government associations opposing AB 1486 (Ting). AB 1486 would impose onerous new requirements on local governments as it pertains to surplus lands, and would seriously tie OCWD’s hands when it comes to leasing district owned lands. We will work with ACWA, CMUA, CSDA, and other local government associations to oppose the bill.

PFAS Action Act of 2019 (H.R. 535 and S. 638)

H.R. 535 (Dingell, D-MI) / S.638 (Carper, D-DE) are identical companion bills that simply require the Administrator of the United States Environmental Protection Agency (EPA) to designate per- and polyfluoroalkyl substances as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980.

This action would effectively make cleanups by potentially responsible persons possible and if such mandates are contested, it would allow the EPA to take actions and then pursue recovery after the fact. Although this legislation does not impact OCWD at this time, if the EPA has authority related to PFAS federal funding could be more readily available if needed in the future for cleanup costs. OCWD staff and consultants recommend a support position.

NPDES Permit Extension - Federal Water Pollution Control Act - Permitting Terms - H.R. 1764

H.R. 1764 (Garamendi, D-CA) would simply allow the State Water Resources Control Board to issue National Pollutant Discharge Elimination System (NPDES) permits under the Clean Water Act for a period of up to 10 years. Current Clean Water Act limits it to five years. This simple change would not impact enforcement etc. and provide the benefit of allowing improved planning in the development and construction of clean water treatment facilities that often take up to ten years, by doing away with the administrative costs of seeking a renewed permit every five years even though there is not a change in the project’s control mandates. H.R. 1764 is supported by Orange County Sanitation District (OCSD) and OCWD staff and consultants recommend a support position to aid in OCSD’s efforts.

The Sites Reservoir Project Act - H.R. 1435

H.R. 1435 (Garamendi, D-CA) is the Sites Reservoir Project Act, which has bipartisan support and aids in providing a reliable and sustainable water supply that protects the environment. H.R. 1435 does not directly impact OCWD, staff and consultants recommend a watch position.

According to H.R. 1435, among other things, the Sites Project would increase surface water storage to enhance water management flexibility in the Sacramento Valley, improve operation of the State’s water system to provide improvements in ecosystem and water quality conditions in the Bay-Delta while providing a more reliable water supply for the State of California.

Jim Watson, General Manager of the Sites Project Authority, will be a speaker at OCWD’s 12th Annual OC Water Summit to be held on May 31.

Congress was in recess the second half of April for the Easter/Spring break. Much of the focus of Congress before the break focused on what has become a perennial issue— trying to develop federal infrastructure legislation.

House Democrats held their annual retreat early in April and discussed the groundwork for a broad infrastructure package that could reach $2 trillion in new investment. They expressed the hope of making the legislation bipartisan, with a House vote by June or July.

Before the recess House and Senate Democratic leaders, Speaker Nancy Pelosi (D-San Francisco) and Senator Chuck Schumer (D-NY), said they would meet with President Trump in May to discuss infrastructure legislation. “It has to be at least $1 trillion,” Speaker Pelosi said. “I would like it to be closer to $2 trillion.”

House leadership has reserved floor time for an infrastructure bill and is considering late spring. The Democrats’ goal is to move the measure through both chambers before the August recess.

Both Democratic leaders criticized the 2018 Trump proposal that included $200 billion mostly from public-private partnerships, but also called for cutting funds from existing transportation programs. That plan never advanced beyond the discussion phase.

Representative David Cicilline (D-RI), chairman of the Democratic Policy and Communications Committee, called this month for the tax cuts enacted by the last Congress to pay for infrastructure. The 2017 tax law (P.L. 115-97) was calculated to run deficits with spending on tax cuts rather than infrastructure, according to the Congressman.

Speaker Pelosi has frequently called for a package to meet wide-ranging infrastructure needs, while Senate Environment and Public Works Chairman John Barrasso (R-WY) is currently working on a surface transportation authorization focused on roads, highways, and bridges. The transportation component is phase one, according to Senator Barrasso. Any broader infrastructure proposal, including water projects would be phase two under his scenario.

