A victim who has a protective/restraining order on their stalker, should not have to go through the process of getting an LTC ( which would be moot if we have Constitutional Carry). Requiring those who are already victims of domestic violence to wait and pay to receive a license to carry could cost them their lives.

Bans on carrying handguns were enacted in the Southern states during Reconstruction as a racist measure. But these bans were unequally enforced and were intended to keep black people from carrying guns. The elitist mindset behind this law is intolerable, and it’s time to get rid of this Jim Crow-era law and move closer to “liberty and justice for all” by allowing handgun carry for all honest citizens. The majority of states don’t require a license to carry a handgun in some form. Requiring a license hurts those who are poor,

But it does nothing to stop criminals, because they are already determined to break the law. No criminal has ever said, “I want to go commit assault and murder – but I have to wait for my license to carry to come in.” But every day, honest Texans who want to carry a gun simply to come home safe at night are forced to wait for their permit so they can carry legally. Violent crime rates generally go down within the five years after a state passes Constitutional Carry. has never required a license to carry, and it is consistently ranked as one of the safest states. In 2019, four out of the top five safest states were Constitutional Carry states (Maine, Vermont, New Hampshire, Idaho). Repealing the training requirement does not endanger public safety. One student in particular, Heather, was beaten within inches of her life by her ex-boyfriend who was dishonorably discharged from US Marine Recon who was also a former MMA fighter and a convicted felon on narcotics issues. Heather purchased a handgun the day she filed a PPO but could not lawfully carry it for 60 days after she completed my LTC class. The Heathers of Texas should be able to carry a handgun for self defense without requiring a license.

This country has a long history of gun laws that date back to the colonies.One of the first was to prevent slaves and indentured servants from possessing them. The concern was that the elite were out numbered (by their slaves/servants) by as much as 20 to 1 and they wanted to prevent uprisings. All subsequent laws have been along the same vein either overtly or blatant. Gun control laws are and have always been racist/classicist.

Gun control laws do not take gun out of the hands of those intending to commit crimes. Look at New Zealand's current situation if you need a clear indication. These laws DO however make criminals out of people who do not intend to break them by making obscure technicalities into felonies. Most gun control laws have the end effect of creating a new tax/license fee that the poor cannot afford thus again, keeping firearms out of the hands of good people in the most crime vulnerable communities. Make no mistake, if you are wealthy enough in this country today you can legally have a tank, a fully automatic machine gun, even a fighter/bomber. If you are poor, you will likely spend some amount of time in jail for defending your home and family.

Lastly, whether you like it or not (and I do not) we as Texans have the blood of nearly 100 innocent lives on our hands. We stood by and did NOTHING as we allowed the ATF to roll into Waco with tanks and murder an entire church of people over a SEARCH WARRANT. We could have said no and forced the ATF to find a peaceful way. We could have said no, and forced the ATF to leave, dealt with it ourselves and not burned those children alive. We as Texans could have taken care of our own, the good and the bad. Instead we groveled before the federal government, knowing they were in the wrong, and watched as the

A gun can solve this problem immediately, as does training, force on force, etc. The first step is to immediately end the LTC for the victim/target. She needs her protection now to defend her life wherever she goes. They become protectors versus victims. This allows women to take personal responsibility for their safety IMMEDIATELY as their own first responder.

I do solemnly swear (or affirm), that I will faithfully execute the duties of the office of the State of Texas, and will to the best of my ability preserve, protect, and defend the Constitution and laws of the United States and of this State, so help me God.

I hope that each of you is an ethical person who will honor the oath you have taken to “… preserve, protect, and defend the Constitution and laws of the United States and of this State”. You may choose to interpret the Second Amendment to the U.S. Constitution and the 23rd right provided by our own Greate State of Texas however you wish, but it’s not up for interpretation. It means what it says.

“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed.”

The right to keep and bear arms is protected by the Second Amendment to the U.S. Constitution and simply states that this right SHALL NOT be infringed. Unfortunately, since the time our great forefathers penned the U.S. Constitution and its amendments, this right has been and continues to be infringed upon.

In addition, the 23rd right of our own Great State of Texas, our citizens are guaranteed the “RIGHT TO KEEP AND BEAR ARMS. Every citizen shall have the right to keep and bear arms in the lawful defense of himself or the State; but the Legislature shall have power, by law, to regulate the wearing of arms, with a view to prevent crime.”

I am in favor of the passing of HB 1094 however, I would like to see the age restriction to be 18 years of age without the need for reserving this right of an adult only when that adult is protected under the restrictions listed in sub-section (3). The age of restriction should simply be 18 years of age, the age of adulthood, the age at which you can be sent to war to fight for our constitution, our country, our citizens. We as a state and nation continue to raise the age at which an individual is granted certain rights to which they are guaranteed but hold them responsible for other things at a younger age. The age of adulthood and guarantee of the right should be the age of adulthood.

