10.1 CITY OF [ETOBICOKE YORK COMMUNITY COUNCIL AREA] 17 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade, and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, along the from south of West to west of Scarlett Road, in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed, as located on property owned by the City of Toronto and TRCA under management agreement to the City of Toronto. The purpose is to rehabilitate an existing sanitary trunk sewer. Works will involve relining the trunk sewer and construction of access routes to each maintenance chamber. 10.2 CITY OF TORONTO [NORTH YORK COMMUNITY COUNCIL AREA] 21 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, and alter a watercourse, on at Deerlick Creek, east of the , in the City of Toronto (North York Community Council Area), Don River Watershed, as located on property owned by the City of Toronto. The purpose is to replace a corrugated steel pipe (CSP) culvert conveying Deerlick Creek below York Mills Road, between Clayland Drive and Fenside Drive, east of the Don Valley Parkway in the City of Toronto. The Ministry of Natural Resources warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNR.

The purpose is to recognize the construction of a 5.75 sq.m. To site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Part Lot 24, Concession 9, (northeast of Major Mackenzie Drive and Huntington Road, Block 61W), in the City of Vaughan, Humber River Watershed as located on the property owned by Nashville Developments (North) Inc. and Nashville Ten Acres Developments Inc. The purpose is to allow development and the alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate topsoil stripping and the installation of sediment and erosion control measures in Phase 4 of a draft approved plan of subdivision (19T-10V004) within Block 61 West, northeast of Major Mackenzie Drive and Huntington Road, in the City of Vaughan.

10.5 STANDARD DELEGATED PERMITS 28 Standard Permits are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard permits are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A199/13. Standard permits are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years or less.

RE: WETLAND CONSERVATION IN ONTARIO: A DISCUSSION PAPER

KEY ISSUE TRCA’s comments on the Ministry of Natural Resources and Forestry’s discussion paper “Wetland Conservation in Ontario”.

RECOMMENDATION

WHEREAS the Ministry of Natural Resources and Forestry (MNRF) has invited the public to provide comments on a discussion paper entitled “Wetland Conservation in Ontario” to inform the development of a strategic plan for wetlands;

AND WHEREAS Toronto and Region Conservation Authority (TRCA) has legislated and delegated roles in the planning and development approvals process, and has responsibilities related to wetland protection, conservation and restoration as a watershed based resource management agency;

THEREFORE LET IS BE RESOLVED THAT TRCA’s formal response to the Province of Ontario on October 30, 2015, in Attachment 1 be received;

AND FURTHER THAT TRCA’s municipal partners and Conservation Ontario be so advised by the CEO’s office.

BACKGROUND In 2014, in response to the continuing loss of wetlands, MNRF was given a mandate to work with other ministries, municipalities and partners to review Ontario’s broad wetland conservation framework and identify opportunities to strengthen policies and stop the net loss of wetlands. On July 27, 2015 MNRF initiated the review of this framework by inviting public comments in response to a discussion paper posted on the Environmental Bill of Rights Registry (EBR #012-4464) entitled “Wetland Conservation in Ontario” (Available at the following link: http://apps.mnr.gov.on.ca/public/files/er/wetlandsdiscussionpaper_en.pdf). This paper is intended to help inform the development of a strategic plan for wetlands in Ontario. As part of the consultation process, MNRF held a series of public listening sessions to seek feedback. TRCA staff participated in one of these sessions on September 23, 2015.

In order to develop a coordinated response on behalf of conservation authorities (CAs), Conservation Ontario (CO) staff solicited input from CA staff across the Province in July and August 2015. TRCA staff contributed to this coordinated response (http://www.conservation-ontario.on.ca/library?view=document&id=304:wetland- conservation-in-ontario-a-discussion-paper&catid=57:natural-heritage-biodiversity). TRCA also produced a response which serves to complement the key messages in the CO collective response within the context of TRCA's specific experiences and perspective. On October 30, 2015, TRCA submitted this formal response to the Province of Ontario (Attachment 1). TRCA’s comments were structured to respond to a series of questions posed in the discussion paper.

Overview of TRCA’s Response TRCA has a keen interest in the development of a wetland conservation strategy for Ontario because as a local watershed management agency, TRCA’s mandate includes a variety of responsibilities related to natural heritage protection, management and restoration including responsibility for regulating wetlands under Section 28 of the Conservation Authorities Act (CA Act). TRCA also protects and manages close to 18,000 hectares of conservation land and works as a key partner to assist its 18 member municipalities in fulfilling their responsibilities associated with natural heritage, water resources and natural hazard management under the Planning Act and Environmental Assessment Act processes.

