THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.93 hectares (2.29 acres), more or less, of vacant land, located north of Rutherford Road and west of Bathurst Street, said land being Part of Lots 17 and 18, Concession 2 designated as Part 19 on Plan 65M-4540 and Parts 19 and 20 on Plan 65M-4541, in the City of Vaughan, Regional Municipality of York, be purchased from Quadrant Holdings Inc.;

THAT the purchase price be $2.00;

CARRIED BACKGROUND Resolution #A161/15 at Authority Meeting #8/15, held on September 25, 2015, approved the Greenlands Acquisition Project for 2016-2020.

Negotiations have been conducted with Ms. Rose Orlando, Law Clerk at Brattys LLP, acting as agent for the owner.

Access to the subject lands will be achieved through its frontage off Marc Santi Boulevard and through adjacent City of Vaughan owned lands to the north.

Attached is a sketch illustrating the location of the subject lands.

RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for 2016-2020. Through the review of Draft Plan of Subdivision 19T-13V004 and 19T-13V005, TRCA staff established the limits of the open space land.

280 TAXES AND MAINTENANCE Based on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that the subject property should be eligible for a tax exemption. While it is expected that the subject parcel of land will not significantly impact TRCA’s maintenance costs at this location, an assessment of the aggregate acquisitions in the area will be undertaken and the results will be integrated into TRCA’s land management program and associated budgets.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Toronto to provide permanent easements for the Coxwell Sanitary Trunk Sewer Bypass Tunnel, within the Lower Don River valley, from north of O'Connor Drive to Ashbridge’s Bay, City of Toronto (Toronto and East York Community Council Area), Don River watershed;

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the City of Toronto in this instance;

THAT said easement be subject to approval of the Minister of Natural Resources and Forestry in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27, as amended, if required;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and signing and execution of documents. CARRIED BACKGROUND At Authority Meeting #11/08, held on January 30, 2009, Resolution #A314/08 was approved as follows:

WHEREAS a very large sanitary sewer, known as the Coxwell trunk, in the City of Toronto is showing signs of structural instability;

AND WHEREAS the City of Toronto is looking at all possible options for repair or replacement of the damaged section of pipe, along with plans to twin the sewer in accordance with the Wet Weather Flow Management Master Plan;

AND WHEREAS failure of the existing pipe could result in the diversion of sanitary sewage to the Don River if alternative measures to contain the flow are not in place;

AND WHEREAS the Toronto and Region Conservation Authority (TRCA) wants to ensure that every effort is made to contain the flows and avoid any diversion to the Don River, but recognizes that an emergency response plan must be in place to deal with any diversion that might occur should the pipe fail before a replacement mechanism for the damaged section of pipe can be put in place;

THEREFORE LET IT BE RESOLVED THAT TRCA requests the City of Toronto to take every possible action to protect the Don River from any possible sewage overflows;

284 THAT the Chief Administrative Officer be authorized to approve Ontario Regulation 166/06 permits to the City of Toronto for the Coxwell Sanitary Trunk Sewer to facilitate an emergency overflow, a new section of sewer to bypass the damaged section, and any emergency repairs and other works associated with the implementation of an emergency response plan to deal with diversion, treatment and cleanup of any sewage flows to the Don River and Harbour, should that become necessary between Executive Committee meetings;

THAT the City of Toronto be requested to proceed with the twinning of the Coxwell trunk as soon as possible as part of the City's comprehensive plan to reduce the frequency and severity of combined sewer overflows;

THAT City of Toronto staff be requested to present the Emergency Response Plan to the Authority once developed;

AND FURTHER THAT regular updates be provided to the Authority regarding the Emergency Response Plan and any measures undertaken.

