I. PROJECT SUMMARY

The applicant requests renewal of expired Land Use Permit #LP96-2039 to allow the continued operation of an existing T-Mobile wireless telecommunications facility on the subject property, and minor modifications related to camouflaging and site security.

II. RECOMMENDATION

Staff recommends that the Zoning Administrator approve County File #LP17-2021, based on the attached findings and subject to the attached conditions of approval. ZA – October 21, 2019 County File #LP17-2021 Page 2 of 7

III. GENERAL INFORMATION

A. Environs – The subject property is a 23.5-acre agricultural parcel located in the Franklin Canyon area of unincorporated Contra Costa County, just south of Highway 4 at the Cummings Skyway exit. The surrounding area is generally characterized by large agricultural parcels presently used as grazing lands. State Route 4 is located approximately 500 feet north of the subject property.

B. General Plan – The subject property is located within the Agricultural Lands (AL) general plan land use designation.

C. Zoning District – The subject property is located within an Agricultural Preserve (A-4) zoning district.

D. California Environmental Quality Act (CEQA) - The proposed project is exempt under CEQA Guidelines Section 15301(b), which specifies that the continued operation of investor and publicly owned utilities, involving negligible or no expansion of the existing or former use, are exempt from review

E. Prior County Files Related to the Property:

a. RZ68-1310: An application to rezone a 810 acres of land in the Crockett and Port Costa areas (including the subject property) into to an Agricultural Preserve (A-4) zoning district. The Board of Supervisors adopted the rezone on January 21, 1969.

b. AP69-3: Williamson Act Contract designating and establishing the subject property, amongst others, within an Agricultural Preserve. The Land Conservation agreement was executed on February 25, 1969.

c. LP96-2039: An application for a land use permit to establish a wireless telecommunications facility on lands within an Agricultural Preserve. This application was approved by the Zoning Administrator and became effective on September 19, 1996.

d. CV10-0017: A five-year compliance review application for the wireless telecommunications facility approved under LP96-2039. This application was approved by DCD staff on May 10, 2010. ZA – October 21, 2019 County File #LP17-2021 Page 3 of 7

IV. SITE/ AREA DESCRIPTION

The 23.5-acre subject property is located at the southeastern corner of the intersection of Franklin Canyon Road and Cummings Skyway, west of Martinez. The lot is roughly trapezoidal in shape and is defined by a steep grade which increases in elevation towards rear portions of the lot. The subject property, aside from the existing 232 square-foot T-Mobile lease area, consists of vacant cattle grazing lands. An existing gravel access road provides vehicular access from the property frontage to the existing T-Mobile facility.

V. PROJECT DESCRIPTION

The applicant requests approval of a land use permit for the renewal of an existing T-Mobile wireless telecommunications facility, previously operating under approved Land Use Permit #LP96-2039. The existing facility consists of four antennas installed upon two 17-foot-tall monopoles (two antennae per monopole), a BTS cabinet, a backup power generator, as well as other ancillary equipment within a 232 square-foot lease area. The applicant proposes to improve the aesthetics of existing equipment by installing an adhesive film around the existing antennae intended to better camouflage the antennae. Additionally, a new 6-foot-tall wooden boundary fence would be installed around the existing T- Mobile lease area to improve site security.

VI. AGENCY COMMENTS

A. Contra Costa Mosquito & Vector Control District: In a returned Agency Comment Request form dated October 19, 2017, District staff indicated they have no comments on the proposed project.

B. Department of Conservation and Development, Building Inspection Division: In a returned Agency Comment Request form dated October 1, 2019, Building Inspection Division staff indicated that a building permit would be necessary if the application of stealth film to existing antennae involves the removal and reinstallation of those antennae. Additionally, Building Inspection Division staff advised that the requirements of current building codes shall be followed.

C. Contra Costa Environmental Health (CCEH): In a returned Agency Comment request form dated November 14, 2017, CCEH staff indicated that they have no comments for the proposed project.

D. Rodeo/Hercules Fire Protection District: Comments from the Rodeo/Hercules Fire Protection District were solicited, but not received as of the publishing of this report.

