Haydon Hall, 110 Laurier Avenue West MINUTES 12 Note: Please note that the Minutes are to be considered DRAFT until confirmed by Council. The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on Wednesday, 27 May 2015 beginning at 10:00 a.m. The Mayor, Jim Watson, presided and led Council in a moment of reflection. NATIONAL ANTHEM The national anthem was performed by Betty Ann Bryanton. OTTAWA CITY COUNCIL 2 MINUTES 12 WEDNESDAY, 27 MAY 2015 ANNOUNCEMENTS/CEREMONIAL ACTIVITIES RECOGNITION - MAYOR'S CITY BUILDER AWARD Mayor Jim Watson and Councillors Mathieu Fleury and Tim Tierney presented the Mayor’s City Builder Award to Marie-Eve Chainey for her tireless work raising public awareness and funds to help living people with chronic kidney disease. ROLL CALL All members were present. CONFIRMATION OF MINUTES The Minutes of the regular meeting of 13 May 2015 were confirmed. DECLARATIONS OF INTEREST INCLUDING THOSE ORIGINALLY ARISING FROM PRIOR MEETINGS No declarations of interest were received. COMMUNICATIONS The following communications were received. Association of Municipalities of Ontario (AMO): OTTAWA CITY COUNCIL 3 MINUTES 12 WEDNESDAY, 27 MAY 2015 Bill 8 - Effective Date for Municipal Governments Confirmed Response to Inquiries: 13-13 - School Mini Buses 05-15 - Public Washrooms Other Communications Received: Submission received containing the signatures of 52 aqua fitness patrons at the St. Laurent Complex, requesting that the evening aqua fitness classes, with the same instructors and schedule, be transferred to a nearby facility (e.g. Lowertown Pool) during the closure for maintenance of the St. Laurent pool. REGRETS No regrets were filed. OTTAWA CITY COUNCIL 4 MINUTES 12 WEDNESDAY, 27 MAY 2015 MOTION TO INTRODUCE REPORTS MOTION NO. 12/1 Moved by Councillor T. Tierney Seconded by Councillor D. Chernushenko That Community and Protective Services Committee Report 4; Environment Committee Report 3; Planning Committee Report 7; and Transit Commission Report 3 be received and considered. CARRIED COMMITTEE REPORTS COMMUNITY AND PROTECTIVE SERVICES COMMITTEE REPORT 4 1. RESPONSE TO TAXI-RELATED COUNCIL MOTIONS OF APRIL 2012 COMMITTEE RECOMMENDATION That Council approve the scope of the comprehensive review of the City of Ottawa’s taxi and limousine regulations, including potential regulations to recognize the emergence of new hailing technologies and transportation-for-a-fee service models, as outlined in this report. CARRIED OTTAWA CITY COUNCIL 5 MINUTES 12 WEDNESDAY, 27 MAY 2015 ENVIRONMENT COMMITTEE REPORT 3 2. STAFF COMMENTS ON THE WATER, WASTEWATER, AND STORMWATER RATE STRUCTURE REVIEW COMMITTEE RECOMMENDATIONS That Council: 1. Direct staff to return to Council by Q1 2016 with an updated water, wastewater, and stormwater rate structure for Council’s consideration and; 2. Approve that the overall guiding principles for this review are as follows: a) Is fair and equitable to users of the service; b) Increases financial sustainability; c) Ensures that the basic level of consumption is affordable for residential customers; d) Is transparent and understandable; e) Preserves conservation; f) Supports Economic Development. CARRIED OTTAWA CITY COUNCIL 6 MINUTES 12 WEDNESDAY, 27 MAY 2015 DIRECTION TO STAFF That staff revisit the policy changes made in 2001, when developing the new policy in order to have a better understanding of the changes that took place and the reasons for these changes. PLANNING COMMITTEE REPORT 7 3. ZONING BY-LAW AMENDMENT – 385 SUSSEX DRIVE COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 at 385 Sussex Drive (Notre Dame Cathedral Basilica) to permit a temporary parking lot for a maximum of three years, as detailed in Document 2. MOTION NO. 12/2 Moved by Councillor J. Harder Seconded by Councillor T. Tierney WHEREAS through inadvertence the incorrect legal comment was inserted into the above report; THEREFORE BE IT RESOLVED that an additional document be appended to the report entitled: “Revised Legal Comment” providing the following: In the event that the recommendation is adopted and appealed to the Ontario Municipal Board, it is expected that a two day hearing will result. It is anticipated that the hearing can be conducted within staff resources. OTTAWA CITY COUNCIL 7 MINUTES 12 WEDNESDAY, 27 MAY 2015 Should the recommendation be refused, results must be provided. In the event that such refusal is appealed to the Ontario Municipal Board, it would be necessary to retain an external planner. CARRIED Item 3 of the City Council Agenda, as amended by Motion No. 12/2, was then put to Council and CARRIED with Councillor J. Leiper dissenting. 