Staff believes the Province has taken a positive step in the protection of wetlands and supports the provincial initiative to develop a strategic plan for Ontario wetlands. In areas that have already seen a loss of over 70% of wetlands such as TRCA watersheds, a strategy of “no net loss” will not result in improvement. It is recommended that the strategy needs to embrace a concept of “net gain” including wetland restoration and creation within these watersheds. The need for restoration or construction of wetlands in the urban context warrants special consideration given their potentially important role in water management, natural heritage and as a public amenity.

Legislation and Policy Challenges  Legislation, policy and regulation involving wetlands are not all consistent and coordinated. The lack of a consistent protected status for small and unevaluated wetlands in various provincial legislation and policies makes it difficult to protect these features through the land use planning process. This can create difficulties and confusion since all wetlands are subject to Section 28 Regulations under the CA Act.  Section 28 Regulations are a complementary tool to support the implementation of other wetland planning policies in Ontario and can fill the gap for those activities that may not be subject to a Planning Act application (and the associated provincial policies and plans) but can still cause wetland destruction/degradation (e.g. site alteration and fill placement).

 When violations under S. 28 of the CA Act occur, and wetlands are illegally lost or damaged, CAs often take on the enforcement role. The costs to go through the court system and prosecute violations are borne by the individual CAs. This can be cost prohibitive for CAs.  The Provincial Policy Statement (PPS) wetland policies do not apply to infrastructure that fall under the Environmental Assessment (EA) Act. Consideration needs to be given to the Ministry of the Environment and Climate Change (MOECC) responsibilities under the EA Act and how these relate to wetland conservation.

Science and Knowledge TRCA staff has found there is a need to ensure that there is better integration between water management and ecological impact assessments for wetlands. There is an urgent need for research on wetland responses and their long-term condition, especially in urbanizing settings including hydrologic modelling and ecological thresholds. TRCA has an on-going research project (partnering with others) looking at wetland water balance from a data collection (instrumentation) and modelling perspective.

Encourage Partnerships Staff supports the discussion paper’s identification of Partnerships as one of the focus areas for the strategic plan for wetlands. Partnerships between the Province, municipalities, CAs, non-government groups, academia, corporations and others are vital, in order to pool resources and expertise for ensuring wetland protection and strategic restoration at the watershed and local levels. In addition, provincial initiatives related to climate change and green infrastructure support the need for wetland protection signifying opportunities for MNRF to collaborate with MOECC, Ministry of Economic Development, Employment and Infrastructure (MEDEI) and Ministry of Transportation (MTO).

Compensation The discussion paper sought input on approaches to achieving wetland conservation including the establishment of a mitigation/compensation hierarchy.

Although not the preferred option in environmental management, and only considered under limited circumstances when impacts cannot be avoided, TRCA and some municipalities have used ecosystem compensation as a tool in the planning and environmental assessment processes.

Provincially endorsed compensation policies and guidelines to operationalize them would be needed if compensation is to be implemented consistently across the province. TRCA has developed an Ecosystem Compensation Protocol (draft) to formalize some of the procedures associated with TRCA’s ongoing work in ecosystem compensation. The draft protocol is currently out for consultation with TRCA’s municipalities, other CAs and the Province.

NEXT STEPS The release of the discussion paper is the first step in MNRF’s review of Ontario’s wetland conservation framework. The feedback received in response to the EBR posting will help inform the development of an Ontario Wetland Conservation Strategy. It is anticipated that the draft strategy will be available by early 2016.

TRCA staff has been invited by MNRF staff to share further information on some of the ongoing wetland research and restoration and compensation initiatives highlighted in TRCA’s response during a workshop scheduled for December 8, 2015.

Development, Interference with Wetlands and Alterations to Shorelines and Watercourses KEY ISSUE: Pursuant to Ontario Regulation 166/06, written permission from the Authority is required for: a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development.

A permit may be refused through a Hearing Process, if in the opinion of the Authority, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land is affected.

RECOMMENDATION THAT permits be granted in accordance with Ontario Regulation 166/06 for the applications which are listed below:

CITY OF TORONTO [ETOBICOKE YORK COMMUNITY COUNCIL AREA]

10.1 CITY OF TORONTO

To construct, reconstruct, erect or place a building or structure, site grade, and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, along the Humber River from south of Lawrence Avenue West to west of Scarlett Road, in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed, as located on property owned by the City of Toronto and TRCA under management agreement to the City of Toronto. The purpose is to rehabilitate an existing sanitary trunk sewer. Works will involve relining the trunk sewer and construction of access routes to each maintenance chamber. The Ministry of Natural Resources and Forestry warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNRF.