Furthermore, at Authority Meeting #8/09, held on October 23, 2009, Resolution #A183/09 was approved as follows:

WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Toronto to provide a permanent easement for the Coxwell Sanitary Trunk Sewer by-pass pipe, west of Coxwell Boulevard, north of O'Connor Drive (behind Barbara Crescent), Don River watershed, City of Toronto (Toronto East York Community Council Area);

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the City of Toronto in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.20 hectares (0.49 acres), more or less, be granted to the City of Toronto for the Coxwell Sanitary Trunk Sewer by-pass pipe, said land being west of Coxwell Boulevard, north of O'Connor Drive (behind Barbara Crescent), City of Toronto (Toronto East York Community Council Area), as shown on a plan entitled: EASEMENT REQUIREMENTS, prepared by City of Toronto - Technical Services, Survey and Mapping, under their Job No. 2009-0787-C, dated September 3, 2009;

The City of Toronto has formally requested permanent easements for the Coxwell Sanitary Trunk Sewer Bypass Tunnel (CSTSBT) along various locations of the route within the Lower Don River valley, from north of O'Connor Drive to Ashbridge’s Bay.

In 1987, the International Joint Commission identified the City of Toronto’s waterfront along Lake Ontario as one of 43 polluted Areas of Concern in the Great Lakes Basin, largely due to impaired water quality conditions in the Don River and the Inner Harbour. The discharges from combined sewer overflows (CSOs) and storm sewers were identified as the principal sources of pollution.

In 2003, approved a City-wide Wet Weather Flow Master Plan (WWFMP) to mitigate the impacts of stormwater runoff and CSO (containing a mixture of untreated sewage and polluted stormwater) discharges. The 25 year WWFMP identified a series of projects for implementation, with the ultimate goal of improving water quality conditions and ecosystem health in all six watersheds across the City and along the waterfront; thereby, advancing the delisting of Toronto as an Area of Concern in the Great Lakes Basin.

In 2008, the Don and Waterfront Trunk Sewers and CSO Control Strategy Municipal Class Environmental Assessment (also referred to as the Don River and Central Waterfront Project) was initiated to provide a comprehensive systems integration approach in one complete project under the WWFMP; the initial component of the project is the CSTSBT.

The CSTSBT consists of a 10.5 kilometre length of sewer, approximately 6.3 metres in diameter, 40 to 45 metres deep, and tunneled through bedrock. The tunnel will provide a bypass to the entire, existing Coxwell Sanitary Trunk Sewer, the City’s most critical trunk sanitary sewer servicing approximately 30% of the City or approximately 750,000 residents.

During the Environmental Assessment investigations for the proposed CSTSBT, cracks were found in the existing sanitary sewer pipe located in the vicinity of Coxwell Boulevard and Barbara Crescent. To eliminate the imminent danger of raw sewage seeping from the existing cracked sewer, a bypass pipe was immediately constructed at this location to prevent seepage of raw sewage into the Don River; hence, the need for emergency permits being issued pursuant to Ontario Regulation 166/06 at that time. However, the permanent easement for the bypass pipe was never finalized and this section is being included for approval along with the various other permanent easements required for the ultimate CSTSBT construction.

286 The CSTSBT will be located within the Regional Storm Flood Plain and Regulated Area of the Lower Don River. A report pursuant to Ontario Regulation 166/06, as amended, for the project is presented separately in this agenda.

The subject TRCA-owned lands were acquired from the Corporation of the Township of East York on November 24, 1961; United Ceramics Ltd. on July 5, 1962; the Municipality of Metropolitan Toronto on February 22, 1973, on September 23, 1980 and March 10, 1983; Torvalley Development Ltd. on February 20, 1987; Domtar Inc. on December 14, 1989; Canadian National Railway Company on November 29, 2000 and March 31, 2006; Metrolinx on January 15, 2010; and Her Majesty the Queen in Right of the Province of Ontario on June 26, 2015, under the Don River Flood Plain Lands Acquisition Project.

Plantings All surface lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan will be prepared and form part of the permit pursuant to Ontario Regulation 166/06, as amended.

A plan illustrating the permanent easement locations is attached.

FINANCIAL DETAILS The City of Toronto has agreed to assume all legal, survey and other costs involved in completing this transaction.

CARRIED BACKGROUND Claremont Nature Centre (Claremont NC) is a 1,036 square metre panabode cedar log building that opened in 1970 for overnight outdoor education programs.