Senate Majority Leader Mitch McConnell (R-KY) has said he would not support deficit spending similar to the recession stimulus (P.L. 111-5) enacted under President Barack Obama in 2009 in the face of a severe economic downturn to support infrastructure legislation. As a result, Members are cautioning the public to temper expectations for a broad infrastructure bill in this Congress.

House Transportation and Infrastructure (T&I) Committee Chairman Peter DeFazio (D- OR) said, "Until the President commits the money and Ways and Means commits the money, we're not going anywhere." His sentiments were echoed by Delegate Eleanor Holmes Norton (D-DC), chairwoman of the T&I Subcommittee on Highways and Transit.

The disagreement over funding is just one challenge facing Congress. Another challenge is the upcoming reauthorization of a surface transportation bill. The Fixing America's Surface Transportation Act is set to expire in 2020. Congress could simply reauthorize the FAST Act and call it a day on infrastructure.

All of which begs the question of including a water infrastructure component as part of any infrastructure bill. House and Senate infrastructure committee leaders seem to be leaning towards using a potential upcoming Water Resources Development Act (WRDA) in 2020 as a vehicle for water project legislation broader than the authorization of just Corps of Engineers projects.

President Trump’s former infrastructure adviser D. J. Gribben said this month, "The odds are against a broader bill happening given a variety of factors, including time lost during the shutdown of the government and interest to bundle climate change with infrastructure, and the early start of the presidential elections. You've got those three dynamics working against this, [which] makes it very long odds that Congress will be able to pass it."

Closer to home in April, I worked (for some six months) to secure Congressman Ken Calvert’s participation in the 50th anniversary celebration of the Water Masters’ decision on the Santa Ana River (SAR). The 1969 court rulings established Santa Ana River water rights in the Santa Ana watershed.

The decision set the future of the river, paving the way for the SAR Mainstem project as well as subsequent water conservation projects along the river. The Orange County Judgment provides water users in the Lower Basin, Orange County area, rights to receive minimum and average annual flows.

In addition to the base flow obligations specified in the Judgment, OCWD is also entitled to all storm flows reaching Prado Dam. Water users in the Upper Basin Areas have the right to divert, pump, extract, conserve, store and use all surface and groundwater supplies, so long as the Lower Basin receives its water flow requirements.

Fortunately, the congressional calendar and spring recess allowed Representative Calvert to give the keynote address at the April 12 Water Masters anniversary event.

I followed up this month on the offer of Representative Lou Correa to Board President Sarmiento to work with OCWD on a possible Orange County congressional delegation letter regarding standards for PFAS (per- and-polyfluoroakyl substances). OCWD staff drafted a sample letter that could serve as the basis for a delegation letter.

Both the State of California and the federal Environmental Protection Agency (EPA) have taken note of rising concern over PFAS standards. Rather than have a multiplicity of standards developed by states around the country, the goal is to have EPA set a nationwide standard. Setting a reasonable federal level for PFAS would allow water agencies everywhere, including Orange County, to plan for remediation of the issue with certainty.

Work on a possible delegation letter will continue when Congress returns to Washington in May.

Congress recessed for its annual Spring District Work Period and as a result legislative activity occurred only during the first half of the month. However, during the recess, congressional committee staff continued to consider water infrastructure policy options with the intention of preparing for committee consideration as early as the end of May. It is becoming increasingly clear that the legislative agenda is shaping up to focus on two policy matters. The first is the development and passage of the fiscal year 2020 budget. The second involves finding common ground between the two parties to fashion an infrastructure assistance bill that could garner overwhelming support in both the House and the Senate. The following provides a brief summary of the status of these matters as well as actions taken on the regulatory front. Fiscal Year 2020 Budget Hearings Begin Amidst Minimal Support for Administration Budget Request The House and Senate Committees on Appropriations held hearings into the Administration’s budget request for the upcoming fiscal year. Additionally, a number of House and Senate committees with program oversight of water resources programs also examined the budget request. The hearings on a bipartisan basis revealed the proposed budget with its focus on significantly reducing spending for water resources programs ranging from USEPA’s water infrastructure-related SRF and WIFIA to USBR’s water recycling program lacks support. Instead, the committees’ membership voiced strong concern over the wisdom of such cuts and supported restoration of spending levels at least to maintain current year spending.

