The MVI report and sketch obtained is not clear to this authority whether the vehicle is regulated through Pala Town in obedience to the judgments in MVAA No 196/2014 dated 29/10/2014 and MVARP No 262/2014 dated 19/05/2015 of Honble STAT Ernakulam. Hence Secretary RTA is directed to obtain a specific report from the field officer with detailed sketch and then place before the RTA. Hence adjourned.”

Now the MVI Pala has submitted a detailed report with route map as follows. 1.The proposed route is Ponkunnam – Veliyannoor via, Koorali, Paika, Pala, Valavoor and Uzhavoor. 2.The total route length of the proposed route is 41.600 km. 100 meters overlapping comes in Kottayam – Thekkady scheme ie, Ponkunnam Kurisukavala to Ponkunnam Bus Stand. 1.600 kms 28

overlapping comes in Kottayam – Kattappana scheme ie, from Kottaramattom B S to Pala Stadium Jn. Hence total distance of overlapping is 1.7 Kms. This is less than 5% of the total route length. 3.The operator demanded 4 trips touching Pala Town. 4.The Traffic Advisory Committee submitted a proposal that the stage carriages coming from Uzhavoor and Ramapuram area shall be reached at Kottaramattom Bus Stand through Kurisupally Jn., River View Road and Pala Old Bus Stand. In return, the stage carriages shall passing through Taluk Hospital – Kurisupally Jn. – Ramapuram Road. The proposal approved by the RTA, Kottayam vide Order No G3/1227/2010/K dtd 01/03/2011. 5.In the above circumstances, the route of Ponkunnam – Veliyannoor via, Koorali, Paika, Kottaramattom B S, Pala Taluk Hospital Jn., Kurisupally Jn., Valavoor, Uzhavoor without touching Pala Old Bus Stand may be considered. Applicant- Sri. M M James, Mazhuvancherril, Thellakom P O, Kottayam.

Notes:- The registered owner of the SC KL 03 J 3548 has applied for the grant of a temporary permit of four months duration U/S 87(1) c of MV Act to operate on the route Kottayam - Kattady Via Chungam, Varisserry, Pullarikkunnu, Thoothootty, Kudamaloor Church, Panampalam, Medical College,Koloth Temple, Navajeevan, Cherupushpam Church, Manaleppally and as Town service, from the date of issue.

The enquiry officer reported that, this is an intra district route having a distance of 11.8 Km. Enquiry officer also reported that applied route portion of 3.9 Km (from Baker Junction to Varisserry (2 Km) and from Kudamaloor to Medical College(1.9 Km) objectionably overlaps on Kottayam- Neendoor Complete exclusion Scheme and 500 meters from Gomathy Junction to Baker Junction objectionably overlaps on the Ernakulam-Thekkady notified Scheme. On perusal of the report it is found that 3.9 Km of the applied route objectionably overlaps on the Kottayam - Neendoor Complete exclusion Scheme. Kottayam – Neendoor is a complete exclusion scheme, vide Govt. notification no. 34626/TC2/64/PW dated 06/05/1965. Private stage carriage operators are prohibited from plying stage carriage services even on part of a complete exclusion scheme. Even the entry with corridor restrictions, is not allowed. (Adharsh Travels Bus Service Vs State of UP, AIR 1986 SC 319).

More over the applied route is having a total distance of 11.8 Km out of which 4.4 Km of the applied route objectionably overlaps on various notified Schemes. As per notification No 42/2009/Trnas dtd 14/07/2009, a private operator is permitted to overlap on notified route mentioned there in by 5 Km or 5 % of the length of their own route, whichever is less on the notified route for the purpose of intersection. In this case the overlapping exceeds the maximum permissible limit.

Honorable High Court also held that a private operator of stage carriage service traversing the same line of travel on a notified route cannot be permitted to overlap for a distance beyond the limit prescribed on the ground that it is an inevitable intersection [2013(2) KLT 280]. 30

The applicant was produced a Judgment in WPC No.15215/2016 dated 19/04/2016. The application was considered in the light of the Judgment in WPC No.15215/2016 and rejected by the Sy RTA Kottayam and issued proceedings in vide order No G1/40870/2016/K dtd 10/05/2016. Against the rejection, the applicant was approached Honorable STAT and produced a Judgment in MVAA No 98/2016. In this judgment the appeal is allowed in part by the Honorable STAT. The impugned order is set aside. The matter is remanded back to the authority concerned. The Authority shall consider the matter afresh in the light of the discussion made herein above and pass fresh orders, after hearing both parties [ie, Applicant & KSRTC]. The applicant and KSRTC were heard and KSRTC submitted their objection that not to allow permit on Kottayam – Kattady route. The Judgment in WP[c] No 30359/2017 dtd 17/10/2017 of Division bench of Honorable High court of Kerala states that no temporary permit U/S 87[1][c] shall be granted.

