Inertia on Guantanamo the day Sachin Tendulkar HE Obama administration has been wrongly constrained by Indian Cricketer Congress from winding down the military prison at Guantanamo TBay, Cuba. But the rebuke it recently received from the International Committee of the Red Cross was entirely its own fault. Despite promising to set up a new system of reviews for foreign detain- ees still held at the facility, the administration had yet to hold a single proceeding. That means there is less due process at Guantanamo now than there was during the last years of the George W. Bush administration. The previous administration, vilified for using Guantanamo to hold terrorism suspects captured abroad, eventually began holding annual reviews to determine if detainees still posed a threat. After conducting its own review of the prisoners, President Barack Obama, who took office vowing to close Guantanamo within a year, signed an execu- tive order in March 2011 establishing a new Periodic Review Board to review cases. There is a genuine need for such reviews: Of the 166 prisoners still at Guantanamo, somewhere between 40 and 60 will prob- ably never be tried by a military commission. While some may never be judged as non-threatening, others are closer calls who deserve a thorough and impartial review. Why has the board not begun work 21 months after Obama’s executive order? The main reason appears to be slow-rolling by the Pentagon bureaucracy. With some reason, offi- cials have feared touching Guantanamo issues: Witness how Congress manhandled Eric Holder’s Justice Department after it proposed staging civilian trials for some detainees in New York — or the departure from office of White House counsel Greg Craig after he pushed for quick action to move prisoners out of Guantanamo. Pentagon officials now say that the review board will start work early next year. But that still leaves Obama with a considerable Guantanamo hangover for his second term. Though it is necessary to hold some of the prisoners, 86 remain in the prison despite having been cleared for transfer to their home countries. Last week congressional conferees approved language in the annual defense authorization act that will continue a ban on moving prisoners to the United States during 2013 and maintain onerous restrictions on transfers to other nations. If Obama is serious about closing Guantanamo, he will veto the bill, as the administration has threatened that he will do. But as we have previously said, closing Guantanamo would be a largely symbolic act; more important is providing justice, or at least due process, to the prisoners who remain. The two travelled by carriage from the station to a little house on Cleveland Lane, where an aged but- ler answered their knock and escorted them past a blazing fire to Wilson’s chamber. The gaunt, square-jawed Wilson — not the most robust of men even when in good health — was propped on pillows. Wilson had been governor for only two years, previous to which he had been an eminent scholar and the president of Princeton University. He was anything but a financial expert, and on the campaign trail he had echoed his party’s anti-banking chorus, declaring, “The money trust is no myth; it is no imaginary thing.” Like other Americans, Wilson was upset by the rush of big compa- nies to merge into giant trusts. Financial conglomerates were the most complex, and thus the most frightening, of all. Although he and Glass were barely acquainted, Wilson was a fellow Virginian, and Glass had reason to expect a receptive hearing. The plan that Glass and Willis presented to Wilson was a model of decentralisation. It envisioned local reserve banks spread about the country — perhaps 20 or more. These would each be entrusted with the cash reserves of the banks in their territory, and would be expected to lend to them in times of distress. The reserve banks would report to the US Comptroller of the Currency, but they would essentially be independent organs — owned by private banks and managed by private bankers. When Wilson’s visitors were done, the president-elect was silent for a moment. Then he spoke. “It needs a capstone,” Wilson said — an “altruistic” body that would sit above the reserve banks, supervise their activities, and direct policy. Wilson hadn’t worked out the details, but he sensed that Glass’ collection of independent banks was inconsistent with the constitutional premise of checks and bal- ances. No single official could manage such a vast banking network. That Glass was unhappy with Wilson’s suggestion may be deduced from the letter he wrote days later to Willis, in which he voiced his suspicion that Wilson had been lobbied by bankers pushing a “dan- gerous centralization.” Glass was correct; Wall Street had lobbied Wilson. Judging that Wilson might yet bend, Glass wrote, “We shall have to keep quiet on this point for the present.” A century after that fateful meeting, the power of Glass’s regional banks has atrophied, while Wilson’s capstone, thanks to its cen- tral structure and authority, has sufficient command of reserves to backstop the financial system. Its leadership, over time, has been variously competent or flawed, but at least until the arrival of the next J P Morgan, it is the necessary lender of last resort.
