3 Kankakee County Board Meeting September 12, 1989 10:00 a.m. The meeting of the Kankakee County Board, Kankakee County, Illinois held pursuant to the adjourned meeting of June 13, 1989, was called to order by the Chairman, Mr. Hendrix on September 12, 1989 at 10 a.m. with the following members present: Mr. O'Connor, Mr. Huot, Mr. Thompson, Mr. Hendri. x, Mr. Davis, Mr. Jensen, Mr. Tripp, Mr. Bertrand, Mr. Riegel, Mr. Bretveld, Mr. Graves, Mr. Piekarczyk, Mr. Minelli, Mr. Dailey, Mr. Young, Mr. Howery, Mr. Stump, Mr. Meling, Dr. Sergeant, Mr. Wenzelman, Rev. Rucker, Mr. Washington, Ms. Shutter, Mr. Mackin, Mr. Ryan, Mr. Breault. Members Absent: Mr. Martin and Mr. Greenley. Quorum Present: Invocation was given by Rev. John Best. County Board Member Doug Graves made the introduction. The Board recited the Pledge of Allegiance. The minutes of the last meeting were presented to the Board, and on the motion of Mr. Stump and second of Mr. Dailey the reading of the minutes was waived and stand approved as recorded. motion carried. CLAIMS COMMITTEE REPORT: The Claims Committee submitted a report recommending the claims be adopted for payment. A motion to adopt the claims for payment was made by Mr. Davis and seconded by Mr. Stump. County General Claims and County Highway claims are included in this action. Motion carried on a roll call vote of 25 ayes, 0 nays. The original claims list may be found in Claims Book Exhibit "C". COMMUNICATION: 1. A communication was received from Doty and Ed Safiran for memorial sent for the loss of their son-in-law. 2. A communication was received from Louis Minelli for flowers sent while in the hospital. 3. A communication was received from Wilma Sherman for the planter sent while she was hospitalized. 4. A communication was received from the family of Al Wadley for flowers sent at the time of his death. 5. The Grand Jury Report was submitted by Albertina Grise with reference to the inspection of the Detention Center. 6. A motion to approve the Department Reports for filing was made by Mr. Tripp and seconded by Mr. Minelli. motion carried. RESOLUTIONS 1. HIGHWAY AND BRIDGE COMMITTEE A. The Committee submitted a resolution for Board consideration with reference to the execution of agreement with the IL Department of Commerce and Community Affairs and Kankakee County for a grant in the amount of $852,000. A motion to adopt the resolution was made by Mr. Bretveld and seconded by Mr. Jensen. Motion carried on a roll call vote of 26 ayes, 0 nays. B. The Committee submitted a resolution for Board consideration with reference to executing an agreement between Kankakee County and State of Illinois for FAS Route 112 (County Highway 9) and improvements to township Road TR 158 and TR 11 in Manteno Township. A motion to adopt the resolution was made by Mr. Thompson and seconded by Mr. Breault. Motion carried on a roll call vote of 26 ayes, 0 nays. C. The Committee submitted a resolution for Board consideration with reference to executing an agreement between the State of Illinois and Kankakee County regarding the jurisdictional transfer of FAS Route 311 (County Highway 9) from IL Route 50 to the Village of Manteno extending easterly +5.42 miles to a point +0.29 miles west of County Highway 17. A motion to adopt the resolution was made by Mr. O'Connor and seconded by Mr. Washington. Motion carried on a roll call vote of 26 ayes, 0 nays. D. The Committee submitted a resolution for Board consideration with reference to the appropriation of funds for the improvement of County Highway 9/FAS 311 Manteno Township roads 158 and 11 and 3rd Street. A motion to adopt the resolution was made by Mr. Mackin and seconded by Mr. Minelli. Motion carried on a roll call vote of 26 ayes, 0 nays. E. The Committee submitted a resolution for Board consideration with reference to assuming jurisdiction of County Highway State 9/FAS 311. A motion to adopt the resolution was made by Mr. Jensen and seconded by Mr. Davis. motion carried on a roll call vote.