VII. STAFF ANALYSIS AND DISCUSSION

A. General Plan: The subject property is located within the Agricultural Lands (AL) land use designation. According to the Land Use Element of the County General Plan, the purpose of the AL designation is to “preserve and protect lands capable of and generally used for the production of food, fiber, and plant materials.” The extension of wireless communications infrastructure throughout the County provides a vital utility for the use of residents, first responders, and commuters traveling in the vicinity. The continued operation of the existing T- Mobile facility will ensure that the existing level of cellular telephone service is maintained along State Route 4, which is a major commuter corridor within Contra Costa County. Because the existing telecommunications facility is confined to a negligible portion of the 23.5-acre subject parcel, it will not substantially affect the viability of agricultural activities on this parcel.

Specific Area Policies The County General Plan has adopted policies for specific geographic areas of the County in addition to the countywide policies. Pursuant to the General Plan’s Map of Unincorporated Communities with Adopted Area Policies, the subject property is located within the Briones Hills specific geographical area. General Plan Policy #3-132 strongly supports the intent of the Briones Hills Agricultural Preservation Area compact that was signed by the County and the Cities of Martinez, Pleasant Hill, Walnut Creek, Lafayette, Orinda, Richmond, Pinole, and Hercules in 1988. The compact states that jurisdictions voluntarily agree not to annex any lands within this area for purposes of allowing urban development. The project does not require annexation, or the conversion of agricultural lands to urban land uses. The subject property is located outside of the urban limit line (ULL) and this application does not propose changes to the ULL. Additionally, the continued use of the wireless facility on the subject property will not diminish the available open space within the Briones Hills Area, or increase traffic within the community. Because the facility is unmanned and only requires periodic maintenance, the project will not cause any strain on public services or result in additional traffic on nearby roadways. Thus, the project will not conflict with the adopted policies of the Briones Hills specific geographic area. ZA – October 21, 2019 County File #LP17-2021 Page 5 of 7

Scenic Resources Policies According to General Plan Figure 9-1 Scenic Ridges and Waterways, there are multiple scenic ridges in the vicinity of the project site. The existing facility is not located on a prominent ridge. Nevertheless, General Plan Policies 9-16 through 9-23 are applicable in areas along major scenic ridges, which are designated for open space use. Generally, these policies restrict the placement of new water tanks, power lines, and structures in order to preserve scenic ridgelines. Because the project does not involve any new development, it does not conflict with these policies. Additionally, the applicant proposes to install a camouflaging film to all existing antennae at the facility, which is intended to better conceal them within their scenic background. Therefore, the continued operation of the existing facility would have a negligible impact on ridgelines within the established scenic corridor.

The subject property is located approximately 500 feet south of State Route 4, which is designated as a Scenic Route in General Plan Figure 5-4 Scenic Routes Plan. General Plan Policies 5-47 through 5-56 guide development near scenic routes to preserve the public enjoyment of aesthetic qualities of the area. Since the project would not introduce any new structures visible from State Route 4, it does not conflict with these policies. With the camouflaging film, the wireless telecommunications facility would be less obtrusive in views of the project site.

B. Zoning: The subject property is located within an Agricultural Preserve (A-4) zoning district. The zoning district is intended to provide areas that provide primarily for the commercial production of food and fiber and other compatible uses. Commercial radio and television transmitting facilities are an allowed use in A-4 upon the issuance of a land use permit1. Therefore, the continued operation of the facility is consistent with zoning regulations applicable to the subject property.

C. Wireless Telecommunications Facilities Ordinance (Chapter 88-24): The existing wireless telecommunications facility was established under a Land Use Permit approved by the County in 1996. That previous entitlement has since expired. Therefore, this renewal request has been reviewed for consistency with the provisions of the County’s current Wireless Ordinance, Chapter 88-24 of the County Code.

Based on the above, the proposed telecommunications facility is consistent with the requirements of the County Wireless Ordinance.

D. Appropriateness of Use: The telecommunications facility has been established on the subject property since 1996. No substantial modifications to the existing facility are proposed with this application. Wireless communications facilities are conditionally allowed within the A-4 district, and the county is unaware of any nuisances arising from the operation of the facility to date. Lastly, the project does not conflict with policies for development along scenic ridges/scenic routes, or the property’s Agricultural Lands (AL) land use designation. Therefore, the project is appropriate use of the subject property.