Michael, HB 1238 & HB 2900 simply state that if you can legally possess a handgun, you can carry it -- open or concealed -- to protect yourself and your loved ones without having to beg for government permission.

In other words, as a law-abiding citizen, you shouldn’t need any “permission slip” from the government to carry your lawfully possessed handgun.

Under Constitutional Carry, the current permitting system will remain in place as optional for residents to obtain a License to Carry, allowing carry in other states (reciprocity).

The only difference is a citizen is not FORCED to ask for government permission in order to exercise this important constitutional right inside state lines.

You can already openly carry your long gun (shotgun or rifle) in Texas without a permit.

But if you try to carry a handgun open or concealed without a permit in Texas, you’re made a criminal!

It’s time politicians in Austin put an end to this disparity between long guns and handguns by passing true Constitutional Carry legislation!

This is yet another horrendous bill. Texas doesn't want to impinge on the Second Amendment, that's fine. But throwing open the doors is not the right thing either. Requiring completion of a firearm safety course, required for a permit, would go by the wayside. Training ensures permit holders are aware of how to properly carry and the responsibilities of carrying a weapon of death. Law enforcement experts, firearm trainers, and military personnel statistically concur that people who carry concealed guns should take firearm training, to include live-fire training. With no permit carry, this all goes away. Any adult could carry and there is no assurance that the individual can be trusted to carry and knows how to safely carry. Permit less carry would allow those who were convicted of assault but only got probation to carry a gun, we know how Boulder CO turned out for the ten victims at King Sooper. Let's speak a language you understand, removing the need for permits would have a negative economic impact to the tune of nearly $37 million to the Texas budget. That's only for the next two years. Weak gun laws, and permit less carry is a weak gun law, its no law, increase the number of crimes and accidental shootings. Maybe an increase of nearly ten percent doesn't mean anything to you, but if it was one of your loved ones, would you care then? A license doesn't protect someone from a criminal that intends to do harm with a gun, but it allows those with a license to properly respond. Nor does it protect a child from using that weapon to kill someone or themselves because the gun owner didn't know how to properly store the weapon because they didn't get licensed.

Furthermore, 88% of Americans oppose permitless carry and most agree that it is a risk to the public to issue concealed carry permits. Opposing this bill will create a safer space for Texans and regulate gun violence.

A member of my family took out a protective order against someone stalking and intimidating her. The idea that such a person could obtain a handgun is terrifying. If only one person in that theater in Colorado had been properly armed and trained maybe there would have only been one death. My .50 Desert Eagle is New York compliant with a mag capacity of 7 rounds but my Walther P22 is not because it holds 10 rounds. Only a politician could screw something up that bad. This bill's mission is to ensure that all persons, capable or not, be allowed to carry a deadly weapon so long as they are older than 18 years of age. This is a reckless and unnecessary change to Texas penal code sec 46.02 and should not become law. There should be no exception, under any circumstances, that the gun laws in the state of Texas be amended to make it legal for dangerous, under-qualified, and reckless persons to possess firearms. The bill lists certain situations in which, to the authors, it is crucial that the person in question be able to carry a deadly weapon. However, this will only lead to more harm than good. It has been proven that the appearance of a gun alone is enough to increase tension and aggression in a situation. The groups listed in HB 1094 that will be exempt from Sec 46.02 are in need of increased protection, as the authors would generously concede in order to justify this change to the code. This means that the addition of an aggravating weapon will not only make a situation worse, it could endanger an individual that HB 1094 seeks to protect. Carrying, brandishing, and openly possessing a gun is a threat in and of itself, and amending the Texas penal code to exempt certain individuals from a law that protects them, and all other Texans, will have massive and grave effects. The Texas Legislature must not remove protections for all Texans by artificially attempting to protect the groups listed in section 1 of HB 1094.

I have not been directly impacted by this situation, but I can see the "huge" need for this bill to prevent an abuser from harming or even killing the victim; restraining orders, in reality, do absolutely nothing to protect the victim. Requiring a victim of domestic violence to have to wait and pay before they receive a LTC permit to be able to legally carry a firearm, could ultimately cost them their lives. As we are all aware, domestic violence is very common place, in today's society. One final note to mention, in states that stopped requiring an LTC permit, violent crime rates went down (including rates of rape, murder, and aggravated assault). I support the HB 1094 the Domestic Violence Victim Defense which will allow anyone who can legally possess a firearm who is protected by a TRO ( restraining order) to be able to carry open or conceal without a license to protect themselves as we know a piece of paper does absolutely nothing against someone trying to do harm to them. In many case while a person is waiting to take a class to get an LTC or wait for the license to come in the mail they are killed by said perpetrator. Personally , . I think back to when someone I knew was 19 years old and had a situation where she felt unsafe because of an ex-boyfriend who’d sneak up on her whenever she was out. She knew that getting a TRO would not really do anything because he’d have to be caught with in the area. After dealing with this for a few months she went to a friend who’s family member was a judge that had a LEO go talk to the ex. It kept him away for a few months then he stated all over again for about a year . It made her uncomfortable and not knowing what he might do. She kept saying, “ if I could only carry I’d feel safer. “ She always made a point to not be alone anywhere. Fortunately for her when she started dating her now husband the ex kept his distance However, that isn’t always the