The request was through petitioners Byron and Joe Tom for a special use permit on a tourist park. A motion to adopt the resolution was made by Mr. Washington and seconded by Mr. Mackin. Motion carried. Mr. Wenzelman abstained. B. The Committee submitted a resolution for Board consideration with reference to ZBA #89-10 amendment to the Kankakee County Zoning Ordinance. A motion to adopt the resolution was made by Mr. Huot and seconded by Mr. Piekarczyk. Motion carried with Mr. Meling voting no. 3. SALARY, PERSONNEL, AUTOMATION COMMITTEE A. The Committee submitted a resolution for Board consideration with reference to increasing the minimum hours for IMRF participation to 1,000 hours. A motion to adopt the resolution was made by Mr. Wenzelman and seconded by Mr. Bretveld. Motion carried on a toll call vote of 24 ayes, 0 nays. 4. FINANCE COMMITTEE A. The Committee submitted a resolution for Board consideration with reference to forwarding a $1,000. to the International Corridors Program. A motion to adopt the resolution was made by Mr. Wenzelman and seconded by Mr. Thompson. Motion carried on a roll call vote of 21 ayes, 4 nays. 5. ADMINISTRATION COMMITTEE A. The Committee submitted a resolution for Board consideration with reference to the execution of an agreement between Kankakee County and Central Management Services for the maintenance of the Classification and Evaluation program. A motion to adopt the resolution was made by Mr. Bretveld and seconded by Mr. Tripp. Motion carried on a roll call vote of 24 ayes, 0 nays. B. The Committee submitted a resolution for Board consideration with reference to the re appointment of Larry Huffman to the Kankakee County Cooperative Extension Board with term expiring 8-30-1991. A motion to adopt the resolution was made by Mr. Huot and seconded by Mr. Washington. motion carried. 6. COUNTY CLERK/TREASURER'S COMMITTEE A. The Committee submitted a resolution for Board consideration with reference to the disposal of the electronic voting machine to Voting Machine Service Center, Inc., New York.

A motion to adopt the resolution was made by Mr. Bretveld and seconded by Mr. Jensen. Motion carried on a roll call vote of 25 ayes, 0 nays. B. The Committee submitted a resolution for Board consideration with reference to a polling place change for Precinct #2, Manteno. A motion to adopt the resolution was made by Mr. TRipp and seconded by Mr. Thompson. motion carried. C. The Committee submitted a resolution for Board consideration with reference to the appointment of Richard Hagenow as trustee of the Manteno Fire Protection District. A motion to adopt the resolution was made by Mr. Thompson and seconded by Mr. Jensen. motion carried. D. The Committee submitted a resolution for Board consideration with reference to the appointment of Vennis Vo9es as Trustee of the Manteno Fire Protection District. A motion to adopt the resolution was made by Mr. Jensen and seconded by Mr. Minelli. motion carried. E. The committee submitted a resolution for Board consideration with reference to the appointment of Leo Hassett as a trustee of the Manteno Fire Protection District. A motion to adopt the resolution was made by Mr. Thompson and seconded by Mr. Bretveld. motion carried. F. Chairman Hendrix delayed the reading of the Judges of Election to the last item on the agenda. Refer to Item F under County Clerk/Treasurer's Committee.

G. The Committee submitted a resolution for Board consideration with reference to a polling place change for Norton Precinct #1. A motion to adopt the resolution was made by Mr. Jensen and seconded Mr. Minelli. Motion carried. 7. JUDICIAL AND STATES ATTORNEY COMMITTEE A. The Committee submitted a resolution for Board consideration with reference to an agreement between the State's Attorney's Appellate Prosecutor Division and the County of Kankakee for labor relations service by virtue of the IL Public Labor Relations Act. A motion to adopt the resolution was made by Mr. Wenzelinan and seconded by Mr. Huot. Motion carried on a roll vote of 24 ays, 0 nays. OLD BUSINESS NONE

NEW BUSINESS: Mr. Huot stated recently President Bush gave his speech on drug abuse. If you watch T.V. you can see reports on drug deals, killings and drug gangs fighting over turfs. If you do not think this is happening in our own back yard your head is in the sand. People have been murdered, people committed suicide and Senior Citizens homes have been invaded, all because of drugs. The money we spend on law enforcement, which we complain about all the time, we could cut in half. We should show the people we mean to put the drugs where they belong. A motion to call for mandatory random drug testing of County employees and refer the matter to Personnel and Administration Committees for study was made by Mr. Huot and seconded by Mr. Howery. Motion carried. Mr. Dailey voted no. Mr. Jensen stated he agrees with this 100% and also feels it should include alcohol which affects this community more than drugs. Mr. Breault: I agree with Mr. Huot, but this will be rough to get through with union contracts. There is great concern over the actually test for drugs. Mr. Dailey: Drug testing also runs about $200. per test. Mr. Huot: According to the FOP President in , if the testing is not used as disciplinary or punitive measure there should not be a problem. Mr. Washington: The concern is the method of testing, and the testing analysis. Mr. Bretveld: I agree with Bruce and what he said.