At Authority Meeting #10/15, held on November 27, 2015, Resolution #A227/15 was approved, in part, as follows:

…THAT TRCA education centres be redeveloped into community engagement centres with an emphasis on local participation in program development and delivery;…

Further, at Authority Meeting #5/17, held on June 23, 2017, Resolution #A106/17 was approved, in part, as follows, after the release of Tender #10005225 using the Claremont Field Centre Project name:

THAT the Claremont Field Centre, a Toronto and Region Conservation Authority (TRCA) owned and operated education facility located in the City of Pickering, be officially renamed the “Claremont Nature Centre”;...

As part of Claremont NC’s transition into a community engagement hub, TRCA has identified the need for renovation of the interior facilities and reprogramming of space to support the delivery of new services to meet the changing needs and expectations of the community users. State of good repair issues have also been identified and will need to be addressed in accordance with the Fire Protection and Prevention Act.

The proposed interior renovation project will include the refurbishment of the existing classroom, including new electrical and mechanical components, as well as upgrading the existing dormitory space to include all new fire rated equipment and materials in order to comply with current Fire Code. Once completed, the refurbished classroom will allow TRCA to provide improved opportunities for community groups to better utilize this multiple use space. It is anticipated that the range of new programs and uses will include private functions, meetings and events, including exercise, meditation, music and art programs, amongst others. Additionally, the fire separation upgrades will improve visitor and staff safety.

RATIONALE Tender #10005225 was publicly advertised on the electronic procurement website Biddingo (www.biddingo.com) on June 8, 2017 with a site information meeting held on June 13, 2017. Tender packages were sent to the following 11 contractors:  Berkim Construction Inc.  EBS Construction Management;  Koler Construction;  Lisgar Construction;  MIR Construction;  MJK Construction Inc.;  Pegah Construction Ltd.;  R-Chad Contracting Inc.;  Staybrite Inc.;  Stracor Inc.; and  Vema Corp.

The Procurement Opening Committee opened the Tenders on Friday, June 30, 2017 with the following results:

Six contractors declined the opportunity to submit a bid, being unable to meet the timelines and specifications stated in the contract documents.

Restoration Services staff reviewed the bid received from MJK Construction Inc. against its own cost estimate and has determined that the bid is of reasonable value and also meets the requirements as outlined in the contract documents. Further assessment by TRCA staff of MJK Construction Inc.’s experience and ability to undertake similar projects was conducted through reference checks, which resulted in positive feedback that MJK Construction Inc. is capable of undertaking the scope of work.

290 Based on the bids received, staff recommend that MJK Construction Inc. be awarded Contract #10005225 for supply of all labour, materials and equipment necessary for interior renovations and fire separation improvements at Claremont Nature Centre, in the City of Pickering for a total cost not to exceed $245,435.00, plus a 25% contingency, plus HST, to be expended as authorized by TRCA staff, it being the lowest bid that meets TRCA specifications. The 25% contingency allowance is to cover any additional construction costs based on approved changes necessitated by unforeseen site conditions.

Award of Contract #10005143 for drilling a nest of monitoring wells and extract core samples in Carruthers Creek watershed. Purpose of the wells and core samples is to gather data to support the Carruthers Creek Watershed Plan, the Oak Ridges Moraine Groundwater Program and contribute to scientific research related to the cored materials.

CARRIED BACKGROUND The opportunity to install a nest of monitoring wells in Carruthers Creek watershed is a welcome outcome of the Region of Durham's funding for the Carruthers Creek Watershed Plan, as Toronto and Region Conservation Authority (TRCA) currently has no monitoring wells in the watershed. The wells will be an important mechanism to provide Carruthers Creek watershed groundwater data to TRCA for the purposes of characterizing the watershed and analyzing its hydrogeology. The cores from the drilled wells will also be significant as part of a regional database of geological information which is accessed by the Oak Ridges Moraine Groundwater Program (ORMGP), the Ontario Geologic Survey (OGS), the Geologic Survey of Canada (GSC), as well as academic and other researchers.

