Morris III Thesis Adviser: Rebecca Boylan, Ph.D. ABSTRACT U.S. Navy SEALs have become ubiquitous in the years since SEAL Team Six killed Osama Bin Laden during Operation Neptune Spear in 2011. SEAL narratives and stories can be found in bookstores, movie theaters, newspapers, talk shows, board rooms, and campaign trails. But who are Navy SEALs? Though existing scholarly literature explores the factual elements of SEALs, the archetypal identity of Navy SEALs remains a mystery. By some popular accounts, SEALs are American superheroes or living legends who bridge the gap between myth and reality. This thesis finds and explores the intricacies of the SEAL identity by reading SEAL narratives and stories, particularly American Sniper (the film), American Sniper (the book), Fearless, The Operator, and Lone Survivor.1 This thesis argues that a Hegelian dialectic between the ordinary and the extraordinary characterizes the Navy SEAL identity which emerges from the intersection of the narratives and stories produced by SEALs, specifically those who waged the War on Terror between 2001 and 2011.

In a book subchapter Kyle detailed an encounter with a "Mr. Scruff aF ce" in a San Diego Bar. The book states that Ventura made certain statements that were demeaning of the United States and the Navy SEALS. Scruff aF ce was subsequently identified by Chris Kyle as Jesse Ventura, former governor of Minnesota. Ventura sued Chris Kyle for defamation, appropriation, and unjust enrichment. Relying on trial court documents, briefs, and the opinions in the case, this article probes those theories of recovery with an emphasis on the jury instructions, with a view to establishing clearer instructions in public figure lawsuits involving overlapping defamation and appropriation claims.

In it, Kyle claimed he punched someone named “Scruff Face,” whom he later identified as Ventura, in a 2006 bar fight. Ventura says the fight never happened. “It’s never been about money. It’s about clearing my name. It’s a lie,” Ventura told The Associated Press in an interview last month. The former SEAL said Ventura bad-mouthed and degraded the U.S. military in front of a group of SEALs. Kyle’s accusation, if true, is all the more egregious considering the fact that the SEALs had converged on that particular spot to commemorate the loss of a comrade who died throwing himself on a grenade. The judge wrote Ventura has offered enough evidence that a jury could conclude Chris Kyle’s statements were “materially false.” Ventura also has presented enough evidence “to create a genuine issue of fact as to whether Kyle knowingly or recklessly published false statements about him,” the judge wrote, saying Ventura’s defamation claim will be left to a jury to resolve.