Hence RTA may hear the applicant, peruse the judgments, file and take a decision.

Registered Owner of SC KL 05 J 7530 operated in the vacancy of SC KEK 8611 from 04/05/2004 to 03/06/2012 on the strength of TP issued U/S 104 of the MV Act. There after R/O of SC KL 06 D 7024 has been operating service on the route Koruthode - Kottayam in the vacancy of SC KEK 8611 on the strength of TP issued U/S 104/87(1) c of the MV Act from 04/06/2012 onwards. Last of such TP issued is valid till 30/10/2014 .There after application for the re issue of TP U/S 104 of MV Act submitted by the applicant was rejected by the RTA in its sitting on 16/11/2013, stating the following reason.

This is an application for the re issue of 04 months TP U/S 104 of MV Act in respect of SC KL 06 D 7024 to operate on the route Koruthodei-Kottayam.As per Judgment of Honorable High Court of Kerala in WA No.1943/2012 and 1957 of 2012 dated 23/08/2013,wherein the Division Bench has pointed out that on the basis of Judgment of Honorable Supreme Court in UP State RTC Vs Sanjitha Bhanu & others(2005 KHC1697 & 2005(10) SCC 250),that the private stage carriage operators have no right to claim any grant of stage carriage temporary permits on the notified route or portions there of.It has ordered that once the scheme is in force and the overlapping is permitted only to a certain extent,it is not possible to grant temporary permit based on the proviso to Section 104 of the MV Act.The benefit of the proviso to section 104 can be granted only in instances where there is no scheme and where no permits have been issued in such route. The proviso to section 104 cannot have any independent application and it is subject to the scheme framed by the Govt.in nationalized routes.

In this case, the applied route is of 60 Kms. Route portion from Kottayam to Mundakkayam 52 Kms overlaps on the notified Ernakulam-Thekkady and Kottayam-Thekkady Schemes and from 14th Mile to 26the Mile 24 Kms of the route overlaps on the notified Chry- Chry Circular Scheme. KSRTC vehemently objected the grant. Hence rejected”.

Then the vehicle has been issued with a 04 months TP in compliance to the Judgment of the Honorable HC of Kerala in WPC No.13577/2014 dated 29/05/2014. Thereafter RTA held from time to time has granted 04 months temporary permit U/S 87(1) c of MV Act. Last of such temporary permit issued by the RTA held on 25/07/2017 was valid till 28/12/2017.

Now the applicant submitted an application for the re issue of a 04 months Temporary permit U/S 87(1) c of MV Act to a leased vehicle KL 05 AC 8056 along with a judgment dtd 02/11/2017 of Honorable High Court of Kerala in WP[c] No 35010/2017 in which it directed the Secretary RTA to consider the request for issue TP U/S 87 [1][c] of MV Act to the leased S/C KL 05 AC 8056 by replacing KL 06 D 7024, from the date of expiry of the existing TP. As per the report of MVI Kottayam that there is no necessity U/S 87(1) c of MV Act.

The vehicle has been conducting service for the past few years, with a settled set of timings. Judgment dtd 17/10/2017 in WP[c] No 30359/2017 and WA No 993/2017 dtd 15/06/2017 of Division bench of Honorable High Court of Kerala states that no temporary permit U/S 87[1][a], [b] [c] is granted.

