O R D E R

Sri Y.Krishna Reddy, Nalgonda District has filed 2nd appeal dated 12-02-2018 which was received by this Commission on 14-02-2018 for not getting the information sought by him from the PIO / O/o. the Mandal Parishad Development Officer, MPP-Narketpally Mandal, Nalgonda District and 1st Appellate Authority / O/o. the Mandal Parishad Development Officer, MPP-Narketpally Mandal, Nalgonda District.

The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 08-09-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: TSIC

The Public Information Officer / O/o. the Mandal Parishad Development Officer, MPP- Narketpally Mandal, Nalgonda District, Vide Letter No. D5/3618/3950/2017, Dated 21-11-2017, has transferred 6(1) application U/s 6(3) to all the PIO’s in the Panchayat Raj and Rural Development Department.

Since the appellant did not receive the complete information from the Public Information Officer, he filed 1st appeal dated 28-12-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005.

As per the records the 1st Appellate Authority has not taken action to hear the appeal and pass appropriate orders.

As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005.

The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 12-7-2019.

On 12-7-2019 the case is called. The appellant is absent. The Public Information Officer, Supdt., O/o the MPDO, MPP-Narketpally Mandal is present.

The Public Information Officer submitted that through letter dated 28.11.2017 the appellant was informed to pay an amount of Rs. 5414/- (@ Rs.2/- per page for 2707 pages) for the required information but the appellant did not pay the requite amount and filed first appeal requesting to furnish the information free of cost. The First Appellate Authority through letter dated 11.01.2018 upheld the decision of the Public Information Officer and also permitted the appellant for inspection of records with prior intimation to the Public Information Officer. But the appellant did not come to their office for inspection of records.

Heard the Public Information Officer and perused the records.

The Commission observed that the 6(1) application dated 08.09.2017 filed by the appellant before the Public Information Officer, O/o the ZPP, Nalgonda was received by the Public Information Officer, O/o the MPDO, MPP-Narketpally Mandal on 24.11.2017 and the Public Information Officer through letter dated 28.11.2017 informed the appellant to pay Rs.5414/- for the required information. The Commission noticed that the intimation to pay the requisite amount by the Public Information Officer is within the stipulated time and the First Appellate Authority, MPDO upheld the decision of the Public Information Officer and also permitted the appellant for inspection of records. The appellant did not pay the requisite amount and he also did not go to the office of the Public Information OfficerTSIC for inspection of records.

In view of the above, the Commission directs the PIO to once again permit the Appellant inspection of records on a mutually convenient date and thereafter furnish copies of required documents on payment of cost. The Public Information Officer shall comply with the above direction within two weeks from the date of receipt of this order and submit compliance report to the Commission.

With the above direction, the appeal is closed.
