Dr Obert Moses Mpofu has achieved both dimensions. With wanton disregard for the boundaries of a “single story”, Mpofu’s submission represents a construction of the struggle for Zimbabwe with the immediacy and novelty of a participant. Please provide a general update on the situation for Movement for Democratic Change (MDC) members, both rank and file members and prominent leaders, in respect to their possible treatment and risk of serious harm in Zimbabwe. The situation for MDC members is precarious, as is borne out by the following reports which indicate that violence is perpetrated against them with impunity by Zimbabwean police and other Law and Order personnel such as the army and pro-Mugabe youth militias. Those who are deemed to be associated with the MDC party either by family ties or by employment are also adversely treated. The latest Country of Origin Information Report from the UK Home Office in December 2009 provides recent chronology of incidents from July 2009 to December 2009 where MDC members and those believed to be associated with them were adversely treated. It notes that there has been a decrease in violent incidents in some parts of the country; however, there was also a suspension of the production of the „Monthly Political Violence Reports‟ by the Zimbabwe Human Rights NGO Forum (ZHRF), so that there has not been a comprehensive accounting of incidents: POLITICALLY MOTIVATED VIOLENCE Some areas of Zimbabwe are hit harder by violence 5.06 Reporting on 30 June 2009, the Solidarity Peace Trust noted that: An uneasy calm prevails in some parts of the country, while in others tensions remain high in the wake of the horrific violence of 2008…. -

Ms Petra Chinyere Mulungushi University, Zambia [email protected] Doi:10.5901/mjss.2014.v5n25p73 Abstract This paper assesses the effectiveness of the Government of National Unity (GNU) in Zimbabwe in fostering peaceful co- existence among traditional rival political parties which were the parties to the agreement that established the unity government. It is mainly based on documentary research, referring to available information on the four year period that the GNU ruled the country, followed up by some views from fellow academics on the subject. The point of departure is the historical background to the formation of the GNU and the modalities surrounding its establishment, then the analysis of what really achieved. The paper argues that the GNU was an inevitable arrangement that was done as a transitional mechanism to rescue the country from total collapse after the 2008 electoral violence that the country had plunged into which could have degenerated into a civil war. The GNU managed to sustain the peace deal that they signed and to calm the political situation in the country to give a peaceful environment even after its lifespan among the parties that fought in 2008, but it brought to the fore the concealed, inherent divisions and intra-party fighting that the Movement for Democratic Change Tsvangirai faction (MDC-T) has been accused of previously. The paper concludes by arguing that the GNU deal was successful in achieving peaceful co-existence among warring factions along the political divide but it still failed to take into consideration the views of the masses since it was an elite contract. -

Section 24 of the Constitution provides that any person who alleges that the Declaration of Rights has been, is being, or is likely to be, contravened in relation to him may apply to the Supreme Court for redress. The applicant, who was at the relevant time a Member of Parliament, assaulted Mr Patrick Chinamasa, MP, Minister of Justice, Legal and Parliamentary Affairs, and Leader of the House (hereinafter referred to as “Chinamasa”). The assault took place in Parliament while it was in session. He was charged with, and found guilty of, contempt of Parliament. He was sentenced, by 2 S.C. 75/05 Parliament, to fifteen months’ imprisonment of which three months’ imprisonment was suspended on certain conditions. The applicant challenges that conviction and punishment on the following four grounds - 1. The proceedings violated his constitutional and fundamental right to a fair hearing by an independent and impartial court or other adjudicating body protected by s 18(1),(2) and (9) of the Constitution of Zimbabwe (“the Constitution”). -

The theme of succession, both of the State Presidency and the leadership of ZANU PF, increasingly bedevils all matters relating to the political stability of Zimbabwe and any form of transition to democracy. The constitutional issues related to the death (or infirmity) of the President have been dealt with in several reports by the Research and Advocacy Unit (RAU). If ZANU PF is to select the nominee to replace Robert Mugabe, as the state constitution presently requires, several problems need to be considered. The ZANU PF nominee ought to be selected in terms of the ZANU PF constitution. -