Notes- SC KRK 8330 had a permit to operate on the route Ranni - Kottayam. When the route was abandoned by the permit holder, Sri. Sajimon J Mattathil was applied for the grant of fresh regular permit to operate on the route Ranni - Kottayam to his vehicle KL 07 J 8343. The regular permit application submitted by the applicant has rejected by the RTA Kottayam dated 29/07/2013 stating that the applied route objectionably overlaps on the notified portion from Kottayam to Kodungoor (27.8 Kms) on Ernakulam-Thekkady and Kottayam-Thekkady Scheme and from Palcherry to Ranny(07 Kms) on Chry-Chry Circular Scheme. There after the applicant has been operating service on this route on the strength of TP issued U/S 104 of MV Act with his various vehicles. Last of such TP issued to SC KL 05 S 190 was valid till 22/01/2014. Thereafter, application for the re issue of TP U/S 104 of MV Act submitted by the R/O of SC KL 05 S 190 has been rejected by the RTA Kottayam held on 16/11/2013 stating the following reason. Heard. This is an application for the re issue of 04 months TP U/S 104 of MV Act in respect of SC KL 05 S 190 to operate on the route Ranni-Kottayam. As per Judgment of Honorable High Court of Kerala in WA No.1943/2012 and 1957 of 2012 dated 23/08/2013, wherein the Division Bench has pointed out that on the basis of Judgment of Honorable Supreme Court in UP State RTC Vs Sanjitha Bhanu & others (2005 KHC1697 & 2005(10) SCC 250), that the private stage carriage operators have no right to claim any grant of stage carriage temporary permits on the notified route or portions thereof. KSRTC vehemently objected the grant. Hence rejected. There after the vehicle had issued with a 04 months Temporary permit in compliance to the Judgment of Honorable HC of Kerala in WPC No.12160/2014 dated 34

09/05/2014. Now the vehicle is operating on the strength of 04 months TP issued U/S 87(1) c of the MV Act, as per the decision of RTA Kottayam held on 25/07/2017 which is valid till 07/01/2018.

Now the applicant submitted an application for the re issue of a 04 months Temporary permit U/S 87(1) c of MV Act, from the date of expiry of the existing TP. MVI Kottayam reported that no necessity U/S 87(1) c of MV Act.

The vehicle has been conducting service for the past few years, with a settled set of timings.

Application for the re issue of TP U/S 104 of MV Act has been rejected by the RTA Kottayam held on 16/11/2013 stating the following reason. “Heard. This is an application for the re issue of 04 months TP U/S 104 of MV Act in respect of SC KL 36 9190 to operate on the route Kottayam - Vaikom.

Later application for the re issue of TP U/S 104 of MV Act submitted by the R/O of SC KL 05 V 2963 has been rejected by the RTA Kottayam held on 16/11/2013 stating the following reason.

Then the vehicle has been operating on this route on the strength of temporary permit issued by the RTA Kottayam dated 14/08/2014. On the expiry of that temporary permit applicant produced a copy of the Judgment of the Honorable HC of Kerala in WPC No.35478/2014 dated 30/12/2014, in which it is ordered to re issue TP for 04 months, within one week from the date of production of the order, subject to preferential claim, if any. In order to comply the order within the time frame, Sy, RTA granted TP for 04 months to SC KL 05 V 2963 which is valid up to 21/05/2015. There after the vehicle has been operating on the strength of Temporary permit granted by the RTA Kottayam U/S 87(1) c of MV Act. Existing TP covered with the vehicle issued as per the decision of the RTA dated 25/07/2017 is valid till 29/12/2017. Now the applicant submitted an application for the re issue of a 04 months Temporary permit U/S 87(1) c of MV Act, from the date of expiry of the existing TP. MVI Kottayam reported that no necessity U/S 87(1) c of MV Act.

In this case the applied route is of 21.8 Kms. 17 Kms of the route overlaps on the notified Scheme Kottayam-Kottarakkara. KSRTC vehemently objected the grant. Hence rejected.

Then the vehicle has been issued with a 04 months TP in compliance to the Judgment of the Honorable HC of Kerala in WPC No.12161/2014 dated 09/05/2014. Thereafter RTA held from time to time has granted 04 months temporary permit U/S 87(1) c of MV Act. Last of such temporary permit issued by the RTA held on 25/07/2017 was valid till 29/12/2017.

Babu, Mandapathil, Pala, had been operated on this route in the vacancy of SC KL 05 H 6212 till 21/01/2014 on the strength of TP issued U/S 104 of MV Act. There after application for the re issue of TP U/S 104 of MV Act submitted by the applicant was rejected by the RTA in its sitting on 16/11/2013,stating the following reason.

