ROAD TRAFFIC REGULATION ACT Amendment Croft Road - the Royal County of Berkshire (restricted Roads and 40mph speed limit) (Shinfield and Swallowfield) (No. 3) Order 1981. Formalisation of: 30mph on Croft Road Spencers Wood, Hyde End Lane Spencers Wood, Ryeish Lane Spencers Wood, and Ryeish Lane Spencers Wood; and 40mph on Croft Road Spencers Wood, Hyde End Lane Spencers Wood and Ryeish Lane Spencers Wood. The Wokingham Borough Council (Croft Road Prohibition of Driving) (Croft Road, Hyde End Lane & Ryeish Lane 30mph Speed Limit) (Hyde End Lane 40mph Speed Limit) Order 2021 1. Notice is hereby given that on 27 May 2021 Wokingham Borough Council, made the above-named Order under sections 1, 2, 3, 4, 83, 84 and 124 of the Road Traffic Regulation Act 1984, as amended and all other enabling powers. The Order will come into operation on 29 April 2021. 2. The effect of the Wokingham Borough Council (Croft Road, Prohibition of Entry) (Croft Road, Hyde End Lane & Ryeish Lane 30mph Speed Limit) (Hyde End Lane 40mph Speed Limit) Order 2021 will be to: - (a) formalise the prohibition of vehicular traffic on Croft Road (20 metre section); (b) formalise the 30mph speed limit signs on Croft Road Spencers Wood, Hyde End Lane Spencers Wood; (c) formalise the 40mph speed limit signs on Hyde End Lane Spencers Wood; (d) revoke and re-enact the 30mph speed limit for Croft Road from the Royal County of Berkshire (restricted Roads and 40mph speed limit) (Shinfield and Swallowfield) (No. 3) Order 1981. 3. A copy of the above-named Order, plan(s) and statement of reasons for making the Order may be viewed online at ‘https://www.wokingham.gov.uk/roadworks-and-outdoor-maintenance/traffic- management-road-signs-and-markings/traffic-regulation-order-consultations/’. 4. If you wish to question the validity of the Order or any provision contained in it on the grounds that it is not within the powers conferred by the Act, or on the grounds that any requirement of the Act or any instrument made under it has not been complied with in relation to the making of the Order, you may, within 6 weeks of the date of the making of the Order, apply to the High Court for this purpose. Citation and Commencement This Order shall come into operation on 29 May 2021 and may be cited as the Wokingham Borough (Croft Road, Prohibition of Entry) (Croft Road, Hyde End Lane, Ryeish Lane 30mph Speed Limits) (Hyde End Lane 40mph Speed Limit) Order 2021. 2. Definitions In this Order: - “bicycle” means a pedal cycle having two wheels, not being a motor vehicle and not being propelled by mechanical power; "enactment" means any enactment, whether public general or local, and includes any order, bylaw, rule, regulation, scheme or other instrument having effect my virtue of an enactment and any reference to this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment; "enforcement officer" means a uniformed police officer, police community support officer or any subsequent designation of these officers; "invalid carriage" has the same meaning as defined by section 20 of the Chronically Sick and Disabled Persons Act 1970(b); "motor vehicle" means a mechanically propelled vehicle intended or adapted for use on roads, as defined in Section 136 of the Road Traffic Regulation Act; “mph” means miles per hour; “the Council” means Wokingham Borough Council; “the Order of 1981” is the Royal County of Berkshire (restricted Roads and 40mph speed limit) (Shinfield and Swallowfield) (No. 3) Order 1981. CROFT ROAD, Spencers Wood that lies between a point 190.0 metres east of its junction with Clares Green Road and a point 210.0 metres east of that point. SCHEDULE 2 [See Article 4] Lengths of 30mph Speed Limits 1. CROFT ROAD, Spencers Wood Its entire length. 2. HYDE END LANE, Spencers Wood between its junction with Croft Road, Shinfield and a point 168.0 metres south-east of its junction with Church Lane, Three Miles Cross. 3. RYEISH LANE, Spencers Wood Its entire length. SCHEDULE 3 [See Article 5] Lengths of 40mph Speed Limits 1. HYDE END LANE, Spencers Wood between its junction with Church Lane, Three Miles Cross and a point 168.0 metres south-east of this junction. STATEMENT OF REASONS Wokingham Borough Council proposes to make the Order to introduce a Prohibition of Motor Vehicles along sections of Ryeish Lane and to revoke part of the existing one way traffic order in place along Ryeish Lane for the following reasons: (a) for avoiding danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising, (b) for facilitating the passage on the road or any other road of any class of traffic (including pedestrians), (c) for preserving or improving the amenities of the area through which the road runs As part of the Outline Planning consent for nearby housing developments new roads are to be built to allow two way traffic to access the sites. As part of these works the existing parts of Ryeish Lane will prohibit motor vehicles whilst still allowing the routes to be used by non-motorised users. Existing properties will be serviced by the new roads throughout the development. Part of the new roads being constructed will be on the existing Ryeish Lane and therefore the revocation of the one way order is required to allow 2-way traffic in and out of the developments. Outline Planning Consent has been granted for the proposed development at Spencers Wood /Three Mile Cross in 2014 (WBC Ref: O/2013/0346). Details of the means of access to the development was not a reserved matter and hence this aspect of the planning application was granted full planning approval. The access strategy for the development, which was approved by Wokingham Borough Council, promoted revisions to the operation of Hyde End Lane between the Croft Road and Ryeish Lane corridors. This section of Hyde End Lane currently caters for one-way northbound vehicle movements only. The existing carriageway width typically varies between 3.0m and 3.5m. The approved access arrangements for the consented development promote the closure of the southern section of Hyde End Lane to vehicular traffic. The regime along the northern section of Hyde End Lane is to remain unchanged, albeit vehicles will instead access the corridor from the Spine Road that is being provided through the development parcels at the Spencers Wood development (currently under construction). A key reason for the Order is to improve the provision for walk and cycle movements along this section of the corridor. Of note is that the resultant car free section would provide an attractive route for trips to and from the primary school which is being promoted in this area of the development. This arrangement will also ensure that an appropriate level of vehicular access for the development is provided in respect of connectivity to the north for egressing traffic. The approved configuration also ensures that satisfactory vehicular access is provided to the primary school via the purpose built 6.1m wide Spine Road within the Spencers Wood development area, rather than the narrow rural lane which would be the case if the closure of Hyde End Lane to traffic was not to be promoted. This measure will also discourage the use of Hyde End Lane for rat-running movements between the Hyde End Road and Church Lane corridors. It is important to note however that traffic will still be able to travel between these two corridors, albeit the movements would instead be made by routing along the Spine Road within the Spencers Wood development. The first phase of the spine road is currently under construction and as part of the works it is necessary to close, to vehicular traffic the section of Croft Road where the new spine road will cross. This will provide a safer, alternative route for pedestrians and cycles. Due to continuing development in the area of Shinfield and other local areas new, purpose built estate roads and sustainable routes are being proposed. Part of the new roads that will be able to carry two way traffic will interact with existing road networks that will no longer need to operate to carry through traffic. It is therefore proposed to remove the motor vehicle facility from these sections where possible to create a safer environment for pedestrians, cyclists and horse riders to enjoy the amenities. The initial section of Hyde End Lane will carry an “except for access” to allow a local landowner to gain access to a field located off Hyde End Lane, the remainder, as shown on the attached plan will be a prohibition to all motor vehicles.
