OFFICE OF PROFIT • In the most recent ‘office of profit’ controversy, The Andhra Pradesh government protected its MP from the ‘office of profit’ rulebook by moving an ordinance. The MP was appointed as special representative of the state. The matter was pending with the Parliament’s Joint Committee on Office of Profit. The President has now referred the matter to the Election Commission. • ‘Office of profit’ has been doing the rounds in the news earlier when the President disqualified 20 MLAs of the Delhi Legislative Assembly for being appointed as parliamentary secretaries. There have been reports of parliamentary secretaries being appointed in 20 states in the past with court judgments striking down these appointments in several cases. What is the constitutional provision regarding the Office of Profit? • Article 102(1), among other provisions, provides for the disqualification of a member of either House of Parliament if he holds any office of profit under the Government of India or the Government of any State, other than an office declared by Parliament by law not to disqualify its holder. • Article 191(1), among other provisions, provides for the disqualification of a member of the Legislative Assembly or Legislative Council of State if he holds any office of profit under the Government of India or the Government of any State specified in the First Schedule, other than an office declared by the Legislature of the State by law not to disqualify its holder. • The articles clarify that “a person shall not be deemed to hold an office of profit under the government of India or the government of any state by reason only that he is a minister”. -

The farmers will be informed about the status of their complaints through SMS. The Bank plans to reach out to more than 20 million small and medium merchants and professional services like doctors, pharmacies, salons and laundry services across the metro, semi-urban and rural India in the next three years. -

The Executive MODULE - 6 The Constitution of India-II 21 THE EXECUTIVE Notes India is a Democratic Republic. It is a Union of twenty eight States and seven Union Territories. Being a Union of States, it has two levels of governance. The Government at the Centre is called the Central or Union Government and the Government at the State level is called State Government. The Union Government has three organs – the Legislature (Parliament), the Executive. (The President, the Prime Minister, the Council of Ministers), and the Judiciary (Supreme Court). In this lesson, we shall study about the Executive part of the Government at the Centre as well as in the States. OBJECTIVES After studying this lesson, you will be able to: z understand the difference between the nominal and real Executive of the Union Government; z describe the functions of the Executive; z appreciate the position of the President of India; z know about the legislative, executive and judicial powers and functions of the President; z highlight the functions and powers of the Council of Ministers; z explain the functions, powers and position of the Prime Minister; z appreciate the role of the Governor as the Executive Head of the state; and z understand the position, powers and functions of the Governor. 21.1 UNION EXECUTIVE The Union Executive of Indian Government is composed of the President, the Prime Minister and his/her Council of Ministers. This part of the executive is temporary and political because it gets changed with the change in government after every general election. MP govt launches ‘Roadmap to Aatma Nirbhar Madhya Pradesh’: Madhya Pradesh Chief Minister, Shivraj Singh Chouhan has launched a roadmap to “Aatma Nirbhar Madhya Pradesh 2023” through a virtual event. Under the roadmap, a special focus will be on health and education in the state. About Aatma Nirbhar Madhya Pradesh 2023: Four seminars were conducted on physical infrastructure, good governance, health and education to prepare the roadmap of the state. On the basis of the inputs received by the experts in the seminar, the roadmap of Aatma Nirbhar Madhya Pradesh has been prepared. Economy and employment will also be major focus areas and small and cottage industries will be motivated. A network of hospitals will be established in the state focusing on the health sector. Along with launching the roadmap to Aatma Nirbhar Madhya Pradesh, the chief minister also transferred the interest-free loan of 10 thousand rupees each into the accounts of rural street vendors under the Mukhya Mantri rural Street Vendor Loan Scheme. The scheme was launched by the state government to provide a loan up to Rs 10,000 to street vendors in rural areas. Under the scheme, the state government will bear 14% interest subsidy per loan beneficiary (for loans up to Rs 10,000). Constitutional Law I LLB 3rd, BALLB 5th By Dr.Syed Asima Refayi President of India The office of the President is very august and the Constitution attaches to it many privileges and immunities. The President along with the Council of Ministers headed by the Prime Minister comprises the Central executive which has been dealt from Article 52 to 78 of the Constitution. The President is the head of the state and the formal executive. All executive action at the centre is expressed to be taken in his name. This power has been granted to him under Article 53(1) which states that the executive power shall be vested in the President and shall be exercised by him directly or through officers subordinate to him. The President of India is the head of state and first citizen of India and the Supreme Commander of the Indian armed forces. In theory, the President possesses considerable power. In practice, the President's role is comparable to those of a constitutional monarch, and indeed the office replaced that of the British monarch (represented by the Governor General) upon India's independence. The Constitution only formally vests functions in the hands of the President. In reality he has no function to discharge his discretion and or his individual judgment. He has to act on ministerial advice and therefore the Prime Minister and the Council of Ministers constitute the real and effective executive. It is said that this structure of the central executive closely resembles the British Model which functions on the basis of unwritten conventions. -

The scheme was launched as a part of a fresh stimulus worth Rs 2.65 lakh crore announced by Finance Minister Nirmala Sitharaman on November 12, 2020 to boost the C-19-hit Indian economy. The Finance Minister had announced 12 new measures under Atmanirbhar Bharat 3.0 during her press conference. She had announced the launch of 'Atmanirbhar Bharat Rozgar Yojana’ alongside other key announcements to revive employment opportunities in India. Government expands credit guarantee scheme to include 26 stressed sectors The Government has decided to expand the scope of emergency credit guarantees to include 26 sectors that are stressed due to the C-19 pandemic. This was announced during Finance Minister Nirmala Sitharaman’s press conference on November 12, 2020 when she had announced few new measures as a part of the new stimulus package worth Rs 2.65 lakh crore to boost the recovery of the Indian economy. Under the expansion of the credit guarantee scheme, the entities will get additional credit up to 20 percent of outstanding credit. The repayment can be done in five years, which includes 1-year moratorium and 4 years of repayment.
