BACKGROUND Exports of electricity from the United States to a foreign country are regulated and require authorization under section 202(e) of the Federal Power Act (FPA) (16 U.S.C. §824a(e)). On December 22, 1998, as supplemented on February 3, 1999, American Electric Power Service Corporation (AEPSC), on behalf of its seven public utility affiliates, collectively known as the “AEP Operating Companies,” applied to the Office of Fossil Energy (FE) of the Department of Energy (DOE) for authorization to transmit electric energy to Canada. The AEP Operating Companies are each investor-owned public utilities that serve retail and wholesale customers in Indiana, Kentucky, Michigan, Ohio, Tennessee, Virginia, and West Virginia. They include: Appalachian Power Company; Columbus Southern Power Company; Indiana Michigan Power Company; Kentucky Power Company; Kingsport Power Company; Ohio Power Company; and Wheeling Power Company. AEPSC and the AEP Operating Companies are wholly-owned subsidiaries of the American Electric Power Company, Inc., a registered holding company. In its February 3, 1999 supplemental filing, AEPSC indicated that an export authorization was being sought only for each of its generation-owning affiliates, thus excluding Kingsport Power Company and Wheeling Power Company from the application. The energy and capacity to be exported will be from either surplus generation to the AEP Operating Companies or from purchases on the wholesale market.
