Climate Change "Crisis" - Struggling for Worldwide Collective Action Lisa Schenck* ABSTRACT Global climate change due to increased levels of atmospheric greenhouse gases caused by human activity has the potential to threaten life on earth. International cooperation is required to effectively address this threat; however the climate crisis represents a classic collective action problem in response to overexploitation of a global commons. This article explains the global climate change issue, traces efforts to confront it, and argues that inherent difficulties plague collective responses to global commons problems. It pinpoints individual reasons for collective action failures, examines background economic and scientific problems, and analyzes how group factors such as strategy and coalition building affect cooperation. Finally, the article overviews how ambiguous international environmental law principles may further hinder global solutions to the climate crisis and suggests a series of best practices for future negotiations. * B.A. (Providence College), J.D. INTRODUCTION Climate change has far-reaching impacts on the human environment: on ocean currents, agriculture, animal and plant extinction rates, and the future of humans on Earth.1 Over the past twenty-five years, nations have identified, researched, and attempted to respond to the international environmental problem of climate change.2 Climate change occurs from sunlight warming the Earth's surface and is exacerbated by the release of a group of gases-collectively known as greenhouse gases (GHG)-into the atmosphere. Typical GHGs include: carbon dioxide, methane, chlorofluorocarbons, nitrous oxide, perfluorocarbons, hydrofluorocarbons, and sulphur hexafluoride. The release of GHG emissions has resulted in an intensified natural greenhouse effect, and may be causing rising sea levels, severe windstorms, and changing rainfall patterns.3 Scientists believe that human activities including fossil fuel combustion, deforestation resulting from agricultural burning and logging forests, 4 land use or cover changes, 5 and industrial use of artificial chemicals (e.g., halocarbons) are responsible for releasing 1. RISCHARD, supra note 3. 2008] Climate Change "Crisis" significant GHG emissions into the atmosphere. 6 Increased GHG emissions enhance the natural greenhouse effect by trapping solar heat and slowing down re-radiation into space, causing an insulating effect.7 Whereas the natural greenhouse effect maintains the Earth's average temperature at approximately sixty degrees Fahrenheit, the atmospheric build up of GHGs traps heat and causes the Earth to warm dramatically.8 The international response to the threat of global climate change has been ineffective to date. The challenge of mobilizing the global community to reduce GHG emissions represents a classic tragedy of the commons, a problem that occurs when a shared or "open access" resource (e.g., the atmosphere) is readily and freely available for unsustainable exploitation. 9 A concerted global response, also known as collective action, offers the opportunity to create incentives for sustainable use. This article argues that in order to address ongoing atmospheric degradation, sovereign states must overcome their divergent interests in order to cooperate and act collectively.'0 Furthermore, it argues that the collective action to date has failed in a number of ways. Part II of this article provides an historical overview of climate change and describes how nations have attempted to deal with this trans- boundary issue. Part III argues that inherent difficulties exist in taking collective action to address a global commons problem. Part IV suggests that certain international environmental law principles actually hinder global collective action. Finally, Part V offers several solutions to encourage effective collective action. 6. Where We Have Been: An HistoricalReview of Climate Change I am far from satisfied with the results of the negotiations thus far, the goal of which is exceedingly ambitiousfor it is no less than to positively control man's impact on the Earth's climate. ' -Senator Robert Byrd, 1998 As scientists uncover stronger evidence about the effects of global warming, the world increasingly recognizes the existence and magnitude 2 of the global threat of climate change. The Kyoto Protocol (Protocol)1 has been the most notable attempt to effectuate collective action and it served to, "established emissions ceilings on 6 specified GHGs for 38 countries, with the 15 members of the European Union (EU) treated as a single unit, to be reached on average in the five-year accounting period 2008-2012."'13 The Protocol, an international agreement of 150 nations, has fallen short in a variety of ways, primarily because it fails to achieve true collective action. Introduction In recent decades, climate change has become an increasingly tangible threat to human existence on Earth. In fact, a combination of climate-related forces (e.g. natural disasters, extreme weather events, and droughts) and carbon-related forces (e.g. air pollution and asthma) already claim about five million lives annually.1 This value is only projected to increase and will account for about six million global deaths per year by 2030.2 While climate change has and will continue to disproportionately affect low-income communities, people of color, and indigenous populations, as well as poorer and smaller countries and island nations that are the least responsible for the carbon dioxide emissions that have contributed to it, climate change is indisputably a collective global crisis with shared consequences that will ultimately affect every country on Earth, regardless of affluence or military prowess.3 Recently, as the consequences of anthropogenic climate change have grown increasingly visible, countries have begun to come together to address this crisis on an international level.

