The PSUs have been established to carry out activities of commercial nature while keeping in view the welfare of people and also occupy an important place in the State economy. As of 31 March 2016, in UT of Puducherry, there were 12 working Government companies and one non-working Government Company. None of the working Government companies were listed on the stock exchange. The details of the PSUs in UT of Puducherry as of 31 March 2016 are given in Table 5.1 below: Table 5.1 - Total number of PSUs as on 31 March 2016 Type of PSUs Working PSUs Non-working PSUs1 Total Government 12 1 13 Companies2 Total 12 1 13 (Source: Details collected from the Government) The working PSUs registered a turnover of ` 362.61 crore, as per their latest finalised accounts as of September 2016. The working PSUs incurred loss of ` 70.62 crore, as per their latest finalised accounts, as of September 2016. They had employed 4,899 employees as at the end of March 2016. Since 2011-12, Pondicherry Electronics Limited is the only non-working PSU in UT of Puducherry. The assets and liabilities of this PSU were taken over by its holding Company (Pondicherry Industrial Promotion Development and Investment Corporation Limited) and the PSU was in the process of getting its name struck off from the Register of Companies.

This department’s role is to facilitate the pursuit of excellence in governance through improvements in government structures and processes, initiatives and dissemination of best practices. Moving towards this goal, the department commissioned a grievance analysis study of top 20 Ministries/Departments receiving high number of citizen grievances. The study involved identification of top grievance categories and recommending systemic reforms. The Parliamentary Standing Committee for Personnel, Public Grievances and Law & Justice recommended conducting similar study for next 20 Ministries/Departments. 1.2 OBJECTIVE The study carried by Quality Council of India, as per the mandate given by DAR&PG, was conducted from August 2016 to March 2017, covering more than 100 grievance categories across 20 Ministries/Departments. A team of consultants was deployed to understand issues in depth from the officials and collect information from more than 70 domain experts. Moreover, this team of consultants conceived the methodology, process and outcome of the study. It is hoped that this study will bring the necessary third party evaluation into picture for guiding the schemes and providing useful lessons for similar evaluations on a larger scale in future.

    Ministry of Corporate Affairs 12,889 shell companies struck off in FY 2020-21 Posted On: 03 AUG 2021 6:41PM by PIB Delhi There is no definition of the term “Shell Company” in the Companies Act. It normally refers to a company without active business operation or significant assets, which in some cases are used for illegal purpose such as tax evasion, money laundering, obscuring ownership, benami properties etc. This was stated by Union Minister of State for Corporate Affairs Shri Rao Inderjit Singh in a written reply to a question in Rajya Sabha today. On the identification shell companies, the Minister stated that the Special Task Force set up by the Government to look into the issue of “Shell Companies” has inter-alia recommended the use of certain red flag indicators as alerts for identification of Shell Companies. Giving more details, the Minister stated that the Government has undertaken a Special Drive for identification and strike off of Companies by invoking the provisions of section 248 (1) of the Act by which the Registrar of Companies (RoC) struck off those companies after following the due process of law from the Register of companies when RoC has reasonable cause to believe that those companies are not carrying on any business or operation for a period of two immediately preceding financial years and has not made any application within such period for obtaining the status of a dormant company under section 455.     Corporate Legal Alert May 2009 The Companies Act 2006: What’s happening on 1 October 2009? Introduction The final implementation date for the Companies Act 2006 (the “CA06”) is set for 1 October 2009. This alert summarises some of the significant changes introduced by the CA06 that will apply from that date (but does not focus on provisions which generally re-state the existing law under the Companies Act 1985 (the “CA85”) nor on minor differences between the two Acts). Our re-issued alert “The Companies Act 2006: the final implementation timetable” lists all the CA06 provisions that will come into force on 1 October 2009 and shows the dates on which other provisions of the CA06 came into force. The CA06 has been implemented over a number of dates starting from when the CA06 received Royal Assent on 8 November 2006, and represents over 11 years’ work which began in March 1998 with the Government’s announcement of its review of company law. Various sections of the CA06 that are coming into force on 1 October 2009 are subject to transitional provisions and savings, some of which we discuss in the relevant sections below. Key action points Companies and their directors should be focussing on the following key action points to take account of implementation of the CA06 on 1 October 2009. ACTION POINTS FOR PUBLIC AND PRIVATE COMPANIES 1. Consider amending articles to: (a) remove or update items which will be incorporated from the memorandum on 1 October 2009, such as a restrictive objects clause (see A company’s constitution (remaining sections of Part 3)); (b) entrench provisions in the articles (although this may be less relevant for public companies) (see A company’s constitution (remaining sections of Part 3)); (c) remove any restriction on authorised share capital which will be imported from the memorandum on 1 October 2009 (see A company’s constitution (remaining sections of Part 3)).