The proposed reduction of $30 million from the current year $58 million spending level is likely to be reversed, perhaps providing at least current year spending. The growing support for alternative water supply production is also likely to benefit, with Congress reversing a proposal that effectively ends the Title XVI program funding. As of this writing, the House leadership has indicated that it intends to approve the twelve spending bills by late Spring. Should this timetable be met, it provides the Senate ample time to approve its versions of spending bills prior to the October 1 deadline. However, given the narrow Senate majority and the broad funding differences between Senate Republicans and Democrats, the prospect of another year-end stopgap spending bill looms. OCWD Presents Testimony on Water Recycling and Receives Plaudits As Congress considers legislative options to rebuild America’s infrastructure, the House Committee on Natural Resources began to establish a legislative record on the value of water recycling and federal assistance. OCWD’s President, Vincente Sarmiento, provided testimony to the committee’s Subcommittee on Water, Oceans, and Wildlife this past month. During the hearing into how water recycling and other options to develop sustainable water supplies can address drought resiliency, protect the environment and maintain economic growth, Representatives Mike Levin (D-CA) and Alan Lowenthal (D-CA), each cited the incredible accomplishments that OCWD achieved through GWRS. Subcommittee Chairman Jared Huffman (D- CA) heralded OCWD’s leadership in advancing the public acceptance and use of recycled water. In comments, they noted the value of collaboration with OCSD to leverage the water supply provided by recovering its wastewater resource. These comments came as a follow-up to formal testimony presented by President Sarmiento. In the testimony, he highlighted the many benefits that have been realized from constructing GWRS to Orange County, including drought proofing the region during times of persistent drought. He also highlighted that the federal investment is now returning dividends to other communities across the nation that can draw upon OCWD’s experiences as these communities plan to develop resilient and sustainable water supplies. Based upon the hearing, it seems increasingly likely that Representative Grace Napolitano’s (D-CA) Water Recycling Investment and Improvement Act (H.R. 1162) could become the legislative vehicle to enhance the federal support of local agencies’ efforts to construct water recycling facilities. Under H.R. 1162, federal assistance would be authorized at $500 million over five years with a project cap increase to $30 million (currently $20 million) through the U.S. Bureau of Reclamation’s WIIN Act program.

Infrastructure Legislation Continues to Evolve in House The House Committee on Transportation & Infrastructure continued its review of approaches to address infrastructure needs of the nation. The focus of this effort is to ensure that any infrastructure legislation captures the needs of the water sector. Representative Harley Rouda (D-CA), who sits on the key Subcommittee on Water Resources and Environment of the Committee on Transportation & Infrastructure has sought input on the issues that any bill should address. OCWD has been invited to present at a regional roundtable on the matter that Rouda is hosting. The foundation of any water infrastructure legislation seems to be maintaining a vibrant federal commitment to the SRF program. OCWD should consider supporting H.R.1497, legislation that would renew the Clean Water SRF program at $4 billion annually over five years. H.R. 1497 would renew the Alternative Water Sources Act, providing direct grants assistance to agencies to construct projects including water recycling facilities and other innovative water supply projects. The bill would also support funding of green infrastructure (stormwater) projects that could boost water recycling efforts. Given that the bill’s provisions are consistent with OCWD’s calls to boost SRF funding and enhance water recycling construction, OCWD should consider supporting H.R.1497. Rouda is a cosponsor of this bill. The subcommittee is expected to consider H.R. 1497 in late May at the earliest.

