April 13, 2020 The Honorable Alex Azar The Honorable Seema Verma Secretary Administrator U.S. Department of Health and Human Services Centers for Medicare and Medicaid Services 200 Independence Ave. SW 7500 Security Blvd. Washington, DC 20201 Baltimore, MD 21244 Dear Secretary Azar and Administrator Verma: In the face of the worst public health crisis in modern history, we as governors are taking unprecedented steps to protect the people of our states from the coronavirus pandemic and the economic devastation occurring in its wake. Many of our states have taken the step of waiving co-payments for coronavirus- related testing and treatment through our Medicaid programs and have encouraged our private insurers to do the same. We all know that more needs to be done to increase access to affordable health care during this crisis, however. To that end, we would ask that you reconsider your decision and immediately open a special enrollment period of at least 30 days on the federal health care exchange. A special enrollment period would ensure individuals in the 38 states on the federal exchange, in addition to those who already qualify, can purchase the coverage they need during this challenging time. Too many of our constituents are uninsured or underinsured despite the steps we’ve taken at the state level. As a result, far too many of our residents are choosing to forgo coronavirus testing and treatment out of fear of the potential costs to themselves and their families at a time of increasing economic distress. Not only is this unacceptable, it’s also dangerous as it undermines our ability as a nation to stop the spread of COVID- 19.

  • The Governor's Full State of the State Address As
Governor Gretchen Whitmer 2020 State of the State Address I. Introduction Thank you. Lieutenant Governor Gilchrist; Speaker Chatfield; Leader Greig; Majority Leader Shirkey; Leader Ananich; members of my cabinet; members of the bench; and all those who serve our state: thank you. I must say, everyone is looking fantastic tonight. But, this year, I want to get one thing straight: This is NOT the red carpet. Please, I urge you, focus on the substance of my speech. It’s about issues, not appearances. I don’t care how distracting Senator Shirkey’s outfit is—cut him a break. Tonight, I have the honor of speaking both on behalf of the people of Michigan—and directly to the people of Michigan. So, whether you are watching from home or you are in this room: welcome. I’m glad you’re here. I’m especially pleased my family is here, Marc, Sherry and Sydney. I also want to acknowledge the dedicated Michigan Army and Air National Guard members who are serving overseas. As they represent our state and defend our country, we owe them our deepest gratitude. Two of our brave servicemembers are here tonight – Colonel Alice Clark and Chief Warrant Officer Amber Burgess, thank you for your service. And there is another person who isn’t with us but who is here in spirit. Governor Bill Milliken. He didn’t just leave a legacy. He lived a legacy. The reason is simple: Governor Milliken brought people together. He was a “passionate moderate”—back when that wasn’t an oxymoron. He knew the real enemy wasn’t on the other side of the aisle.

FOR IMMEDIATE RELEASE March 23, 2020 Governor Whitmer Signs “Stay Home, Stay Safe” Executive Order Governor directs all non-critical businesses to temporarily close, all Michiganders to stay home or six feet away from others during COVID-19 crisis LANSING, Mich. -- Today, Governor Gretchen Whitmer signed the “Stay Home, Stay Safe” Executive Order (EO 2020-21), directing all Michigan businesses and operations to temporarily suspend in- person operations that are not necessary to sustain or protect life. The order also directs Michiganders to stay in their homes unless they’re a part of that critical infrastructure workforce, engaged in an outdoor activity, or performing tasks necessary to the health and safety of themselves or their family, like going to the hospital or grocery store. Effective at 12:01 am on March 24, 2020, for at least the next three weeks, individuals may only leave their home or place of residence under very limited circumstances, and they must adhere to social distancing measures recommended by the Centers for Disease Control and Prevention when they do so, including remaining at least six feet from people from outside the individual’s household to the extent feasible under the circumstances. “In just 13 days, we’ve gone from 0 to over 1,000 COVID-19 cases,” said Governor Whitmer. “This is an unprecedented crisis that requires all of us working together to protect our families and our communities. The most effective way we can slow down the virus is to stay home. I know this will be hard, but it will be temporary. If we all come together, get serious, and do our part by staying home, we can stay safe and save lives.” “Taking aggressive action to protect our communities is the most important thing we can do to mitigate further spread of COVID-19,” said Michigan Department of Health and Human Services Chief Deputy for Health and Chief Medical Executive Dr.