I am in support of HB1094 Constitutional Carry and ask that the committee vote to pass this bill out of committee. • Licensing is an unnecessary additional step to be able to protect myself or others • Barrier to those of limited means to pay for licensing or may not have a licensing facility close and need to take time off work to go through the process. • Law inconveniences law- abiding citizens, while doing nothing to stop criminals who wouldn’t obey the law anyway.

I am providing input in support of all of the Constitutional Carry bills filed - with a preference toward HB1238, allowing adults (18 and older) who can legally posses a firearm to carry it, openly or concealed, without a permit. I am a mom of young adult children; I am licensed to carry in Texas and also serve on my church’s safety response team as an armed protector.

Requiring an additional step of requesting a license and permission to exercise my right, creates a barrier to me being able to protect myself and potentially those around me. It also places a barrier between me and my ability to avoid potential victim, because I may not have the funds to pay for a license or need to miss time from work to travel and process an application for license renewal. This also disproportionately affects others who may be of even lesser means or live far from licensing facilities. This is especially the case of young adults, who while still responsible for their own safety and protection, are not permitted to legally carry a sidearm, should they have the need to protect themselves or others. This leaves my children and all adults who are younger than age 21 vulnerable in the event of life-threatening violence and unable to protect themselves.

A licensing requirement keeps law-abiding citizens from carrying their firearm without asking for permission, but does nothing to

One common objection to permitless carry - claiming a need for periodic criminal background checks as part of the renewal license period - is not valid in my opinion, since the enforcement of the loss of the right to possess a firearm should be carried out during the punitive phase of a conviction and would be criminalized and on record as such. Those who would possess a firearm, regardless of being prohibited from doing so by law, would not abide by the law regarding license application, prompting a background check.

Article 1 Section 23 of the Texas Constitution protects our right to bear arms, and only authorized the legislature to regulate the wearing of arms (not acquisition) by stating "the Legislature shall have power, by law, to regulate the wearing of arms, with a view to prevent crime.".

The key phrase here is "WITH A VIEW TO PREVENT CRIME". Requiring a plastic card (such as an LTC) does not prevent crime. How enforceable is it to know if someone carrying a firearm has an LTC or not without running foul of the "unreasonable search" clauses of both the federal and State Constitutions?

How does it "prevent crime" to allow businesses to post signs banning concealed carry, for example (30.06)?

Not only should a permit not be required, but banning concealed carry is asinine, and turns businesses, hospitals, movie theaters, etc. into targets for the criminal, the crazy, and the terrorist.

Carrying a gun openly or concealed should be without a permit.

ALSO, businesses should not be able to ban concealed carry, because such bans only affect those who follow the law and the signs, and turns business patrons into disarmed victims.

The State Legislature should not be in the business of subsidizing criminal acts - in other words, the State of Texas should not help criminals and disarm the law abiding.

Gun-free zones, therefore, should be abolished too.

Dear Sir,

I would like to say that I am fully in support of Texans being able to carry firearms and support constitutional carry laws.

My Background is that I have until two years ago lived in Alberta Canada but moved to Texas relocating our company here for the economy and in particular because of the Texas way of doing things and in particular gun laws.

In spite of holding all available permits in Canada, even for prohibited weapons we are not allowed to carry or even use firearms for self defense.

The police when called are often half an hour away or wont even come when an intruder is actually in the house. Instructions from 911 is usually to go and hide in a closet, difficult to do if you have kids in the house. If you defend yourself the culprit gets free legal aid to sue the home owner and the police will charge you as well.

Criminals know this is how things work, they are armed and enter homes and steal peoples property with impunity. Young women are attacked on public transit and making their way to cars in office and shopping mall parking lots. This happens all the time and is recorded on CCTV. Nobody comes to their aid in time to prevent the situation. They are defenseless just like fish in a barrel waiting to be picked off.

As soon as we had Texas tags on our vehicles after moving here we felt safer because the assumption is Texans are carrying firearms. Road rage is almost non existent here. In places without guns the criminals have the upper hand and it shows in every day life. The criminals are completely unaffected by any laws as they keep none of them and often enjoy free legal aid to help them after breaking laws..

I urge you to fully support constitutional carry and all pro gun laws including the second amendment as this is the great equalizer between law abiding and non law abiding citizens.