Regulation of Groundwater Contamination of Surface Waters As reported in prior updates, a judicial decision, known as the Maui Decision, found that the transport of pollutants by groundwater into a surface water, absent an NPDES permit, is a violation of the Clean Water Act. Under California’s Porter Cologne water law, this circumstance already exists. However, the decision, currently under appeal to the U.S. Supreme Court, would, if upheld, would allow the use of the Clean Water Act’s citizen suit provisions for any such violations. EPA has issued formal policy guidance, stating that the agency disagrees with the Maui Decision. In the guidance, the agency states that it will not consider the introduction of a pollutant into surface waters through groundwater a violation of the Clean Water Act’s mandate that a permit is required. Confirmation Secretary of the Interior Acting Secretary of the Interior, David Bernhardt, received a bipartisan vote of 56- 41 in the Senate to become the Secretary of the Interior. The vote of approval means that the key water and environment federal agencies and departments have Senate confirmed appointees in place. Senator Dianne Feinstein voted no, and Senator Kamala Harris did not vote.

Federal Update for Orange County Water District April 2019

FY 2020 Budget Talks Continue: Congress has been negotiating a budget deal during recess, after failing to meet the April 15 deadline for adopting a budget resolution. Thus far, the House and Senate have taken different approaches to establishing FY 2020 spending guidelines. In the Senate, the Budget Committee approved a budget resolution earlier in April, but Republican leaders do not plan on bringing the measure to the floor, nor have they publicly announced their allocations for the appropriations subcommittees for FY 2020 funding.

The House decided to forego a budget resolution, and instead approved a measure before recess that would set topline limits for FY 2020 spending bills. The measure sets an overall funding limit of $1.3 trillion for FY 2020 bills, and serves as a fallback plan after progressive Democrats derailed the House budget bill introduced by Budget Committee Chairman John Yarmuth (D- KY) that would increase spending caps by about $88 billion in FY 2020, which would exceed limits for both defense and non-defense spending. It is unlikely that the Senate will accept the House’s $1.3 trillion plan because the Senate’s plan will have significantly higher cuts to non- defense spending.

Thus, House lawmakers will be required to rework their funding measures to reach a final FY 2020 compromise. House Appropriations Subcommittees are expected to start marking up FY 2020 spending bills after returning from recess. House Appropriations Chairwoman Nita Lowey (D-NY) said she is deciding on the budget caps for the 12 appropriations bills, referred to as 302(b)s, that will set spending levels for FY 2020 spending. House Majority Leader Steny Hoyer (D-Md.) is aiming to finalize the FY 2020 appropriations bills by June 30, an ambitious timeline that will require quick work from committees.

House Speaker Nancy Pelosi (D-CA) and Senate Majority Leader Mitch McConnell (R-KY) agreed to begin negotiations on a two-year plan to set funding levels; however, it is unclear if such a deal will receive support from the President, as he stated in a tweet last week that a Democrat-backed plan would not happen.

Drought Contingency Plan Legislation Signed into Law: On April 2, Senator Martha McSally (R-AZ) and House Natural Resources Chairman Raúl Grijalva (D-AZ) introduced legislation (S. 1057/H.R. 2030) to athorized the Bureau of Reclamation to implement drought plans for the Colorado River. Senators Dianne Feinstein (D-CA) and Kamala Harris (D-CA) co-sponsored the Senate bill, and Reps. Alan Lowenthal (D-CA), Rep. Ken Calvert, Rep. Grace Napolitano (D- CA), Rep. Jared Huffman (D-CA), and Rep. Mike Levin (D-CA) co-sponsored the House bill. On April 8, the Senate and House passed the bill, and on April 16, the President signed the bill into law. House Hearings on EPA’s FY 2020 Budget: On April 9, the House Energy and Commerce Committee held a hearing with EPA Administrator Andrew Wheeler to discuss the President’s FY 2020 budget request which cut almost a third of the EPA’s funding. The Administrator said that the budget request would still support the agency’s mission of protecting public health and the environment. House Democrats disagreed and expressed frustration with the Administration for rolling back environmental regulations.

