The Sikkim Information Commission consist of a State Chief Information Commissioner, Shri K.T.Chankapa, IAS (Retd.) with 25 other Official and staffs. 1-2 Right to Information under the Act A citizen has right to seek such information from a public authority which is held by the public authority or which is held under its control. This right includes inspection of work, documents and records; taking notes, extracts or certified copies document or records; and taking certified samples of material held by the Public authority or held under the control of the Public authority. 1-3 Object of the Right to Information Act The basic object of the RTI Act is to empower the citizens, promote transparency and accountability in the working of the government contain corruption, and make our democracy work for the people in real sense. It goes without saying that on informed citizen is better equipped to keep necessary vigil on the instruments of governance and makes the government more accountable to the governed. The Act is a big step towards making the citizens enforced about the activities of the government. 1-4 Proactive Dissemination of Information The Act makes it mandatory force each public authority to publish seventeen (17) types of manuals to disseminate information about the working of the organisations, their structures, norms for disposal of work, salary of officers and staff, budgetary provisions, subsidized activities etc. The information if properly, compiled and uploaded on website can reduce the number of applications substantially, where information of general nature is sought by the citizens. 1-5 Yearly Implementation Report -2014 The Sikkim Information Commission after the end of each year, are required to prepare reports on the implementation of the provisions of the Act during that year. Each Department is required in relation to the Public Authorities within its jurisdiction to collect and provide information to the Commission for 7 preparation of the report. The report of the Commission inter-alia contains following information in respect of the year to which report relates:- a. the number of requests made to each Public Authority; b. the number of decisions where applicants were not entitled to access to the documents pursuant to the requests, the provisions of the Act under which these decisions were made and the number of times such provision were invoked; c. particulars of any disciplinary action taken against any officer in respect of the administration of the Act; d. the amount of charges collected by each Public Authority under the Act; and e. any facts which indicate an effort by the Public Authorities to administrator and implement the sprit and intention of the Act. School Ranipool, East Sikkim 9 2-2 RTI Week – 2014, Celebration in Sikkim – A CSS Programme Each year 6th to 12th October is officially celebrated as the RTI Week across the Country. It is an annual celebration of an individual’s right to information as enshrined under Article 19 of the Indian Constitution and the celebration marks the benefits of a transparent, accessible government. The Sikkim Information Commission under the direction of the Hon’ble Chief Information Commissioner took active initiative for celebrating RTI Week 2014 throughout the State w.e.f. 6th to 12th October 2014. The Ministry of Personnel, PG and Pension, DOPT, Government of India had sanctioned Rs. 3.00 lakhs as financial assistance under Awareness Generation and Capacity Building components of the Centrally Sponsored Scheme to celebrate the RTI Week. Programme Description: Special Awareness Programme at 64 Sr. Sec. Schools was organized to sensitize and create awareness on the importance of RTI Act, 2005. The Secretary and other senior officers from Sikkim Information Commission, Resource Persons from State Government Departments, and Principal of Sr. Sec. School attended and spoke on the occasion while senior students of class X to XII actively interacted during the session. Elocution Competition among Senior Students of all 64 Sr. Sec. School, East Sikkim, Gangtok 11 Date: 11/10/2014 Venue: T.N.Sr.Sec. School, East Sikkim, Gangtok On 11th October 2014, a unique Street Play was staged under the patronage of the Commission in association with students of Tadong Sr. Sec. School Gangtok in the bustling MG Marg at Gangtok, the capital city. In North District Mangan Sr. Sec. School, South Girls Sr. Sec. School Namchi and Public Sr. Sec. School Namchi and West District Pelling Sr. Sec. School, Gyalshing also enthusiastically present the play. The play highlighted relevant topics of RTI and helped in bringing public consciousness and response in the implementation of the RTI Act, 2005 that guarantees 12 the fundamental right to the citizens. Local News Papers and TV Channel also covered the RTI week celebration with Press releases and daily news updates. On the occasion of RTI Week Celebration 2014, Sikkim Information Commission hold a panel discussion on the importance goals, objectives and achievements of RTI Weeks of RTI Act, 2005 with the participation of members from various walks of life on 29th September 2014, at Sahithya Parishad Bhawan, Development Area, Gangtok. Press release of Chief Information Commission of SIC have been telecast in between English & Nepali News Bulletine on 8th, 11th and 12th October 2014 for general information for the Public on the occasion of RTI Week 2014. Date: Wednesday, October 11, 2014 Street Play at M.G Marg, Gangtok 13 Swachh Bharat Abhiyan Drive on 11/November 2014 conducted by Officers & Staff of all Commissions Office located at Old Secretariat Building, Opposite Super Market, Gangtok. 14 CHAPTER – 3 Suo- motto disclosure u/s 4 (1) (b) (i-xvii) The Right to Information Act has envisaged that all the Public Authorities shall make a constant endeavour to take steps in accordance with the requirements of this Act to publish all relevant information for the knowledge of citizens at large and update the same at regular intervals. It implies that all the records of the Public Authority should be duly catalogued and indexed in a manner and in the form which facilitates the right to information of citizens. For this purpose, the records are needed to be computerized within a reasonable time and connected through a network all over the country so that access to such records is facilitated. Section 4 (1) (b) has given a list of seventeen such vital information pertaining to each Public Authority which is to be published suo moto so that the public have minimum resort to the use of this Act to obtain information. (i) The particulars of Sikkim Information Commission, functions and duties; The Commission mandate is to exercise the power conferred on and to perform the functions assigned to it under the Act. Jurisdiction:- Under the RTI Act, Public Authorities include institutions and non- governmental organizations which are controlled or are substantially financed by the government institutions such as Panchayat Raj Bodies, Cooperative Banks, Aided Schools and Colleges, Management of Religions Institutions and Places of Worships which are other controlled or are substantially financed by the government are also covered under the RTI Act. Duties: - As per the RTI Act 2005 the Commission has been assigned the task of receiving complaints and 2nd appeals for providing suitable relief to the complaints/appellants as per the provisions of the RTI Act, 2005. 15 U/S 4 (1) (b) (i) Sikkim Information Commission (Men in Position) In the Commission Name Designation 1.