Heard. This is an application for the re issue of 04 months TP U/S 104 of MV Act in respect of SC KL 03 K 4369 to operate on the route Vechoor - Kidangoor.As per Judgment of Honorable High Court of Kerala in WA No.1943/2012 and 1957 of 2012 dated 23/08/2013,wherein the Division Bench has pointed out that on the basis of Judgment of Honorable Supreme Court in UP State RTC Vs Sanjitha Bhanu & others(2005 KHC1697 & 2005(10) SCC 250),that the private stage carriage operators have no right to claim any grant of stage carriage temporary permits on the notified route or portions there of. Thereafter the vehicle is operating on the strength of TP issued U/S 87(1) c of MV Act by the RTA from time to time. Last of such TP issued by the RTA dated 25/07/2017 is valid till 18/01/2018. 42

Then the vehicle had operated on the strength of 04 months temporary permit issued in compliance to the Judgment of the Honorable HC of Kerala in WPC No.35492/2014 dated 30/12/2014 which is valid till 27/05/2015.There after KL-05-AA-3471 has been operating on the strength of 4 months temporary permit issued U/S 87 (1) c of MV Act by the RTA. Last of such TP issued is valid till 09/01/2018

The vehicle has been conducting service for the past few years, with a settled set of timings.

RTA Kottayam held on 16/11/2013 has rejected application in respect of KL-07-AK-5499 submitted for the issue TP U/S 104 of MV Act stating the following reason. “As per Judgment of Honorable High Court of Kerala in WA No.1943/2012 and 1957 of 2012 dated 23/08/2013,wherein the Division Bench has pointed out that on the basis of Judgment of Honorable Supreme Court in UP State RTC Vs Sanjitha Bhanu & others(2005 KHC1697 & 2005(10) SCC 250),that the private stage carriage operators have no right to claim any grant of stage carriage temporary permits on the notified route or portions there of. It has ordered that once the scheme is in force and the overlapping is permitted only to a certain extent, it is not possible to grant temporary permit based on the proviso to Section 104 of the MV Act. The benefit of the proviso to section 104 can be granted only in instances where there is no scheme and where no permits have been issued in such route. The proviso to section 104 cannot have any independent application and it is subject to the scheme framed by the Govt. in nationalized routes”.

This is an intra district route with a length of 26Kms. Out of which 18Kms overlaps on Ernakulam-Thekkeady, Trivandrum - Thekkedy via Ranny and CHRY - CHRY circular scheme. Hence rejected.

Then the SC KL-07-AK-5499 had operated on the strength of a 20 days temporary permit issued in compliance to the Judgment of the Honorable HC of Kerala in WPC No.438/2015 dated 07/01/2015.Thereafter RTA held from time to time granted 4 months TP U/S 87(1)c of MV Act. 46

The application submitted for 4 months temporary permit was placed before the RTA Kottayam held on 02/02/2017 as Item No-15 and taken the following decision.

“Heard learned counsel represented the applicant. Considered the fresh application for the issue of 4 months Temporary Permit U/S 87(1)© of MV Act to SC KL 33 H 8818 to operate on the route Kottayam-Karukachal Via Kanjikuzhy,Puthupally and Thottacadu, in the vacancy of KL-07-AK-5499 (Which was conducting service in the vacancy of KL 05 D 2601) from the date of issue. This is an intra district route with a length of 26Kms. Out of which 18Kms overlaps on Ernakulam-Thekkeady ,Trivandrum-Thekkedy via Ranny and CHRY-CHRY circular scheme. Total overlapping exceeds more than 5% of the total route length violating GO(P) No 42/2009.Hence rejected.”

On 04/07/2017 the applicant produced a Judgment in WPC No 12905 of 2017 dated 11/04/2017 of Honorable High Court of Kerala directing RTA Kottayam to consider his application for 4 months which he had filed on 24/03/2017 in accordance with law within 6 weeks from the date of receipt of the Judgment. RTA has rejected the temporary permit in vide Order No G1/36389/2017/K.dated 25/07/2017.