Senate Confirms DOI Secretary David Bernhardt: On April 11, the Senate voted to confirm David Bernhardt be the Secretary of the Department of Interior (DOI) by a vote of 56-41. Three Democrats (Senate Energy and Natural Resources Committee Ranking Member Joe Manchin (D-WV), Martin Heinrich (D-NM) and Kyrsten Sinema (D-AZ) and one independent (Senator Angus King (D-ME)) joined all Republicans in supporting the nomination of David Bernhardt who is currently the acting Interior Secretary.

EPA Announces WIFIA Notice of Funding Availability (NOFA): On April 4, the EPA released the NOFA to solicit letters of interest from prospective borrowers requesting WIFIA loans. This third selection round provides $60 million which will provide approximately $6 billion in credit assistance and may finance approximately $12 billion in water infrastructure investment. Letters of interest are due by July 5. The EPA’s four priorities for this round are: x Readiness for a project to proceed toward development; x Provide for clean and safe drinking water, including reducing exposure to lead and emergent contaminants in the nation’s drinking water systems; x Repair, rehabilitate, and replace aging infrastructure and conveyance systems; and x New or innovative approaches including water reuse and recycling.

6 SEC. 2. FINDINGS. 7 Congress finds the following:

In water year 2017, the State of Cali- 7 fornia experienced one of the wettest years on 8 record. New surface water storage infrastructure 9 with the capacity to store water in wet years for use 10 in dry periods is urgently needed. 11 (2) The Sites Project (sometimes referred to as 12 ‘‘North-of-Delta Offstream Storage’’) has been iden- 13 tified by the State of California and the Federal 14 Government as an important component to inte- 15 grated water management in the Sacramento Valley 16 that would advance the co-equal objectives of im- 17 proving water management and restoring ecological 18 health for beneficial uses of the Sacramento-San 19 Joaquin Delta and the Sacramento River watershed. 20 Further, the Sites Reservoir was found in the 2000 21 CALFED Record of Decision to be the preferred lo- 22 cation to provide North-of-Delta Offstream Storage 23 and subsequent studies have shown the Sites Res- 24 ervoir to be technically and economically feasible.

Additional surface water 9 storage can help meet water supply goals under the 10 Central Valley Project Improvement Act (title 11 XXXIV of Public Law 102–575). 12 (6) It is in the interests of the United States 13 for the Federal Government to work with the Sites 14 Project Authority, which has been established under 15 the laws of the State of California as an independent 16 joint exercise of powers authority to, among other 17 things, study, promote, develop, design, finance, ac- 18 quire, construct, manage, and operate Sites Res- 19 ervoir and related facilities to advance the Sites 20 Project in the most expeditious and cost-effective 21 manner possible. 22 (7) On July 24, 2018, the California Water 23 Commission voted to award $816,000,000 to the 24 Sites Project under Proposition 1 (Water Quality, 25 Supply, and Infrastructure Improvement Act of

In addition, other agencies from the 13 Sacramento Valley and agencies from the Bay Area, 14 San Joaquin Valley, and southern California are ac- 15 tively participating to advance the Sites Project.

16 SEC. 3. DEFINITIONS. 17 In this Act:

18 (1) AUTHORITY.—The term ‘‘Authority’’ means 19 the Sites Project Authority that entered into a Joint 20 Exercise of Powers Agreement on August 26, 2010, 21 for the purpose of advancing the Sites Project as a 22 non-Federal facility.

23 (2) BUREAU.—The term ‘‘Bureau’’ means the 24 Bureau of Reclamation.

22 (6) SECRETARY.—The term ‘‘Secretary’’ means 23 the Secretary of the Interior.

24 (7) SITES PROJECT.—The term ‘‘Sites 25 Project’’—

9 (8) STATE.—The term ‘‘State’’ means the State 10 of California.

