Public Hearing 1. Items 19-054: Public Hearing and Action to consider an application for a Special Event Full Pouring License to sell Wine, Malt Beverages, and Distilled Spirits. The name in which the licenses are to be issued – Living Wholly/Licensee – Jenny Emblom. The location of the special event – 10950 Hutcheson Ferry Road, Chattahoochee Hills. The dates of the event are November 8-11. 2. Items 19-055 and 19-056: Public Hearing and Action to consider applications for two Special Event Limited Pouring Licenses to sell Wine and Malt Beverages. The name in which the licenses are to be issued – Tough Mudder, Inc./Licensee – Fowler. The location of the special events – 9445 Browns Lake Road, Chattahoochee Hills. The dates of the events are November 9-10 and November 15-17.

Minutes Regular Meeting of the Mayor and Council City of Chattahoochee Hills, Georgia September 10, 2019 / 6:00 p.m.

Call to Order Mayor Reed called the meeting to order at 6:00 p.m. Councilmembers in attendance were James Stephens, Richard Schmidt, Claire Williams, Alan Merrill, and Don Hayes. All members were present. Also present was City Attorney Rick Lindsey.

Mayor Reed called for a moment of silence in remembrance of 9/11.

Review and Approval of Agenda Mayor Reed requested that the agenda be amended as follows: 1. Add Item 19-053, Replacement police vehicle Councilmember Stephens made a motion to approve the agenda as amended. Councilmember Schmidt seconded. The motion passed unanimously.

Approval of Minutes 1. Minutes of the Regular Meeting of August 6, 2019 Councilmember Merrill made a motion to approve the minutes of the Regular Meeting of August 6, 2019. Councilmember Hayes seconded. The motion passed unanimously.

Presentations/Proclamations There were no presentations or proclamations.

Staff Reports Financial Update: City Manager Robbie Rokovitz City Manager Robbie Rokovitz introduced new City Planner Cheryl Brooks. He also announced that the Community Luncheon is September 11th at noon and that Police Chief Jim Little was sworn in one year ago. He reported on the year-to-date financials. The city is 17.8 percent through the fiscal year. Revenues are 22.8 percent, and all departments are at or under on expenditures.

Fire Department Report: Greg Brett Chief Brett reported that the Fire Department will not hold a formal September 11th memorial service but will sound the siren in remembrance at 10:00 a.m. He also gave a special commendation to Police Officer Chad Blackmon for his exceptional effort locating four lost hikers in Cochran Mill Park on August 4th. Firefighter/Paramedic Brad Wilson achieved Fire Officer II certification. City of Atlanta Watershed Management regarding water line auto flush outs causing erosion issues at some residences. The department has joined with the City of Palmetto and City of Fairburn to establish a wildland brush fire task force.

Police Department Report: Jim Little Chief Little thanked the Mayor and Council and citizens for the opportunity to serve the community. He reported the statistics for the month of August. There were 292 citations, 73 warnings, 44 parking citations, 8 misdemeanor arrests, and 1 felony arrest. Investigations include a theft at Halsa, a recovered stolen auto with drugs, and a critical missing person.

Public Works/Parks Report: Darold Wendlandt Mr. Wendlandt gave an update on gravel road maintenance. Mixon Road and Piney Woods Church Road are complete. Staff is currently working on Jenkins Road and will be scraping and recrowning several roads that need maintenance. New signs have been installed at the crosswalk at Cochran Mill Park.

Community Development: Mike Morton Mr. Morton reported that were not a lot of building permits issued in August. There was a Southern Fulton County Transportation Plan community meeting held at city hall on September 9th. Additional meetings are being held in the other South Fulton cities. He reported on the Historic Commission’s activities. Their top three priorities are city owned properties, development advocacy, and policy development. Research on breweries, wineries, and distilleries in rural settings will be a topic of dicussion on the September 19th Planning Commission meeting agenda.

New Business 1. Item 19-052: Approval of a reroute of a section of Cochran Mill Park yellow trail from Boy Scout Bridge to field to NICA Standards. Public Works Director Darold Wendlandt presented the item. The proposed reroute will help with drainage issues on the trail.

Mayor Reed called for a motion on Item No. 19-052. Councilmember Stephens made a motion to approve Item No. 19-052. Councilmember Schmidt seconded. The motion passed unanimously.

2. Item 19-053: Replacement police vehicle. Police Chief Jim Little presented the item. One of the 2019 Ford Interceptor patrol vehicles

Chief Little is recommending purchasing a 2019 F150 from Brannen Ford for $31,425.

Mayor Reed called for a motion on Item No. 19-053. Councilmember Schmidt made a motion to approve Item No. 19-053. Councilmember Merrill seconded. The motion passed unanimously.

Mayor and Council Comments Councilmember Stephens congratulated Police Chief Jim Little on his one-year anniversary. He also welcomed new City Planner Cheryl Brooks.

Mayor Reed reflected on the anniversary of 9/11 and role of public safety.

Executive Session Councilmember Merrill made a motion to move to into Executive Session to discuss real estate and legal matters. Councilmember Hayes seconded. The motion passed unanimously at 6:49 p.m.

Councilmember Schmidt made a motion to convene the Executive Session. Councilmember Hayes seconded. The motion passed unanimously at 6:52 p.m.

Councilmember Merrill made motion to come out of Executive Session. Councilmember Hayes seconded. The motion passed unanimously at 7:12 p.m.

Councilmember Schmidt made a motion to reconvene the Regular Meeting. Councilmember Merrill seconded. The motion passed unanimously at 7:14 p.m.

Adjourn Meeting Councilmember Hayes made a motion to adjourn the meeting. Councilmember Merrill seconded. The motion passed unanimously and the meeting adjourned at 7:15 p.m.

AN ORDINANCE TO AMEND AND REVISE CHAPTER 35, ARTICLE VIII, DIVISIONS 1, 2 AND 4 CITY OF CHATTAHOOCHEE HILLS ZONING ORDINANCE AND FOR ALL OTHER PURPOSES REALTED THERETO

WHEREAS, the City has conducted two public hearings, one with the Planning Commission and the second with the City Council; and

WHEREAS, after debate, discussion, and citizen input, the Mayor and City Council wish to amend and revise the zoning ordinance for the City of Chattahoochee Hills, Georgia.

NOW, THEREFORE, THE COUNCIL OF THE CITY OF CHATTAHOOCHEE HILLS HEREBY ORDAINS that:

Section 1: The definition of “Small Craft Brewery, Winery, or Distillery” found in Section 35- 570 of the Zoning Ordinance be deleted.

Section 2: The current Table 35-595 found in Section 35-595 of the Zoning Ordinance be modified such that the provision for “Craft Breweries, Wineries, and Distillers, Small” be removed so that the revised table reads as follows:
