As initially designated in 2016, BENM encompassed 1.3 million acres of land with exceptionally fossiliferous rock units. Subsequently, in December 2017, presidential action reduced BENM to two smaller management units (Indian Creek and Shash Jáá). Although the paleontological resources of BENM are extensive and abundant, they have historically been under-studied. Here, we summarize prior paleontological work within the original BENM boundaries in order to provide a complete picture of the paleontological resources, and synthesize the data which were used to support paleontological resource protection. -

In 2016, using the power given to the president in the Antiquities Act, President Obama issued a presidential proclamation establishing the monument. But in 2017, President Donald Trump issued a proclamation that significantly reduced the acreage of the monument. -

UTAH BEARS EARS MOUNTAIN BIKE TOUR For some, the default image of Utah’s southern tier reaches back to the raw and open American frontier, the hard to settle Interior West. For others, it speaks of the mystical lives of bygone, primeval civilizations. Fast forward now: to the feel of a nurturing sun at your back. Before you, at distance, snow-capped mountains loom with an almost palpable majesty. Welcome to the Abajo Mountains! A 1.3-million acre Bears Ears National Monument, created by President Obama in 2016—reduced by 85% two years later—covers a broad expanse of red rock, juniper forests, high plateau, and cultural, historic and prehistoric legacy. The latter includes an abundance of very early human, as well as Native American historical artifacts left behind by the first wave of Clovis people, followed by the Ancestral Puebloans, Fremont culture and others. A pair of monumental 2,000-ft twin buttes, the Bears Ears is the remarkable remnant of 200-million- - year-old sand dunes. Capped in shades of pale orange to light red sandstone, The Bears Ears formation is so distinctive they can be seen, even at great distance, from nearly every direction. May 25, 2017 Dear Secretary Zinke: We the undersigned 71 environment and natural resources law professors submit these comments to express our serious concerns with the process initiated by Executive Order (EO) 13792, which directs the Secretary of the Interior (Secretary) to “review” the Bears Ears National Monument and provide “recommendation for such Presidential actions, legislative proposals, or other actions consistent with law.”1 EO 13792 and the President’s public statements upon signing that order reflect profound misunderstandings of both the nature of national monuments and the President’s legal authority under the Antiquities Act. Most fundamentally, EO 13792 implies that the President has the power to abolish or diminish a national monument after it has been established by a public proclamation that properly invokes authority under the Antiquities Act. This is mistaken. Under our constitutional framework, the Congress exercises plenary authority over federal lands.2 The Congress may delegate its authority to the President or components of the executive branch so long as it sets out an intelligible principle to guide the exercise of authority so delegated.3 The Antiquities Act is such a delegation. It authorizes the President to identify “objects of historic or scientific interest” and reserve federal lands necessary to protect such objects as a national monument.4 But the Antiquities Act is a limited delegation: it gives the President authority only to identify and reserve a monument, not to diminish or abolish one. Congress retained that power for itself. The plain text of the Antiquities Act makes this clear. The Act vests the President with the power to create national monuments but does not authorize subsequent modification.