E. Federal Communications Commission (FCC) Compliance: The applicant has provided a report on Radio Frequency (RF) emissions originating from the facility. The RF report, prepared by a licensed electrical engineer, indicates that RF energy on the ground is less than 5% of the FCC general population limit. Therefore, the project is compliant with federal regulations pertaining to RF emissions.

VIII. CONCLUSION

The project does not involve any substantial modifications to the established facility. As discussed throughout this report, the proposed renewal of an existing T-Mobile wireless telecommunications facility is consistent with the County’s Wireless Ordinance, the A-4 zoning district, FCC radio frequency emissions standards, as well as all applicable General Plan policies. The minor modifications to the facility would improve the camouflaging of the facility and site security. Therefore, staff recommends that the Zoning Administrator approve County File #LP17-2021 based on the attached conditions of approval.

I. FINDINGS

A. Growth Management Performance Standards

1. Traffic: The wireless facility is unmanned, and does not require regular staff for its’ daily operation, and will generate a minimal number of vehicle trips. The project will not create 100 or more peak hour trips. Therefore, the preparation of a traffic report is not required.

2. Water: The wireless telecommunications facility is unmanned and has no potential for increasing the water demand at the site. The project involves the continued operation of an antenna array installed upon two steel monopoles with a maximum height of 17-feet and associated equipment. Therefore, the project will not increase the demand for water at the site in a manner that would require the construction of new or expanded water infrastructure.

3. Sanitary Sewer: The wireless telecommunications facility is an unmanned improvement that does not produce waste or other by-products as a result of its daily operation or use. Therefore, the project will not create an increased demand for sanitary sewer services at the site.

4. Fire Protection: The subject property is located within the service area of the Rodeo/Hercules Fire Protection District. The Department of Conservation and Development, Community Development Division (CDD) has not received any comments of concern from the Fire District. Given that the facility has been in operation since 1996, there is no indication that the continued use of the site would represent a new fire hazard or a need for expanded fire protection services.

5. Public Protection: The new improvements to the existing wireless facility will not create new housing, provide previously unavailable services, or provide substantial amounts of new business opportunities within the County that would result in a significant population increase. Therefore, the project will not impact the County’s ability to maintain the standard of having 155 square feet of Sheriff’s facility per 1,000 members of the population.

6. Parks & Recreation: There is no element of the project that will induce any population increase within the County. Therefore the project will not impact the County’s ability to maintain the standard of having three acres of neighborhood parks per 1,000 members of the population.

7. Flood Control & Drainage: The project area is not located within a Federal Emergency Management Agency-designated special flood hazard zone and does not include the construction any new impervious surface. Therefore, the continued use of the site as a wireless telecommunications facility is not anticipated to affect any flood control improvements or existing drainage patterns of the area.

B. Land Use Permit Findings

1. The proposed project shall not be detrimental to the health, safety and general welfare of the County.

Project Finding: The existing facility is located on private property, several hundred feet from the nearest publicly accessible location. A security gate at the property frontage prevents unauthorized vehicular access to the subject property and the T-Mobile lease area is secured by another locking gate. The applicant has submitted a radio frequency (RF) report for existing facility which indicates that RF exposure originating from the facility will be at approximately 5% of the FCC public exposure limit. Thus, the existing facility is does not generate unsafe levels of RF emissions, as determined by the FCC, and is adequately secured to prevent public access to the equipment area. Therefore, the continued use of the existing unmanned wireless facility will not be detrimental to the health, safety and general welfare of the County.

2. The proposed project shall not adversely affect the orderly development within the County or the community.

Project Finding: The existing facility is located within an established lease area on otherwise vacant grassland. Because the facility affects a negligible portion (232 square-feet) of the 23.5-acre subject property, the project will have no effect on the viability of agricultural activities on the subject property. Therefore, the continued operation of the facility will not prevent the orderly development of the subject property, or any surrounding property, with agricultural buildings or other non-urban uses consistent with the established rural setting.