Considered the fresh application for the issue of 4 months Temporary Permit U/S 87(1)© of MV Act to SC KL 33 H 8818 to operate on the route Kottayam-Karukachal Via Kanjikuzhy,Puthupally and Thottacadu, in the vacancy of KL-07-AK-5499 (Which was conducting service in the vacancy of KL 05 D 2601) from the date of issue. Perused the file and enquiry report. This is an intra district route with a length of 26Kms. Out of which 18Kms overlaps on Ernakulam - Thekkeady ,Trivandrum-Thekkedy via Ranny and CHRY-CHRY circular scheme. Total overlapping exceeds more than 5% of the total route length violating GO(P) No.8/2017 Trans dated 23/03/2017.Hence rejected. Against the rejection the applicant has produced an Order in MP No 401/2017 in MVAA No 73/2017 of Honorable STAT and obtained two months temporary permit. Last of such two months temporary permit issued was valid till 17/11/2017. Now the R/O of the SC KL-33-H-8818 has produced an Order in MP No 690/2017 in MVAA No 203/2017 of Honorable STAT as follows. “Advanced on application. Learned Standing Counsel for KSRTC opposed granting temporary permit in this case. Initially temporary permit was issued for two months. No counter filed so far. Hence temporary permit is granted for 7 days more. In the meanwhile the respondent shall file objection and matter will be heard on merits and pass orders”. But Judgment dtd 17/10/2017 in WP[c] No 30359/2017 and WA No 993/2017 dtd 15/06/2017 of Division bench of Honorable High Court of Kerala states that no temporary permit U/S 87[1][a], [b] [c] is granted.

Hence RTA may hear the applicant peruse the judgment and take a decision.

An application for transfer of ownership [ death] submitted on 15/7/2017 by Sri. Santhosh , the successor of the vehicle with request to condone the delay .On 09/11/2017, Sri. Meanwhile a Judgment in WP[C] No 24264 of 2017 dtd 27/7/2017 has been produced by the applicant which directed to consider the application in accordance with law , taking note of any reliable document available with respect to the transfer sought for the true copy of the letters of consent submitted by the other legal heirs agreeing to transfer the vehicle in the name of the petitioner ,if required after issuing notice to the petitioner and all concerned persons and attain finality to the same within 6 weeks from the date of receipt of this judgment .Also make it clear that the judgment rendered by this court in Bhagyalakshmi vs RTA Palakkadu [2010[2] klt 431] shall also be taken into consideration .ie, “ the person seeking such transfer of permit would have to satisfy the authority that he had legally succeeded to the possession of the vehicle by producing supporting documents “

Hence all of them were heard by the Secretary RTA Kottayam on 15/11/2017. Among them the legal heir Sri Nadarajan was deceased on 03/11/2015 and the death certificate produced . All others are given consent to transfer the permit to the name of Sri. Santhosh.Also the genuiness of the application was enquired through the field officer and reported that the application was genuine one.

Even though the regular permit valid up to 03/10/2018 the registration validity expired on 01/02/2017. Along with the transfer of permit [death] application the applicant submitted application for replacement of vehicle by KL 04 N 3641 .It is a leased higher model vehicle[2003] Signed lease agreement and other valid documents also submitted.

The applicants were failed to produce current records of the S/c KL 05 Y 5099 in time. The Secretary, RTA,Kottayam had heard both the applicants on 18/08/2017. The permit holder informed that the production of current records were delayed due to the delay to obtain the clearance certificate from KMTWWF Board. He also requested to condone the delay to produce the current records of the vehicle and effect transfer of permit as per the earlier decision of RTA in this matter.

The permit holder of the S/c KL 34 D 6274, Sri.Thomas Chacko, Kollamparambil house, Koottickal, Yendayar P O, Kanjirappally, expired on 12/04/2017. The permit holder’s wife Betsy Thomas expired on 28/11/2015 and his mother Valsamma Chacko expired on 12/04/2017.

As per the certificate issued by the village officer, Koottikkal, dated 05/06/2017 , the legal heir of the deceased person,Thomas Chacko, is as follows.

Smt. Brijit K A, maternal grand mother of Anna Selin Thomas, intimated that the S/C KL 34 D 6274 is under her possession and also requested to transfer the permit of the vehicle in her name since the legal heir of the deceased permit holder is a minor girl. She was appeared for personal hearing on 04/07/2017. This authority has directed to the applicant to stop the service of the vehicle with effect from 12/07/2017 in accordance with the sub rule [1] of Rule 56 of the Central Motor Vehicles Rules, 1989 .

