WASHINGTON THIS WEEK

FCC Chairman Al Sikes has issued an 11 page reply to the lengthy list of questions that were recently posed to Sikes by House Energy & Commerce committee Chairman John Dingell about the commission's policy on the recent slew of lease and program supplier arrangements.

In short, Sikes' response says what previous FCC rulings and various commission spokespersons have already said about leasing arrangements --that they're okay as long as other conditions of the license are being met, and as long as licensees are doing the things that would prove they are still in control of their own License.

Specifically, Sikes also says that there is plenty of room for potential abuses of the time brokerage process to come to FCC attention through the complaint process, petitions to deny, etc. Otherwise, such arrangements constitute a programming issue and not something the FCC would need to approve in advance. And by pointing out that the FCC does not require network affiliations to be reported to the commission, Sikes seems to buy into the contention of most participants in leasing deals that theirs are similar to conventional network arrangements.

Sikes does say, however, that the FCC will request comments on the leasing issue for its upcoming review of radio rules. The commission will also consider "whether to set a limit on the number of radio stations in the same market . . . a single station program supplier may serve."

The Commission has issued a series of clarifications on its 1990 order allowing upgraded facilities of Class A FMs and conversion of Class A's to Class C3 status. Among the issues addressed: consent requirements for short -spacing apply only to grandfathered Class A's for which a power increase is planned with an omnidirec- tional antenna; the FCC will retain its five -mile exemption standard for short spacing; short spaced Class A station applicants would not be required to submit public interest showings; the non -availability of non -short spaced allocations would require a showing only for grandfathered stations seeking to move to another short spaced allocation; and the FCC will retain criteria for protection of second and third adjacent channel interference.

This week's DAB Gazette: the FCC's first DAB license has gone to Shannondale Wireless, a wireless cable operator in rural West Virginia. Shannondale's S -band facility (a higher frequency even than the L -band broadcasts that the NAB's Eureka 147 system would require) will be made commercially available for companies to test DAB systems. Los Angeles FMs KLIT and KQLZ have also been granted permission to conduct DAB tests in the S -band from the Mount Wilson tower facility over- looking Los Angeles; the two stations also say their tests will be open to review by anyone in the industry. A successful test of S -band broadcasts would mean the lower L -band systems would also be viable; both bands, especially S, would consume far greater quantities of power than Gannett's proposed in -band ACORN system, and would also involve massive station reallocations. The White House is said to be leaning heavily on the FCC to move DAB to S -band rather than L -band; L -band broadcasts would interfere with hi -tech weapons systems that currently use the spectrum space.

Two more pirates silenced: a shortwave station known as "The Voice of Oz" in Unionville PA, and an amateur radio operator's "WLAR" in Arlington MA. Both operators were fined $1,000 by the FCC. ELSEWHERE

Several news items came from the Radio Advertising Bureau's biannual Board of Directors Meeting in Sarasota last week. The Board adopted a new dues structure that affects stations in Top 50 markets, tying rates to overall station percentages of market revenue rather than average midday rate (the previous yard- stick). The new system will be phased in over a three -year period. The Board also: eliminated a requirement that all stations in a group owner's chain must become members if any are to be accepted; passed a resolution in support of the Arbitron Radio Advisory Council's proposals to reform Arbitron survey- taking practices; and announced the theme of next year's RAB Managing Sales Conference as "Full Speed Ahead: Maximizing Your Share of the Economic Recovery." The 1992 conference will be held Jan. 30 -Feb. 2 at the Opryland Hotel in Nashville.

Financially troubled United Press International this week announced plans to relocate its national broadcast news wire operations from Chicago to Washington, effective May 13. Consolidation with UPI's print and audio services, already based in Washington, brought the firing of UPI's Chicago staff and addition of an equal number of new employees in D.C. UPI expects to announce a buyer soon.

RAB has released its revenue figures for the first quarter of 1991. They show that overall radio revenues for the quarter decreased 5.2% from 1990. A 1.2% gain in national ad revenue was offset by a 7% drop in local sales. The decrease was attributed to the economic recession and the effects in January ana February of the Gulf War.

The NAB has announced that New York Governor Mario Cuomo will be the keynote speaker at September's Radio 1991 convention. The event will be held September 11 -14 at the Moscone Convention Center in San Francisco.

