INDICTMENTANDCHARGES TheinitialindictmentagainstStanišićwasconfirmedon25February2005,andmadepublicon10March 2005.PursuanttotheTrialChamberdecisionsof19Julyand22August2005,theProsecutionfiledan amendedindictmenton22August2005.On22September2005,followingarequestforclarificationfrom the Trial Chamber, the Prosecutor filed the revised amended indictment. On 11 October 2005, the Chamberacceptedthechangesandconfirmedtheindictmentastheoperativeoneinthecase(Stanišić’s casenumberwasIT0479). TheinitialindictmentagainstŽupljanin,whichincludedascoaccusedRadoslavBrñaninandMomirTalić, was confirmed on 14 March 1999. Following the arrests of Brñanin and Talić, an amended indictment againstthemandaseparateamendedindictmentagainstŽupljaninwereconfirmedon20December1999. On6October2004,withtheleaveoftheTrialChamber,theProsecutionfiledanamendedindictment againstŽupljanin.ThiswasthelastoperativeindictmentagainstŽupljanin(casenumberIT9936/2),who wasarrestedon11June2008andtransferredtotheICTYon21June2008. On16July2008,theProsecutionfiledamotionrequestingthatthecasesofStanišićandŽupljaninbe joined.On23September2008,theTrialChambergrantedthemotionandorderedtheProsecutiontofile an amended consolidated indictment. The joinder (named “consolidated”) indictment was filed on 29 September 2008. On 1 December 2008, the Prosecution filed its motion for leave to amend the consolidatedindictmentinordertofurtheramendtheallegationsagainsttheaccusedandtocorrecta numberoftypographicalerrors.Themotionwasgrantedon28April2009andtheProsecutionfiledthe amendedconsolidatedindictmenton1May2009. On 9 June 2009, the Chamber invited the Prosecution to remove a number of events listed in the schedules of the indictment. Subsequently, on20 July 2009, the Prosecution filedamotionseeking to removefiveincidents.Themotionwasgrantedon4September2009andtheProsecutionfiledthenew, secondamendedconsolidated,indictmenton10September2009. The indictment alleges that from 1 April 1992 Stanišić was Minister of the newly established Serbian MinistryofInternalAffairsinBosniaandHerzegovina(RSMUP).AsMinisteroftheRSMUP,Stanišićwasthe highest authority in the Ministry and was a member of the Government of the Bosnian Serb Republic/RepublikaSrpska.RegardingŽupljanin,theindictmentallegesthatfrom1991onwards,hewas ChiefoftheRegionalSecurityServicesCentre(“CSB”)ofBanjaLuka.Fromatleast5May1992untilJuly 1992,hewasalsoamemberoftheAutonomousRegionofKrajina (“ARK”) Crisis Staff and in 1992he becameanadvisoroninternalaffairstothePresidentofRepublikaSrpska. Accordingtotheindictment,StanišićandŽupljaninparticipatedinajointcriminalenterprise(JCE)asco perpetrators.AJCEcameintoexistencenolaterthantheestablishmentoftheAssemblyoftheSerbian PeopleinBiHon24October1991andcontinuedthroughouttheperiodoftheconflictinBiHuntilthe signing of the Dayton Accords in 1995. The objective of the JCE was to permanently remove Bosnian Muslims,BosnianCroatsandothernonSerbsfromtheterritoryoftheplannedSerbianstatebymeans which included the commission of the crimes alleged. Numerous individuals participated in this JCE. StanišićandŽupljanineachactedinconcertwithothermembersoftheJCEincluding,butnotlimitedto, MomčiloKrajišnik,RadovanKaradžić,BiljanaPlavšić,NikolaKoljević(deceased),MomčiloMandić,Velibor Ostojić,GeneralRatkoMladić,othermembersoftheBosnianSerbleadershipandleadingmembersofthe Serbian Democratic Party (SDS) at republic, regional and municipal levels, leading members of the YugoslavArmy(JNA)/BosnianSerbArmy(VRS)includingGeneralMomirTalić(deceased),leadingmembers oftheCSBs,leadingmembersofPublicSecurityServices(SJB)includingSimoDrljača(deceased),leading membersofregionalandmunicipalcrisisstaffsincludingRadoslavBrñanin,andleadingmembersofother civilianbodieswithinBiH.
