Subordinate Legislation Act 1994 NOTICE OF PREPARATION OF A REGULATORY IMPACT STATEMENT Specification of conditions that are to be implied into every driver agreement Notice is given under section 12I(3) of the Subordinate Legislation Act 1994 that a Regulatory Impact Statement (RIS) has been prepared in relation to the specification of implied conditions of every driver agreement. The proposed instrument is made under section 162L(1) of the Transport (Compliance and Miscellaneous) Act 1983, as amended by section 32 of the Transport Legislation Amendment (Foundation Taxi and Hire Car Reforms) Act 2013 (Reform Act), which will commence operation on or before 30 June 2014. The objective of the proposed instrument is to: address an imbalance in bargaining power between taxi-cab operators and drivers; provide better working conditions for drivers to attract high-quality drivers to the taxi-cab industry and in turn improve service delivery in accordance with the requirements and objectives of the Reform Act. The proposed instrument achieves these objectives by, amongst other requirements: Requiring operators to indemnify drivers for all damage caused in relation to the taxi-cab, subject to a requirement for the driver to contribute to the cost of the damage where the driver has admitted fault or has been found guilty of an offence in relation to the incident; Victoria Government Gazette G 13 27 March 2014 591

Requiring operators to maintain an insurance policy covering the driver for liability in respect of third party property damage; Requiring operators to provide regular records to drivers of all shifts worked, fares earned and payments made to the driver; Requiring operators to pay all operating and maintenance costs of the taxi-cab; Providing for unpaid leave entitlements for drivers who drive for one operator regularly for 12 months or more; Providing a dispute resolution process; Specifying when the parties may terminate the agreement; Specifying a maximum bond that operators may charge drivers, and the circumstances when operators may deduct from the bond. The RIS assesses the strengths and weaknesses of the proposed instrument and possible alternative means of achieving the stated objectives and explains why the proposed conditions are the preferred option. The RIS concludes that the proposed instrument is the optimal method of meeting the objectives.
