SECTION IV - ONTARIO REGULATION 166/06, AS AMENDED PERMIT APPLICATION 10.1 - 10.3 ARE MAJOR APPLICATIONS - REGULAR Applications that involved a more complex suite of technical studies to demonstrate consistency with policies; applications that cover a significant geographic area (e.g.subdivisions, stormwater management ponds), extensive modifications to the landscape,major infrastructure projects, emergency works, resolution of violations/after the fact permits, trail construction 10.1 CITY OF TORONTO [ETOBICOKE YORK COMMUNITY COUNCIL AREA] 17 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade, and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, along the Humber River from south of Lawrence Avenue West to west of Scarlett Road, in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed, as located on property owned by the City of Toronto and TRCA under management agreement to the City of Toronto. The purpose is to rehabilitate an existing sanitary trunk sewer. Works will involve relining the trunk sewer and construction of access routes to each maintenance chamber. The Ministry of Natural Resources and Forestry warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNRF. 10.2 CITY OF TORONTO [NORTH YORK COMMUNITY COUNCIL AREA] 21 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, and alter a watercourse, on York Mills Road at Deerlick Creek, east of the Don Valley Parkway, in the City of Toronto (North York Community Council Area), Don River Watershed, as located on property owned by the City of Toronto. The purpose is to replace a corrugated steel pipe (CSP) culvert conveying Deerlick Creek below York Mills Road, between Clayland Drive and Fenside Drive, east of the Don Valley Parkway in the City of Toronto. The Ministry of Natural Resources warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNR. 2 10.3 TOWN OF RICHMOND HILL 24 54 MISTY MOOR DRIVE To construct, reconstruct, erect or place a building or structure on Lot 68, Plan 65M-2078, (54 Misty Moor Drive), in the Town of Richmond Hill, Don River Watershed. The purpose is to recognize the construction of a 5.75 sq.m. (61.8 sq.ft.) basement walkout at the rear of an existing dwelling within TRCA's Regulated Area of the Don River Watershed associated with a municipal building permit.. AND NASHVILLE TEN ACRES DEVELOPMENTS INC. To site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Part Lot 24, Concession 9, (northeast of Major Mackenzie Drive and Huntington Road, Block 61W), in the City of Vaughan, Humber River Watershed as located on the property owned by Nashville Developments (North) Inc. and Nashville Ten Acres Developments Inc. The purpose is to allow development and the alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate topsoil stripping and the installation of sediment and erosion control measures in Phase 4 of a draft approved plan of subdivision (19T-10V004) within Block 61 West, northeast of Major Mackenzie Drive and Huntington Road, in the City of Vaughan. 10.5 STANDARD DELEGATED PERMITS 28 Standard Permits are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard permits are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A199/13. Standard permits are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years or less. 11. AT HEAD OFFICE, 101 EXCHANGE AVENUE, VAUGHAN Brian Denney, Chief Executive Officer /jr 3 Item 9.1 Section III – Items for the Information of the Board TO: Chair and Members of the Executive Committee Meeting #12/15, December 4, 2015 FROM: Carolyn Woodland, Senior Director, Planning, Greenspace and Communications RE: WETLAND CONSERVATION IN ONTARIO: A DISCUSSION PAPER KEY ISSUE TRCA’s comments on the Ministry of Natural Resources and Forestry’s discussion paper “Wetland Conservation in Ontario”. RECOMMENDATION WHEREAS the Ministry of Natural Resources and Forestry (MNRF) has invited the public to provide comments on a discussion paper entitled “Wetland Conservation in Ontario” to inform the development of a strategic plan for wetlands; AND WHEREAS Toronto and Region Conservation Authority (TRCA) has legislated and delegated roles in the planning and development approvals process, and has responsibilities related to wetland protection, conservation and restoration as a watershed based resource management agency; THEREFORE LET IS BE RESOLVED THAT TRCA’s formal response to the Province of Ontario on October 30, 2015, in Attachment 1 be received; AND FURTHER THAT TRCA’s municipal partners and Conservation Ontario be so advised by the CEO’s office. BACKGROUND In 2014, in response to the continuing loss of wetlands, MNRF was given a mandate to work with other ministries, municipalities and partners to review Ontario’s broad wetland conservation framework and identify opportunities to strengthen policies and stop the net loss of wetlands. On July 27, 2015 MNRF initiated the review of this framework by inviting public comments in response to a discussion paper posted on the Environmental Bill of Rights Registry (EBR #012-4464) entitled “Wetland Conservation in Ontario” (Available at the following link: http://apps.mnr.gov.on.ca/public/files/er/wetlandsdiscussionpaper_en.pdf). This paper is intended to help inform the development of a strategic plan for wetlands in Ontario. As part of the consultation process, MNRF held a series of public listening sessions to seek feedback. TRCA staff participated in one of these sessions on September 23, 2015. 4 Item 9.1 In order to develop a coordinated response on behalf of conservation authorities (CAs), Conservation Ontario (CO) staff solicited input from CA staff across the Province in July and August 2015. TRCA staff contributed to this coordinated response (http://www.conservation-ontario.on.ca/library?view=document&id=304:wetland- conservation-in-ontario-a-discussion-paper&catid=57:natural-heritage-biodiversity). TRCA also produced a response which serves to complement the key messages in the CO collective response within the context of TRCA's specific experiences and perspective. On October 30, 2015, TRCA submitted this formal response to the Province of Ontario (Attachment 1). TRCA’s comments were structured to respond to a series of questions posed in the discussion paper. Overview of TRCA’s Response TRCA has a keen interest in the development of a wetland conservation strategy for Ontario because as a local watershed management agency, TRCA’s mandate includes a variety of responsibilities related to natural heritage protection, management and restoration including responsibility for regulating wetlands under Section 28 of the Conservation Authorities Act (CA Act). TRCA also protects and manages close to 18,000 hectares of conservation land and works as a key partner to assist its 18 member municipalities in fulfilling their responsibilities associated with natural heritage, water resources and natural hazard management under the Planning Act and Environmental Assessment Act processes. Staff believes the Province has taken a positive step in the protection of wetlands and supports the provincial initiative to develop a strategic plan for Ontario wetlands. In areas that have already seen a loss of over 70% of wetlands such as TRCA watersheds, a strategy of “no net loss” will not result in improvement. It is recommended that the strategy needs to embrace a concept of “net gain” including wetland restoration and creation within these watersheds. The need for restoration or construction of wetlands in the urban context warrants special consideration given their potentially important role in water management, natural
