And Respondent: The Assistant Executive Engineer, Electrical Sub Division, Veliyam. ORDER 1. Grievance of the petitioner is as follows. The petitioner is a LT IV consumer under the area of Electrical Section, Oyoor with the Consumer No. 11102. His grievance is with regard to an electricity bill of Rs.2,797/- which was issued to him on 1/07/2017. The petitioner claims that all the machinery erected were sold out one year before as he was incapable of managing the flour mill. The petitioner has been paying minimum charge since the closure of the premises. Based on the reading on 1/7/2017, the aforesaid bill has been issued to the petitioner. In response to this the petitioner has submitted application to reduce the bill amount to the minimum. - 2 – The respondent examined the premises and was noticed that failure of electric supply was at the premises due to the disconnection of one phase with the neutral in the service post. After rectifying the defects, the KSEB officials installed parallel meter along with the existing meter on 6/7/2017. The reading shown on both the meters were same and no fault was found in the premises’ meter. Even though the petitioner made repeated complaint, no action has been taken by the respondent till that time. Hence the petitioner prays the forum to revise the impugned bill to the minimum charge. 2. The opposite party was filed a version as follows. The petitioner is a LT IV consumer running a flour mill under Electrical Section, Oyoor with connected load of 7640 watts. The respondent contented that the flour mill has been shut down for six months. While taking reading on 1/7/2017 the electricity consumption recorded on meter was 447 units and the respondent issued a bill of Rs.2,820/-. As per the complaint lodged by the petitioner against this bill the officials installed a parallel meter along with the existing meter on 6/7/2017. One week later, on 15/7/2017 it was found that the consumption recorded in both the meters were same as it is 25 units. The petitioner was issued the meter testing report on the same day itself. As no irregularities were found with the meter, revision of the bill not possible based on the prevailing rules. As per the request of the petitioner, for examining the meter in an approved laboratory, the respondent issued a notice on 19/8/2017 for remitting fees required for the meter testing. But no fee was remitted by the petitioner till this date. For the above reasons, the respondent requested that the petition may be dismissed and the petitioner shall be directed to remit the dues at the earliest. - 3 – 3. The case was posted for hearing on 21/10/2017. Both the petitioner and the respondent were present and heard the matter in detail. 4. On going through the petition and other documents in the file it is seen that the petitioner was aggrieved by an electricity bill in 7/2017. During hearing the petitioner stated that since the petitioner’s industry was in shut down condition, he has been remitting minimum amount as electricity charge. But in 7/2017, he received an exorbitant bill of Rs.2,797/- for the consumption of 447 units. The petitioner contented that this consumption is abnormal and wrong. The respondent contented that as per the complaint of the petitioner the disputed meter was tested with a parallel meter and found that the meter was working properly. Hence the petitioner is liable to pay the bill. 5. On perusal of the documents in the file, the forum found that the petioner is an industrial consumer under Electrical Section, Oyoor. Both the petitioner and the respondent stated that the industry was not functioning. The reading in 7/2017 showed 447 units. As per the request of the petitioner the meter was tested with a parallel meter and it was found that the meter was working properly. Hence the forum found that the recorded consumption in the meter was the actual energy consumed by the petitioner. Since the meter is in good condition, the forum views that the petitioner is liable to pay the recorded energy in the meter. So the bill issued is just and proper and the petitioner is bound to remit it. 6. Considering the above facts and circumstances of the case, the petition is dismissed due to lack of merit. No order as to cost. If the petitioner is not satisfied with the above order of this Forum, he is at liberty to prefer appeal before the Electricity Ombudsman within 30 days from the date of receipt of this order. - 4 – The address of the Electricity Ombudsman is furnished below.