The permit will be issued for the period of December 4, 2015 to December 3, 2017 in accordance with the following documents and plans which form part of this permit:

• Letter of undertaking from the City of Toronto to TRCA to provide revisions to the engineering and landscape drawings to the satisfaction of TRCA; dated November 13, 2015; received by TRCA on November 16, 2015.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The City of Toronto is proposing to reline an existing sanitary trunk sewer (STS), located along the Humber River from south of Lawrence Avenue West to west of Scarlett Road. This sewer was identified for relining following inspections carried out on various pieces of Toronto Water infrastructure following the July 8, 2013 storm event. TRCA previously approved the relining of another area sewer, the Chapman STS, located along Humber Creek, draining to the Humber STS north of West. That work was approved by the Executive Committee on February 6, 2015 under permit C-150127 (CFN 51770) and is going to construction in late fall 2015.

Works under the Humber STS contract will involve construction of access routes to nine of the trunk sewer’s maintenance chambers so that relining works can be carried out, and the chambers repaired or replaced where required. The Humber STS, as well as the Chapman STS' connection to it under the Humber River, will be relined. The approach proposed involves adding a new fiberglass reinforced plastic liner on the inside of the sewer. To allow for liner installation, eight temporary construction shafts will be created along the sewer alignment, all of them around existing maintenance chambers. The section of the Chapman STS under the Humber River will also be replaced by this method, however a small section of the Chapman STS just before it meets the Humber STS, located on the east side of the Humber River, will be replaced by open cut methods, as this segment is too short to slipline.

18 In a phased approach, flows in the existing trunk sewers will be bypassed around the segment being lined, with high density polyethylene (HDPE) bypass ducts laid and staked in place adjacent to existing pathways within the valley, crossing the watercourse three times. The first crossing will be located on the bridge carrying pedestrian and cycling traffic over the Humber River in Raymore Park. The second crossing will involve placing the watertight ducts in the Humber River upstream of an existing weir, located east of Scarlettwood Court. This crossing will consist of twin bypass ducts held in place with stainless steel strapping and concrete block. The third and final crossing will see the bypass duct laid on the bridge carrying Eglinton Avenue West over the Humber River, east of Scarlett Road. Each phase of bypass pumping will be removed as the sewer relining advances and each phase ends.

Granular and Geogrid™ access routes will be created from Hickory Tree Road, Raymore Drive, Sidney Belsey Crescent, and Emmett Avenue. Two access points will also be created from Scarlett Road, one opposite Edenbridge Drive and another at Humber Creek, the latter route previously approved under the relining permit for the Chapman STS. Access points will use the existing trail system to a large extent. Staging areas will be established around each construction shaft and some site entrances, as well as in the parking lot at Raymore Park. All access routes and staging areas created for this project will be removed at the completion of works, and existing conditions restored, with some paths upgraded to 3.5 metre granular pathways to permit future maintenance access for the trunk sewer. Silt Soxx™ will be employed for erosion and sediment control.

Tree protection fencing will be established in accordance with City of Toronto Urban Forestry standards. There are approximately 100 tree removals and 339 injuries associated with this project. Access routes have been selected to reduce vegetation removals to the extent possible. These removals and injuries will be compensated through the planting of 14 caliper trees, 183 tree whips, and over 2,600 shrubs. The planting of 175 additional tree whips will occur at off-site locations due to space constraints in the parks along the affected segments of the Humber STS. A seed mix will also be applied. Existing grassed areas will be restored to prior conditions using topsoil and sod at the completion of works. TRCA is continuing to work with City staff to augment and enhance the planting plan to ensure removed vegetation is compensated and an ecological net gain achieved. Construction will occur from early 2016 through 2019.

Control of Flooding: The proposed works are not anticipated to impact flooding, flood storage or conveyance of flood waters. All grades will be maintained or matched.

Pollution: Erosion and sediment control measures (Silt Soxx™) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into the Humber River. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

Dynamic Beaches: The proposal will not have any implications to dynamic beaches.

Erosion: There are no impacts identified to slope stability or erosion as a result of these works.

19 Conservation of Land: The Ministry of Natural Resources and Forestry warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNRF.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The City of Toronto has completed the works to replace a deteriorated corrugated steel pipe (CSP) culvert conveying Deerlick Creek below York Mills Road, between Clayland Drive and Fenside Drive, east of the Don Valley Parkway. City staff determined that this culvert presents an imminent risk of failure due to corrosion and the development of significantly sized voids above the culvert. During recent inspections, city staff also noticed a number of significant holes in the roof of the culvert, located roughly below the first and second eastbound lanes of York Mills Road. There are also several significantly sized voids above the culvert roughly in the same location. Since the initial inspection, the City has undertaken additional investigations to determine repair methodology. The curb east bound lane was closed to traffic due to concerns about the integrity of the road bed for a significant period of time and traffic was reduced to one east bound land at all times of the day.