3. The proposed project shall not adversely affect the preservation of property values and the protection of the tax base within the County.

Project Finding: The renewal of the existing wireless facility limits the need for additional wireless facilities within the immediate area and does not involve an expansion or substantial alteration to the as-built facility. The use is compatible with the surrounding area and no changes that would affect property values or tax base are proposed with this application.

4. The proposed project as conditioned shall not adversely affect the policy and goals as set by the General Plan.

Project Finding: The subject property is located within the Agricultural Lands (AL) General Plan land use designation. The project is consistent with policies for the AL designation as it does not affect the viability of agricultural activities on the property and would not convert farm land to urban uses. Additionally, the project would not introduce new structures to the property which may affect the visual character of nearby scenic ridgeways, or views from County scenic routes. Thus, the project will allow the continued operation of a previously approved wireless facility that is consistent with the policies and goals of the general plan.

5. The proposed project shall not create a nuisance and/or enforcement problem within the neighborhood or community.

Project Finding: The facility is located on a large parcel primarily used for cattle grazing. The facility is located on private property and secured by multiple locking gates. There is no record of any nuisance and/or enforcement issues arising from the operation of this site since its establishment in 1996. The site will remain unmanned except for routine and emergency maintenance visits. The ground mounted equipment is to remain fenced off from public access and thus the project will not create a nuisance and/or enforcement problem within the neighborhood or community.

6. The proposed project as conditioned shall not encourage marginal development within the neighborhood.

Project Finding: The continued use of the existing facility will not affect the development of the subject property nor the surrounding neighborhood. The establishment of the facility was a result of the demand for wireless communication facilities along major transit corridors in the County. Thus the continued use of the facility will not encourage marginal development within the neighborhood.

7. That special conditions or unique characteristics of the subject property and its location or surroundings are established.

Project Finding: The existing facility has been established on the subject property since 1996. Approval of this permit would allow the continued operation of the as- built facility with no substantial modifications. The need for quality wireless communication service in this area arises from its proximity to transit corridors serving commuters traveling within or through Contra Costa County. Thus, the

conditions and characteristics of the subject property and its surroundings are established and would be largely unchanged by the approval of this permit.

C. Wireless Telecommunications Facility Land Use Permit Findings (County Code Section 88-24.614(b))

1. The application is complete. On August 22, 2019, County staff deemed the application complete and acceptable.

2. The facility or substantial change will meet the requirements of this chapter. This request to renew expired land use permit #LP96-2039 for the continued operation of an existing T-Mobile facility at its previously approved location with no substantial modifications, is consistent with all applicable design, location, and security standards within Chapter 88-24 of the County Ordinance Code. The minor modification of the facility improve the camouflaging of the facility and site security. County staff will conduct a condition of approval Compliance Review for this application prior to issuance of building permits, and again five years after approval, to ensure the facilities continued compliance throughout the life of the permit.

3. The facility or substantial change has been reviewed pursuant to all appropriate environmental laws and regulations, including the California Environmental Quality Act (CEQA). Pursuant to CEQA guidelines section 15301(b), which specifies that the continued operation of investor and publicly owned utilities, involving negligible or no expansion of the existing or former use are categorically exempt from CEQA review.

4. If an environmental impact report or mitigated negative declaration was prepared for the facility or substantial change, the facility or substantial change will incorporate all mitigation measures identified in either of those documents. Each mitigation measure will be included as a term of the permit. This finding is not applicable to this project, which was exempt from CEQA review and for which there are no environmental migration measures to be included as a term of the permit.

5. If the Contra Costa County Airport Land Use Commission reviewed and commented on the application, the facility or substantial change will incorporate each mitigation measure recommended by the commission and deemed by the

Zoning Administrator to be necessary to protect public safety, health, and welfare. Each mitigation measure will be included as a term of the permit. Because the project site is not proximate to any public or private airfields, it was not reviewed by the Airport Land Use Commission. Therefore, this finding is not applicable to the project.

