INDICTMENTANDCHARGES TheinitialindictmentagainstMićoStanišićwasconfirmedon25February2005,andmadepublicon10 March2005.PursuanttotheTrialChamberdecisionof19July2005,andtheTrialChamberdecisionof22 August2005, the Prosecution filed anamended indictment on22 August 2005. Followinga requestfor clarificationfromtheTrialChamber,on22September2005,theProsecutorfiledtherevisedamended indictment.On11October2005,theChamberacceptedthechangesandconfirmedtheindictmentasthe operativeone(MićoStanišić’scasenumberwasIT0479). TheinitialindictmentagainstStojanŽupljanin,whichincludedascoaccusedRadoslavBrñaninandMomir Talićwasconfirmedon14March1999.FollowingthearrestsofBrñaninandTalić,anamendedindictment againstthemandaseparateamendedindictmentagainstŽupljaninwereconfirmedon20December1999. On6October2004,withtheleaveoftheTrialChamber,theProsecutionfiledanamendedindictment againstStojanŽupljanin.ThiswasthelastoperativeindictmentagainstStojanŽupljanin(casenumberIT 9936/2),whowasarrestedon11JuneandtransferredtotheICTYon21June2008. On16July2008,theProsecutionfiledamotionrequestingthatthetwocasesbejoined.On23September 2008,theTrialChambergrantedthemotionandorderedtheProsecutiontofileanamendedconsolidated indictment.Thejoinder(named“consolidated”)indictmentwasfiledon29September2008. On1December2008,theProsecutionfileditsmotionforleavetoamendtheconsolidatedindictmentin order to further amend the allegations against the accused and to correct a number of typographical errors. The motion was granted on 28 April 2009 and the Prosecution filed the amended consolidated indictmenton1May2009. Theindictmentallegesthatfrom1April1992,MićoStanišićwasMinisterofthenewlyestablishedSerbian MinistryofInternalAffairsinBosniaandHerzegovina(RSMUP).AsMinisteroftheRSMUP,MićoStanišić was the highest authority in the Ministry and was a member of the Government of the Bosnian Serb Republic/RepublikaSrpska.RegardingStojanŽupljanin,theindictmentallegedthatfrom1991onwards, hewasChiefoftheRegionalSecurityServicesCentre(“CSB”)ofBanjaLuka.Fromatleast5May1992 untilJuly1992,hewasalsoamemberoftheAutonomousRegionofKrajina(“ARK”)CrisisStaffandin 1992hebecameanadvisorforinternalaffairstothePresidentofRepublikaSrpska. Accordingtotheindictment,MićoStanišićandStojanŽupljaninparticipatedinajointcriminalenterprise (JCE)ascoperpetrators.AJCEcameintoexistencenolaterthantheestablishmentoftheAssemblyof theSerbianPeopleinBiHon24October1991andcontinuedthroughouttheperiodoftheconflictinBiH untilthesigningoftheDaytonAccords in1995.The objective of the JCE was to permanently remove BosnianMuslims,BosnianCroatsandothernonSerbsfromtheterritoryoftheplannedSerbianstateby means whichincluded thecommissionofthe crimesalleged. Numerous individuals participated in this JCE.MićoStanišićandStojanŽupljanineachactedinconcertwithothermembersoftheJCEincluding, but not limited to Momčilo Krajišnik, Radovan Karadžić, Biljana Plavšić, Nikola Koljević (deceased), MomčiloMandić,VeliborOstojić,GeneralRatkoMladić,othermembersoftheBosnianSerbleadershipand leadingmembersoftheSerbianDemocraticParty(SDS) at the republic, regional and municipal levels, leadingmembersoftheYugoslavArmy(JNA)/Bosnian Serb Army (VRS) in the regions including General Momir Talić (deceased), leading members of the CSBs, leading members of Public Security Services (“SJBs”) including Simo Drljača (deceased), leading members of regional and municipal crisis staffs includingRadoslavBrñanin,andleadingmembersofothercivilianbodieswithinBiH.

TheindictmentallegesthatMićoStanišićiscriminallyliableforcrimescommittedintheperiodbetween 1Apriland31December1992inthemunicipalitiesofBanjaLuka,Bileća,BosanskiŠamac,Brčko,Doboj, Donji Vakuf, Gacko, Ilijaš, Ključ, Kotor Varoš, Pale, Prijedor, Sanski Most, Skender Vakuf, Teslić, Vlasenica,Višegrad,VogošćaandZvornik.StojanŽupljaninisallegedtobecriminallyliableforcrimes committedinthesameperiodintheARKmunicipalitiesofBanjaLuka,DonjiVakuf,Ključ,KotorVaroš, Prijedor,SanskiMost,SkenderVakufandTeslić.
