    Columbia University Graduate School of Arts and Sciences Human Rights Studies Master of Arts Program Silencing “Breaking the Silence”: The Israeli government’s agenda respecting human rights NGOs activism since 2009 Ido Dembin Thesis Adviser: Prof. Yinon Cohen Submitted in partial fulfillment of the requirements for the degree of Master of Arts 12 September, 2018 Abstract This research examines a key aspect in the deterioration of Israeli democracy between 2009-2018. Mainly, it looks at Prime Minister Benjamin Netanyahu's Right-wing governments utilization of legislative procedure to limit the right to free speech. The aspects of the right to free speech discussed here pertain to dissenting and critical activism against these government’s policies. The suppression of said right is manifested in the marginalization, delegitimization and ultimately silencing of its expression in Human Rights NGOs activism. To demonstrate this, the research presents a case study of one such NGO – “Breaking the Silence” – and the legal and political actions designed to cause its eventual ousting from mainstream Israeli discourse. The research focuses on the importance and uniqueness of this NGO, as well as the ways in which the government perceives and acts against it. First, it analyzes the NGO’s history, modus operandi and goals, emphasizing the uniqueness that makes it a particularly fascinating case. Then, it researches the government’s specific interest in crippling and limiting its influence. Finally, it highlights the government’s toolbox and utilization thereof against it. By shining a light on this case, the research seeks to show the process of watering down of a fundamental right within Israeli democracy – which is instrumental to understanding the state’s risk of decline towards illiberal democracy.

    Remembering the fallen As the world celebrates the Games of the XXX Olympiad in London, I wonder how many will remember that it is also the 40th anniversary of the Munich Massacre. If this was before your time, at the Munich Games in 1972, Palestinian terrorists murdered 11 members of the Israeli Olympic Team. On September 5, 1972, Palestinian terrorists broke into the Olympic Village. They immediately killed two and nine were taken hostage. Efforts to rescue the hostages failed and they were eventually killed. The Olympic Games are a great time to remember that countries can usually put aside their differences and come together for a few weeks on the world’s grandest stage. And while we all have our favorite athletes and sports, I would like to believe most of us enjoy seeing the world come together, sending its best athletes to compete. But as we talk about the history of the Olympics, most don’t talk about the tragedy of the Munich Games. I know what you’re thinking, “Why should we remember something so sad?” It’s simple. We remember because that’s how we heal. Each time there is a tragedy of large proportions, such as the recent shooting in Aurora, Colorado, the Oklahoma City bombing, 9/11, etc., we take a moment to remember those who were lost and those still affected by such tragedies. Remembering the fallen of the Munich Games is no different. With that, I would like to thank Rabbi Ruth Abusch-Magder (on Twitter as @RabbiRuth http://twitter.com/RabbiRuth) for bringing this to my attention and calling for a two-minute moment of silence (turn off your TV if you like) during the Opening Ceremonies.

    The Munich Olympics Massacre It was meant to be a coming together of nations, in peace, to celebrate sporting excellence. For the athletes attending, it was the pinnacle of their achievements, a moment to be proud of. For some, it held even more meaning. It was the first OIympic Games to be held in Germany since 1936, when it had been under the auspices of the Nazi regime. Now, stepping into the arena, an Israeli team held their flag high. Eleven of them would not return alive. I’m Kari Fay, and this is Great Disasters. The theme of the 1972 Summer Olympics was an optimistic one; the official motto was “Glückliche Spiele” or The Happy Games, and the logo was a bright blue sun. The West German government was keen to present their new democratic Germany well, and the Olympics seemed like the perfect opportunity to do so. In contrast to the militaristic 1936 Games, which were festooned with swastikas and presided over by Hitler himself, these would be bright, open and carefree. Their security personnel would be discreet, and they would subtly deal with drunkenness or ticket fraud, without disrupting the joyous atmosphere. When they were dispatched to deal with a congregation of Maoist supporters in the Olympic Park, they dispersed the crowd by giving them candy. They allowed people to come and go somewhat freely; athletes later reported that it was easy for anybody to walk into the Olympic Village, so long as they were dressed like athletes. The athletes themselves took liberties with security arrangements, often scaling the fences around the village rather than walk the long way around to the gates.

    Left & Right in Israeli Election Last week Steven Krubiner, J Street’s Chief of Staff, came to Pittsburgh (where I live) to talk about the Israeli election. It is often difficult to explain to the American Jewish public how the Israeli election system works and who is likely to win. Krubiner mapped Israeli parties into two camps, right and left, and noted a few that could go either way. He gave the latest poll numbers on how many seats each party is expected to win and a forecast on what a future coalition might look like. There was nothing unusual about the presentation. Many of you have attended several of these in your lifetime. But Krubiner oversimplified a very complex political reality and therefore somewhat mislead his audience. The simple maps which position certain parties on the left and others on the right no longer represent the Israeli political scheme. Krubiner’s argument, therefore– that this is the most important election in Israel’s history, where the choice between right and left is clear– is wrong. Such forecasts have been misrepresentative in the past. In January 2013 election, for example, all political maps positioned Yair Lapid of Yesh Atid on the left. But soon after the election, Lapid befriended Naftali Bennett of Habait Hayehudi, which put him far right of the center on most issues. Tsipi Livni, who two weeks ago decided to run with the Labor Party, was a Likud member until 2005, when she joined Kadima and then in 2012 formed Hatnua. In the past two years, Livni sat in a right wing government with Bennett and Lieberman.