6. The applicant has provided the financial assurance required by this chapter. The financial assurance required by this chapter has been included as condition of approval (COA) #8. Verification of compliance of this condition will occur during the initial COA compliance review, prior to CDD stamp approval of construction plans for the issuance of a building permit.

7. The applicant has paid all required fees and costs, including but not limited to the application fee, any required environmental review fee, and any required peer review fee. The applicant is current with monthly billing statements for time and materials costs associated with the processing of this application. An updated accounting report will be generated and receipt of payment verified during the initial COA compliance review.

II. CONDITIONS OF APPROVAL FOR COUNTY FILE #LP18-2018:

Land Use Permit Approval

1. This Land Use Permit is APPROVED for the renewal of an existing T-Mobile wireless telecommunications facility and the application of camouflage film to existing antennas, as well as the construction of a new 6-foot-tall wooden fence around the existing lease area.

2. The Land Use Permit approval described above is granted based on the following information and documentation:

 Land Use Permit application submitted to the Department of Conservation and Development, Community Development Division (CDD) on October 16, 2017.  Project plans by Black and Veatch, submitted on August 15, 2019.  Photo simulations prepared by Artistic Engineering, submitted on August 15, 2019.  RF Emissions Compliance Report prepared by Site Safe RF Compliance Experts, Inc., dated November 17, 2016.

Initial Compliance Report Prior to Submittal of a Building Permit

3. Prior to CDD stamp approval of plans for issuance of a building permit, the applicant shall submit a report addressing compliance with the conditions of approval, for review and approval of the CDD. The report shall list each condition followed by a description of what the applicant has provided as evidence of compliance with that condition. Unless otherwise indicated, the applicant will be required to demonstrate compliance with the conditions of this report prior to issuance of construction permits. The Zoning Administrator may reject the report if it is not comprehensive with respect to applicable requirements for the requested permit. The deposit for review of the Compliance Report is $500.00; the actual fee shall be time and materials.

4. Within 30-days of the completion of improvements relative to this approval, color photographs showing the as-built condition of the facility shall be submitted for the review and approval of the CDD to verify compliance with these Conditions of Approval. Photographs shall be taken following completion of construction and shall be submitted within 30 days of completing construction.

Permit Duration and Permit Review

5. This land use permit is granted for a period of ten (10) years and shall be administratively reviewed at five-year intervals. The applicant shall initiate the first review by submitting a statement as to the current status of the project to the CDD no later than five years following the effective date of the project approval. This review by the CDD will be for the purpose of ensuring continued compliance with the conditions of permit approval. Non-compliance with the approved conditions and/or the ordinance code provisions after written notice thereof shall be cause for revocations proceedings.

For the review of existing commercial wireless communications facilities, submittal shall include photo documentation of existing conditions and equipment for comparison with the applicable approved conditions.

The applicant is encouraged, at the time of each administrative review, to review the design of the telecommunications facility and make voluntary upgrades to the facility for the purpose of improving safety and lessening visual obtrusiveness.

A review fee in the amount of $500.00 (subject to time and materials) will be filed through a Compliance Verification application to allow for review of the approved conditions.

Permittee is Responsible for Keeping CDD Informed of Party Responsible for Permit Compliance at all Times

6. The Permittee (wireless operator) is responsible for keeping the Department of Conservation and Development, Community Development Division (CDD) informed of who is responsible for maintenance of compliance with this permit and how they may be contacted (i.e., mailing and email addresses, and telephone number) at all times.

 Prior to CDD stamp approval of plans for issuance of a building permit, the Permittee shall provide the name of the party (carrier) responsible for permit compliance and their contact information.

 Should the responsible party subsequently change (e.g., facility is acquired by a new carrier), within 30 days of the change, the Permittee shall issue a letter to the CDD on the name of the new party who has been assigned permit compliance responsibility and their contact information. Failure to satisfy this condition may result in the commencement of procedures to revoke the permit.

Removal of Facility/Site Restoration

7. All structures and equipment associated with a commercial wireless communications facility shall be removed within 60 days of the discontinuance of the use, and the site shall be restored by the permittee to its original pre-development condition. In addition, the permittee shall provide the CDD with a notice of intent to vacate the site a minimum of 30 days prior to vacation.