11 SEC. 4. FEASIBILITY STUDY AND ENVIRONMENTAL IMPACT

12 STATEMENTS.

13 (a) DUTIES OF THE BUREAU.—With respect to the 14 Sites Project, the Bureau shall— 15 (1) be the lead Federal agency for the purposes 16 of all Federal reviews, analyses, opinions, state- 17 ments, permits, licenses, or other approvals or deci- 18 sions required under Federal law to allow the con- 19 struction of the Sites Project, including all require- 20 ments under— 21 (A) the National Environmental Policy Act 22 of 1969 (42 U.S.C. 4321 et seq.); 23 (B) the Endangered Species Act of 1973 24 (16 U.S.C. 1531 et seq.); and

VerDate Sep 11 2014 20:59 Mar 12, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H1435.IH H1435 pamtmann on DSKBFK8HB2PROD with BILLS 9 1 (C) any other Federal law applicable to the 2 construction of the Sites Project facilities by 3 the Authority; 4 (2) take such steps as are necessary to ensure 5 that all Federal reviews, analyses, opinions, state- 6 ments, permits, licenses, or other approvals or deci- 7 sions required under Federal law to allow the Au- 8 thority to construct and operate the Sites Project 9 are completed on an expeditious basis and use the 10 shortest applicable process, and, to the maximum ex- 11 tent practicable, are completed not later than Janu- 12 ary 1, 2022, as required by the California Water 13 Quality Supply, and Infrastructure Improvement 14 Act, as approved by California voters on November 15 4, 2014, as a condition of State financial participa- 16 tion in a project deemed eligible for assistance under 17 the aforementioned Act; and 18 (3) coordinate, as appropriate, with the non- 19 Federal project sponsors, which are the State of 20 California and the Sites Project Authority.

21 (b) FINAL ENVIRONMENTAL IMPACT STATEMENT

22 AND ENVIRONMENTAL IMPACT REPORT.—No later than 23 6 months after the date of the enactment of this Act, the 24 Secretary shall work with the Secretary of Commerce, the 25 Assistant Secretary of the Army for Civil Works, and the

5 (c) REQUIREMENTS OF EXISTING LAW.—Nothing in 6 this section affects the requirements of Federal law.

7 SEC. 5. CONSTRUCTION AND OPERATION OF NON-FEDERAL

8 PROJECT.

9 (a) AUTHORIZATION OF CONSTRUCTION.—Section 10 103(d)(1)(B) of the Calfed Bay-Delta Authorization Act 11 (Public Law 108–361) is amended— 12 (1) by redesignating clauses (ii) and (iii) as 13 clauses (iv) and (v), respectively; 14 (2) by inserting after clause (i) the following:

15 ‘‘(ii) CONSTRUCTION AUTHORIZA-

16 TION.—If the Secretary determines that 17 the project described in subparagraph 18 (A)(ii)(I) is feasible, the Secretary, in co- 19 operation with the Authority, may partici- 20 pate in the design, planning, and construc- 21 tion of the Sites Project, as a non-Federal, 22 State-led project as defined under section 23 4007(a)(2) of Public Law 114–322, in a 24 manner that is substantially in accordance 25 with the recommended plan, subject to the

3 ‘‘(iii) FEDERAL INVESTMENT IN A

4 NON-FEDERAL SITES PROJECT.—As re- 5 quired by section 4007(c)(2)(C), the Sec- 6 retary shall take such steps as are nec- 7 essary to ensure that, in return for any 8 Federal investment in a non-Federal Sites 9 Project, a proportionate share of the 10 project’s public benefits are Federal bene- 11 fits, including water supplies dedicated to 12 specific purposes such as environmental 13 enhancement and those purposes referred 14 to in section 5(f) and (g) of the Sites Res- 15 ervoir Project Act.’’; 16 (3) in clause (iii), by striking ‘‘the project’’ and 17 inserting ‘‘a project described in subparagraph 18 (A)(ii)(I)’’; and 19 (4) in subclause (I) of clause (v) (as so redesig- 20 nated by paragraph (1) of this subsection), by strik- 21 ing ‘‘clause (ii)’’ each place it appears and inserting 22 ‘‘clause (iv)’’.

