Submission to the Parliament Inquiry on Australia-Hong Kong Free Trade Agreement by Hong Kong Higher Institutions International Affairs Delegation1 1. On 26 March 2019, Australia and Hong Kong signed the Australia-Hong Kong Free Trade Agreement, which was expected to consolidate the following cultural and economic ties between the two territories: a. Approximately 100,000 Australians live in Hong Kong, while around 96,000 Hong Kong people live in Australia;2 b. Over 120,000 people in Hong Kong are alumni of Australian universities;3 c. In 2018, Australian companies based 35 regional headquarters4, 50 regional offices5, and 87 local offices6 in Hong Kong, with more than 600 Australian business having a presence in the city;7 d. In 2018, Australian total merchandise trade with Hong Kong amounted to A$11.4 billion, making Hong Kong Australia’s 14th largest trading partner; in particular, Hong Kong was Australia’s 7th export destination, totalling A$10.4 billion;8 e. In 2018, the total stock of Australian investment in Hong Kong amounted to A$52.2 billion, while the total stock of Hong Kong investment in Australia amounted to A$118 billion, making Hong Kong Australia’s 12th largest source of inwards FDI stock.9 2. However, China’s encroachment on Hong Kong’s autonomy has been eroding the city’s freedom of speech and rule of law which underpin its ideal business environment for Australian companies, as shown by the following cases: a. In 2015, five booksellers who were based in Hong Kong and sold works critical of Beijing were abducted to mainland China and suffered from detentions and forced confessions;10 the incident constitutes a serious breach to Hong Kong’s freedom of press and human rights; 1 The Hong Kong Higher Institutions International Affairs Delegation (the Delegation thereafter) was founded in July 2019 amid a series of protests against the government’s proposed extradition bill in Hong Kong. -

HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. Hong Kong Watch * * * * * * * International parliamentarians condemn today’s imprisonment of the ‘most moderate and distinguished’ pro-democracy activists Today, authorities in Hong Kong have sentenced nine prominent pro-democracy activists for taking part in a peaceful protest in August 2019, including the the ‘father of Hong Kong’s democracy’ Martin Lee, ‘the owner of Apple Daily Jimmy Lai, and international barrister Margaret Ng. The nine pro-democracy activists which span the generations have received jail sentences and suspended sentences, with Jimmy Lai receiving 12 months, Lee Cheuk-yan receiving 12 months, Leung Kwok-hung receiving 18 months, Au Nok-hin receiving 10 months, and Cyd Ho receiving 8 months in prison and Margaret Ng receiving 12 month suspended sentence, Martin Lee receiving 11 months suspended sentence, Albert Ho receiving 12 months suspended sentence, and Leung Yiu-chung receiving an 8 month suspended sentence for the charge of ‘unlawful assembly’. U.N. Special Rapporteurs for human rights have previously called for the Hong Kong Government to withdraw the Public Order Ordinance which allows authorities to criminalise peaceful protest describing it as an assault on freedom of expression and freedom of assembly. A group of international parliamentarians led by Hong Kong Watch’s patron and the last British governor of Hong Kong, Lord Patten, have responded to the sentencing of the prominent pro-democracy activists. Their comments follow calls from over 100 UK MPs for the sanctioning of Hong Kong officials. E-Leader Budapest 2010 eLeadership for the 21 st century: coping with new challenges Frank Owarish, PhD Executive Director, International Institute for Strategic Research Training and Keller Graduate School of Management, New York, New York, USA Introduction Leadership has always been a crucial factor in the advancement of society as a whole and of specific segments thereof such as government organizations or business companies. No entities can progress without leadership. Studies have been undertaken over time to capture the essence of leadership and much has been written about the subject which is even taught in several universities. Leadership can be exercised by a single person or by a group (collective leadership such as that of a university senate) depending on the context. There are also different expectations from leaders depending on the particular socio-political context. As society has evolved and become more complex, leadership has become more demanding. Leadership which may have been successful in a prior era may not be suited to a new era. Leadership may also have to be adapted to specific circumstances. While there is much to the credit of the so-called democratic leadership, there may be situations which require a strong hand such as autocratic leadership. Also, leadership which may be suitable for a traditional society may not be suitable for a modern technological society. The so called advanced, developed, societies are facing leadership challenges. The context has changed drastically over th years, yet leaders with style which may have worked in the previous era often do not realize that a new leadership approach may be needed. -

EN EN EN EUROPEAN COMMISSION HIGH REPRESENTATIVE OF THE UNION FOR FOREIGN AFFAIRS AND SECURITY POLICY Brussels, 14.4.2011 COM(2011) 204 final JOINT REPORT TO THE COUNCIL AND THE EUROPEAN PARLIAMENT ANNUAL REPORT HONG KONG 2010 EN EN Hong Kong Special Administrative Region: Annual Report 2010 INTRODUCTION Since the handover of Hong Kong to Mainland China more than thirteen years ago, the European Union has closely monitored economic and political developments in the Hong Kong Special Administrative Region (SAR), in order to fulfil its 1997 commitment to the European Parliament to issue an annual report on developments in Hong Kong. This is the thirteenth such report covering developments in 2010. During 2010, the principle of ‘one country, two systems’, as established in the Sino-British Declaration and the Basic Law of Hong Kong, has continued to work well, as the rights and fundamental freedoms of the people of Hong Kong have been respected, the rule of law protected and the market economic system and business environment maintained. Bilateral relations and cooperation between the EU and Hong Kong have continued to move forward on a very positive track, in terms of trade, investment and dialogue on issues of common interest. The EU continued to be Hong Kong’s second largest trading partner. It is Hong Kong’s biggest source of foreign direct investment (FDI) after Mainland China and the British Virgin Islands. With one of the biggest European business communities in Asia and as a financial and economic hub for the region, Hong Kong maintains its strategic importance as a trading and investment partner for the EU. -

CHAPTER 6 HONG KONG Key Findings • The Hong Kong government’s proposal of a bill that would allow for extraditions to mainland China sparked the territory’s worst political crisis since its 1997 handover to the Mainland from the United Kingdom. China’s encroachment on Hong Kong’s auton- omy and its suppression of prodemocracy voices in recent years have fueled opposition, with many protesters now seeing the current demonstrations as Hong Kong’s last stand to preserve its freedoms. Protesters voiced five demands: (1) formal with- drawal of the bill; (2) establishing an independent inquiry into police brutality; (3) removing the designation of the protests as “riots;” (4) releasing all those arrested during the movement; and (5) instituting universal suffrage. • After unprecedented protests against the extradition bill, Hong Kong Chief Executive Carrie Lam suspended the measure in June 2019, dealing a blow to Beijing which had backed the legislation and crippling her political agenda. Her promise in September to formally withdraw the bill came after months of protests and escalation by the Hong Kong police seeking to quell demonstrations. The Hong Kong police used increasingly aggressive tactics against protesters, resulting in calls for an independent inquiry into police abuses. • Despite millions of demonstrators—spanning ages, religions, and professions—taking to the streets in largely peaceful pro- test, the Lam Administration continues to align itself with Bei- jing and only conceded to one of the five protester demands. In an attempt to conflate the bolder actions of a few with the largely peaceful protests, Chinese officials have compared the movement to “terrorism” and a “color revolution,” and have im- plicitly threatened to deploy its security forces from outside Hong Kong to suppress the demonstrations.