Security to Provide for Removal of Equipment

8. Prior to CDD stamp approval of plans for issuance of a building permit, the applicant or permittee shall provide bond, cash, or other surety, to the satisfactory of the CDD, for the removal of the facility in the event that the use is abandoned or the use permit expires, or is revoked, or is otherwise terminated. If the permittee does not remove any obsolete or unused facilities as described above, the financial guarantee shall be used by the County to remove any obsolete or unused facilities and to return the site to its pre-development condition.

The financial assurance must be submitted before a permit will be issued. A financial assurance must be irrevocable and not cancelable, except by the County.

Each form of financial assurance must remain valid for the duration of the permit and for six months following termination, cancellation, or revocation permit.

Any unused financial guarantee shall be returned to the applicant upon termination of the use and removal of the facility, or transfer of the lease accompanied by a financial guarantee by the new lessee or owner. The amount of the security shall be based on a cost estimate provided by a contractor or other qualified professional to the satisfactory of the Zoning Administrator.

General Provisions

9. Any deviation from or substantial change beyond the limits of this permit approved under this application may require the filing and approval of a request for modification of the Land Use Permit.

10. A minor alteration to this land use permit (or collocation if CEQA environmental review of collocation for the land use permit has been completed) may be issued if the proposed modification(s) are not considered a substantial modification as stated under federal law (Title 47, Section 1.40001).

A minor alteration (or a collocation) has a term that is the shorter of the following:

a. 10 years: or, b. The duration, including any renewal period, of the permit that authorizes the existing facility on which the new facility will be collocated or on which the minor alteration will occur.

11. The conditions contained herein shall be accepted by the applicant, their agents, lessees, survivors or successors for continuing obligation.

12. At all times the facility shall comply with applicable rules, regulations and standards of the FCC and other agencies having jurisdiction, and any other applicable Federal, State, and County laws and regulations.

13. Facilities shall be operated in such a manner as not to contribute to ambient RF/EMF emissions in excess of then-current FCC adopted RF/EMF emission standards. Within 15 days of new antennas being installed, T-Mobile shall take RF power density measurements with the antennas operating to verify the level reported in the RF report and to ensure that the FCC public exposure level is not exceeded in any public accessible area. This measurement shall be submitted to CDD for review.

14. The recommendations within the approved RF Report shall be noted on the plans for a building permit and are required to be implemented on site prior to final building inspection.

15. The equipment shall be maintained in good condition over the term of the permit. This shall include keeping the structures graffiti-free.

16. Antennas, towers, cabinets, and mountings shall not be used for advertising.

17. The equipment cabinets shall be kept locked, except when T-Mobile personnel are present, in order to restrict access to the equipment.

18. No lights or beacons may be installed on any antenna or antenna support structure, unless lights or beacons are required by a state or federal agency having jurisdiction over the antenna or antenna support structure, such as the California Public Utilities Commission, Federal Communications Commission, or Federal Aviation Administration, or if lights or beacons are recommended by the County Airport Land Use Commission.

19. A facility, all fences and walls surrounding a facility, and all other fixtures and improvements on a facility site must be repainted as often as necessary to prevent fading, chipping, or weathering of paint.

Exterior Noise

20. No more than 30 days after final building permit inspection, the applicant shall submit evidence for review and approval of the CDD that the wireless telecommunications facility meets acceptable exterior noise level standards as established in the Noise and Land Use Compatibility Guidelines contained in the Noise Element of the County General Plan. The evidence can either be theoretical calculations for identical equipment or noise monitoring data recorded on the site.

Frequency Interference

21. No facility may be operated at a frequency that will interfere with an emergency communication system or 911 system, including any regional emergency communication system.

Color Palette

22. All antennas, monopoles, and associated equipment shall be painted to match the existing equipment and antenna poles, and shall be maintained for the life of the facility. All exterior portions of the poles shall be treated with materials that have a non-reflective finish (less than 55 percent), except as otherwise required by the terms of the FCC Antenna Structure Registration applicable to the facility. Color photographs showing the as-built condition shall be submitted for review of CDD

staff to verify compliance with this Condition of Approval within 30 days of completing work approved under this permit.

