July 29, 2020 -- The Saul Zaentz Charitable Foundation, The Hunt Institute and The Ounce of Prevention today announced two special events, free and open to all, to support the upcoming documentary film Starting at Zero: Reimagining Education in America, a film that culminates with a call to governors across America for collective action: to set our nation on the path to future success through significant investments in high-quality early childhood education, both to support today’s workforce, and to build the workforce of tomorrow. Abramorama will release the film in virtual cinemas nationwide beginning August 14, 2020. The events will include current Governors Roy Cooper (NC), Gretchen Whitmer (MI), Steve Bullock (MT) and Ralph Northam (VA) as well as senior officials with The Bill & Melinda Gates Foundation and Bezos Family Foundation. “Post-COVID 19 we want to come back to become better than we were, to become the kind of country we ought to be, become the kind of people we ought to be. That's what America should do. And early childhood education is absolutely essential.” - Former Governor of North Carolina James B. Hunt The pre-premiere panel, set for Monday, August 10th, will feature a live conversation between North Carolina Governor Roy Cooper, Michigan Governor Gretchen Whitmer, Former U.S. Secretary of Education John B. King, President and CEO of the Education Trust, and Illinois Lieutenant Governor Juliana Stratton, moderated by Dr. Javaid Siddiqi, President & CEO of The Hunt Institute and Former Virginia Secretary of Education. The panel will focus on the importance of state and federal investment in early learning. Panelists will share innovative state approaches and participate in Q&A with the audience. Many of our states have taken the step of waiving co-payments for coronavirus- related testing and treatment through our Medicaid programs and have encouraged our private insurers to do the same. We all know that more needs to be done to increase access to affordable health care during this crisis, however. To that end, we would ask that you reconsider your decision and immediately open a special enrollment period of at least 30 days on the federal health care exchange. A special enrollment period would ensure individuals in the 38 states on the federal exchange, in addition to those who already qualify, can purchase the coverage they need during this challenging time. Too many of our constituents are uninsured or underinsured despite the steps we’ve taken at the state level. As a result, far too many of our residents are choosing to forgo coronavirus testing and treatment out of fear of the potential costs to themselves and their families at a time of increasing economic distress. Not only is this unacceptable, it’s also dangerous as it undermines our ability as a nation to stop the spread of COVID- 19.

Named for renowned education governors Jim Hunt (D-NC | 1977-1985; 1993- 2001) and Tom Kean (R-NJ | 1982-1990), the national, nonpartisan Fellowship launched in the fall of 2014. Since its development, the program now boasts a network of over 100 Fellows representing all 50 states and the District of Columbia, with each year adding an incoming cohort of 20-25 Fellows. The Hunt Institute offers ongoing support to Fellows through The Institute’s research, tools, mentors, and access to The Institute’s wide network of policymakers and experts.     THE JOHN MARSHALL REVIEW OF INTELLECTUAL PROPERTY LAW SHOULD THERE BE A PRESUMPTION FAVORING AWARDS OF ATTORNEY’S FEES IN COPYRIGHT LITIGATION? WILLIAM T. MCGRATH ABSTRACT Section 505 of the Copyright Act allows courts to award attorney’s fees to the prevailing party in a copyright case. Almost twenty years ago, the Supreme Court in Fogerty resolved a split among the circuits over the interpretation of that statute. First, it held that courts should apply several nonexclusive factors when determining if the prevailing party, whether defendant or plaintiff, should be entitled to recover attorney’s fees. Second, the Court refused to apply a presumption that the prevailing party will automatically recover attorney’s fees, opting instead for the districts courts to apply “equitable discretion” in awarding fees. But in recent years, the Seventh Circuit has called for “presumptive entitlement” of attorney's fees to the prevailing party. It also isolated two factors as being primary in its analysis: the strength of the prevailing party's case and the amount of damages the prevailing party obtained. Because the prevailing defendant typically receives no monetary award, the Seventh Circuit's factors tend to favor the defendant. This paper points out the number of problems with such a presumption, including: 1) its conflicts with the statute; 2) conflicts with the principles of Fogerty; and 3) its chilling effect on plaintiffs with legitimate claims.
