14th February 1846 Certificate of Chargeability to Sithney (Mark Kemp & family) A COUNTY OF CORNWALL HELSTON UNION The Board of Guardians of the Poor of the Helston Union do hereby certify that on the thirtieth day of December last past Mark Kemp, Ann his wife and their eight children became chargeable to the Parish of Sithney in the said Union, and are now in receipt of relief from the said parish In testimony whereof, the Common Seal of the said Guardians is hereunto affixed at a Meeting of their Board, this fourteenth day of February 1846 (Signed) Presiding Chairman (LS) Wm. Words in bold italics inserted into printed document Source: LDS Film 1596549 images 954‐955; original document CRO Ref: P42/13/3/15/1 14th February 1846 Examination of Mark Kemp (re Mark Kemp & family, Sithney‐Crowan) Cornwall THE Examination and Deposition of Mark Kemp now residing in the Parish of to wit Sithney in the said County Miner taken on Oath before us John Rogers Clerk and John Peter Clerk two of Her Majesty's Justices of the Peace in and for the said County at the Borough of Helston in the said County this fourteenth day of February one thousand eight hundred and forty six touching the place of the last legal Settlement of the said Mark Kemp, Anne his wife and their eight Children ‐ WHO saith as follows, I am now about thirty eight years of age and am the son of William and Anne Kemp. My Father is now deceased. I was born at Blue Pool in the parish of Sithney and lived with my parents until I was about twenty three years of age. I was legally married to my present wife Anne in the parish Church of the said parish of Sithney about fifteen years ago and have since had eight children by her all born in lawful wedlock, that is to say, Mary Jane now aged about fourteen years, Matthew now aged about twelve years, Mark now aged about nine years, Elizabeth now aged about seven years, Luke now aged about five years, Susan now aged about three years, Caroline now aged about two years and Mary now aged about two months. I have never at any time done any act to gain a Settlement in my own right and I am now together with my said wife and eight children resident in and actually chargeable to the said parish of Sithney Sworn before us this The sign of mark of Mark Kemp Examination having been first read over and explained to the said Mark Kemp J. Entire document handwritten Source: LDS Film 1596549 image 956; original document CRO Ref: P42/13/3/15/2 14th February 1846 Examination of George Matthews (re Mark Kemp & family, Sithney‐Crowan) Cornwall THE Examination and Deposition of George Matthews of the Parish of Sithney to wit in the said County taken on Oath before us John Rogers Clerk and John Peter Clerk two of Her Majesty's Justices of the Peace in and for the said County at the Borough of Helston in the said County this fourteenth day of February one thousand eight hundred and forty six touching the place of the last legal Settlement of Mark Kemp, Anne his wife and their eight Children ‐ WHO saith as follows, The Certificate marked ‘A’ now produced is under the seal of the Helston Union and under the hand of William Thomas Clerk the presiding Chairman of the said Board of Union and Thomas Treloar acting as Clerk to the Board of Guardians of the Helston Union. It refers to the Pauper now present and to his wife Anne and to their children called in the Deposition of the said Mark Kemp Mary Jane, Matthew, Mark, Elizabeth, Luke, Susan, Caroline and Mary Taken before us George Matthews (signed) J. Entire document handwritten Source: LDS Film 1596549 image 956; original document CRO Ref: P42/13/3/15/2 14th February 1846 Examination of Samuel Hill Moyle (re Mark Kemp & family, Sithney‐Crowan) Cornwall THE Examination and Deposition of Samuel Hill Moyle of the Parish of Wendron to wit in the said County taken on Oath before us John Rogers Clerk and John Peter Clerk two of Her Majesty's Justices of the Peace in and for the said County at the Borough of Helston in the said County this fourteenth day of February one thousand eight hundred and forty six touching the place of the last legal Settlement of Mark Kemp, Anne his wife and their eight Children ‐ WHO saith as follows, I am one of the Relieving Officers of the Helston Union. The parish of Sithney is one of the parishes forming that Union. The Pauper Mark Kemp is now resident in the said parish of Sithney and is actually chargeable thereto. I have relieved the said Pauper with his wife and eight children from the thirtieth day of December last during all which time he has been resident in the said parish of Sithney with his said wife and family. The relief has been delivered to the Pauper his wife and children in money and food and the whole of the same money and food have been charged to the account of the said parish of Sithney. Entire document handwritten Source: LDS Film 1596549 image 957; original document CRO Ref: P42/13/3/15/3 14th Februaruy1846 Removal Order Sithney to Crowan (Mark Kemp & family) To the Overseers of the Poor of the Parish of Sithney in the County of Cornwall and to the Overseers of the Poor of the Parish of Crowan in the County of Cornwall and to each and every of them Cornwall WHEREAS Complaint hath been made unto us, whose Names are hereunto set and to wit Seals affixed, being Two of Her Majesty’s Justices of the Peace, acting in and for the said County of Cornwall (one whereof being of the Quorum) by the Churchwardens and Overseers of the Poor of the Parish of Sithney That Mark Kemp and Anne his wife and their eight children namely Mary Jane now aged about fourteen years Matthew now aged about twelve years Mark now aged about nine years Elizabeth now aged about seven years Luke now aged about five years Susan now aged about three years Caroline now aged about two years and Mary now aged about two months have come to inhabit, and are now inhabiting in the said Parish of Sithney not having gained a legal Settlement there nor having produced any Certificate owning them to be settled elsewhere, and that they are now actually chargeable to the same Parish of Sithney and now receiving Relief therefrom We the said Justices upon due proof thereof as well by Examination of witnesses, to wit, of the said Mark Kemp, Anne Kemp, Samuel Hill Moyle and George Matthews upon Oath, as otherwise, and upon due consideration of the Premises, do adjudge the same to be true, and that the Place of the last legal Settlement of the said Mark Kemp Anne his wife and their said eight children is in the said Parish of Crowan in the said County of Cornwall THESE are therefore, in Her Majesty's name, to require and Order that if within Twenty‐one Days after you, the said Churchwardens and Overseers of the said Parish of Sithney shall have sent, by Post or otherwise, unto the Churchwardens and Overseers of the Poor of the said Parish of Crowan a Notice in Writing of the said Mark Kemp Anne his wife and their said eight children being so chargeable as aforesaid, together with a Copy or Counterpart of this Order, and a Copy of the Examinations on which this Order is made, no Notice of Appeal against this Order shall be given by the Churchwardens and Overseers of the Poor of the said Parish of Crowan or if Notice of Appeal shall be given within the Twenty‐one Days aforesaid, then forthwith after the time for prosecuting such Appeal shall have expired (if the same be not duly prosecuted), or in case the same shall be duly prosecuted, then forthwith after the final determination of the same, if this Order shall thereupon be confirmed, you the said Churchwardens and Overseers of the Poor of the said Parish of Sithney or some or one of you, or some proper person or persons to be employed by you, do remove and convey the said Mark Kemp Anne his wife and their said eight children from and out of your said Parish of Sithney to the said Parish of Crowan and them deliver, together with this our Order or a Duplicate or true Copy thereof, unto the Overseers of the Poor there, or one of them, who are hereby required to receive and provide for them according to Law. GIVEN under our Hands and Seals, at the Borough of Helston in the said County of Cornwall the fourteenth day of February in the Year of our Lord One Thousand Eight Hundred and Forty six J.
