PROJECT SUMMARY The applicant requests renewal of expired Land Use Permit #LP96-2039 to allow the continued operation of an existing T-Mobile wireless telecommunications facility on the subject property, and minor modifications related to camouflaging and site security. II. RECOMMENDATION Staff recommends that the Zoning Administrator approve County File #LP17-2021, based on the attached findings and subject to the attached conditions of approval. ZA – October 21, 2019 County File #LP17-2021 Page 2 of 7 III. GENERAL INFORMATION A. Environs – The subject property is a 23.5-acre agricultural parcel located in the Franklin Canyon area of unincorporated Contra Costa County, just south of Highway 4 at the Cummings Skyway exit. The surrounding area is generally characterized by large agricultural parcels presently used as grazing lands. California State Route 4 is located approximately 500 feet north of the subject property. B. General Plan – The subject property is located within the Agricultural Lands (AL) general plan land use designation. C. Zoning District – The subject property is located within an Agricultural Preserve (A-4) zoning district. D. California Environmental Quality Act (CEQA) - The proposed project is exempt under CEQA Guidelines Section 15301(b), which specifies that the continued operation of investor and publicly owned utilities, involving negligible or no expansion of the existing or former use, are exempt from review E. Prior County Files Related to the Property: a. RZ68-1310: An application to rezone a 810 acres of land in the Crockett and Port Costa areas (including the subject property) into to an Agricultural Preserve (A-4) zoning district. The Board of Supervisors adopted the rezone on January 21, 1969. b. AP69-3: Williamson Act Contract designating and establishing the subject property, amongst others, within an Agricultural Preserve. The Land Conservation agreement was executed on February 25, 1969. c. LP96-2039: An application for a land use permit to establish a wireless telecommunications facility on lands within an Agricultural Preserve. This application was approved by the Zoning Administrator and became effective on September 19, 1996. d. CV10-0017: A five-year compliance review application for the wireless telecommunications facility approved under LP96-2039. This application was approved by DCD staff on May 10, 2010. SITE/ AREA DESCRIPTION The 23.5-acre subject property is located at the southeastern corner of the intersection of Franklin Canyon Road and Cummings Skyway, west of Martinez. The lot is roughly trapezoidal in shape and is defined by a steep grade which increases in elevation towards rear portions of the lot. The subject property, aside from the existing 232 square-foot T-Mobile lease area, consists of vacant cattle grazing lands. An existing gravel access road provides vehicular access from the property frontage to the existing T-Mobile facility. V. PROJECT DESCRIPTION The applicant requests approval of a land use permit for the renewal of an existing T-Mobile wireless telecommunications facility, previously operating under approved Land Use Permit #LP96-2039. The existing facility consists of four antennas installed upon two 17-foot-tall monopoles (two antennae per monopole), a BTS cabinet, a backup power generator, as well as other ancillary equipment within a 232 square-foot lease area. The applicant proposes to improve the aesthetics of existing equipment by installing an adhesive film around the existing antennae intended to better camouflage the antennae. Additionally, a new 6-foot-tall wooden boundary fence would be installed around the existing T- Mobile lease area to improve site security. VI. AGENCY COMMENTS A. Contra Costa Mosquito & Vector Control District: In a returned Agency Comment Request form dated October 19, 2017, District staff indicated they have no comments on the proposed project. B. Department of Conservation and Development, Building Inspection Division: In a returned Agency Comment Request form dated October 1, 2019, Building Inspection Division staff indicated that a building permit would be necessary if the application of stealth film to existing antennae involves the removal and reinstallation of those antennae. Additionally, Building Inspection Division staff advised that the requirements of current building codes shall be followed. C. Contra Costa Environmental Health (CCEH): In a returned Agency Comment request form dated November 14, 2017, CCEH staff indicated that they have no comments for the proposed project. Rodeo/Hercules Fire Protection District: Comments from the Rodeo/Hercules Fire Protection District were solicited, but not received as of the publishing of this report. VII. STAFF ANALYSIS AND DISCUSSION A. General Plan: The subject property is located within the Agricultural Lands (AL) land use designation. According to the Land Use Element of the County General Plan, the purpose of the AL designation is to “preserve and protect lands capable of and generally used for the production of food, fiber, and plant materials.” The extension of wireless communications infrastructure throughout the County provides a vital utility for the use of residents, first responders, and commuters traveling in the vicinity. The continued operation of the existing T- Mobile facility will ensure that the existing level of cellular telephone service is maintained along State Route 4, which is a major commuter corridor within Contra Costa County. Because the existing telecommunications facility is confined to a negligible portion of the 23.5-acre subject parcel, it will not substantially affect the viability of agricultural activities on this parcel. Specific Area Policies The County General Plan has adopted policies for specific geographic areas of the County in addition to the countywide policies. Pursuant to the General Plan’s Map of Unincorporated Communities with Adopted Area Policies, the subject property is located within the Briones Hills specific geographical area. General Plan Policy #3-132 strongly supports the intent of the Briones Hills Agricultural Preservation Area compact that was signed by the County and the Cities of Martinez, Pleasant Hill, Walnut Creek, Lafayette, Orinda, Richmond, Pinole, and Hercules in 1988. The compact states that jurisdictions voluntarily agree not to annex any lands within this area for purposes of allowing urban development. The project does not require annexation, or the conversion of agricultural lands to urban land uses. The subject property is located outside of the urban limit line (ULL) and this application does not propose changes to the ULL. Additionally, the continued use of the wireless facility on the subject property will not diminish the available open space within the Briones Hills Area, or increase traffic within the community. Because the facility is unmanned and only requires periodic maintenance, the project will not cause any strain on public services or result in additional traffic on nearby roadways. Thus, the project will not conflict with the adopted policies of the Briones Hills specific geographic area. ZA – October 21, 2019 County File #LP17-2021 Page 5 of 7 Scenic Resources Policies According to General Plan Figure 9-1 Scenic Ridges and Waterways, there are multiple scenic ridges in the vicinity of the project site. The existing facility is not located on a prominent ridge. Nevertheless, General Plan Policies 9-16 through 9-23 are applicable in areas along major scenic ridges, which are designated for open space use. Generally, these policies restrict the placement of new water tanks, power lines, and structures in order to preserve scenic ridgelines. Because the project does not involve any new development, it does not conflict with these policies. Additionally, the applicant proposes to install a camouflaging film to all existing antennae at the facility, which is intended to better conceal them within their scenic background. Therefore, the continued operation of the existing facility would have a negligible impact on ridgelines within the established scenic corridor. The subject property is located approximately 500 feet south of State Route 4, which is designated as a Scenic Route in General Plan Figure 5-4 Scenic Routes Plan. General Plan Policies 5-47 through 5-56 guide development near scenic routes to preserve the public enjoyment of aesthetic qualities of the area. Since the project would not introduce any new structures visible from State Route 4, it does not conflict with these policies. With the camouflaging film, the wireless telecommunications
