    THE JOHN MARSHALL REVIEW OF INTELLECTUAL PROPERTY LAW SHOULD THERE BE A PRESUMPTION FAVORING AWARDS OF ATTORNEY’S FEES IN COPYRIGHT LITIGATION? WILLIAM T. MCGRATH ABSTRACT Section 505 of the Copyright Act allows courts to award attorney’s fees to the prevailing party in a copyright case. Almost twenty years ago, the Supreme Court in Fogerty resolved a split among the circuits over the interpretation of that statute. First, it held that courts should apply several nonexclusive factors when determining if the prevailing party, whether defendant or plaintiff, should be entitled to recover attorney’s fees. Second, the Court refused to apply a presumption that the prevailing party will automatically recover attorney’s fees, opting instead for the districts courts to apply “equitable discretion” in awarding fees. But in recent years, the Seventh Circuit has called for “presumptive entitlement” of attorney's fees to the prevailing party. It also isolated two factors as being primary in its analysis: the strength of the prevailing party's case and the amount of damages the prevailing party obtained. Because the prevailing defendant typically receives no monetary award, the Seventh Circuit's factors tend to favor the defendant. This paper points out the number of problems with such a presumption, including: 1) its conflicts with the statute; 2) conflicts with the principles of Fogerty; and 3) its chilling effect on plaintiffs with legitimate claims. Miloš Forman - Auditions and Adaptations My first meeting with Miloš Forman took place in April 1968 - a couple hours after I had been thrownoutof the Variety office on 43rd Street for daring to ”sign myself on” as a future correspondent. Dear Academy Member Some years are more susceptible than others to characterization with a glib phrase. For some, for example, this will be "The Year the Oscars were Stolen."     Saul ZAENTZ USA Film producer „Perhaps the last of the great independent producers“ - One Flew Over the Cuckoo’s Nest, five Acamedy Awards - Amadeus, eight Acamedy Awards - The English Patient, nine Acamedy Awards - Co-owner of Fantasy Records, which has grown to become the largest jazz label in the world. „In order to make an idea succeed you (or actors...) have to get to a point where there is no you and no me.“ Saul ZAENTZ Introduction by Gottlieb GUNTERN Saul Zaentz was born in New Jersey of Russian-Polish parents. Throughout childhood he was consumed by passions he continues to enjoy today: reading, music, sports, theatre and movies. He also developed a penchant for calculated gambling which marks his career as a producer. After serving in the Army during World War II, Zaentz settled in San Francisco where he worked in record distribution. He moved to New York for one year (1954) and worked with music impresario Norman Granz’s jazz record company managing concert tours that took him on the road with Duke Ellington, Dave Brubeck, Gerry Mulligan and Stan Getz. In 1955 Zaentz returned to San Francisco to join Fantasy Records, whose first hit was Vince Guaraldi’s Cast Your Fate to the Wind. In 1967 Saul Zaentz and a group of investors purchased the company and in 1968 the label became hugely successful recording Creedence Clearwater Revival. Fantasy has grown to become the largest jazz label in the world. Today Fantasy Records and The Saul Zaentz Company occupy a seven-storey complex in Berkeley that consists of offices, state of the art recording studios, film editing and mixing facilities.
