NOTIFICATION WHEREAS, the Election Commission of India has decided to update its Notification No. 56/2011/PPS-II, dated 28th December, 2011, as amended from time to time, specifying the names of recognised National and State Parties, registered-unrecognised parties and the list of free symbols, issued in pursuance of paragraph 17 of the Election Symbols (Reservation and Allotment) Order, 1968; NOW, THEREFORE, in pursuance of paragraph 17 of the Election Symbols (Reservation and Allotment) Order, 1968, and in supersession of its aforesaid notification No. 56/2011/PPS-II, dated 28th December, 2011, as amended from time to time, published in the Gazette of India, Extra-Ordinary, Part-II, Section-3, Sub-Section (iii), the Election Commission of India hereby specifies: - (a) In Table I, the National Parties and the Symbols respectively reserved for them and postal address of their Headquarters; (b) In Table II, the State Parties, the State or States in which they are State Parties and the Symbols respectively reserved for them in such State or States and postal address of their Headquarters; (c) In Table III, the registered-unrecognized political parties and postal address of their Headquarters; and (d) In Table IV, the free symbols. IN SO FAR AS elections to the Legislative Assembly of Jammu and Kashmir are concerned, this notification shall be deemed to have been issued in terms of Rules 5 and 10 of the Jammu and Kashmir Conduct of Elections Rules, 1965 and under the Election Symbols (Reservation and Allotment) Order, 1968 as made applicable for elections to the Legislative Assembly of Jammu and Kashmir.     List of Bharat Ratna Award Winners (1954 – 2015) The Bharat Ratna, which was instituted in 1954 by the government of India, is the country’s highest and most prestigious civilian award and ranks seventh in the order of precedence. The award is given “in recognition of exceptional service/performance of the highest order”. It is a merit-based award and is presented to the winners without any distinction of position, race, sex, or occupation. Prior to 2011, the award was only given for achievements in the fields of science, arts, literature, and public services. However, in December 2011, achievements in “any field of human endeavour” was also included thereby expanding the criteria of the awards. Every year, a maximum of three awards are presented. The Bharat Ratna awards are given by the President of India; however, the recommendations are made by the Prime Minister.Over the years many noted personalities in the fields of politics, business, sports, music, etc have received the Bharat Ratna awards. Below we present a list of the winners. C Rajagopalachari (Awarded the Bharat Ratna in 1954) C Rajagopalachari was the Governor General of independent India from 1948 to 1950. At the very outset, I would prefer to examine the principles of law that can render assistance in weighing the merit or otherwise of the contentious disputations asserted before the Court by the parties in the present suo moto petition. Besides restating the law governing Articles 19(1)(a) and 19(1)(b) of the Constitution of India and the parallel restrictions contemplated under Articles 19(2) and 19(3) respectively, I would also gauge the dimensions of legal provisions in relation to the exercise of jurisdiction by the empowered officer in passing an order under Section 144 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’). 2. It appears justified here to mention the First Amendment to the United States (US) Constitution, a bellwether in the pursuit of expanding the horizon of civil liberties. This Amendment provides for the freedom of speech of press in the American Bill of Rights. This Amendment added new dimensions to this right to freedom and purportedly, without any limitations. The expressions used in wording the Amendment have a wide magnitude and are capable of liberal construction. It reads as under : “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” 3.
