In these areas, driving becomes a privilege many people don’t think about – providing an avenue to commute to work, pick-up children from school, travel to doctor’s appointments, and fulfill many other essential tasks. If New York were to enact the Driver’s License Access and Privacy Act, it would join twelve states, Washington, D.C., and Puerto Rico in providing access to licenses for undocumented immigrants. Heastie Speaker of the Assembly State Capitol, Room 349 Albany, NY 12248 Dear Speaker Heastie: I am pleased to submit the 2019 Annual Report for the Assembly Standing Committee on Banks. Included herein are details of the Committee’s 2019 legislative work, other initiatives undertaken during the year, and important developments since the close of session. Additionally, you will find the Committee’s outlook for the 2020 legislative session where we will continue to protect consumers’ financial interests and rights while helping to improve and grow the banking industry across the State. The Banks Committee made significant progress during the 2019 session, reporting legislation that aimed to maintain and enhance the vitality of our State’s financial industry, expand the banking development district program, address the student loan debt crisis, increase access for consumers in under-banked communities, and maintain sound operations within the industry. The Committee’s significant accomplishments in 2019 include adding meaningful protections for student loan borrowers in the State budget as well as imposing important restrictions on bad actors in the student debt consulting industry; increasing disclosure to consumers on issues such as mortgage lending, allowing credit unions and savings banks to take municipal deposits; and, expanding the banking development district program to include credit unions. I want to thank my fellow members of the Assembly Banks Committee for all the time and work they have put in to serving the interests of the residents of our State.

    NEW YORK STATE LEGISLATURE July 30, 2019 Carmine Di Sibio Chairman and CEO Ernst & Young- EY Five Times Square New York NY 10036 Dear Chairman Di Sibio, We write to express our disappointment with the efforts by Ernst & Young to deny your former partner, Karen Ward, a reasonable opportunity to have her claims of sexual harassment and gender discrimination heard in a court of law. By limiting her recourse to forced arbitration at a personal cost of hundreds of thousands of dollars, you are effectively silencing her and sending a message to your other employees that their claims will not be given a fair hearing and that they will have to pay exorbitant costs to simply have their claims heard. This case is a particularly egregious example of the abuses that led New York State to pass legislation banning such forced arbitration agreements in cases of harassment and discrimination in the first place. New York State is not alone in rejecting forced arbitration in cases of harassment. The private sector has also recognized that these requirements are vestiges of a past where sexual misconduct in the workplace was tolerated or ignored. Companies such as Microsoft, Uber, Google, Facebook, Lyft, Slack, Airbnb, Skadden, Arps, Slate, Meagher & Flom LLP, Sidley Austin, Kirkland & Ellis, and Orrick, Herrington & Sutcliffe LLP have voluntarily dropped mandatory arbitration requirements. It is disturbing that Ernst & Young is unwilling to recognize the negative impact arbitration requirements have on the ability of workers to get a fair hearing and the chilling effect these agreements can have on reporting. While the problems with forced arbitration are clear, the facts in this case are even more troubling.

We believe the ExpressVoteXL voting machine does not meet all technical requirements for certification, in particular the language and independent voter verification requirements. ​ ​ The US Election Assistance Commission, which is responsible for federal certification of machines, has certified this ExpressVoteXL machine. This federal commission states that the machine is sufficient to meet the disability and language requirements. However, their criteria are notably less thorough than state election certification procedures and accepting their findings is voluntary to follow by states. We hope you will take the prudent action of not certifying the ExpressVoteXL machine in New York to protect the quality, security, and accessibility of our state election process. As noted above there are two technical issues with the summary card of the vote that is printed for verification by the voter: ● The summary card is only in English and does not meet the language requirement for ​ ​ certification in New York. The touch screen ballot marking process does ask voters to select a language for marking the ballot but once the ballot is marked it prints out a summary card under glass for independent verification. This summary card is only in English.

    Child Care Legislative Priorities 2021

    The Cost of Educating and Caring for the Whole Child 2021 For too long our state has used children and their needs on the back burner, not prioritizing any meaningful or adequate investment in their care and education. The COVID-19 pandemic illuminated all the inequities and disparities that Black, Brown, immigrant, and low income children and students face. The pandemic did not create these inequities and disparities, but it did exacerbate them. The path to recovery and to just schools must be ladened with investment in strategies that work. Below are the priorities we are urging the legislature to take up this year. Education Funding Increase for 2021 Budget $5.8 Billion $4 Billion to Fully fund Foundation Aid owed to school districts $1.1 Billion Repay the Pandemic Adjustment cut of 2020 $400 Million to reimburse expense base aids (Including pandemic related transportation cost) $225 Million for COVID-19 Expenses Fully Fund Universal Pre-K for all 3-4 year-olds $770 Million increase + $5 million for Technical Assistance Centers, invest in ensuring that all children that need it have access to preschool special education programs and services. Adult Literacy Investment Restore FY20’s $1.5 million enhancement to Adult Literacy Education (ALE) Invest an additional $17.2m in ALE for a total of $25m in FY21. Child Care Investment Invest $485 million in child care in 2021-22, so New York State can extend child care subsidies to an estimated 30,000 additional children each month, lower the cost of care among families receiving support, and boost child care worker wages to a level more commensurate with their importance to New York’s children, families, and communities.