Chairman Hendrix announced the following vacancies: 1. Welfare Services Committee, Department of Public Aid 2. Private Industry Council 3. Kankakee County Health Board 4. 911 Vacancy The Chairman then called for Item 6E on the agenda. The Clerk read the Judges of Election. A motion to approve the Judges of Election was made by Mr. Howery and seconded by Mr. Washington. motion carried. GRAND JURY JAIL INSPECTION JULY 21, 1989

We, the Grand Jury of Kankakee County toured the Kankakee County Detention Center on July 21, 1989 at 12:00 P.M. and present the following comments:

1. We wish to thank officer Mark Schwark for a very informative tour and for answering are many questions.

2. The facilities were clean except for the empty section we saw and the class roon. The kitchen was fine.

3. The library needs books and magazines. If the county can't afford to buy them maybe an appeal to some charity organizations could help.

4. We felt the facility was a little short of staff but the personnel we saw were professional and appeared properly trained.

5. Security appeared adequate.

Regarding the improvement of various local roads to facilitate traffic generated by the proposed Sears warehouse/distribution facility at the Illinbis Diversatech Campus.

This agreement entered into the day of

1989, A.D. and day of , 1989, A.D. by and

between Kankakee County, Illinois; hereinafter called the COUNTY, the

Village of Manteno, Illinois, hereinafter called the VILLAGE and the

State of Illinois acting through its Department of Transportation,

hereinafter called the STATE.

WHEREAS, the COUNTY, VILLAGE and STATE, are desirous of improving

certain segments of highways in order to facilitate the free flow of

traffic, insure safety for the motoring public and adequately serve the

planned Sears warehouse/distribution facility at the Illinois

Diversatech Campus. WHEREAS, the majority of the described improvements

will be accomplished under Phase I of this project as part of MET

sections 89-00240-00-IL, 89-00241-00-WR and 89-00242-00-WR. The lone

exception is the improvement of County Highway 9, described in paragraph

F of this agreement, to be accomplished under Phase II of the project.

WHEREAS, the following portions of highways will be improved:

A. ILLINOIS ROUTE 50 AND COUNTY HIGHWAY 9 (3RD ST./FAS 311)

INTERSECTION

Reconstruct the east leg of the intersection, from Route 50 to a

point +340 feet east, which includes adding a 12 foot wide right

turn lane, constructing curb and gutter with storm sewer, increase

turning radii, resurface with bituminous concrete and construct 5

foot concrete sidewalk on both sides of the nighway. The west leg of the intersection will be resurfaced with

bituminous concrete and tapering to existing parking lanes, from

Route 50 westerly +420 feet to Oak Street. New pavement markings

will be applied to the north and south legs of Route 50. Traffic

signals will also be installed.

B. COUNTY HIGHWAY 9 (FAS 311/MANTENO - WHITAKER ROAD), FROM NEAR RT.

50 TO SEARS ENTRANCE

From a point +340 feet east of Illinois Route 50 easterly +0.57

mile (+3,010 feet) to Manteno Township Road 158 (E300 Rd.),

resurface the existing 26 foot wide pavement with bituminous

concrete. Install traffic signals at the intersection of County

Highway 9 and Township Road 158.

- From Manteno Township Road 158 (E300 Rd.) easterly +0.5 mile to

the Sears entrance, resurface the existing 26 foot wide pavement

with bituminous concrete and construct turning lanes at the Sears

warehouse entrance.

C. MANTENO TOWNSHIP ROAD 158 (E300 RD./SYCAMORE ST.)

From County Highway 9 northerly 1.0 mile (+5,280 feet) to Manteno

Township Road 11 (f4l000 Rd.), widen the existing 20 foot pavement

to 24 feet and resurface with bituminous concrete.

From Township Road 158 (E300 Rd./Sycamore Street) westerly +0.30

mile (+1584 feet) to Illinois Route 50, widen the existing gravel

road to 24 feet and resurface with bituminous concrete.

E. ILLINOIS ROUTE 50 AND MANTENO TOWNSHIP ROAD 11 (N1000 RD.)

INTERSECTION

Increase turning radii, provide roadway lighting construct left

turn lanes on both the north and south legs of Route 50, and an

exclusive right turn lane on the east leg of Manteno Township Road

11 (Nl000 Rd.).

F. COUNTY HIGHWAY 9 WAS 311/MANTENO WHITAKER ROAD), FROM SEARS

ENTRANCE TO TOWNSHIP ROAD 222

From the Sears entrance easterly +8.58 miles (+45,300 feet) to

Yellowhead Township Road 222 (EllOO Rd.), the existing pavement

will be reconstructed and bridges replaced or rehabilitated, where

necessary. This is the only segment of highway to be improved

under Phase II.

