The Bearcat Benefit is truly a collaborative effort; a heartfelt thank you to everyone who had a hand in bringing Viva Mateo to life - the wonderful committees, parents, staff, teachers, Foundation members, alumni and friends.

San Mateo High School Foundation 13 THE BEARCAT BENEFIT 2011 AUCTION RULES & REGULATIONS

HOW TO BE AN AUCTION WINNER 1. Plan ahead! Read the program book carefully before the auction. Decide what you want to bid on in advance. 2. Invite a group of friends to join you in buying a party or vacation home together. Forming these consortia gives you greater buying power and makes the auction more fun! AUCTION ITEMS 1. All live and silent auction items have been donated by generous sponsors, donors, parents and community members. Proceeds directly benefit San Mateo High School via the San Mateo High School Foundation (SMHSF). LIVE AUCTION 1. Minimum bids will be announced prior to the start of bidding for each auction item. 2. To enter a bid, raise your bid number card towards the auctioneer. Volunteer spotters will assist the auctioneer in recognizing bidders throughout the room, but bids are not official until acknowledged by the auctioneer. The highest bid recognized by the auctioneer will win the item and the auctioneer will confirm bid amount and bidder number at the conclusion of each item. In the event of a dispute, the auctioneer will determine the winning bidder. SILENT AUCTION 1. Each item in the silent auction has a separate bid sheet. 2. To bid on an item, LEGIBLY write your name and table number, the bid number and amount of your bid on the next available line on the bid sheet. 3. To be valid, each new bid must equal or exceed the minimum increment stated on the item’s bid sheet. 4. The silent auction will close promptly at 7:30 pm. Bid sheets will be removed immediately. No bids will be accepted after closing. The highest valid bid at closing constitutes the winning bid. 5. By 9:00 pm, the winning bidders will be notified and a purchase summary will be delivered to each winning bidder at their table. 6. Pay-to-Play items are open to the maximum number of participants indicated. Anyone can participate in Pay-to-Play by purchasing one or more slots and recording their name and bid number on the bid sheet. PAYMENT AND RECEIPT 1. All auction items must be paid in full by cash, check, MasterCard or Visa. We cannot accept American Express. Please pay your auction bill by going to the auction treasury, located in the entrance foyer. The auction treasury will be open at 10:30. 2. All sales are final; no exchanges or refunds are possible. ITEM(S) PICK-UP 1. Retrieve your winning items at the auction pick-up, adjacent to the treasury. 2. All items must be claimed and removed from the auction site.

All items are sold “as is.” The respective donors have furnished all statements of value appearing in this program. Values assigned to some items are estimates only, and are not warranted for tax purposes or general value. SMHSF does not appraise or estimate the fair market value (FMV) of auction items. SMHSF has made a good-faith effort to furnish accurate and sufficient information on the Internal Revenue Service’s guidelines in establishing FMV of goods and services. 2. In determining the tax deductibility of items purchased at the Auction, IRS Ruling #67-245, issued 8/4/88, reminds buyers that a deduction is allowable except to the extent that the taxpayer can show that his or her payment exceeded the fair market value (FMV) at retail of the item or service received. SMHSF will provide all donors and buyers with appropriate tax receipts for payments made above the fair market value of goods and services received after the auction. 3. SMHSF reprints this information here to exercise its responsibility to fully inform its supporters of the applicable tax law, but is not responsible for the tax consequences of these transactions. Please consult with your own advisors regarding applicable tax laws. RESTRICTIONS 1. All dates for services or events must be mutually agreed upon by both parties, in advance, unless otherwise noted. Some items are only valid for a specific date or time period. Please make reservations for specific items or events as soon as possible to avoid potential disappointment. 2. Most items expire by October 15, 2012 unless otherwise stated. 3. Taxes and gratuities are excluded and dinners do not include wine or alcoholic beverages, unless specifically stated. Please leave a tip for restaurant servers when you use the gift certificates. Ground transportation is not included unless otherwise noted. 4. The item or items you purchase by being a successful bidder are not warranted and/or guaranteed by San Mateo High School or SMHS Foundation. Please note: San Mateo High School and SMHS Foundation recommend that you verify the use, restriction, and expiration directly with the donor as soon as possible. Any dispute or claim arising from the purchase is between the donor and the successful bidder. 5. Please note that this auction program book contains items, donors, sponsors and volunteers known to the Benefit Committee as of October 1, 2011. 6.