A lot has been written about call -out research, but Christian -formatted WABS Arlington VA has turned the tables with call -IN research. At designated times of the year listeners are asked to call a special number during business hours to ask a questionnaire. This reverse research allows listeners to give direct feedback to the station. The station has a chance to build a listener database and to make decisions on listener needs. As an incentive to call, random callers receive free cassettes and CD's. M STREET

We here at M Street nave been privileged to try out NewsDesk from the Associated Press. For some time we have been working on a study of ways to automate radio stations by the use of computers. NewsDesk is just one of several new products we've found that can add to station creativity while adding control to daily activities.

AP NewsDesk is versatile, allowing us to print only the stories we need and to set up custom file categories to "catch" stories by key words. Complete editing is simple to accomplish with function keys and pull down menus. With the touch of two keys, stories can be transmitted to the local AP Broadcast Editor. The system costs very little extra per month over regular AP costs and provides far greater use and control over the information AP provides. Additional tools include a pronunciation guide with over 100,000 words (automatically updated), an electronic atlas of the U.S. and a calendar /planning guide. The only equipment needed is a PC- computer and a printer; single user and LAN versions are available. As expected, the FCC last Thursday opened a broad inquiry into expansion of the present 12 -12 -12 limits on multiple station ownership. The inquiry raised a number of possible proposals and also brought several seemingly unrelated issues into the fracas. Commenters were asked to address the following proposals:

"Whether the current national ownership rule generally prohibiting common ownership of more than 12 AM and 12 FM stations should be relaxed, using a numer- ically based, audience -based or market rank -based approach;

"Whether to modify the contour overlap rule that prohibits ownership of more than one AM and one FM station in the same area...by permitting ownership of multiple stations in a market, limited by cumulative audience share; and,

Additionally, the Commission sought comments on a joint proposal by the NAACP and several other groups to expand minority ownership limitations from fourteen to twenty stations in each band. In framing the proposals, the FCC particularly focused on the dramatic decline in the economic health of the AM band, and on whether expanding AM ownership limits and relaxing contour rules would allow more efficient operation of a greater number of stations.

Several of the Commissioners issued separate statements with the notice of inquiry. James Quello focused particularly on AM stations and various proposals to advance minority ownership, and raised concerns regarding the wisdom of allowing multiply owned stations to simulcast and regarding time brokering agreements. Ervin Duggan expressed similar concerns about diversity of ownership. And Andrew Barrett noted that "...ownership limits have ensured that more than a handful of people own this nation's broadcast stations." Barrett also comments that new technology (e.g., DAB) might make the entire concept of local broadcasting and ownership limits obsolete in he near future.

The FCC- initiated inquiry comes at a time when issues of time -brokering, lease agreements, diversity of ownership and minority interests are drawing new heat from Congress. Any significant expansion of ownership limits seems likely to be a further invitation to a political minefield.

No deadline date was issued for comments in the inquiry (Docket 91 -140).

The FCC has acted with unusual speed and harshness in issuing an order to show cause why the license of now -silent WOKJ -ì550 Jackson MS should not be revoked. In addition WOKJ's owner, David J. Price, was given a notice of apparent liability for up to $250,000 for "failing to light the station's towers, filings to respond to Commission Directives, and discontinuing operation without authorization." Price took WOKJ off the air in July 1990 without notifying the FCC ana repeatedly ignored FCC inquiries. Price also owns three other stations: WKPG -1320 Port Gibson MS, which he has just filed an application to sell, and KNEK AM /FM Washington LA. Clarifications and some amendments were issued by the Commission this week in its new rules limiting settlement payments among applicants for new radio stations. The changes will allow repayment of expenses that occur at any point during prose- cution of the application; previously, the FCC had decreed that expenses could only be reimbursed up to the point at which comparative hearings began. The FCC has also amended its rules so that payment limitations will not apply to two (or more) parties who merge their applications; but in doing so, said that it would examine such agreements carefully to insure that the transaction was genuinely a full merger of the applications.

The Commission also issued clarifications for its streamlining of the comparative hearing process. The comparative clarifications were limited to minor procedural issues; the FCC rejected petitions that would have modified criteria within the comparative hearings themselves.

The FCC this week also upheld a Review Board decision that denied license renewal to KUKQ /KUPD Tempe AZ. The case stems from a misrepresentation of ownership interests when Tri -State Broadcasting Co. purchased the stations in 1974. Seventeen years later, Tri -State has now exhausted all of its appeals within the Commission.

The CRTC this week adopted a number of revisions to its policies for private commercial FM radio. They include: replacement of requirements for foreground programming with rules specifying a minimum level of spoken word programming; deletion of limits on commercial content, to be replaced by a station -generated proposal during licence renewal that may not exceed 15' of the broadcast week; deletion of all references to classes of licence; extension of "Cancon" music requirements to apply evenly to both AM and FM licensees; and redefinition of the term "market" as it pertains to simulcasting prohibitions.

