NOTICE OF RIGHT TO APPEAL AND OPTION FOR MOTION FOR RECONSIDERATION
The Examiner’s summary dismissal order shall be final and conclusive unless proceedings for review of the decision are properly commenced in Superior Court within 21 days of the Examiner issuing the decision. (The Land Use Petition Act defines the date on which the Examiner issues a land use decision three days after the Examiner mails the written document.)
As an alternative, prior to expiration of the appeal period any party is free to file with the Examiner a motion for reconsideration. Such a timely-filed motion stays the deadlines for filing an appeal to superior court. After weighing the motion for reconsideration, the examiner will issue another written determination; that document will reset the appeal deadlines. If no motion for reconsideration is timely filed, the examiner’s jurisdiction will terminate.