Works involved the removal and replacement of the damaged CSP culvert with a bigger size precast concrete box culvert, as well as roadway repair. An existing Enbridge Gas main was also relocated as part of this works. Access to the site was via York Mills Road. Construction occurred during the spring and summer 2015. Approximately 28 trees were impacted within the proposed works; City Urban Forestry Staff is working with Toronto Water staff on appropriate compensation for these impacts. The site was stabilized following construction.

This application seeks to formalize works that have already been approved through the emergency works process. These works were classified as emergency works because the failed culvert presented an immediate hazard to public safety, and as such, represents a threat of injury to persons, loss of life, or loss of property (Conservation Authorities Act).

Control of Flooding: The proposed works are not anticipated to impact flooding, flood storage or conveyance of flood waters as the replaced culvert is larger than the existing culvert structure.

Pollution: Standard erosion and sediment control measures, including sediment envirobags were implemented prior to construction and maintained for the duration of construction, and until the site was stabilized and restored, in order to prevent construction generated sediments from entering Deerlick Creek, a tributary of the East Don River. Erosion and sediment control measures was provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

Dynamic Beaches: The proposal did not have any implications to dynamic beaches.

Erosion: There were no impacts identified to slope stability or erosion as a result of these works.

Conservation of Land: The Ministry of Natural Resources warm water fisheries timing window applied to this proposal.

22 Plantings The City of Toronto Tree Protection policies were followed and appropriate tree protection measures were installed to protect trees and vegetation that remained in place during the construction period. To compensation for the trees impacted, approximately 40 native 75mm caliper trees will be planted as part of compensation for these works. The site restoration plan is aimed at ensuring that all disturbed areas are restored to pre-construction conditions, or better, upon completion of work. All other disturbed areas have been restored with native/non-invasive species following construction.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose is recognize the construction of a basement walkout, approximately 5.75 sq. m. (61.8 sq.ft.), at the rear of an existing dwelling associated with a municipal building permit. The subject property is located adjacent to a dry valley corridor associated with the Don River Watershed. The valley corridor is a gently sloping, well vegetated, headwater area of the Don River. The proposed works extend no further than the existing limit of development and are appropriately setback from the valley corridor. TRCA geotechnical engineering staff reviewed this application and do not anticipate any geotechnical and/or slope stability concerns as a result of the constructed works. As such, no geotechnical and/or slope stability concerns are anticipated with this project. In addition, no ecology or flood related concerns are anticipated with this project.

24 Permit Fee and Timing: The applicant initiated works in advance of obtaining a permit under Ontario Regulation 166/06, therefore the permit to be issued "after the fact". The applicant has paid the application fee plus 100% as required for a permit "after the fact" in association with the violation of the regulation. In addition, the time frame for this permit will be adjusted to reflect that the works have been completed.

Control of Flooding: The proposed works are located outside of the Regional Storm Floodplain. As such, there are no impacts to the storage and/or conveyance of flood waters anticipated.

Pollution: Erosion and sediment controls (i.e. silt fencing) will not be required as the proposed works have been completed.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose is to allow development and the alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate topsoil stripping and the installation of sediment and erosion control measures in Phase 4 of a draft approved plan of subdivision (19T- 10V004) within Block 61 West, northeast of Major Mackenzie Drive and Huntington Road, in the City of Vaughan.

Phase 4 of the draft approved plan of subdivision is owned by Nashville Developments (North) Inc. et al., operating in conjunction with a larger landowners' group which own the remaining lands in the draft approved plan of subdivision. There is one watercourse on the Phase 4 lands, which traverses the eastern portion of the site (Tributary 'A').

26 This permit will facilitate topsoil stripping and the installation of various erosion and sediment control measures in Phase 4. The watercourse will be isolated from the topsoil stripping activities by a double row of siltation control fencing. Other sediment and erosion control measures will also be employed including, but not limited to, temporary swales, rock check dams, sediment traps and erosion control blankets.

It should also be noted that only a portion of the topsoil stripping activity is regulated by TRCA. The applicant requires approval from the City of Vaughan for those portions of the site not within TRCA's Regulated Area.

Control of Flooding: There will be no impact on the storage or conveyance of floodwaters.

Pollution: Sediment and erosion control measures will be installed and maintained throughout construction to prevent sediment from entering the adjacent natural features.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical/slope stability issues associated with the proposed development. In addition, the implementation of the aforementioned sediment and erosion control measures will minimize erosion on the site.

Conservation of Land: All natural features on the site will be protected during the topsoil stripping activities.

Plantings A planting plan has not been submitted with the current proposal, but the applicant is required to provide extensive plantings to satisfy TRCA's conditions of draft plan approval. Some of these plantings will be provided with future TRCA permit applications on this site (e.g., final Tributary 'A' enhancement).

As part of the current proposal, seeding of the disturbed areas will be utilized as a means of erosion control.