In other actions, the CRTC: approved an application for an English- language network to broadcast "The Pat Burns Hotline" talk show from Vancouver; approved an application to revoke the network licence of "The Automobile Hotline," a program no longer produced; and revoked the licences of the low power French and English AM stations, CFBG, at Bagotville PQ. ELSEWHERE

ABC Radio Networks has announced that Deborah Norville will replace Sally Jesse Raphael as host of ABC Talkradio's evening talk show. Norville, most recent a co- host on television's "Today" show who resigned to have a baby, will host the program from her home with her infant son. She begins host duties in September; ABC will fill with substitute hosts through the summer.

A new player has leaped into the satellite -delivered programming arena. North East Satellite Entertainment (NESE), a Rochester NY -based company, hopes to begin programming operations in October 1991. NESE plans to offer a "information, music, news, agricultural features and special entertainment" package from 6 PM to 6 AM, seven days a week, to twelve states in the Northeastern U.S.

Another variation on the co- programming game? Two years ago, WADO -1280 took advantage of new AM interference rules to purchase Long Island's WGLI -1290 and sign it off, minimizing adjacent channel interference on the eastern part of the WADO's coverage. Now, perhaps with the simulcast success of WNEW -FM on eastern Long Island's WWHB in mind, WADO has applied to move WGLI - 30 miles further away from New York City, to Mastic Beach NY. If granted, the move could allow WADO to sign WGLI back on as a separate station with minimal interference - or perhaps as another Long Island satellite of a New York station that can't reach that far.

Country Radio Broadcasters, hosts of the annual Country Radio Seminar, has scheduled a one -day workshop for air personalities. In what may be the first warning shot of a tougher FCC look at time brokerage and lease arrangements, the Commission has notified WREM -710 Monticello ME of an NAL (Notice of Apparent Liability) for $10,000 for unauthorized transfer of control. According to the FCC, "...an investigation by the FCC's Field Operations Bureau raised questions concerning [the licensee, Benito Rish's] lease agreement with ARK Communications, Inc. The investigation revealed that Rish had granted broad authority to ARK and that ARK controlled all aspects of station operation, including finances, personnel and programming. Under the agreement, ARK paid Rish a fixed monthly rental fee and received compensation from the station's profits. The Commission concluded that Rish's involvement with station affairs, apparently limited to selection of a lessee and a general format, was insufficient to fulfill a licensee's obligations under the communications Act...this constituted an abdication of control by Rish to ARK."

It is not immediately clear how the WREM case might differ from literally dozens of other lease and time brokerage agreements that have gone forward in the last six months. Of interest: the FCC itself uses the term "lease," which it has strenuously avoided in public statements on the issue, to characterize the WREM arrangement. Of further interest: the action officially came only two days before the deadline by which FCC Chair Alfred Sikes was required to respond to a pointed Congressional letter of inquiry on the topic of the FCC's oversight of time brokerage agreements.

The U.S. Court of Appeals for the District of Columbia has overturned Congress - mandated indecency regulations implemented last year by the FCC. :n ruling that a 24 -hour ban on allegedly indecent (but not necessarily obscene) broadcast program- ming was unconstitutional, the court struck down both the FCC regulations and the law that required them. The Appeals Court ruling explicitly requires any indecency regulations to allow such material during part of the broadcast day. The FCC and various religious and advocacy groups are expected to appeal.

FCC Chair Alfred C. Sikes surprised nearly everyone last week by coming out publicly in favor of allowing foreign ownership of any broadcast properties in the U.S. Such ownership has been prohibited since the inception of the Communications Act of 1934; Congressional action would be required to make the change. Under Sikes' proposal foreign nationals would be allowed any percentage of ownership if their country of citizenship reciprocated by allowing U.S. investment in that country's domestic media. M Street comments: with the indecency ban struck down, political advertising laws still a hot issue, and rude noises being made on Capitol Hill regarding time brokerage arrangements, the last thing broadcasters need is the head of the FCC handing Congress an issue ready -made for cheap demagoguery. What could Sikes possibly have been thinking?