All other work, necessary to complete the work in accordance with approved plans and specifications, will be performed.

WHEREAS, the COUNTY and VILLAGE are desirous of said improvement in that same will be of immediate benefit to VILLAGE and COUNTY residents.

3 SI U. S WHEREAS, the COUNTY has expressed its desire to participate in financing the cost of the aforedescribed roadway work.

WHEREAS, the COUNTY will be the lead agency and thereby assume all responsibilities in the coordination and implementation of all phases of the aforedescribed improvements

WHEREAS, all phases of the said project will be accomplished in accordance with the current Motor Fuel Tax, policies and procedures.

WHEREAS, the COUNTY is currently responsible for the maintenance, administration, engineering and improvements of County Highway State 9; from Illinois Route 50 easterly +5.42 miles to Whitaker, as in accordance with the provisions of a county-state agreement it entered into with the STATE on July 8, 1975.

WHEREAS, by reason of COUNTY'S present maintenance, administration and engineering responsibilities for County Highway State 9, and its proposed improvement of the said highway, the COUNTY and STATE have mutually determined it is in the interest of both parties to transfer the jurisdiction to the COUNTY the portion of County Highway State 9 presently under the jurisdiction of the STATE. The said transfer will

include County Highway State 9 from its intersection with Illinois Route

50 and extending easterly +5.42 miles (+28,620 feet) to a point +0.29 mile (+1530 feet) west of County Highway 17 (E800 Rd.) within the

community of Whitaker.

L4 I. S NOW, THEREFORE, in consideration of the material and covenants contained herein, the parties agree as follows:

1. The COUNTY agrees to make or cause to be made, the surveys, prepare plans and specifications, purchase the necessary rights of

way, receive bids and award contracts, furnish engineering

inspection during construction, and cause the improvement to be

built in accordance with the plans, specifications and contracts.

The COUNTY further agrees to provide acceptance sampling and

testing of materials in accordance with the Standard

Specifications for Road and Bridge Construction, Project

Procedures guide and methods, prescribed by the STATE.

2. The STATE agrees to reimburse the COUNTY for 75% of the engineering and construction costs estimated to be $176,000, for

improving the Illinois Route 50 and County Highway 9 (3rd St./FAS

311) intersection, as aforedescribed in paragraph A of this

agreement.

3. The STATE agrees to reimburse the COUNTY for 50% of the

engineering and construction costs estimated to be $568,000 for

improving County Highway 9 from a point +340 feet east of Illinois

Route 50 easterly +0.57 mile to Manteno Township Road 158 (E300

Rd.), including the installation of traffic signals at County

Higwhay 9 and Township Road 158, as aforedescribed in paragraph B

of this agreement.

.5 4. The STATE agrees to reimburse the COUNTY for 50% of the

estimated engineering and construction costs estimated to be

$263,000 for improving County Highway 9, from Manteno Township

Road 158 (E300 Rd.) easterly +0.5 mile, as aforedescribed in

paragraph B of this agreement.

5. The STATE agrees to reimburse the COUNTY for 50% of the

engineering and construction costs, estimated to be $785,000;

for improving Manteno Township Road 158 (E300 Rd.) from County

Highway 9 northerly 1.0 mile to Manteno Township Road ll(Nl000

Rd.), Manteno Township Road 11 from TR 158 westerly +0.30 mile

to Illinois Route 50, and the intersection of T.R. 11 with

Route 50.

6.) A summary of the estimated cost and cost distribution of the

described Phase I improvements is as follows:

6 7. The STATE agrees to reimburse the COUNTY for 50% of the estimated engineering and construction costs, this share not to exceed a

maximum of $500,000, for the improvement of County Highway 9 from

the Sears entrance easterly +8.58 miles to Township Road 222, as

aforedescribed in paragraph F of this agreement. This work is to

be accomplished under Phase II.

8. The COUNTY agrees to provide the STATE with a written proposal identifying the scope of work and cost estimates for the

improvement of County Highway 9, from +0.5 mile east. of Township

Road 158 (E300 Rd.) easterly to Township Road 222 (Ell00 Rd.).

The COUNTY further agrees to submit this information to the STATE

no later than December 1, 1989.

9. The COUNTY agrees to pay 100% of the project costs subject to reimbursement by the STATE, as described in paragraphs 2 through 5

of this agreement.

