("Cafe"), hereby petitions the Federal Communications Commission for the initiation of a rulemaking proceeding to amend the FM Table of Allotments, Section 73.202 of the Commission's Rules, to assign FM Channel 239A to the community of Lindale, Texas as follows: City Present Proposed Lindale, Texas --- 239A 1. As indicated in the attached FM allocation Study, Channel 239A can be assigned to Lindale, Texas in complete compliance with the Commission's distance separation requirements as contained in 47 CFR 73.207. The reference coordinates: N32-32-09 W95-21-36 will show the 70 dbu contour entirely encompassing the city of Lindale, Texas. 2. Lindale is an incorporated city located in Smith County, Texas near Interstate highway 20 and State highway 69. According to the 1990 Census, Lindale has a population of 2428 persons. Lindale has a full time city government, police department, and it's own city water system. Lindale has it's own pUblic schools serving Elementary, Middle, and Senior High. Lindale has many restaurants, retail shops, and professional offices including medical, dental and legal offices. Other businesses in Lindale include; a Chamber of Commerce, health and fitness, automotive, hardware, real estate, banking, and a weekly newspaper. Lindale is not served by any AM, FM or Television stations. Therefor, the public interest will be served by the assignment of channel 239A to Lindale, Texas. 3. If the Commission assigns channel 239A to Lindale, Cafe will apply for a construction permit and will construct a new facility upon award of that permit. PJC Campus Police have the authority to contact persons on campus and determine whether those individuals have lawful business at Paris Junior College.

These Joint Comments support the rule changes from their perspective as AM broadcasters. The following is submitted: INTRODUCTION - AM BROADCASTING NEEDS TECHNICAL ENHANCEMENTS, NOT REGULATORY RESTRAINTS 1.
