Campbell University School of Law Scholarly Repository @ Campbell University School of Law Scholarly Works Faculty Scholarship 2018 "Assault Weapon" Myths E. Gregory Wallace Follow this and additional works at: https://scholarship.law.campbell.edu/fac_sw Part of the Second Amendment Commons “ASSAULT WEAPON” MYTHS E. Gregory Wallace Scary black rifles that spray bullets like machine guns. Military arms designed solely for killing on the battlefield. Weapons of choice for mass shooters. These are common descriptions of so-called “assault weapons,” a favorite target for those who want to eliminate gun violence by eliminating guns. Several states and localities currently ban “assault weapons,” as did the federal government from 1994-2004. In response to recent mass shootings, bills have been introduced in Congress to create a new national ban. Lawmakers and judges often use these descriptions to justify such bans. But are the descriptions factual? If not, what does that say about the laws and court decisions that rely on them? While there is no generally agreed-upon definition of “assault weapon,” laws banning such weapons typically criminalize possession or transfer of semiautomatic rifles with detachable magazines and at least one specified feature such as a pistol grip, telescoping stock, flash suppressor, barrel shroud, bayonet mount, or grenade launcher.1 Other “assault weapon” bans prohibit certain semiautomatic rifles, shotguns, and pistols by name and by features, along with any copies, duplicates, or variants.2 The main target of these bans is the AR-15 rifle, the most popular rifle in America, owned by millions for lawful purposes including self-defense.3 The AR-15 looks like a fully automatic military M4 carbine or M16 rifle, but it has a semiautomatic firing system like most modern handguns.

The evolution and spreading of video gaming has brought the escalation of security dangers, too. • If Looks Could Kill, Bans on Physical Features of Assault Style Weapons: Contribution to Firearm and Gun Violence Safety Or Violation of the Second Amendment?
IF LOOKS COULD KILL, BANS ON PHYSICAL FEATURES OF ASSAULT STYLE WEAPONS: CONTRIBUTION TO FIREARM AND GUN VIOLENCE SAFETY OR VIOLATION OF THE SECOND AMENDMENT? by Joel Micah Holmstock A thesis submitted to Johns Hopkins University in conformity with the requirements for the degree of Master of Arts Baltimore, Maryland January 2020 © 2020 Joel Holmstock All rights reserved Abstract The number of mass shootings with assault rifles, such as AR-15’s, continue to make headlines, fuel public concern over gun violence, and spur elected officials to find solutions for what remains a highly divisive issue in American politics. Recently, it was reported that in 158 congressional districts at least one mass shooting has occurred in 2019; that is more than a third of the nation’s congressional districts.1 in part because so many communities are directly impacted by mass shootings, there is growing bi- partisan support for gun control legislation such as assault weapons.2 Supporters of an assault weapons ban contend that no one needs such weapons because they are “weapons of war.” Yet, in truth guns labeled “assault weapons” are merely cosmetic in appearance to military weapons. The difference is that military weapons are capable of automatic fire while civilian versions are capable of semiautomatic fire. This makes them similar to other semiautomatic firearms on the market. This thesis examines whether an assault weapon ban would likely reduce gun violence and if there are legitimate concerns with respect to infringement of the Second Amendment right to bear arms. Questions that will be addressed are: What should the criteria be for regulating gun ownership? Should appearance alone be sufficient grounds to ban one type of weapon over another, i.e., is there evidence that particular types of guns are more often used in mass shootings? Are universal background checks or other requirements equally or more important to consider? What would a comprehensive approach to gun control 1 Jarvis et al (2019), 1.

Subject: THE GUN THAT NEVER WAS: Heckler & Koch G11 Posted by abradley on Wed, 15 Feb 2006 06:37:00 GMT View Forum Message <> Reply to Message THE GUN THAT NEVER WAS: Heckler & Koch G11 It had it all -- accuracy, ease of use, and a revolutionary "caseless ammunition" system that might have changed the way rifles are made -- but the Heckler & Koch G11 rifle was never put into mass production. What happened to this unique rifle? Continued Soldier Tech Subject: Re: THE GUN THAT NEVER WAS: Heckler & Koch G11 Posted by Forsaken on Wed, 15 Feb 2006 17:26:00 GMT View Forum Message <> Reply to Message Well, as far as I know that programm was sacked because of the caliber. You know, 4.7mm is not a Nato-Standard as 7.62 or 5.56. Therefore the G36 pattern with 5.56 was followed, since the greater calibers like 7.62 are not used so often any more with assault rifles - because of the increased weight. Of course another reason why the G11 didn't make it into production was a cost thing. Were there any serious possibilities to sell that weapon? I don't think so, and since the German military budget gets smaller and smaller, they couldn't afford it then. • Assault Weapons Ban of 2013
ASSAULT WEAPONS BAN OF 2013 U.S. Senator Dianne Feinstein A bill to ensure proper regulation of military-style 331 Hart Senate Office Building Washington, DC 20510 assault weapons and high-capacity ammunition http://feinstein.senate.gov feeding devices. 2/13 20152370 Confronting Assault Weapons in Society More than eight years have passed since the federal Assault Weapons Ban on military-style firearms expired in 2004. Since then, more than 350 people have been killed and more than 450 injured by these weapons. Towns like Newtown, Aurora and Tucson are now known for the mass shootings that shocked the nation. Mass murders in these towns and others across America demonstrate all too clearly the need to regulate deadly assault weapons and high-capacity ammunition magazines. On January 24, 2013, we gathered to introduce a new Assault Weapons Ban of 2013. This legisla- tion, stronger than the 1994 bill, has two primary goals: • First, halt the sale, manufacture, transfer and importation of 157 of the most commonly-owned military-style assault weapons and ban an additional group of assault weapons that are particularly lethal because they can accept a detachable ammunition magazine and have one or more military characteristics. • Second, ban large-capacity magazines and other ammunition feeding devices that hold more than 10 rounds of ammunition. These devices allow shooters to fire numerous rounds in rapid succession without having to reload. We firmly believe that weapons designed for war have no place on the streets of a civilized soci- ety. We must enforce existing law and enact commonsense measures to stop the proliferation of military-style assault weapons while protecting the rights of law-abiding citizens who use guns for hunting, household defense or legitimate recreational purposes.