10. The COUNTY has passed a resolution appropriating $2,000,000 to

finance its share of cost for the aforedescribed improvements. A

copy of the resolution is attached hereto as Exhibit #2 and made a

part hereof.

qI 0 [1 Q TI 11. The STATE agrees, that upon receipt of the first and subsequent

progress payments made to the contractor for Phase I only, the

STATE will pay the COUNTY an amount equal to' the STATE'S estimated

share of $940,000, divided by the estimated construction costs

(based on bid unit prices) multiplied by the actual progress

payments (appropriately adjusted for nonparticipating costs) made

to the contractors, until the entire obligation incurred under

this agreement has been paid. The COUNTY'S periodic billing to

the STATE must contain sufficient cost information and include

evidence of payment to the contractor by the COUNTY. The STATE

will reimburse the COUNTY for the STATE'S share of engineering on

the basis of periodic billing consisting of sufficient cost

information and evidence of payment by the COUNTY. The STATE'S

payment to the COUNTY will be made within 30 days after its

receipt of itemized bills. An addendum to this agreement will be

prepared for Phase II at a later date, when the scope of work and

costs have been determined.

12. The COUNTY agrees to furnish the STATE with a complete set of

final plans and specifications and thereafter obtain the STATE'S

written approval. The STATE'S written approval will be required

prior to advertising for bids for the improvement.

[;] 11 U 0 Li 13. The COUNTY agrees to furnish the VILLAGE with a set of final plans

and specifications pertaining to the improvement of the Illinois

Route 50 and County Highway 9 (3rd Street) intersection, located

within the VILLAGE. The VILLAGE'S written approval of the said

plans will be required prior to advertising for bids for the

improvement.

14. The COUNTY agrees to obtain written concurrence from Manteno

Township, authorizing the improvement of Manteno Township Roads

158 (E300 Rd.) and 11 (Nl000 Rd.), and acknowledging that Manteno

Township will retain jurisdiction of the said highway. The COUNTY

will be required to submit to the STATE, the said letter of

concurrence approved by Manteno Township, prior to advertising for

bids for the improvement.

15. The COUNTY agrees to retain all records for STATE Audit, for a

period of three years after the completion of the project.

16. The COUNTY agrees to comply with all applicable Executive Orders

and Federal Highway Acts pursuant to the Equal Employment

Opportunity and non-discrimination regulations required by the

Illinois Department of Transportation.

17. The COUNTY agrees to acquire all rights of way and/or easements at

no cost to the STATE and will certify to the STATE, prior to the

COUNTY'S advertising of bids, that all necessary rights of way

and/or easements have been acquired.

vej Zqq . 'a • 18. It is mutually agreed that the STATE reserves the right to inspect

any phase of the aforedescribed improvement, at the STATE'S

descreti on.

19. The COUNTY agrees to Invite a representative of Manteno Township

to inspect the completed construction work on Manteno Township

Roads 158 (E300 Rd.) and 11 (Nl000 Rd.), prior to the final field

inspection of the improvement of these roads by the COUNTY. and

STATE.

20. The COUNTY agrees to invite a representative of the STATE to accompany COUNTY representatives in the final field inspection of

completed improvements.

21. The COUNTY agrees to assume jurisdiction of County Highway State 9 WAS Route 311 /Manteno-Whi taker Rd.), beginning at Illinois Route

50 and extending easterly +5.42 miles (+28,620 feet) to a point

+0.29 mile (+1530 feet) west of County Highway 17 (E800 Rd.),

including structures #046-0059, #046-0060, and #046-0061. The

said portion of highway was constructed as state section U-15d and

improved in 1975 by the COUNTY as county section

75-00184-00-W&RS. The jurisdictional transfer will become

effective 21 calendar days after the STATE'S execution of this

agreement, as described in the jurisdictional transfer document

(BLR Form 1600), which is hereto attached as Exhibit #4 and made a

part hereof.

23. The VILLAGE agrees that 3rd Street, from Illinois Route 50

westerly to Oak Street, will remain under the jurisdiction of the

VILLAGE.

24. Upon acceptance by the STATE of the installation of new traffic

signals at Illinois Route 50 and County Highway 9 (3rd Street) in

the Village of Manteno, (as aforedescribed in paragraph A of this

agreement), and the completion of installing traffic signals at

the intersection of County Highway 9 and Township Road 158 the

financial responsibility for maintenance and electrical energy for

the operation of signals will be proportioned as follows:

the traffic signals at County Highway 9 and Township Road 158.

It is further agreed that the signals shall be maintained to at least

the Levels of Maintenance shown above and specified in the attached

Exhibit 5 which is made a part hereof.