Later, The applicant produced an interim order in I.A No.1313/17 in O.P [G&W] No.63/17 of The Additional District Judge-V, Kottayam. The interim order as follows

“ Heard, perused the affidavit, taking note of the prayer in the petition, I am of considered view that it is highly necessary to permit the petitioner to look after the affairs of the stage carriages. This would in the best interest of the minor. Therefore I allowed the petition and permit the petitioner to look after the permit of the stage carriages bearing No.KL 34 A 5741 and KL 34 D 6274 until further orders.”

Smt. Brigit Thomas [Possessor] submitted an application for temporary permit to the S/c KL 34 D 6274 on the route Pala – Elamkadu and granted T P vide Order No.82012/2017, dated 17/07/2017. But the applicant had not submitted the current records of the vehicle . A communication, vide Letter No.C2/7359/2017/K, Dated 05/08/17, was sent to the applicant to produce the current records of the vehicle within 7 days from the date of receipt of the letter , failing which the sanction for the issue of temporary permit is liable to be revoked with out further notice . She approached before the Honorable High Court of Kerala against this communication [Ext. P7] and prayed to quash order of the Secretary, RTA, to produce the current records of the vehicle to issue temporary permit and give a direction to the Secretary, RTA, not to interfere with the smooth service of the stage carriage on the strength of the regular permit on the route Pala – Elamkadu. The Honourable Court has delivered its judgment in WP[C] 27839/17 as follows.

“ Having regard to the facts and circumstances of the case, and hearing learned cousel for the petitioner and learned Sernior Government Pleader, I think the writ petition can be disposed of with suitable directions.

Therefore there will be a direction to the respondent [Secretary, RTA] to place all the current records of the vehicle bearing registration No.KL 34 D 6274 before the RTA, Kottayam, who shall take a decision in the matter at the earliest possible time, and at any rate, within six weeks from the date of receipt of a copy of this judgment.

Till such time the interim order passed by this Court 23/08/17 will be in force.[ a stay of further proceedings pertaining to Ext.P7] “

While the S/C KL 05 AM 63 conducts stage carriage service in the route Chamakala – Kottayam as Town service .ie, These two vehicles conducts stage carriage services in different routes and class of service.

2] S/C KL 05 AM 63 conducts stage carriage service on the route Kallampara –Kottayam as town service before variation of permit as Chamakkala – Kottayam . The variation of permit is 111

Enquiry conducted trough MVI ,Kanjirappally reveals the following

1. The Stage Carriage Preceding to KL-35-9542 departs Kanjirappally to Edakkunnam at 11.40 hrs and in return it departs Edakkunnam to Kanjirappally at 12.23 hrs and the Stage Carriage succeeding KL-35- 9542 departs Kanjirappally to Edakkunnam at 12.49 hrs and in return it departs Edakkunnam to Kanjirappally at 13.25 hrs. If curtailment /avoiding of trip of Stage Carriage KL-35-9542 departing Kanjirappally to Edakkunnam at 12.00 hrs is allowed, the time gap will increase to 69 minutes [Kanjirappally to Edakkunnam] and 62 minutes[Edakkunnam to Kanjirappally] which are presently 34 minutes & 32 minutes respectively .This will cause undue hardships to the travelling public on Kanjirappally - Edakkunnam sector & they will be compelled to depend other modes of transport such as parallel services. 2. Notes:- The regular permit issued to S/C KL 05 P 2187 on the above route is valid up to 03/07/2018. On 15/05/2012, the RTA Kottayam granted Transfer of Permit U/S 82 of MV Act in respect of the above vehicle in to the name of Sri. Jojo Antony, Edackathalackal House, Anakkallu P.O., Kanjirappally, the proposed transferee had not obtained the transfer of permit even after the lapse of long 5 years. It is evident from the file that subsequent to the grant of transfer, the possession of the stage carriage KL 05 P 2187 was transferred to another person by executing agreement between the permit holder and others. But the intention of sale of vehicle and permit was not brought to the notice of the Regional Transport Authority. Hence there is a clear violation of Rule 178 of KMV Rules 1989.

After the transfer possession of the vehicle, the route bus KL 05 P 2187 had not conducted regular service on the route Pala – Kanjirappally. Subsequently, temporary permits were being granted to Sri. K S Shereef, Kunnackattu House, Erattupetta wef. 15/05/2015. As there was an interim order from the Honorable Judicial First Class Majistrate Court Pala, the vehicle KL 05 P 2187 seen possessed by Sri. K S Shereef.