Backbenchers continued to ask critical questions that affect people in their respective constituencies. Incomplete Government Projects Hon. F.M. Sibanda (MDC-T Magwegwe) quizzed the Minister of Public Works, Hon. Gabbuza on the more than 500 government projects dotted around the country which have remained incomplete for many years. Hon. Gabbuza acknowledged that there were 550 incomplete projects around the country and he attributed this to inadequate budgetary allocations. He said as a wayforward, his ministry has prioritized 126 of those projects for completion next year provided the ministry was allocated $46 million in the 2011 national Budget. Investment Promotion Measures The Minister of Economic Planning and Investment Promotion, Hon. Tapiwa Mashakada informed the House that his ministry was working on various initiatives to promote investment in the country. One such initiative was the one-stop investment centre. The idea was to try to put all government departments and agencies that have to do with investment under one roof at the Zimbabwe Investment Authority offices in order to expedite licence processing. The Minister further revealed to the House that at the present moment Zimbabwe’s investment was standing at 4% of GDP and government’s objective was to increase it to 25% of GDP to complement or reinforce the growth that has been registered. -

Introduction Introduction To the ancient question, ‘Who will guard the guardians?’ there is only one answer: those who choose the guardians. On 29 March and 27 June 2008, Zimbabwe held two historic elections. Both were ‘critical’ in the sense of defining or redefining the strategic direc- tion of the country and ensuring that it would never be the same again. Though they were different in every fundamental way, both had a pro- found effect on the tenor of national politics and firmly put the country on what appears to be an irreversible though bumpy journey towards demo- cratic transition and away from resilient authoritarianism. The 29 March elections were the first ever ‘harmonized’ elections, for the presidency, the Senate, the House of Assembly, and local government councils; they were held on one day, and results were posted at the polling stations for all to see. The 27 June election was the first presidential run- off in the country’s history and, as some of the contributions in this book will demonstrate, was also the most controversial and violent election since Independence in 1980. Elections and democracy A country’s people are the ultimate source of political legitimacy, and this is most often expressed through free elections. In the contemporary world, elections are and remain the best known and most effective device for connecting citizens to policy makers. They are a formal expression of democratic sovereignty. Paul Clarke and Joe Foweraker make a distinction between ‘thin’ and ‘fat’ conceptions of democracy and argue that the former centres on electoral democracy.1 Most such conceptions borrow from Joseph Schumpeter’s now 1 See Paul A.B. -

ZIMBABWE HUMAN RIGHTS NGO FORUM POLITICAL VIOLENCE REPORT NOVEMBER 2001 December 2001 A report by the Zimbabwe Human Rights NGO Forum Summary Attacks on farm workers residing on invaded farms, ongoing since the end of February 2000, were reported to the Human Rights Forum in November. Since January this year, more than 70 000 farm workers have been displaced and countless others have been beaten and tortured whilst others lost their homes in arson attacks. Once again the ZRP was been found wanting in its protection and reaction to violations concerning farm workers and MDC supporters. In one recorded case, policemen in Kadoma arrived at the local Zanu-PF offices and witnessed the torture of two MDC members but left without rendering assistance. However 14 MDC members were arrested for the murder of Bulawayo war veteran’s chairman, Cain Nkala. In Harare members of the ZRP unlawfully arrested and tortured two MDC officials from Zengeza, accusing them of having had some involvement in Cain Nkala’s murder, despite their being in Harare at the time. The two were released without being charged having been interrogated about the operations of their party. Six deaths were recorded in November. A list of all deaths that have been reported since January 2001 is given at the end of the report. Introduction This paper examines Africa’s contribution to the global quest for tran- quillitas ordinis (tranquillity in the social order) with particular emphasis on the role of African continental and regional organisations in promoting pacem in terris (peace on earth).The paper explores the role of African organisations both continental and regional especially in solving problems that have beset the continent in the postcolonial era. The context is the turmoil in Africa particularly in the new millennium, where governance could broadly be described as not in the interest of citizens and changes or expected changes in government have been accompanied by violence, bloodshed and large- scale displacement of citizens who have turned refugees in states neigh- bouring the epicentres of violence. What is also noteworthy, and needs exploring, is the development of a concept of a government of national unity in Africa. This is a concept which is hardly neutral given the circum- stances under which it arises and the resistance of African leaders to relin- quish political office despite the purported popular elections. What appears to be the inherent tenacity of dictatorial regimes is also a factor to be con- sidered when making propositions for a government of national unity.