It is understood that Level of Maintenance I meets the minimum

requirements of the Illinois Manual on Uniform Traffic Control Devices

for Streets and Highways and Level of Maintenance II exceeds the manual

requirements and is prescribed for those signals that the District

Engineer, with the concurrence of the Engineer of Traffic, determines to

require a higher level of service for adequate operations of the highway

system at those locations.

It is also understood that if, in the judgment of the STATE, the VILLAGE

has not provided adequate maintenance for those signals at Illinois

Route 50 which it has been assigned to maintain, the STATE will, upon

giving 30 days notice in writing, arrange for the appropriate

maintenance efforts and bill the VILLAGE for its share of the costs.

The VILLAGE agrees to bill the STATE, for its proportionate share of the

Illinois Route 50 signal maintenance costs on a three-month basis. The

amount billed shall be the actual costs incurred less any third party

damage claims received during the billing period for repair of signals

that are the responsibility of the billed party. Any proposed

installations must be approved by the billed party before the

expenditure is made. The STATE reserves the right to examine the

records of the VILLAGE to determine that costs billed are fully

documented.

Payment by the STATE of any or all of its share of maintenance and

energy costs of traffic signals at Route 50, is contingent upon the

STATE receiving adequate funds in its annual appropriation.

The parties hereto agree that the traffic signal maintenance and energy

provisions of this Agreement shall remain in effect for a period of

twenty (20) years from the date of its execution or so long as the

traffic signals covered by the terms of this Agreement or any amendment

hereto remain in place either in their current or some modified

configuration, whichever is the shorter period of time.

Such an effective term shall apply unless otherwise agreed in writing by

the parties hereto.

The COUNTY agrees to make arrangements with the local power company to

furnish the electrical energy for the operation of the traffic signals

on County Highway 9 at both Illinois Route 50 and Township Road 158

intersections. The STATE and COUNTY agree to pay their proportionate

shares of this costs, as billed by the local power company.

The STATE retains the right to control the sequence and timing of the

traffic signals at the intersection of Illinois Route 50 and County

Highway 9.

contemplated herein is not awarded by July 1, 1990.

26.) This agreement shall be binding upon and inure to the benefit of

the parties hereto, their successors and assigns.

WHEREAS, the County of Kankakee, Illinois, hereinafter called the COUNTY, has entered into an agreement with the State of Illinois, hereinafter called the STATE, to improve portions of County Highway 9/FAS Route 311 (Man teno-Whitaker Road), Manteno Township Roads 158 and 11, and 3rd Street in Manteno, designated as part of M.F.T. Sections 89-00240-00-IL, 89-00241-00-WR, and 89-00242-00-WR, to insure safety for the motoring public and facilitate the free flow of additional traffic to be generated by the planned Sears warehouse/distribution facility at the Illinois Diversatech Campus. WHEREAS, in compliance with the aforementioned agreement, It is necessary for the COUNTY to appropriate MOTOR FUEL TAX FUNDS and/or OTHER FUNDS to pay its share of cost for the Phase I Improvement of the abovementioned highways.

NOW, THEREFORE, BE IT RESOLVED, that there is hereby appropriated TWO MILLION DOLLARS ($2,000,000) or so much thereof as may be necessary from money now and hereinafter alloted under. the Motor Fuel Tax Law and/or other money allotted to the COUNTY, to pay its share of the cost of improving various roads in the vicinity of the Illinois Diversatech Campus, as provided by the related county-state agreement; BE IT FURTHER RESOLVED, that the COUNTY agrees to pass a supplemental resolution to provide necessary funds for its share of the cost of this improvement if the amount appropriated herein proves to be insufficient to cover said costs.

WHEREAS, the STATE of ILLINOIS, hereinafter called the STATE and the County of Kankakee, Illinois, did under the date of 1989, enter into an agreement identified as part of M.F.T. Sections 89-00240-00-TL, 89-00241-00-WR and 89-00242-00-WR, for the improvement of County Highway 9/FAS Route 331 (also known as the Manteno-Whi taker Road), constructed as state section U-15d improved in 1975 by the COUNTY as county section 75-00184-00-W&RS; and

WHEREAS, the aforementioned agreement provided that the COUNTY will assume jurisdiction of County Highway State 9/FAS Route 311, from Illinois Route 50 in the Village of Manteno and extend easterly +5.42 (+28,620 Ft.) miles to a point +0.29 mile (+1530 Ft.) west of Cunty Highway 17 (E800 Rd.). The COUNTY'S jurisiction of the described portion of County Highway 9/FAS Route 311 will go into effect 21 calendar days after the STATE'S execution of this agreement.

