PRE-UNION STATUTE LAW REVISION ACT 78 of 1967 Page 1 of 39 PRE-UNION STATUTE LAW REVISION ACT 78 OF 1967 Page 1 of 39 PRE-UNION STATUTE LAW REVISION ACT 78 OF 1967 [ASSENTED TO 7 JUNE 1967] [DATE OF COMMENCEMENT: 14 JUNE 1967] (Afrikaans text signed by the Acting State President) ACT To repeal certain laws in force in the various provinces of the Republic and to provide for incidental matters. 1 Repeal of laws The laws specified in the Schedule are hereby repealed to the extent specified in the third column thereof. 2 Savings The repeal of any law by this Act shall not- (a) revive anything not in force or existing at the time at which the repeal takes effect; (b) affect the previous operation of any law so repealed or anything duly done or suffered under the law so repealed; (c) affect any right, privilege, obligation, liability or indemnity acquired, accrued, incurred or granted under any law so repealed; (d) affect any right to any pension, annuity, grant or allowance acquired under any law so repealed; (e) affect any power conferred or duty imposed under any law so repealed and relating to the construction, deviation or maintenance of any existing railway; (f) affect any penalty, forfeiture or punishment incurred in respect of any offence committed against any law so repealed; (g) affect any investigation, legal proceedings or remedy in respect of any right, privilege, obligation, liability, forfeiture or punishment referred to in this section, and any such investigation, legal proceeding or remedy may be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed or ordered, as if this Act has not been passed. 3 Short title This Act shall be called the Pre-Union Statute Law Revision Act, 1967.     IMPERIAL LAWS APPLICATION BILL NOTE THIS Bill is being introduced in its present form so as to give notice of the legislation that it foreshadows to Parliament and to others whom it may concern, and to provide those who may be interested with an opportunity to make representations and suggestions in relation to the contemplated legislation at this early formative stage. It is not intended that the Bill should pass in its present form. Work towards completing and polishing the draft, and towards reviewing the Imperial enactments in force in New Zealand, is proceeding under the auspices of the Law Reform Council. It is intended to introduce a revised Bill in due course, and to allow ample time for study of the revised Bill and making representations thereon. THE AWFUL STATUTE BOOK OF GREAT BRITAIN* Sir Noel Hutton** The Statutes of the United Kingdom have never been the object of much admiration, at all events in the United Kingdom it- self. One of my predecessors, as First Parliamentary Counsel, Sir William Graham Harrison, writing in 19351 said that they resembled the early Christians in Rome: "As for this sect, we know that everywhere it is spoken against." More recent- ly Lord Gardiner, who was Lord Chancellor in the Labour Administration of 1964-70 and in that capacity initiated or participated in a number of changes (always referred to honoris causa as "reforms"), addressed the University of Durham on the subject of the Role of the Lord Chancellor in the field of Law Reform. 2 His address listed the things which the new Law Commission, set up by Act of Parliament in 1965, had done, were doing and had yet to do.

    STATUTE LAW RESTATEMENT (LRC 91 – 2008) REPORT STATUTE LAW RESTATEMENT (LRC 91 - 2008) © COPYRIGHT Law Reform Commission 2008 FIRST PUBLISHED JULY 2008 ISSN 1393-3132 i LAW REFORM COMMISSION‟S ROLE The Law Reform Commission is an independent statutory body established by the Law Reform Commission Act 1975. The Commission‟s principal role is to keep the law under review and to make proposals for reform, in particular by recommending the enactment of legislation to clarify and modernize the law. Since it was established, the Commission has published over 130 documents containing proposals for law reform and these are all available at www.lawreform.ie. Most of these proposals have led to reforming legislation. The Commission‟s role is carried out primarily under a Programme of Law Reform. Its Third Programme of Law Reform 2008-2014 was prepared by the Commission following broad consultation and discussion. In accordance with the 1975 Act, it was approved by the Government in December 2007 and placed before both Houses of the Oireachtas. The Commission also works on specific matters referred to it by the Attorney General under the 1975 Act. Since 2006, the Commission‟s role includes two other areas of activity, Statute Law Restatement and the Legislation Directory. Statute Law Restatement involves the administrative consolidation of all amendments to an Act into a single text, making legislation more accessible. Under the Statute Law (Restatement) Act 2002, where this text is certified by the Attorney General it can be relied on as evidence of the law in question. The Legislation Directory - previously called the Chronological Tables of the Statutes - is a searchable annotated guide to legislative changes.
