THE WEST BENGAL UNIVERSITY LAWS (AMENDMENT) ORDINANCE, 2019.

WHEREAS it is expedient to amend the Calcutta University Act, 1979, the North West Ben. Ad XXXV111 of 1979. Bengal University Act, 1981, the Burdwan University Act, 1981, the Vidyasagar West Ben. Act XXV of 1981. University Act, 1981, the Kalyani University Act, 1981, the West Bengal State West Ben. Act XXIII of 1981. West Ben. West Ben. Act the Act, 2018, the Dakshin Dinajpur University Act, 2018, XIX of 2013. West Ben. Act the Greenfield University Act, 2018, the University Act, 2018, the XXVI of 2014. West Ben. Act Act, 2018, the Harichand Guruchand University Act, 2018, XXI of 2014. West Ben. Act for the purposes and in the manner hereinafter appearing; XXXIII of 2015. West Ben. Act L of 2017. WHEREAS AND the Legislative Assembly of the State of West Bengal is not in West Ren. Act XLVII of 2017. session and the Governor is satisfied that circumstances exist which render it necessary West Ben. Act XLVIII of 2017. for him to take immediate action; West Ben. Act LI of 2017. The Governor is pleased, in exercise of the power conferred by clause (1) of West Ben. Act XVIII of 2018. article 213 of the Constitution of India, to make and promulgate the following West Ben. Act XIX of 2018. Ordinance:- West Ben. Act XVI of 2018. West Ben. Act XVII of 2018. West Ben. Act XXVIII of 2018. West Ben. Act Short title and 1. (0 This Ordinance may be called the West Bengal University Laws XXVII of 2018. comencement. (Amendment) Ordinance, 2019.

(2) It shall come into force at once.

Amendment of 2. In sub-section (2) of section 8 of the Calcutta University Act, 1979,— West Ben. Act XXXVIII of (a) for clause (a), the following clause shall be substituted:— 1979. "(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 3. In sub-section (2) of section 9 of the University Act, 1981,— West Ben. Act XXV of 1981. (a) for clause (a), the following clause shall be substituted:—

eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 4. In sub-section (2) of section 9 of the Burdwan University Act, 1981,— XXIII of (981. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 5. In sub-section (2) of section 9 of the Act, 1981,— West Ben. Act XVIII of 1981. (a) for clause (a), the following clause shall be substituted:—

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 6. In sub-section (2) of section 9 of the Kalyani University Act, 1981,— XL of 1981. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Govemment and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrati ve success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 7. In sub-section (2) of section 9 of the West Bengal (Barasat, West Ben. Act XXVIII of 2007. North 24-Parganas) Act, 2007,—

(a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.", PART IV] THE KOLKATA GAZETTE, EXTRAORDINARY, FEBRUARY 26, 2019 5

Amendment of 8. In sub-section (2) of section 9 of the Gour Banga University Act, 2007,— West Ben. Act XXVI of 2007. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier."; (b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall tinder no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 9. In sub-section (2) of section 9 of the Sidho-Kanho-Birsha University Act, 2010,— West Ben. Act XII of 2010. (a) for clause (a), the following clause shall be substituted.—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1). and shall he eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier."; (b) for clause (b), the following clause shall be substituted:— "(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years. 6 THE KOLKATA GAZETTE, EXTRAORDINARY, FEBRUARY 26, 2019 [PART IV

Amendment of 10. In sub-section (2) of section 9 of the Jadavpur University Act, 1981,— West Ben. Act XXIV of 1981. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 11. In sub-section (2) of section 9 of the Rabindra Bharati Act, 1981,— West Ben. Act XXXVI of 1981. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.". Amendment of West Ben. Act 12. In sub-section (2) of section 10 of the Netaji Subhas Open University Act, XIX of 1997. 1997,—