TRAFFIC SIGNAL MAINTENANCE PROVISIONS

LEVEL I

The maintaining agency agrees to:

1. Patrol the traffic control signal system on a regular basis and replace burned out lamps or damaged sockets as may be required. All lamps should be replaced as frequently as experience proves necessary to prevent undue failures. The reflector and lens should be cleaned each time a lamp is replaced. All replacement lamps shall equal the wattage and type of the existing lamp.

2. Keep signal heads properly adjusted, controller cabinets, signal posts, and controller pedestals tight on their foundations and in alignment.

3. Keep detector equipment in proper working order.

4. Check the controllers, relays, and detectors at frequent intervals to ascertain that they are functioning properly and make all necessary repairs and replacement.

5. Keep interior of controller cabinet in a neat condition at all times.

6. Remove and clean and overhaul the controllers (except solid-state) relays, special auxiliary control equipment, and time clock once a year or more often if necessary. When solid-state controllers malfunction, they shall be removed, repaired, and bench checked. Solid-state controllers shall not be removed for annual maintenance inspections.

7. Replace burned out fuses.

8. Clean reflectors, lenses, and lamps once every six (6) months.

9. Repaint all signal components exposed to weather on a regular basis.

10. Repair or replace any and all equipment .damaged by any cause whatsoever.

11. Be responsible to make recovery for damage to any part of the installation or systems from the party causing the damage.

12. Provide alternate traffic control during a period of failure or when the controller must be disconnected. This may be accomplished through installation of a spare controller, placing the intersection on flash, manually operating the controller, or manually directing traffic through the use of proper authorities.

• ' I 3. Provide skilled maintenance personnel who will be available to respond without delay to emergency calls. This may be provided by agency forces, contract, or maintenance agreement. Controller failure, lights, out, knockdowns, or two (2) red lights out at an intersection are considered emergencies.

14. Provide the DEPARTMENT the names, addresses, and telephone numbers of at least two persons who will be available for emergency repair of the traffic signals and keep the DEPARTMENT informed of any changes of same.

RE: ZONING BOARD OF APPEALS CASE #89-9 WHEREAS, an application for a Special Use Permit pursuant to the terms of the Kankakee County Zoning Ordinance has been filed by Bryan and Joe Tom in the office of the County Clerk of Kankakee County to allow a tourist park on property generally located approximately three miles south of the 1-57 interchange on Illinois Route 49/U.S. 52 and one half mile east on County Road S600W, in Otto Township on the premises hereinafter legally described and by said office delivered to the Zoning Board of Appeals of said County; and,

WHEREAS, the Zoning Board of Appeals has caused a public hearing, after due notice, to be held on said application; and,

WHEREAS, all matters required by law of the State of Illinois and the Zoning Ordinance of Kankakee County to be done, have been done; and,

WHEREAS, the Zoning Board of Appeals has recommended that said Special Use Permit be granted, with stipulations hereinafter described, as requested in said application and the Planning and Zoning Committee has concurred in said recommendation; and,

WHEREAS, it is in the best interest of the public and consistent with the public health, safety, and general welfare, that said Special Use Permit be granted, including stipulations.

NOW, THEREFORE, be it and it is hereby resolved by the County Board of the County of Kankakee and State of Illinois, as follows:

SECTION I That a Special Use Permit, pursuant to the terms of the Kankakee County Zoning Ordinance, is hereby granted to allow a tourist park, legally described as Exhibit A, located in the County of Kankakee, Illinois, with the following stipulations: 1. That the tourist park be available for transient use only, with a maximum stay of four weeks, excluding one permanent site for the manager of the park. 2. That parking be provided on a one to four ratio of off- site parking per travel vehicle site. 3. That a deep well be utilized for water. 4. That sewage disposal be handled by a holding tank system with a septic tank utilized only for the service building and 16 sites with proper location of seepage fields or, in the alternative, an approved sewage treatment system. 5. That the site plan be reviewed and approved by the Planning and Zoning Committee before any building permit is issued. 6. That the roads and parking areas shall be improved with a compacted base and dust proof wearing surface be provided for.

SECTION II That this Resolution granting a Special Use Permit, including the stipulations, under the terms of the Zoning Ordinance of Kankakee County shall be in full force and effect upon its passage.