Finally on 13/10/2017, a subsequent temporary permit was granted to Sri. K S Shereef in respect of his vehicle S/C KL 35 F 6766 to operate upto 01/11/2017 in the defaulted vacancy of KL 05 P 2187. The above grant was challenged before the Honorable STAT by the permit holder of the vehicle KL 05 P 2187 Sri. Baby Antose, Parayil House, Edamaruku P O, Pala, vide order in MP NO 724/2017 in MVRP No 122/2017 dtd 09/10/2017, the tribunal directed the Secretary 138

RTA Kottayam to hear the petitioner and the 3rd respondent Sri. K S Shereef in accordance with the principles of natural justice for the grant of temporary permit to the applicant and it is also directed to consider all the contentions raised in this case in the light of Sec 82 of MV Act and Rule 178 of KMV Rules and pass orders in accordance with law.

On perusal of the permit file, it is very well clear that the 20 days temporary permits are being issued to operate in place of S/C KL 05 P 2187 on the route Pala – Kanjirappally Sri. K S Shereef, the registered owner of S/C KL 35 F 6766, was issued with substitute temporary permit in place of above route bus on consideration that he is operating service to cater the need of public on the route Pala – Kanjirappally wef 15/05/2015. In the above period, the permit holder Sri. Baby Antos had not applied for the permit by replacing the S/C KL 05 P 2187 which is possessed by other person as per the Order of Judicial First Class Majistrate Court Pala.

As the petitioner Sri. Baby Antose is the basic permit holder, he has a preferential claim for obtaining STP in place of his defaulted service. Therefore, considering the natural justice reported in the order of Honorable STAT, Sri. Baby Antose is more eligible than Sri. K S Shereef for availing substitute temporary permit in place of S/C KL 05 P 2187. Hence RTA has taken a decision by circulation of file U/R 130 of KMV Rules that to issue temporary permit to Sri. Baby Antos, the permit holder as and when the application made for that purpose. It is also observed that however, the issue related to the transfer of permit and unauthorized change of possession of the vehicle KL 05 P 2187 covered by a valid regular permit without prior sanction of the RTA is clear violation of Rule 178 of KMV Rules 1989. Therefore, the RTA, the authority granted the permit is bound to consider all the contentions with regard to the above violation and take appropriate action on regular permit and its secretary RTA is directed to place the above matter for the consideration of RTA in the very next sitting itself.

It is submitted that the permit holder Sri. Bay Antose and Sri. K S Shereef have applied for temporary permit for 4 months in place of KL 05 P 2187 on the route Pala – Kanjirappally in respect of their vehicles KL 34 C 7787 & KL 35 F 6766 respectively.

It is also submitted that both Baby Antose and K S Shereef have also applied for replacement of vehicle with their on S/Cs KL 34 C 7787 & KL3 5 F 6766 for replacing S/C KL 05 P 2187.

Hence the RTA may peruse the file, judgment, and take a decision.

Notes:- RTA, Kottayam held on 9-10-2001 approved the Dalavakulam Bus stand at Kizhakkenada, Vaikom. In order to implement some traffic reforms in Vaikom Town and for start functioning of Delavakulam Bus stand, the Traffic regulatory Committee Vaikom submitted recommendations before the RTA held on 16-11-2013 a decision was taken but not implemented. So many decisions were taken by the RTA & Traffic regulatory committee Vaikom in this matter. AT last, the Traffic Regulatory Committee held on 29-06-2017 examined the representations from various organizations and scrutinized the matters relating to the implementation of the traffic reforms as follows.

1. All stage carriages coming from Ernakulam, Kottayam side should proceed through the link road and halt at Dalavakulam stand after alighting passengers in the various stops at Thekke Gopuram, Padinjare Gopuram, Kacherikavala, KSRTC, Valiyakavala. Stage carriages having only passing time shall continue their service from Dalavakulam stand. 2. Stage carriages coming from Vechoor, Alappuzha, Cherthala, Kaipuzhamuttu should operate through Padinjare Gopuram, Kacherikavala Old Stand, Valiyakavala, Link road to Dalavakulam stand and those vehicles having no passing time should continue their service. 3. Stage carriages coming from T.V Puram should operate through Kacherikavala, Old stand Valiyakavala, link road and parking at Dalavakulam stand. Those vehicles having no passing time should continue service with destination board, and others should run one round service for the convenience of passengers. 4. All buses should operate through Dalavakulam Bus stand including KSRTC, Ordinary, FP, SFP and other higher class services. 5. New bus stop is to be considered at Dalavakulam Stand for all classes of KSRTC services. 141

6. No entry is allowed for stage carriages and goods vehicles through link road from south to north. 7. One way system to be insisted between Kacherikavala to Thekke Gopuram except 2&3 wheelers.