The three KROQ -FM (Los Angeles) disc jockeys who faked an on -air murder confession last summer have agreed to personally reimburse authorities for the cost of the subsequent investigation. KROQ morning personalities Kevin Ryder and Gene Baxter and evening host Doug Roberts will split the $12,170 bill run up by the Los Angeles County Sheriff's Department in the course of their investigation. The three have also agreed to each perfort 149 hours of community service - the amount of time authorities spent on the investigation. The actions were disclosed as part of owner Infinity Broadcasting's response to an FCC inquiry on the incident. In addition to the FCC inquiry, KROQ -FM also faces possible challenges during license renewal proceedings later this year.

But before Infinity can worry about that, they have to deal with a challenge to the renewal of WXRK -FM New York. WXRK was one of two New York stations which drew competing new station applications during license renewal proceedings in New York this week. The anti -WXRK filing comes from Edward Atsinger and Stuart Epperson, principals in Salem Media (owner of WMCA -570 New York) and several other related licensees. Atsinger and Epperson are among the few who have used this process successfully - they obtained the license to what is now KKLA -FM -99.5 Los Angeles by filing against the previous licensee in the early 1980's. Also facing a fight: WNCN- 104.3, whose owner, GAF Corp., includes a principal convicted of stock mani- pulation charges three years ago. Two companies have filed against WNCN.

Broadcasters beware: the FCC has released a supporting text in the wake of its recent $25,000 fine to KSHE Crestwood (St. Louis) MO, reemphasizing the importance of Emergency Broadcast System requirements. In part, the FCC notes that it is "...warning broadcasters not to alter the weekly EBS test or air any musical rendition or alteration of the test script...This would undermine the serious nature of the system...use of prerecorded (taped) EBS encoder tones is not in

The FCC has decided that comparative applicants for broadcast facilities must pay their hearing fees before they are designated for a comparative hearing. The new guidelines will take effect July 1, 1991. If a commercial applicant has been accepted for filing in a public notice released prior to July 1, the applicant must pay its hearing fee on or before July 15, 1991. The new requirement also applies to renewal applicants where a public notice announcing the acceptance for filing of a competing application is released before July 1.

The U.S. Senate last week approved S. 521, a piece of legislation mandating changes in lowest unit rate rules for political advertising. With the legislation, candidates would receive fixed spots at lowest preemptible rates. In turn, lowest unit rates would apply during shorter time periods.

The National Radio Systems Committee (NRSC) a joint effort of the EIA and the NAB is seeking comments and will be holding a meeting to form a recommendation as to format types to be included in the national standard for RBDS (Radio Broadcast Data Systems) or RDS as it is known in Europe. RBDS has the potential to allow a radio to scan by format and as such which formats are available if of importance to broadcasters. The meeting will be held at the EIA in Washington DC, Wednesday June 12th at 10 am. ABC has named its summer replacement host for Talkradio's Sally Jesse Raphael show. She is Cyndy Garvey, an occasional TV and radio host and author best known as the former wife of ex- baseball star Steve Garvey. Garvey will host the show from May 27 through September 1991, when permanent host Deborah Norville will take over the program.

The RAB has released a study showing significant increases in national advertiser figures spending for a number of major advertiser categories during 1990. The include: Communications + 37.9i Government + 27.2% + Gasoline & Oil + 32.3% Household Products 52.5% + Soft Drinks & Water + 22.9% Confections 26.8%

The five leading categories (Food Products, Automotive, Travel & Shipping, Beer/ Ale /Wine, and Consumer Services) remained relatively stable, with spending for all five areas increasing an average of 1.7% over 1989 figures.

The state of Michigan is considering a tax regulation change that would adversely affect broadcasters in that state. Michigan's Treasury Department has proposed defining "royalties" in such a way that the fees radio broadcasters pay to ASCAP and BMI would no longer be tax -deductible. The change in definition will be considered at a hearing June 11, and does not need legislative action or executive approval in order to take effect.

The FCC dismissed a petition for rulemaking and order to show cause filed by KXA Radio Corp., and a counterproposal filed by Warden Broadcasting Associates, concerning amend- ment of the FM table for Rock Island, Moses Lake and Warden, WA. WASHINGTON THIS WEEK

FCC Chair Alfred Sikes last Wednesday submitted to Congress this year's proposal for 1992 -93 FCC reauthorization legislation, including next year's FCC budget. The FY 1992 budget contains a 15% increase over the 1991 budget, and includes provisions for computer modernization, improvement of the FCC's Laurel, MD tech- nical laboratory, acceleration of the licensing process, and what Sikes termed "adapting regulations to today's environment" - a catch phrase to describe the series of deregulatory proposals the FCC is considering for radio and other communications industries. Sikes specifically defended FCC radio industry proposals that have been criticized for limiting ownership diversity and catering to large group owners. According to Sikes: "The real issue...is whether radio must continue as a fragmented, perpetual small business -- or whether Government will allow radio entrepreneurs more choices."