On a corner lot and at any points of vehicular intersection, within that part of a front yard located within twenty (20) feet from the point of intersection, no solid fence, structure, building, wall, hedge, or other landscaping shall be erected, constructed, planted, or maintained having a height exceeding thirty (30) inches or trees planted and maintained having branches lower than eight (8) feet above the grade at the curb or pavement edge of the adjacent street or roadway." 5. That Section III, N. is hereby amended to read as follows: "N. Access To Roads From Developments. Access, including driveways and service entrances, to roads—must conform to the following minimum requirements pertaininq to frequency of intervals unless impossible due to existing land division made prior to the effective date of this ordinance or due to unusual topographic characteristics: In an A-Agriculture District and R-1 and R-2 Residence Districts: 1. agricultural ingress and eress - not less than 660 feet measured from centerline to centerline; 2. residential ingress and egress other than farm related not less than 800 feet along U.S. and State Highways as measured from centerline to centerline and not less than 400 feet along County and Township highways as measured from centerline to centerline. The intersection of roads shall be considered as points of ingress and egress. All lots shall be afforded access to at least an all- weather road. An all-weather road is a public thoroughfare adequately drained with the travelled area surfaced either with crushed stone or bituminous material placed over a crushed stone base. The design thickness shall be sufficient to accommodate normal vehicular traffic during all periods of the year without excessive maintenance costs or without disruption due to weather.

RE: CMS MAINTENANCE AGREEMENT

WHEREAS, the County of Kankakee Did enter into a contract for the preparation of a Classification and Evaluation Program for the employees of Kankakee County, and, WHEREAS, the program was completed and instituted in the County effective July 1, 1989, and, WHEREAS, it has been determined it is in the best interest of Kankakee County to enter into a one year maintenance agreement with the Technical Services Division of the Central Management Services, State of Illinois, for purposes of providing Class Specifications revisions, Establishment of new class specifications, and update of pay plan review with cost of agreement being $4,000., NOW, THEREFORE, BE IT RESOLVED, by the County Board of Kankakee County, Kankakee, Illinois, the chairman of the County Board be and he is hereby authorized to enter into the contract agreement a copy of which is attached hereto and marked Exhibit "A", with CMS, State of Illinois with maintenance program beginning August, 1990.

The State of Illinois, Department of Central Management Services, herein- after termed the Department, will provide technical personnel services to the County of Kankakee hereinafter termed the County, for the below listed activities: Maintenance Program

Prior to the review, the County shall identify changes in:

A liaison person will be designated by the County for meeting and conferring with officials.

All inclusions in the Department's Report shall stand. Any dissemination of data contained in the Department's report shall be at the discretion of the County.

WHEREAS, the State's Attorneys Appellate Prosecutor has beeauthorized pursuant to Public Act 83-124 to represent Illinois Counties outside of Cook County in labor relations cases under and by virtue of the Illinois Public Labor Relation Act; and, WHEREAS, said statute authorizes the State's Attorneys Appellate Prosecutor to represent said counties in negotiations with unions as well as formal proceedings before the Illinois Labor Relations Board and Courts of the State of Illinois; and, WHEREAS, the State's Attorneys Appellate Prosecutor has determined that the fee to be charged for said service in addition to the normal fee paid be your County shall be $125 per Attorney or Negotiator for two hours or less on each day; $175 per Attorney or Negotiator for more than two hours but less than four hours on each day; $225. per Attorney or Negotiator in excess of four hours on each day; an initial $250. charge for the first draft of the Employer proposal, a $75 charge for major revisions in the Employer proposals or major memoranda to the bargaining teams; and a $50 per hour charge for all work pertaining to arbitration. NOW, THEREFORE, BE IT RESOLVED by the County Board of Kankakee County as follows: Section 1: That the County Board of Kankakee County hereby authorizes and empowers the State's Attorneys Appellate Prosecutor to represent said County in all labor negotiations and other labor matters in said County including but both limited to matters prior to a representation election, any negotiations with the union covering wages, hours and other conditions of employment and any proceedins before the Labor Relations Board, cases in the Courts of Illinois and any and all other matters incident to and arising out of County activities under and by virtue of the Illinois Public Labor Relations Act, including the resolution of disputes arising out of and under collective bargaining agreements if any.

Section 3: It is mutually understood and agreed between the parties that the said labor negotiator(s) and/or Attorney(s) shall serve at the pleasure of the County Board and any and all services provided for herein may be terminated by the County Board upon ten (10) days prior written notice to the Director of the State's Attorneys Appellate Prosecutor by registered mail and a copy to the State's Attorney of Kankakee County. Section 4: It is further understood and agreed that the State's Attorneys Appellate Prosecutor in any and all services rendered herein shall obtain direction in said negotiations and other labor matters from the County States Attorney and/or Chairman of the County Board and said Appellate Prosecutor through its' agents and employees shall advise the State's Attorney and Chairman of the County Board of all of the Appellate Prosecutor activities, functions and duties pursuant to this resolution.