Don't let Texas or the US turn into Canada where law abiding people have no defense.

Someone intent on causing harm won’t obey a law and a sign. “Gun-free” zones only make law-abiding citizens more vulnerable. Around 94% of mass shootings since 1950 have occurred in places where ordinary, honest people weren’t allowed to carry a gun for self-defense. Statistically, “gun-free” zones are not safe. In fact, New Hampshire does not prohibit carry in any location besides courthouses, and it is consistently ranked one of the top 3 safest states.

As much as we respect and appreciate our Texas law enforcement officers, even a quick police response will be too late to stop an attacker from killing innocent victims. We have the best chance of saving our lives when we are able to respond to an attack with equal or greater force.

Texas should end all government-mandated “gun-free” zones and not penalize gun carry in specific locations. Specifically, I support School Carry legislation (allowing LTC holders to carry concealed in K-12 schools) and Designated Defender legislation (allowing those who are not intoxicated to carry in bars, similar to a designated driver who accompanies friends to a bar but remains sober). Of course, business owners in Texas have the right to prohibit carry in their privately-owned establishments and to ask those who carry to leave the premises, although this makes their establishments less safe. Texas should not criminally penalize a person for simply carrying past 30.06 or 30.07 signs.

Texas should end all government-mandated “gun-free” zones.

Constitutional Carry bills which I hope you will make into law, would also take care of this matter.

No restraining order can really protect someone from a person intent on doing them harm. Americans defend themselves up to 8,000 times a day with firearms. HB 1094 is a reasoned and carefully tailored effort to ensure that Texans between the ages of 18 and 21 who have demonstrated a specific need for self-defense to a Texas court will be able to use the most commonly available means for self-defense.

The bill is limited in scope, in that it would benefit Texans old enough to vote, pay taxes and answer to the courts for any wrong- doing as adults with a demonstrated need to protect themselves against specific and identified threats. These are Texans who are at a time in their life when they may need to move away from family and friends in order to pursue work in a still-halting economy or attend school in order to begin the process of building lives for themselves. Such young people are often surrounded by older adults, including adults who have become confirmed predators over the course of their lives. Without the means to defend themselves, the young Texans that the bill would protect could be forced to choose between building a future for themselves or being forced for their own safety to remain in an environment where options may be few or it may be impossible to escape older predators.

HB 1094 should therefore be reported from this Committee with a favorable recommendation for passage.

I grew up in Georgia and attended UT-Austin for a PhD in chemical engineering. I now live and vote in Magnolia.

My family has a long history of commitment to liberty. My sister is named for our great great great, great great great, grandmother, Rebecca Motte, who lived in Charleston, South Carolina. British soldiers occupied in her home. She was so delighted by the patriots' plan to burn the British out that she provided the incendiary arrows to set her home ablaze. Patriot rifles and cannons drove the British to surrender.

How grateful I am, that Rebecca had the benefit of arms comparable to those of her oppressors.

A firearm is a great equalizer supporting the natural right of self defense. I have lived long enough to see the evil in this world.

Evildoers prefer unarmed targets and do not wait for their targets to get a carry permit. Further, they do not obey the so-called gun-free zones that are effectively victim disarmament zones. US Senator Ted Cruz testified this week in Washington that guns are used defensively about a million times per year.

I would like to see every person allowed to carry whatever firearm they own anywhere they are allowed to go without having to apply for a government permission slip. The licensing requirement is inherently infringement. It has been abused politically. Also, every dollar of fees and every moment of classes is an obstacle to an abused wife scrimping pennies to fund her escape.

In conclusion, I ask you to support HB 1094 and the permitless carry bills, including modifications to allow carry by all lawful gun owners in so-called gun-free zones.

Law-abiding Texans should not have to beg the government for permission and pay a fee to exercise their God-given right to self- defense. That is why Constitutional Carry is the most important Second Amendment rights issue to come before the Texas Legislature in over a generation.

“The Right of the People to Keep and Bear Arms” is protected both by the U.S. Constitution and by the Constitution of the State of Texas. Yet, the permitting process in Texas creates an undue burden on this unalienable right.

Thirty-five states already have some form of permit-less carry on the books. Texans have been fighting an uphill battle to reclaim gun rights for permit-less carry for the past eight years. It's high time Texas caught up on returning gun rights to Texans!

Real-life experience and extensive research both clearly demonstrate that restricting the right to bear arms in self-defense only encourages more violent crime. Meanwhile, law-abiding Texans continue to be left defenseless against criminals who ignore the laws that are currently in place.

In real life, this means that a single mother, who works more than one job to put food on the table for her kids and does not have the time nor the means to obtain a CHL, is denied her right to carry a gun to protect herself and her kids because she does not have a government permission slip. Where is the freedom in that?

We urge you to pass HB 1094 by Oliverson out of committee.