The ORMGP will monitor the wells over the long-term, and results will be available to the ORMGP’s network, which includes other conservation authorities, OGS, GSC and other researchers. Given the value of the data for both the Carruthers Creek watershed plan and the larger regional context, the wells must be properly installed to yield reliable data over the long-term, and the cores must be of suitable quality to facilitate future scientific study. Due to these specific requirements, TRCA staff has consulted with ORMGP to retain a drilling contractor with significant expertise and experience in this specialized work. ORMGP staff contacted the recommended drilling contractor to get a quote for drilling the wells.

292 RATIONALE ORMGP staff includes professional hydrogeologists who have been in practice since 1985, and have the experience of working closely with the drilling industry with this type of expertise. In the opinion of ORMGP staff, only a few drillers are able to collect the high quality soil and rock samples when coring which are needed for OGS and GSC research purposes, and to install wells which function reliably over the long-term. ORMGP staff also advised that lower cost drilling companies may not actually be more cost effective in the end, due to poor core recovery and groundwater monitoring wells which do not function as intended, and therefore yield unreliable, or no, data.

Based on ORMGP staff recommendation, TRCA staff has determined that Aardvark Drilling Incorporated is uniquely positioned to complete this work because they retain the best drilling crews and have a proven track record working for the ORMGP, OGS and GSC.

Therefore, staff recommends that Contract #10005413 for the purpose of drilling a nest of monitoring wells in the Carruthers Creek watershed and collecting core samples to be submitted for storage and scientific study, be awarded to Aardvark Drilling Incorporated on a preferred source basis.

The preferred source decision is in accordance with Section 9.3.3 of TRCA’s Purchasing Policy for non-competitive procurement, as follows:

The required goods and services are to be supplied by a vendor or supplier having specialized knowledge, skills, expertise or experience that cannot be reasonably provided by any other supplier.

FINANCIAL DETAILS The cost of drilling and TRCA staff time to organize the drilling contract will be covered from the hydrogeology study allocation, account 120-85 under the Carruthers Creek Watershed Plan, a special fee-for-service project funded by the Region of Durham. RATIONALE TRCA has utilized the services of AppVision for the last 15 years. As a result, AppVision has extensive knowledge of TRCA business processes and technology infrastructure. CARRIED BACKGROUND Toronto and Region Conservation Authority (TRCA) procures a variety of office supplies including paper and envelope products for use by TRCA staff at various locations. Staff has used the City of Toronto Vendor of Record (VOR) arrangement for many years and has benefitted from its favourable pricing. In reviewing this purchasing arrangement, staff compared the Toronto contracts with the Province of Ontario's VOR contracts to obtain best value.

The City of Toronto VOR for office supplies expired on March 31, 2017, and for paper products on June 30, 2017, and since that point TRCA has continued to purchase from the approved vendors, Corporate Express and Spicers, respectively, but for many products at higher rates than in the original contracts. The City of Toronto has advised that it does not have a timeline for completion of a new Request for Quotation process for subsequent years, and as a result the current higher prices also apply to TRCA.

TRCA staff has reviewed the recently completed combined provincial VOR for office supplies and paper products. The results compared to the current City of Toronto arrangements indicate there can be significant savings by going with the provincial arrangement, and one company can supply most of TRCA needs, opposed to two vendors under the Toronto agreements.

RATIONALE This Province’s Request for Bids (RFB) opportunity was posted on the Ontario Tenders Portal. Four companies responded to the RFB and the Province awarded the contract to NOVEXCO Inc. as it was the lowest bidder meeting specifications. The provincial VOR arrangement took effect on May 1, 2017 and expires on April 30, 2020. The term of this agreement is for a period of three years with the option to extend the agreement for up to two additional terms of one year each at the discretion of The Ministry of Government and Consumer Services (MGCS).

Based on the volume of 2016 purchases and expected growth, staff estimates costs to be a maximum of $150,000 for the entire five year period, plus 15% contingency, under the NOVEXCO contract. This is an approximate savings of more than 50% from the City of Toronto arrangement. There are very few regularly purchased office supply and paper product items not included in the NOVEXCO contract, and in the instances that such products are required, staff will review NOVEXCO availability and pricing, as well as other suppliers as required, to obtain best value.