    Extinction is inevitable in the globalized world Aishwarya Maheshwari1 1Banda University of Agriculture and Technology July 23, 2020 Abstract No abstract - Extinction is a natural process and every species on this planet has an expiration date except Homo sapiens because we are extending our expiry at the cost of other species (Brook and Alroy 2017, Pimm et al. 2014, Ceballos et al. 2015). In contrast, biodiversity loss is not natural but a global issue and it is not caused by the globalization, but as a result of human activities at the global level (Pimm et al. 2014, Ceballos et al. 2015). Eventually, severe biodiversity losses lead to anthropogenic die-off and extinction of naturally occurring species (Pimm et al. 2014, Ceballos et al. 2015, DeVos et al. 2014). The previous, current and future extinction rates have been estimated using a variety of measures and their estimation methodologies vary (to be between 100 to 10,000 times higher than the natural extinction rate) but they clearly demonstrate that current extinction rates are far above than the \background" rates (Brook and Alroy 2017, Pimm et al. 2014, Ceballos et al. 2015, DeVos et al. 2014, Lamkin and Miller 2016). Aggravatedly, population declines and extirpations are appearing to be more graving than species extinction and negative cascading consequences on ecosystem services (Ceballosa et al. 2020). Substantial information is available on over-exploitation of natural resources by humans in the globalization perspective (Ceballosa et al. 2020, Millennium Ecosystem Assessment, 2005, Groom et al. 2006, Ehrnfeld 2003) and we have lost an estimated US$ 4-20 trillion per year in ecosystem services owing to land-cover change and US$ 6-11 trillion per year from land degradation during 1997 to 2011 (OECD 2019).

    The Pathway to a Green New Deal: Synthesizing Transdisciplinary Literatures and Activist Frameworks to Achieve a Just Energy Transition Shalanda H. Baker and Andrew Kinde The “Green New Deal” resolution introduced into Congress by Representative Alexandria Ocasio Cortez and Senator Ed Markey in February 2019 articulated a vision of a “just” transition away from fossil fuels. That vision involves reckoning with the injustices of the current, fossil-fuel based energy system while also creating a clean energy system that ensures that all people, especially the most vulnerable, have access to jobs, healthcare, and other life-sustaining supports. As debates over the resolution ensued, the question of how lawmakers might move from vision to implementation emerged. Energy justice is a discursive phenomenon that spans the social science and legal literatures, as well as a set of emerging activist frameworks and practices that comprise a larger movement for a just energy transition. These three discourses—social science, law, and practice—remain largely siloed and insular, without substantial cross-pollination or cross-fertilization. This disconnect threatens to scuttle the overall effort for an energy transition deeply rooted in notions of equity, fairness, and racial justice. This Article makes a novel intervention in the energy transition discourse. This Article attempts to harmonize the three discourses of energy justice to provide a coherent framework for social scientists, legal scholars, and practitioners engaged in the praxis of energy justice.     Swelling Seas: Planning for sea level rise Westley Owers Bachelor of Town Planning Faculty of the Built Environment University of New South Wales November 2006 Abstract Emissions of greenhouse gases into the atmosphere over the last hundreds of years have placed us in a precarious position, in that we have forced change upon one of the world’s most important systems: climate. This climate change will have devastating impacts around the world. Of all the impacts of human induced climate change, it is sea level rise that is regarded as the most certain. Sea level is expected to rise in a best case scenario of one metre by the year 2100. However, there is still uncertainty surrounding how the environment will react to greenhouse gas emissions, and therefore a sea level rise of up to six metres above current levels by the year 2100 cannot be ruled out. As sea level rises it will bring with it debilitating impacts such as inundation of coastal areas, increased coastal erosion and an increased flooding of inland areas in storm surge occurrences. The scope and magnitude of this environmental issue is such that these impacts will seriously alter human settlement and fragile ecosystems in nations throughout the world. The only way of reducing the impacts of this environmental issue is for government to prepare coastal policy and legislation to address this issue now. The extent at which the impacts of sea level rise are experienced at a local, state and national level within nations will be a direct result of the adaptive response that governments implement to address this environmental issue.

    How Can We Avert Dangerous Climate Change? James Hansen Abstract. Recent analyses indicate that the amount of atmospheric CO2 required to cause dangerous climate change is at most 450 ppm, and likely less than that. Reductions of non-CO2 climate forcings can provide only moderate, albeit important, adjustments to the CO2 limit. Realization of how close the planet is to ‘tipping points’ with unacceptable consequences, especially ice sheet disintegration with sea level rise out of humanity’s control, has a bright side. It implies an imperative: we must find a way to keep the CO2 amount so low that it will also avert other detrimental effects that had begun to seem inevitable, e.g., ocean acidification, loss of most alpine glaciers and thus the water supply for millions of people, and shifting of climatic zones with consequent extermination of species. Here I outline from a scientific perspective actions needed to achieve low limits on CO2 and global warming. These changes are technically feasible and have ancillary benefits. Achievement of needed changes requires overcoming the spurious argument that developed and developing countries have equivalent responsibilities, as well as overcoming special interests advocating minimalist or counterproductive actions such as corn-based ethanol and liquid-fuel- from-coal programs. This paper consists of written testimony that I delivered as a private citizen to the Select Committee on Energy Independence and Global Warming, United States House of Representatives on 26 April 2007. I have added to that testimony: this abstract, references for several statements in the testimony, and some specificity in the final section on solutions.