RTA Kottayam at its sitting dtd 25/07/2017 took the following decision in vide Order No G1/8420/2017/K. dated 25/07/2017. “Perused the decision taken by Vaikom Traffic Regulatory Committee on 29/06/2017 in detail. Objectors also heard at the time of sitting. It is seen that the proposal are on the basis of various discussions and studies. Considering the urgent necessity of control of traffic in Vaikom Town relating to Dalavakkulam Bus Stand, the proposals accepted and directed to implement with immediate effect. The Chairman Traffic Advisory Committee is also directed to report to the next meeting of the RTA if any variations needed in the proposed system after hearing all the objectors”.

The above decision was communicated to Joint RTO Vaikom and directed to submit report on the direction contained in the decision of RTA. Now Joint RTO Vaikom submitted a report that Chairman of Traffic Regulatory Committee Vaikom was convened a meeting on 12/10/2017 and discussed the matter in detail. There were 14 Participants in the meeting and no new proposals / suggestions were arrived at. RTA may take a decision.

Agenda-To consider the request for the sanction of Bus stop for LSOS buses at Shanthi Nagar Bus Stop.

Ref:- Complaint filed by Sri. James Mathew, Palathanathel, Marangattupilli dtd 31/05/2017 before Honorable Chief Minister of Kerala.

Notes- Vide reference cited, Sri. James Mathew filed a complaint dtd 31/05/2017 before Honorable Chief Minister of Kerala that to allow stops for LSOS vehicle at Shanthi Nagar Bus Stop which is situated between Paikkadu and Marangattupilly. A detailed enquiry has been conducted through MVI Uzhavoor regarding the matter and he has submitted a detailed report as follows.

1.This bus stop is located in the Vaikom – Pala route between Paikkadu and Marangattupilly.

2.A bus shelter is provided at this location adjacent to the main road and having stop for Ordinary services.

3.Stopping the bus at present condition may cause probability of accident due to insufficient width of the Road for two way traffic.

4.The condition of the road at this location is very Steep with sharp curves and a dangerous spot in view of Road Safety.

5.The distance from the proposed Bus Stop in between the notified Limited Stop Bus Stops Paikkad and Marangattupilly are 1 kms and 1.4 kms respectively to both sides.

6.There is no important offices / institutions located in connection with this Bus Stop.

7.There is no provision to provide a Bus way at present road conditions especially insufficient width and steep with sharp curve.

Considering the above facts, a bus stop for LSOS vehicles is not feasible at this proposed place. Kind attention is invited in an important Road Safety matter also that, the aforementioned Santhinagar Bus Stop is not a sung area on the route and it may cause possibility of accidents and traffic conjunction due to stoppage of further stage carriages. Construction of a bus bay and modern bus waiting shelter is the basic necessity of a new bus stop also. The proposal can be considered in future along with the straitening and widening of the present road only. Also given strict directions to all the Ordinary Service Operators and Crew to avail the Bus Stop facility.

A detailed enquiry has been conducted through MVI Vaikom regarding the matter and he has submitted a detailed report as follows.

Mattappallikkunnu is situated from 1 km from the eastern side of the Peruva Jn. stop and 900 meters from western side of the Avarma Govt. LP School Stop on Vaikom – Thodupuzha Route. Majority of the busses are the Ordinary, LSOS, FSLS and FP of KSRTC. But only ordinary services of KSRTC are stopping at Mattappallikkunnu at present. More over many religious institutions are situating at this place and this highly populated area also. Hence there is much travelling difficulty is existing in this region. Hence recommended that if stops allowed at Mattappallikkunnu for LSOS, FSLS vehicles of KSRTC, will reduces the travelling difficulty of the travelling public of Mattappallikkunnu region.