  • Former Governors
Hunt-Kean Leadership Fellows The Hunt-Kean Leadership Fellows program partners with senior-level political leaders who have the knowledge, skill, and will to be effective, reform-minded education policymakers at the state level. Named for renowned education governors Jim Hunt (D-NC | 1977-1985; 1993- 2001) and Tom Kean (R-NJ | 1982-1990), the national, nonpartisan Fellowship launched in the fall of 2014. Since its development, the program now boasts a network of over 100 Fellows representing all 50 states and the District of Columbia, with each year adding an incoming cohort of 20-25 Fellows. The Hunt Institute offers ongoing support to Fellows through The Institute’s research, tools, mentors, and access to The Institute’s wide network of policymakers and experts. Vision Education is the most important investment we can make to strengthen our nation’s economy and society. Senior, state-level policymakers have enormous influence over our complex education system, and yet, all too often, these leaders are required to assume massive responsibilities with little background in education policy. Our goal is to help political leaders develop a deeply-rooted vision for educational improvement. The Hunt-Kean Leadership Fellows program – unlike any other Fellowship in the nation – provides political leaders from across the country with the knowledge they need to cultivate smart and effective education agendas. The nonpartisan Fellows program: • Exposes Fellows to the best research and analysis on innovative and successful education policies and practices; • Provides an environment that welcomes distinct views and fosters debate on multifaceted education issues; and • Introduces Fellows to other leaders directing successful reform efforts across the nation.

Today, our innovative and resourceful manufacturers are again on the front lines in this pandemic battle. American manufacturing is the key part of the solution and no region is more important than the industrial Midwest. Collectively, we represent nearly 3.5 million women and men employed on factory floors or 27 percent of all manufacturing jobs in the United States. 1 The impact of our industry is enormous with a direct economic output of $580 billion2 while the jobs multiplier and direct economic multiplier are the largest of any sector in the nation. Manufacturing is a cornerstone of the nation and nowhere is this more evident than in the Midwest where we drive the economy.

  • Should There Be a Presumption Favoring Awards of Attorneyâ•Žs
THE JOHN MARSHALL REVIEW OF INTELLECTUAL PROPERTY LAW SHOULD THERE BE A PRESUMPTION FAVORING AWARDS OF ATTORNEY’S FEES IN COPYRIGHT LITIGATION? WILLIAM T. MCGRATH ABSTRACT Section 505 of the Copyright Act allows courts to award attorney’s fees to the prevailing party in a copyright case. Almost twenty years ago, the Supreme Court in Fogerty resolved a split among the circuits over the interpretation of that statute. First, it held that courts should apply several nonexclusive factors when determining if the prevailing party, whether defendant or plaintiff, should be entitled to recover attorney’s fees. Second, the Court refused to apply a presumption that the prevailing party will automatically recover attorney’s fees, opting instead for the districts courts to apply “equitable discretion” in awarding fees. But in recent years, the Seventh Circuit has called for “presumptive entitlement” of attorney's fees to the prevailing party. It also isolated two factors as being primary in its analysis: the strength of the prevailing party's case and the amount of damages the prevailing party obtained. Because the prevailing defendant typically receives no monetary award, the Seventh Circuit's factors tend to favor the defendant. This paper points out the number of problems with such a presumption, including: 1) its conflicts with the statute; 2) conflicts with the principles of Fogerty; and 3) its chilling effect on plaintiffs with legitimate claims.
