THE CASE OF THE ENGLISH PREMIER LEAGUE Abstract This paper investigates the peculiar nature of competition in the broadcasting market for live English Premier League matches in the United Kingdom. Following the movement from free- to-air to subscription television in 1992, British Sky Broadcasting secured a monopoly on live broadcasting rights. The exclusive arrangements were later found to be in breach of European competition law and resulted in competition from the start of the 2007-08 season. However, competition has not reduced prices charged to consumers. -

PREMIER LEAGUE FOOTBALL Research into viewing trends, stadium attendance, fans’ preferences and behaviour, and the commercial market Analysis advising the Commission of the European Communities relating to a proceeding under Article 81 of the EC Treaty in case COMP/C/38.173 - FAPL SUMMARY The European Commission has been concerned about the way Premier League sells the media rights to Premier League matches in the UK since 2001. It set out these concerns in a Statement of Objections issued to the Premier League in December 2002. It provisionally agreed commitments from the Premier League in December 2003, which were subject to consultation in 2004. On the basis of responses to the consultation, the Commission concluded that the commitments needed to be strengthened. In October 2004, the Commission asked Ofcom and the OFT to assist it in its investigation. In response to this request, Ofcom commissioned a wide-ranging programme of market research and economic analysis from third party suppliers, undertaken between October 2004 and June 2005, in order to understand fully: ° how markets are affected by the way Premier League content is made available; ° how markets are likely to be affected in the future in response to changes in the way that Premier League content is made available; and ° Premier League fans’ expressed preferences. The findings of this work programme have been provided to the Commission as research in its on-going investigation, to inform the Commission’s consideration of appropriate strengthening of the commitments. ANNEX 2 NON-CONFIDENTIAL VERSION APPENDIX 1: OFCOM’S INCONSISTENT REFERENCES TO RELEVANT MARKETS 1.1 One of the most surprising features of Ofcom’s approach to market definition in the Consultation Document is the inconsistent (and largely haphazard) way in which market definitions are stated, and the fact that a number of the statements on the market definitions that Ofcom has reached comprise products that are not actually supplied to consumers. 1.2 Set out below is an indication of the extremely large variety in the ways in which Ofcom expresses its findings in relation to relevant markets, separated according to whether they relate to sports, film or basic pay TV-only services.1 Sports • “There is a narrow economic market for premium sports retailing (sic) in the UK, which does not include FTA or basic-tier TV channels”2 • “…the retail market for packages containing premium sports…channels“3 • “It remains likely that there are separate retail and wholesale markets for the supply of premium sport… channels. We received a request from one of our readers a while back asking how Everton had fared in the live Premier League matches on Sky Sports, and how this record compared against the other Premier League teams. After a couple of years of searching, we can now provide some meaningful statistics in regards to live Premier League matches on Sky. It should be borne in mind that, at present, we still do not have a definitive listing of all Sky matches, but as we have managed to collate about 85%, the following statistics can provide a reasonable view. Naturally, as more matches are found, the stats will be updated. Also, we will be looking to expand this section as more matches are found. Also, when talking about overall statistics, these include matches shown on PremPlus (the Pay per View channel). Also, when applicable, stats have been broken down into individual programs and will be shown under these titles. Games played on PremPlus are automatically given a Pay per View [PPV] title, irrespective of what day of the week the match was played. Matches shown on Sky Sports can come under three different headings. Super Sunday [SS], Monday Night Football [MNF] and Football Special [FS] – which are games played on any other day of the week. Anyway, let’s get on with the facts and stats. APPEARANCES Everton have made 78 known appearances on Sky Sports since the League’s inception, which means we are currently 10th on the overall list (out of 39 Premier League teams). -

Email: [email protected] Abstract: This paper tests the impact of match outcome uncertainty on stadium attendance and television audiences of English Premier League football. The method accounts for different measures of outcome uncertainty, an issue identified as a potential source of discord between existing evidence. Results show that more certain matches are preferred by spectators at the stadium yet more uncertain matches are preferred on television spectators. Thus, a change in revenue sharing polices aimed at promoting a more uncertain match may affect both television and stadium demand in opposing directions. JEL classification numbers: D12, L83 Spectator demand and uncertainty of results: Evidence from the English Premier League. 1 Introduction The English Premier League is one of the most popular football leagues globally. Live matches aired in 212 territories, reaching approximately 4.7 billion viewers and raising £1.2 billion in revenue per year (Premier League). Domestically, stadium attendance was over 13 million in the 2011 - 2012 season (Rollin, 2012), driving £547 million in match day revenue (Deloitte, 2013). The Premier League restricts access to the television market by not allowing broadcasters to negotiate with individual clubs and instead forcing them to buy a package from the central negotiating body. The UK Restrictive Practices Court and the European Commission found in favour of this collective selling method to promote solidarity at all levels of football by redistribution of revenue (European Commission, 2002).
