To quash the Order dated 14.07.2020, passed in OS No.510/2020 by the Hon’ble II ACJ, Bengaluru Rural District, at Bengaluru as per Annexure-D b. Pass such other order or orders as deemed fit to be granted in the facts and circumstances of the case to serve the interests of justice and equity. 5 2. On 14.07.2020, when O. S. No. 510/2010 was listed before the II Additional Civil Judge, Bengaluru Rural District there was no representation on behalf of the plaintiff. Consequently the trial Court passed the following order:- “No representation. Hence issue Emergent Notice on IA No. 1 and 2 and suit summons to defendants.” 3. Due to outbreak of Covid-19, plaintiff counsel could not attended on the date fixed i.e., 14.07.2020. Consequently in all fairness, a date should have been assigned instead of issuing Emergent Notice on IA No. 1 and 2, without hearing the plaintiff’s counsel. Therefore, the trial Court is hereby directed to hear the plaintiff counsel on IA No. 1 and 2 and pass an order on the aforesaid interlocutory applications. The above exercise shall be effected within a period of one week from the date of receipt of this order. Accordingly, the writ petition is disposed of . Sd/- JUDGE mbb .