Broadcast consultant Larry Fuss has filed a petition with the FCC to give a preference in new FM station filings to the applicant (if any) that filed to create the new or amended FM allotment. According to Radio & Records, Fuss' petition would create an "entrepreneur's preference" for broadcasters who take the risk of seeking out and filing for new allocations. Presently, if an attractive allocation is established the petitioner becomes simply one of a number of competing applicants for the new facility. The FCC and NAB have indicated support for the idea.

A second station in two weeks has been assessed a $10,000 notice of apparent liability for an unauthorized transfer of control. This week's recipient is WETS- 790 Johnson City TN. WETB's licensee, Mountain Signals Inc., repossessed the station from Alpha -Omega Broadcasting, Inc., in 1989, several months before receiving FCC approval to do so.

The House Energy and Commerce Committee this week approved a bill that would release to the public a number of broadcast spectrum frequencies now reserved for government use. The bill does not provide for a mechanism for the reassignment. FCC, Commerce Dept. and administration officials have spoken in favor of a plan that would auction off the frequencies to the highest bidder, with the government pocketing the proceeds. The frequency reallocations could have an impact on frequencies available for direct audio broadcasting. Financially beleaguered United Press International has, for "absolutely the last time," asked its guild employees to continue to work for reduced pay until a sale is completed. The third round in a series of cutbacks over the last year would have workers at 75% of normal pay until July 13, then 80% of normal pay until

The FCC has upheld an ALJ ruling that enlarged issues against Carmel Broadcasting, LP in a proceeding for a new Carmel CA FM. The ALJ's action was upheld due to a rule that specifies ALJ interlocutory rulings cannot be appealed until the time for filing exceptions to the Initial Decision in the proceeding. Also upheld was an ALJ dismissal of N. Walter Goins' application for a new FM in Eden Prairie MN. Goins' application had been dismissed for failure to adequately demonstrate his financial qualifications.

CANADA THIS WEEK

CKST -800 and CIMG -1040 in metro Vancouver B.C. have announced a plan to switch frequencies. The move would give the progressive rock -formatted Coast 800 a better signal in the city, and standards -formatted Magic 1040 better suburban coverage. The plan is subject to CRTC approval. ELSEWHERE

Arbitron has announced that it will poll subscribers to determine the level of support for moving from four to three annual survey periods per year in its largest markets. The poil is in response to an Arbitron Radio Advisory Council recommendation that the ratings firm consider only three annual surveys. Numbers from the summer survey are widely discounted by broadcasters and advertising agencies due to perceived seasonal shifts in listening habits and consumer patterns. Results from the subscriber poll will be brought to the next Council meeting in August.

A buyer has been announced for the Financial News Network. FNN operations have already been taken over by the Consumer News and Business Channel, a cable TV service owned by NBC. Operations have moved from Manhattan to CNBC studios in Fort Lee, NJ.

Also sold this week: Business Radio Network, to a group of Colorado Springs investors with primarily print and advertising backgrounds. The group is led by brothers Lester B. and Gary O. Loo., who will serve as the new Chairman of the Board and President of BRN, respectively.

Radio entrepreneur Ragan Henry, who has had several investment schemes struggle for capital over the past two years, has announced another one. The Milwaukee Journal reports that Henry plans to parlay newly -purchased WBZN AM /FM into a new, six -station group as "UNC Media Group." UNC refers to Urban National Corp., a Boston -based firm that will be the largest single investor. Henry is still trying to get his "Kidwaves" pre -teen network up and running, and recently officially disbanded Waldron Partners, a would -be group that in four years failed to close any of its announced station purchases.

This week's sale of WQZQ Dickson TN marks another bookend simulcast of a major market. The two -part sale leaves WQZQ owned by WYCQ -102.9 Shelbyville TN (south of Nashville), which also recently purchased and has begun simulcasting on WCTZ- 1550 Clarksville TN (northwest of Nashville). WQZQ, to the west of the city, will upgrade to 50 kw on 102.5 and also simulcast WYCQ's country format, creating a new ring of three stations (and counting).

TNNR has announced that the 1991 TNN Music City News Country Awards, set for June 10, will be made available for a radio simulcast of the TV awards show. For information on availability, contact Group W Satellite at 212- 916 -1037. BCFM JULY CALENDAR NOTES