23 (b) IN GENERAL.—Notwithstanding any provision of 24 this Act, the Commissioner shall take any and all actions 25 possible to advance the Sites Project as a non-Federal

5 (c) PROJECT PARTNERSHIP AGREEMENTS.—At the 6 request of the Authority, the Bureau shall enter into a 7 project partnership agreement with the Authority for the 8 Authority to provide full project management control for 9 construction of the Sites Project, or a separable element 10 of the project, in accordance with plans approved by the 11 Secretary.

12 (d) DETAILED PROJECT SCHEDULE.—Not later than 13 180 days after entering into a Project partnership agree- 14 ment under subsection (c), the Authority, to the maximum 15 extent practicable, shall submit to the Secretary a detailed 16 project schedule based on estimated funding levels that 17 lists all deadlines for each milestone in the construction 18 of the project.

19 (e) TITLE; OPERATIONS AND MAINTENANCE.—The 20 Authority shall— 21 (1) hold title to all new facilities constructed 22 under this section; and 23 (2) be solely responsible for the operation and 24 maintenance costs for such facilities.

1 (f) COORDINATED OPERATIONS.—The Secretary 2 shall execute and implement a long-term agreement be- 3 tween the United States and the Authority to provide for 4 the coordination of operations of the Central Valley 5 Project and the Sites Project to— 6 (1) satisfy any contracts or cooperative agree- 7 ments entered into subsection (g); 8 (2) help meet any unmet needs for Sacramento 9 Valley inbasin water uses; 10 (3) help meet any unmet needs of existing Cen- 11 tral Valley Project repayment and water service con- 12 tracts; and 13 (4) ensure that any surplus water supplies from 14 the Sites Project are put to full and beneficial use.

15 (g) CONTRACTS AND COOPERATIVE AGREEMENTS.— 16 The Secretary is authorized to enter into long-term con- 17 tracts and cooperative agreements with the Authority to 18 complete all planning and preconstruction activities and 19 to acquire water supplies and lease-of-power privilege 20 made available from the Sites Project for the purposes of 21 meeting the requirements under section 3406(b)(3) and 22 section 3408(j) of the Central Valley Project Improvement 23 Act (Public Law 102–575) and such other purposes as 24 the Secretary may deem appropriate.

3 (a) ISSUANCE OF GUIDELINES.—Section 4007(c)(4) 4 of Public Law 114–322 is amended— 5 (1) by striking ‘‘(B)’’ and inserting ‘‘(C)’’; 6 (2) by striking ‘‘but’’ after ‘‘analyses’’; and 7 (3) by inserting after subparagraph (A), the fol- 8 lowing: 9 ‘‘(B) shall, not later than 120 days after 10 the date of the enactment of the Sites Reservoir 11 Project Act, issue guidelines for feasibility (or 12 the equivalent) studies for State-led storage 13 projects that shall be deemed to provide suffi- 14 cient information for making the independent 15 determinations described in paragraph (2); 16 and’’.

17 (b) DEFINITIONS.—Section 4011(f)(2) of Public Law 18 114–322 is amended— 19 (1) by inserting ‘‘permitting,’’ following ‘‘de- 20 signing’’; and 21 (2) by inserting ‘‘mitigation’’ following ‘‘regu- 22 latory’’.

23 SEC. 7. COMPLIANCE WITH ENVIRONMENTAL LAWS. 24 Nothing in this Act—

Events x On April 12, OCWD, Inland Empire Utilities Agency, Western Municipal Water District, and San Bernardino Valley Municipal Water District hosted an event in Norco to celebrate 50 years of cooperation and collaboration on the Santa Ana River. April 2019 marks the 50th Anniversary of two major legal disputes regarding surface water and groundwater rights on the SAR. Agreements between the four water agencies in the SAR Watershed ended a decades-long period of lawsuits and ushered in a new era of stability and cooperation. The agreements have resulted in 50 years of effective management of water resources that are realized today. The keynote address was given by Congressman Ken Calvert and representatives from federal and state legislators’ offices attended to present resolutions/certificates. OCWD Director Kelly Rowe was in attendance.