23. The application of 3M™ Conceal Film to the existing antennas shall be considered compliant with COA #22. The film shall be maintained for the duration of this land use permit. All other equipment, to which this film cannot be applied, shall be painted to match their surroundings.

Cultural Resources – These conditions shall be included on all sets of construction drawings.

24. If deposits of prehistoric or historical archaeological materials are encountered during ground disturbance activities, all work within 50 feet of the discovery should be redirected and a qualified archaeologist contacted to evaluate the finds and make recommendations. It is recommended that such deposits be avoided by further ground disturbance activities. If such deposits cannot be avoided, they should be evaluated for their significance in accordance with the California Register of Historical resources.

25. If the deposits are not eligible, avoidance is not necessary. If the deposits are eligible, they will need to be avoided by impacts or such impacts must be mitigated. Upon completion of the archaeological assessment, a report should be prepared documenting the methods, results, and recommendations. The report should be submitted to the Northwest Information Center and appropriate Contra Costa County agencies.

Prehistoric materials can include flake-stone tools (e.g., projectile points, knives, choppers) or obsidian, chert, or quartzite tool-making debris; culturally darkened soil (i.e., midden soil often containing heat-affected rock, ash and charcoal, shellfish remains, and cultural materials); and stone milling equipment (e.g., mortars, pestles, handstones). Historical materials can include wood, stone, concrete, or adobe footings, walls and other structural remains; debris-filled wells or privies; and deposits of wood, glass ceramics, and other refuse.

26. If human remains are encountered, work within 50 feet of the discovery should be redirected and the County Coroner notified immediately. At the same time, an archaeologist should be contacted to assess the situation. If the human remains are of a Native American origin, the Coroner must notify the Native American Heritage Commission within 24 hours of this identification. The Native American Heritage Commission will identify a Most Likely Descendant (MLD) to inspect the site and provide recommendations for the proper treatment of the remains and associated grave goods.

Upon completion of the assessment, the archaeologist should prepare a report documenting the methods and results, and provide recommendations for the treatment of the human remains and any associated cultural materials, as appropriate and in coordination with the recommendations of the MLD. The report should be submitted to the Northwest Information Center and appropriate Contra Costa agencies.

Work Restrictions – All construction activity shall comply with the following requirements, which shall be included on all sets of construction documents.

27. The applicant shall make a good faith effort to minimize project-related disruptions to adjacent properties, and to other uses on the site. This shall be communicated to project-related contractors.

28. The project sponsor shall require their contractors and subcontractors to fit all internal combustion engines with mufflers which are in good condition and shall locate stationary noise-generating equipment such as air compressors and concrete pumps as far away from existing residences as possible.

29. Transportation of heavy equipment and trucks shall be limited to weekdays between the hours of 9:00 A.M. and 4:00 P.M. and prohibited on Federal and State holidays.

30. The site shall be maintained in an orderly fashion. Following the cessation of construction activity; all construction debris shall be removed from the site.

31. A publicly visible sign shall be posted on the property with the telephone number and person to contact regarding construction-related complaints. This person shall respond and take corrective action within 24 hours. The CDD phone number shall also be visible to ensure compliance with applicable regulations.

32. Non-emergency maintenance, construction and other activities on the site related to this use are restricted to the hours of 8:00 A.M. to 5:00 P.M., Monday through Friday, and shall be prohibited on State and Federal holidays on the calendar dates that these holidays are observed by the State or Federal government as listed below:

Application Processing Fees

33. The Land Use Permit application was subject to an initial deposit of $2,700 that was paid with the application submittal, plus time and material costs if the application review expenses exceed the initial deposit. Any additional fee due must be paid prior to issuance of a building permit, or 60 days of the effective date of this permit, whichever occurs first. The fees include costs through permit issuance and final file preparation. Pursuant to Contra Costa County Board of Supervisors Resolution Number 2013/340, where a fee payment is over 60 days past due, the application shall be charged interest at a rate of ten percent (10%) from the date of approval. The applicant may obtain current costs by contacting the project planner. A bill will be mailed to the applicant shortly after permit issuance in the event that additional fees are due.