(a) for clause (a), the following clause shall be substituted:— "(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier."; (b) for clause (b), the following clause shall be substituted:— "(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 13. In sub-section (2) of section 8 of the Presidency University Act, 2010,— XIII of 2010. (a) for clause (a), the following clause shall be substituted:— "(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier."; (b) for clause (b), the following clause shall be substituted:— "(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 14. In sub-section (2) of section 9 of the Cooch Behar Panchanan Barma University XXI of 2012. Act, 2012,— (a) for clause (a), the following clause shall be substituted:— "(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 15. In sub-section (2) of section 9 of the Kazi Nazrul University Act, 2012,— West Ben. Act XIX of 2012. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1 ), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success establ ished during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 16. In sub-section (2) of section 9 of the Diamond Harbour Women's University West Ben. Act XXXVII of 2012. Act, 2012,—

(a) for clause (a), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 17. In sub-section (2) of section 9 of the Bankura University Act, 2013,— XIX of 2013. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success establ fished during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 18. In sub-section (2) of section 9 of the Raiganj University Act, 2014,— XXVI of 2014. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

Amendment of West Ben. Act 19. In sub-section (2) of section 12 of the West Bengal University of Teachers' XXI of 2014. Training, Education Planning and Administration Act, 2014,—

(a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section ( I), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier."; (b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrativesuccess established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 20. In sub-section (2) of section 9 of the Sanskrit College and University Act, West Ben. Act XXXII! of 2015. 2015,—

(a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such i n terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier."; (b) for clause (b), the following clause shall be substituted:—

Amendment of West Ben. Act L 21. In sub-section (2) of section 12 of the Rani Rashmoni Green University Act, of 2017. 2017,--

(a) for clause (a), the following clause shall be substituted: -

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or ii II he attains the age of seventy years, whichever is earlier.";

(b) fur clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 22. In sub-section (2) of section 12 of the Biswa Bangla Biswabidyalay Act, XLV11 of 2017. 2017,—

(a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capaci ty of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 23. In sub-section (2) of section I I of the Jhargram University Act, 2017,— XLVIII of 2017. (a) for clause (a), the following clause shall be substituted:—

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

Amendment of 24. In sub-section (2) of section 11 of the Mahatma Gandhi University Act, West Ben. Act LI of 2017. 2017,—

(a) for clause (a), the following clause shall be substituted:—

"(a) The Vice Chancellor shall hold office for a period of four years appointed as such i u terms of the pi ovisi ons of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains theage of seventy years, whichever is earlier:';

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative successestablished during his term of office in the capacity of Vice-Chancellor.".

Amendment of 27. In sub-section (2) of section 11 of the Greenfield University Act, 2018,— \Vest Ben. Act XVI of 2018. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years. whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

Amendment of 28. In sub-section (2) of section II of the Act, 2018,— West Ben. Act XVII of 2018. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till he attains the age of seventy years, whichever is earlier.";

(h) for clause (h), the following clause shall he substituted:---

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall tinder no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established duri ng his term of office in the capacity of Vice-Chancellor.".

Amendment of West Ben. Act 29. In sub-section (2) of section 12 of the Kanyashree University Act, 2018,— XXVIII of 2018. (a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (1), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office i n the capacity of Vice-Chancellor, or till he attains theage of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

Amendment of 311. In sub-section (2) of section 11 of the Harichand Guruchand University Act, West Ben. Act XXVII of 2018. 2018,—

(a) for clause (a), the following clause shall be substituted:—

"(a) The Vice-Chancellor shall hold office for a period of four years appointed as such in terms of the provisions of sub-section (I), and shall be eligible for reappointment for another term of four years subject to the satisfaction of the State Government and on the basis of his past academic excellence and administrative success established during his term of office in the capacity of Vice-Chancellor, or till heattains the age of seventy years, whichever is earlier.";

(b) for clause (b), the following clause shall be substituted:—

"(b) The Chancellor may, notwithstanding the expiration of the term of office of the Vice-Chancellor, allow him to continue in office for a period not more than two years at a time in consultation with the Minister, which shall under no circumstances be extended beyond the age of seventy years, subject to the satisfaction of the State Government and on the basis of his past academicexcellence and administrative success established during his term of office in the capacity of Vice-Chancellor.".