4. ZONING BY-LAW AMENDMENT – 187 METCALFE STREET COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 187 Metcalfe Street to allow public parking within the parking garage, as detailed in Document 2 and shown on Document 1. CARRIED OTTAWA CITY COUNCIL 8 MINUTES 12 WEDNESDAY, 27 MAY 2015 BULK CONSENT AGENDA PLANNING COMMITTEE REPORT 7 A. ZONING BY-LAW AMENDMENT – 873, 875, 877 CONTOUR STREET AND 2705, 2709 PAGÉ ROAD COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 for 873, 875, 877 Contour Street and 2705, 2709 Pagé Road, as shown in Document 1. CARRIED B. ZONING BY-LAW AMENDMENT – PART OF 3872 GREENBANK ROAD COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 for part of 3872 Greenbank Road to permit a residential subdivision containing 477 dwelling units, one school and one park, as detailed in Document 2. CARRIED OTTAWA CITY COUNCIL 9 MINUTES 12 WEDNESDAY, 27 MAY 2015 TRANSIT COMMISSION REPORT 3 C. EXTENSION OF TEMPORARY REDUCTION OF PARA TRANSPO CASH FARES COMMISSION RECOMMENDATIONS That City Council: 1. Extend the temporary reduction of cash fares for Para Transpo service to be consistent with the Presto e-purse fares for conventional OC Transpo service, as outlined in Document 1; 2. Add the Para Transpo cash fares to the fare table for trips made on Para Transpo services until June 30, 2016, or until one month after the successful implementation of the Para Transpo electronic fare payment system, whichever comes first as outlined in Document 2; and, 3. Approve the reduction in fare revenue be funded from the capital budget for the Presto smartcard project as outlined in this report. CARRIED OTTAWA CITY COUNCIL 10 MINUTES 12 WEDNESDAY, 27 MAY 2015 DISPOSITION OF ITEMS APPROVED BY COMMITTEES UNDER DELEGATED AUTHORITY That Council receive the list of items approved by its Committees under Delegated Authority, attached as Document 1. RECEIVED MOTION TO ADOPT REPORTS MOTION NO. 12/3 Moved by Councillor T. Tierney Seconded by Councillor D. Chernushenko That Community and Protective Services Committee Report 4; Environment Committee Report 3; Planning Committee Report 7; and Transit Commission Report 3 be received and adopted as amended. CARRIED MOTIONS OF WHICH NOTICE HAS BEEN PREVIOUSLY GIVEN MOTION NO. 12/4 Moved by Councillor T. Nussbaum Seconded by Councillor C. McKenney WHEREAS the City of Ottawa appreciates the importance of the Government of Canada’s Long Term Vision and Plan for the Parliamentary Precinct and Judicial Precinct (“the Plan”) to the City of Ottawa, the National Capital Region and the country; and OTTAWA CITY COUNCIL 11 MINUTES 12 WEDNESDAY, 27 MAY 2015 WHEREAS the Plan speaks to the importance of completing the Judicial Triad with the future construction of a Federal Court judicial building on Wellington Street, part of Confederation Boulevard, complementing the Parliamentary Triad along Ottawa’s ceremonial route; and WHEREAS the City of Ottawa joins others, including the Royal Architectural Institute of Canada, the Canadian Society of Landscape Architects and the Ontario Association of Architects, in expressing concern that the proposed location for the Memorial to the Victims of Communism will prevent the completion of the Judicial Triad and violate the guiding principles of the Plan, particularly those of symbolic primacy and heritage value; THEREFORE BE IT RESOLVED that City Council, through the Mayor, formally request that the Government of Canada relocate the proposed Memorial to the Victims of Communism and indicate the City of Ottawa’s willingness to work with the Government of Canada and other partners to identify a suitable site that conserves the integrity of the Judicial Precinct in the Government of Canada’s Long Term Vision and Plan. Darouze. OTTAWA CITY COUNCIL 12 MINUTES 12 WEDNESDAY, 27 MAY 2015 MOTIONS REQUIRING SUSPENSION OF THE RULES OF PROCEDURE MOTION NO. 12/5 Moved by Councillor J. Harder Seconded by Councillor T. Tierney That the Rules of Procedure be waived to consider the following motion, due to timelines as the Canada 150 Community Infrastructure Program funding was announced on Friday, May 15, 2015, with an application deadline of June 9, 2015 and Council is not scheduled to meet again until June 10, 2015. WHEREAS the Government of Canada announced Canada 150 Community Infrastructure Program funding on Friday, May 15, 2015, that supports rehabilitation, renewal and limited expansion of existing public infrastructure assets; and WHEREAS the Federal Economic Development Agency for Southern Ontario (FedDev Ontario) is delivering the program in southern Ontario with an allocation of $44.4 million over two years and applications with supporting documentation for Canada 150 Community Infrastructure Program funding must be submitted to FedDev Ontario no later than 5:00 p.m.
