Inside Back Cover 2021 FDCC Roster | 1 FEDERATION OF DEFENSE & CORPORATE COUNSEL Overview Since 1938 the Federation of Defense & Corporate Counsel (FDCC) has served as the pre- eminent professional trade association of the premier defense and senior corporate counsel and insurance industry representatives from across the United States and around the world. Established and dedicated to promoting knowledge, fellowship and professionalism among attorneys and other professionals striving to achieve a balanced justice system in the defense of civil lawsuits. This Roster comprises leaders from the boardrooms and the courtrooms; who have been nominated by their peers for having achieved a reputation of excellence and continuing to provide their respective colleagues and clients with the highest degree of legal advocacy and professional- ism. Following a rigorous vetting process these individuals exemplify the highest standards within the defense legal community. The FDCC provides its members with exclusive benefits to facilitate increasing their competen- cies, advancing the profession through the engagement and collaboration among its 25 Substantive Law Sections, Committees and arranging annual, winter, Corporate Counsel, Insurance Industry, technology, regional and other meetings as well as online webinars and other virtual presenta- tions. The Federation also champions providing tools and resources dedicated to the personal and emotional side of the profession; working toward a higher standard of civility; and contributing to advance local and other non-profit community-based organizations. Scholarly articles and updates from the various substantive law sections are also shared among the membership in the FDCC’s publications, social media channels, webinars and on our website. The Federation also advocates the positions of its membership and the professional legal community through amicus curiae briefs in the courts and is regularly requested to provide formal comments to administrative and regulatory agencies and within other legal advisory groups. The organization is comprised of trusted colleagues able to connect and engage with one specialized area of experience and capabilities are required. The FDCC maintains its commitment to fostering diversity and inclusiveness within the organization and among its membership, which is open to qualified individuals who meet the membership criteria. Special programs are also part of the Federation’s efforts to build on the strong foundation of past, current and future members who can help in mentoring and helping others establish, market and differentiate themselves in the industry. The Federation also maintains a mutually beneficial relationship with other organizations within the legal community, including Lawyers for Civil Justice (LCJ), of which the FDCC is a founding mem- ber and the National Foundation for Judicial Excellence (NFJE). Progress on and compliance with the tactical objectives and implementation of the FDCC’s strategic plan is regularly measured in order to ensure its relevancy and, where appropriate, is refined by the Board of Directors so as to chart the sustainability of the Federation and provide for the increasing needs of its growing membership. Having examined its files and records, the Commission finds: 1. On February 1, 2018, Westar Energy, Inc. (Westar) and Kansas Gas and Electric Company (KG&E) ( collectively Evergy) 1 filed a Joint Application for a rate increase of approximately $52.6 million to cover costs prudently incurred for Evergy to continue providing reliable, efficient service at a reasonable cost to customers, all in accordance with its public service obligation.2 Evergy's requested rate increase is motivated by several factors: (1) the change in the corporate tax rate implemented by the Tax Cuts and Jobs Act of 2017, which reduces Evergy's revenue requirement by $74 million;3 (2) costs associated with Evergy's investment in the Western Plains wind farm; 4 (3) Evergy's efforts to aggressively refinance debt since its most recent rate case, saving almost $29 million annually in interest expense;5 and (4) increased depreciation expense.6 1 Westar Energy, Inc., and Kansas Gas and Electric Company are now known as Evergy Kansas Central, Inc., and Evergy Kansas South, Inc., respectively.
